L\u2019arr\u00eat attaqu\u00e9 a annul\u00e9 la vente de la chose d\u2019autrui, laquelle est nulle et de nul effet \u00bb.<\/p>\n<p>REPUBLIQUE DE MADAGASCAR<\/p>\n<p>COUR DE CASSATION<\/p>\n<p>CHAMBRE CIVILE COMMERCIALE SOCIALE<\/p>\n<p>La Cour de Cassation, Chambre Civile Commerciale Sociale en son audience publique ordinaire du vendredi quatre ao\u00fbt deux mille dix-sept, tenue au Palais de Justice \u00e0 Anosy, a rendu l&#039;arr\u00eat dont la teneur suit :<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi :<\/p>\n<p>Statuant sur le pourvoi de A.V ayant pour conseil Ma\u00eetre Tantely RAMAROSON, avocat, en l&#039;\u00e9tude duquel il \u00e9lit domicile, contre l&#039;arr\u00eat n\u00b0 258 du 08 mars 2010 de la Chambre Civile de la Cour d&#039;Appel d&#039;Antananarivo rendu dans le litige l&#039;opposant \u00e0 N.R ;<\/p>\n<p>Vu les m\u00e9moires en demande et en d\u00e9fense ;<\/p>\n<p>Sur le moyen unique de cassation, pris de la violation de l&#039;article 121 de l&#039;ordonnance 60.146 du 03 octobre 1960 sur le r\u00e9gime foncier de l&#039;immatriculation en ce que l&#039;arr\u00eat attaqu\u00e9 a annul\u00e9 la mutation effectu\u00e9e par le demandeur au pourvoi avec toutes les cons\u00e9quences de droit, alors que ce dernier a acquis de bonne foi le terrain litigieux qui a d\u00e9j\u00e0 fait l&#039;objet de partage entre les ayant-droits suivant acte de partage n\u00b0 127 du 21 avril 1994 et en application de l&#039;article 121 de l&#039;ordonnance 60.146 qui pr\u00e9conise que le titre foncier \u00e9tabli en suite d&#039;une proc\u00e9dure d&#039;immatriculation dans les formes et conditions qui seront d\u00e9termin\u00e9s par d\u00e9cret est d\u00e9finitif et inattaquable ; le moyen est ainsi fond\u00e9 et la cassation encourue ;<\/p>\n<p>Attendu ainsi qu&#039;il r\u00e9sulte des \u00e9l\u00e9ments constants de la proc\u00e9dure que les rapports d&#039;expertise du 11 novembre 2005 atteste que le terrain litigieux, objet de l&#039;acte de vente du 06 f\u00e9vrier 1997 correspond bien au lot attribu\u00e9 \u00e0 A.R.H suivant l&#039;acte de partage n\u00b0 127 du 21 avril 1994 et est vendu \u00e0 N.R ; le terrain vendu \u00e0 A.V par R.A.J ne lui appartient donc pas, toujours selon l&#039;acte de partage dont s&#039;agit ;<\/p>\n<p>Attendu qu&#039;il est de bon droit que l&#039;arr\u00eat attaqu\u00e9 a annul\u00e9 la vente de la chose d&#039;autrui, celle-ci \u00e9tant nulle et de nulle effet ;<\/p>\n<p>Et attendu que la bonne foi \u00e0 laquelle fait r\u00e9f\u00e9rence le demandeur au pourvoi ne saurait \u00eatre invoqu\u00e9e que par celui qui tient ses droits du v\u00e9ritable propri\u00e9taire, le moyen n&#039;est pas fond\u00e9 ;<\/p>\n<p>REJETTE le pourvoi ;<\/p>\n<p>Condamne le demandeur \u00e0 l&#039;amende et aux d\u00e9pens.<\/p>\n<p>Ainsi jug\u00e9 et prononc\u00e9 par Cour, Chambre les jour, mois et an que dessus.<\/p>\n<p>O\u00f9 \u00e9taient pr\u00e9sents :<\/p>\n<p>Messieurs et Mesdames<\/p>\n<p>&#8211; RAKETAMANGA Odette, Pr\u00e9sident de Chambre, Pr\u00e9sident ;<\/p>\n<p>&#8211; RANDRIAMANANTENA Mauricette, Conseiller &#8211; Rapporteur ;<\/p>\n<p>&#8211; RABETOKOTANY Marcelline, Conseiller, RAZAFIMORIA David, Conseiller, TOBSON Emma Augustine, Conseiller, tous membres ; ;<\/p>\n<p>&#8211; RAKOTONDRASOA Jean Fid\u00e8le, Avocat G\u00e9n\u00e9ral ;<\/p>\n<p>&#8211; RAJAONARISON Herimalala Patricia ;<\/p>\n<p>La minute du pr\u00e9sent arr\u00eat a \u00e9t\u00e9 sign\u00e9e par le Pr\u00e9sident, le Rapporteur et le Greffier.<\/p>\n<\/div>\n<hr class=\"kji-sep\" \/>\n<p class=\"kji-source-links\"><strong>Sources officielles :<\/strong> <a class=\"kji-source-link\" href=\"https:\/\/jurisprudence.justice.gov.mg\/decision\/details\/DCS6806DD1E15B07\" target=\"_blank\" rel=\"noopener noreferrer\">consulter la page source<\/a> &middot; <a class=\"kji-pdf-link\" href=\"https:\/\/jurisprudence.justice.gov.mg\/decision\/print\/DCS6806DD1E15B07\" target=\"_blank\" rel=\"noopener noreferrer\">PDF officiel<\/a><\/p>\n<p class=\"kji-license-note\"><em>Portail officiel du Ministere de la Justice de Madagascar.<\/em><\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Mati\u00e8res : Vente Mots cl\u00e9s : LITIGE DE TERRAIN \u2013 VENTE \u2013 VENTE DE LA CHOSE D\u2019AUTRUI \u2013 NULLITE ABSOLUE Le terrain vendu par le demandeur au pourvoi ne lui appartient pas.
