Sauf pour les avocats, le mandat doit \u00eatre constitu\u00e9 par \u00e9crit (art.4 de l\u2019ordonnance 60 .120 du 1er octobre 1960 d\u00e9terminant la proc\u00e9dure devant les juridictions du travail). \u00bb<\/p>\n<p>Soci\u00e9t\u00e9 ARSENE Louys et Compagnie<\/p>\n<p>Me Arlette RAFANOMADIO<\/p>\n<p>R\u00c9PUBLIQUE DE MADAGASCAR<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;<\/p>\n<p>Cour de Cassation<\/p>\n<p>Chambre Civile Commerciale Sociale<\/p>\n<p>La Cour de Cassation, Chambre Civile Commerciale Sociale en son audience publique ordinaire du mardi douze septembre deux mille dix-sept, tenue au Palais de Justice \u00e0 Anosy, a rendu l&#039;arr\u00eat dont la teneur suit :<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>Statuant sur le pourvoi de la Soci\u00e9t\u00e9 ARSENE LOUYS et COMPAGNIE domicili\u00e9 \u00e0 Andasifahatelo Andasibe Moramanga mais \u00e9lisant domicile en l\u2019\u00e9tude de son conseil Ma\u00eetre RAFANOMADIO Arlette logement 350 Cit\u00e9 Ampefiloha, contre l\u2019arr\u00eat n\u00b0 CATO-14 \/Soc rendu le 24 mars 2011 par la Chambre Sociale de la Cour d\u2019Appel de Toamasina dans l\u2019affaire l\u2019opposant \u00e0 Monsieur J.B.V ;<\/p>\n<p>Vu le m\u00e9moire produit en demande ;<\/p>\n<p>Sur l\u2019unique moyen de cassation, pris de la violation de l\u2019article 04 de l\u2019ordonnance n\u00b0 60.120 du 1er octobre 1960 d\u00e9terminant la proc\u00e9dure devant les juridictions de travail pour fausse application de la loi, d\u00e9tournement de proc\u00e9dure et d\u00e9naturation des faits ; <\/p>\n<p>En ce que sieur A.M.J n\u2019avait pas qualit\u00e9 pour interjeter appel au nom et pour le compte de la soci\u00e9t\u00e9 ARSENE LOUYS et COMPAGNIE car il aurait \u00e9t\u00e9 d\u00e9pourvu de mandat \u00e9crit pour ce faire alors que l\u2019article 4 susmentionn\u00e9 vise la comparution, l\u2019assistance et la repr\u00e9sentation des parties non \u00e0 l\u2019audience mais pour effectuer la d\u00e9claration d\u2019appel pr\u00e9vue par l\u2019article 17 de l\u2019ordonnance suscit\u00e9e ; qu\u2019il r\u00e9sulte du rapprochement de l\u2019article 17\u00a72 et \u00a73 et de l\u2019article 1er de l\u2019ordonnance suscit\u00e9e que l\u2019appel devant le Tribunal du Travail ne requiert aucun formalisme et que le d\u00e9faut de mandat \u00e9crit rel\u00e8ve plut\u00f4t de la faute du greffier qui a re\u00e7u la d\u00e9claration d\u2019appel ;<\/p>\n<p>Vu ledit texte ;<\/p>\n<p>Attendu que l\u2019article 4 de l\u2019ordonnance 60.120 du 1er octobre 1960 vis\u00e9 au moyen stipule que \u00ab les employeurs ont la facult\u00e9 de se faire repr\u00e9senter par un directeur ou un employ\u00e9 de l\u2019entreprise ; sauf en ce qui concerne les avocats le mandataire doit \u00eatre constitu\u00e9 par \u00e9crit ;<\/p>\n<p>En l\u2019esp\u00e8ce aucun \u00e9crit n\u2019est vers\u00e9 au dossier, le moyen non fond\u00e9 est \u00e0 \u00e9carter ;
