Occupation pr\u00e9caire"},"content":{"rendered":"<div class=\"kji-decision\">\n<div class=\"kji-full-text\">\n<p>Mati\u00e8res : Foncier<\/p>\n<p>Mots cl\u00e9s : Occupant pr\u00e9caire &#8211; dur\u00e9e \u2013 contrat sans modification \u2013 Possessoire (non)<\/p>\n<p>L\u2019occupant pr\u00e9caire en vertu d\u2019un contrat reste en cette qualit\u00e9 tant que le contrat ne subit pas de modification, peu importe la dur\u00e9e de cette qualit\u00e9.<\/p>\n<p>Cassation : Ordinaire<\/p>\n<p>Nature : Civile<\/p>\n<p>Solution : Cassation<\/p>\n<p>Arr\u00eat n\u00b0 584 du 01 septembre 2017<\/p>\n<p>Dossier : 481\/12-CO<\/p>\n<p>OCCUPANT PR\u00c9CAIRE \u2013 DUR\u00c9E \u2013 CONTRAT SANS MODIFICATION \u2013 POSSESSOIRE (NON)<\/p>\n<p>\u00ab L\u2019occupant pr\u00e9caire en vertu d\u2019un contrat reste en cette qualit\u00e9 tant que le contrat ne subit pas de modification, peu importe la dur\u00e9e de cette qualit\u00e9. \u00bb<\/p>\n<p>R\u00c9PUBLIQUE DE MADAGASCAR<\/p>\n<p>COUR DE CASSATION<\/p>\n<p>CHAMBRE CIVILE COMMERCIALE SOCIALE<\/p>\n<p>La Cour de Cassation, Chambre civile Commerciale et Sociale en son audience publique ordinaire du vendredi premier septembre deux mille dix sept, tenue au palais de Justice \u00e0 Anosy, a rendu l&#039;arr\u00eat dont la teneur suit :<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi;<\/p>\n<p>Statuant en suite du pourvoi de R. et C., demeurant [Adresse 1] Ambalakirajy, Mandritsara, contre d&#039;arr\u00eat n\u00b0 404 du 26 octobre 2011 rendu par la Chambre Civile de la Cour d&#039;Appel de Mahajanga, dans le litige l&#039;opposant \u00e0 N. ;<\/p>\n<p>Vu les m\u00e9moires en demande;<\/p>\n<p>Sur le premier moyen de cassation tir\u00e9 de l&#039;article 26 de la loi 2004-036 du 01 octobre 2004 sur la Cour Supr\u00eame pour violation de la loi, en ce que l&#039;arr\u00eat leur a fait d\u00e9fense de troubler la jouissance des consorts N., alors que ceux-ci sont des occupants pr\u00e9caires et ne m\u00e9rite pas la protection de la loi ;<\/p>\n<p>Vu les textes de loi vis\u00e9s au moyen ;<\/p>\n<p>Attendu que l&#039;occupant pr\u00e9caire, en vertu d&#039;un contrat, reste en cette qualit\u00e9 tant que le contrat n&#039;ait subi une modification ; qu&#039;il importe peu de la dur\u00e9e de cette qualit\u00e9 ; que l&#039;arr\u00eat constatant l&#039;existence du contrat dat\u00e9 de 1930, dans lequel il a \u00e9t\u00e9 clairement stipul\u00e9 la qualit\u00e9 de fermier des consorts N., n&#039;a pas su tirer les cons\u00e9quences de droit de ce contrat ; qu&#039;en effet, \u00e9tant ainsi \u00e0 l&#039;origine, des occupants \u00e0 titre pr\u00e9caire, les consorts N. le reste ; qu&#039;ils ne peuvent b\u00e9n\u00e9ficier de la protection de la loi en mati\u00e8re de possession ;<\/p>\n<p>Que le moyen est fond\u00e9 ;<\/p>\n<p>Sur le second moyen de cassation tir\u00e9 de l&#039;article 26 de la loi 2004-036 du 01 octobre 2004 sur la Cour Supr\u00eame pour violation de la loi, d\u00e9naturation des faits, en ce que l&#039;arr\u00eat a dit le contrat dat\u00e9 de 1930 inop\u00e9rant par suite de la prescription trentenaire, alors que la prescription ne trouve pas application en l&#039;esp\u00e8ce et que le d\u00e9lai court \u00e0 partir du 22 ao\u00fbt 1998, date de r\u00e9clamation pour l&#039;abandon du terrain par les consorts N. ;<\/p>\n<p>Attendu que la prescription trentenaire s&#039;entend des actions en vue de l&#039;ex\u00e9cution d&#039;une obligation que la prescription trentenaire n&#039;est pas un constat de caducit\u00e9 de tout contrat apr\u00e8s trente ans ; que l&#039;action principale de R. et C. \u00e9tait la r\u00e9clamation du terrain en mettant fin au bail \u00e0 fermage qui \u00e9tait illimit\u00e9 ; que le contrat dat\u00e9 de 1930 a \u00e9t\u00e9 produit pour faire la preuve de la qualit\u00e9 d&#039;occupant pr\u00e9caire des consorts N. et non une action en vue de l&#039;ex\u00e9cution d&#039;une obligation due depuis cette date ;<\/p>\n<p>Que le moyen est fond\u00e9 et la cassation encourue ;<\/p>\n<p>CASSE ET ANNULE l&#039;arr\u00eat n\u00b0 404 du 26 octobre 2011 de la Cour d&#039;Appel de Mahajanga;<\/p>\n<p>Renvoie la cause et les parties devant la m\u00eame juridiction mais autrement compos\u00e9e ;<\/p>\n<p>Ordonne la restitution de l&#039;amende de cassation ;<\/p>\n<p>Condamne le d\u00e9fendeur aux d\u00e9pens ;<\/p>\n<p>Ainsi jug\u00e9 et prononc\u00e9 par la Cour de Cassation, Chambre civile Commerciale et Sociale les jour, mois et an que dessus.<\/p>\n<p>O\u00f9 \u00e9taient pr\u00e9sents:<\/p>\n<p>Mesdames et Messieurs :<\/p>\n<p>La minute du pr\u00e9sent arr\u00eat a \u00e9t\u00e9 sign\u00e9e par le Pr\u00e9sident, le Rapporteur, et le Greffier.\/.<\/p>\n<\/div>\n<hr class=\"kji-sep\" \/>\n<p class=\"kji-source-links\"><strong>Sources officielles :<\/strong> <a class=\"kji-source-link\" href=\"https:\/\/jurisprudence.justice.gov.mg\/decision\/details\/DCS6806DD1E18270\" target=\"_blank\" rel=\"noopener noreferrer\">consulter la page source<\/a> &middot;
