POINT DE DEPART INTERET MORATOIRE (NON)<\/p>\n<p>\u00ab La lettre consignant un accord de principe de r\u00e9\u00e9valuation des loyers sans d\u00e9termination du taux et de son effectivit\u00e9 ne vaut mise en demeure qui est le point de d\u00e9part des int\u00e9r\u00eats moratoires \u00bb.<\/p>\n<p>Me Jacques RAKOTOMALALA<\/p>\n<p>REPUBLIQUE DE MADAGASCAR<\/p>\n<p>COUR DE CASSATION<\/p>\n<p>CHAMBRE CIVILE COMMERCIALE SOCIALE<\/p>\n<p>La Cour de Cassation, Chambre Civile Commerciale Sociale en son audience publique ordinaire du vendredi dix-huit ao\u00fbt deux mille dix-sept, tenue au Palais de Justice \u00e0 Anosy, a rendu l&#039;arr\u00eat dont la teneur suit :<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi;<\/p>\n<p>Statuant sur le pourvoi de L.S demeurant au [Adresse 1], contre l&#039;arr\u00eat n\u00b0 785 du 29 juin 1999 rendu par la Chambre Civile de la Cour d&#039;Appel d&#039;Antananarivo dans la proc\u00e9dure qui l&#039;oppose \u00e0 R.S et R.C ;<\/p>\n<p>Vu les m\u00e9moires en demande et en d\u00e9fense ;<\/p>\n<p>Sur le premier moyen de cassation pris de la violation de l&#039;article 180 du Code de Proc\u00e9dure Civile, articles 192, 194 et 195 de la loi sur la Th\u00e9orie G\u00e9n\u00e9rale des Obligations pour non r\u00e9ponse \u00e0 conclusion ;<\/p>\n<p>En ce que l&#039;arr\u00eat attaqu\u00e9 a fix\u00e9 le point de d\u00e9part du nouveau taux de loyer \u00e0 compter du 10 mars 1992, alors qu&#039;il a \u00e9t\u00e9 demand\u00e9 que le taux du nouveau loyer parte \u00e0 compter du 27 novembre 1980 comme il a \u00e9t\u00e9 express\u00e9ment convenu ou pour le moins \u00e0 compter du 20 janvier 1983, date de la demande en justice ;<\/p>\n<p>Que l&#039;arr\u00eat attaqu\u00e9 a viol\u00e9 manifestement les dispositions des articles 192, 194 et 195 pr\u00e9cit\u00e9s ;<\/p>\n<p>Vu les textes vis\u00e9s au moyen ; <\/p>\n<p>Attendu que les parties avaient un accord sur le principe d&#039;une r\u00e9vision du taux de loyer sans que ni le loyer ni la date du d\u00e9part des nouveaux loyers n&#039;aient \u00e9t\u00e9 convenu ;<\/p>\n<p>Que les lettres consignant les accords de principe de la r\u00e9\u00e9valuation des loyers ne peuvent \u00eatre consid\u00e9r\u00e9es comme des mises en demeure qui est le point de d\u00e9part des int\u00e9r\u00eats moratoires ;<\/p>\n<p>Que le moyen ne saurait \u00eatre accueilli ;<\/p>\n<p>Sur le deuxi\u00e8me moyen de cassation pris de la violation de l&#039;article 180 du Code de Proc\u00e9dure Civile, articles 192, 194 et 195 de la loi sur la Th\u00e9orie G\u00e9n\u00e9rale des Obligations pour non r\u00e9ponse \u00e0 conclusion ;<\/p>\n<p>En ce qu&#039;il a \u00e9t\u00e9 demand\u00e9 \u00e0 la Cour d&#039;ordonner une nouvelle expertise et \u00e0 d\u00e9faut de fixer les nouveaux loyers au vu des \u00e9l\u00e9ments officiels apport\u00e9s \u00e0 un minimum de 2.500.000 FMG pour R.C et 3.000.000 FMG pour R.S, alors que l&#039;arr\u00eat attaqu\u00e9 n&#039;a pas apport\u00e9 de r\u00e9ponse \u00e0 cette demande et n&#039;a pas motiv\u00e9 son refus ;<\/p>\n<p>Attendu qu&#039;en fixant les nouveaux taux de loyer, la Cour d&#039;Appel a n\u00e9cessairement r\u00e9pondu aux conclusions des demandeurs au pourvoi ;<\/p>\n<p>Attendu qu&#039;une demande de nouvelle expertise s&#039;analyse comme une demande de mesure d&#039;instruction dont l&#039;appr\u00e9ciation de l&#039;opportunit\u00e9 appartient au juge du fond au vu des \u00e9l\u00e9ments du dossier et cette appr\u00e9ciation \u00e9chappe au contr\u00f4le de la Cour de Cassation ;<\/p>\n<p>D&#039;o\u00f9 il suit que le moyen n&#039;est pas fond\u00e9 ;<\/p>\n<p>Attendu que les deux moyens de cassation pr\u00e9sent\u00e9s ne sont pas fond\u00e9s ; <\/p>\n<p>REJETTE le pourvoi ;<\/p>\n<p>Condamne le demandeur \u00e0 l&#039;amende et aux d\u00e9pens.<\/p>\n<p>Ainsi jug\u00e9 et prononc\u00e9 par Cour, Chambre les jour, mois et an que dessus.<\/p>\n<p>O\u00f9 \u00e9taient pr\u00e9sents :<\/p>\n<p>Messieurs et Mesdames<\/p>\n<p>&#8211;
