D\u2019ACQUISITION \u2013 DROIT DE PROPRIETE \u2013 SITUATION JURIDIQUE<\/p>\n<p>\u00ab Le d\u00e9p\u00f4t d\u2019une demande d\u2019acquisition ne cr\u00e9e aucun droit de propri\u00e9t\u00e9 et ne permet pas en cons\u00e9quence au demandeur le droit de remettre en cause la situation juridique actuelle de cette propri\u00e9t\u00e9 \u00bb.<\/p>\n<p>REPUBLIQUE DE MADAGASCAR<\/p>\n<p>COUR DE CASSATION<\/p>\n<p>CHAMBRE CIVILE COMMERCIALE ET SOCIALE<\/p>\n<p>La Cour de Cassation, Chambre civile Commerciale et Sociale en son audience publique ordinaire du vendredi quatre ao\u00fbt deux mille dix-sept, tenue au palais de Justice \u00e0 Anosy, a rendu l&#039;arr\u00eat dont la teneur suit :<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>Statuant sur le pourvoi de R.S.P, et de R.J.D, demeurant au [Adresse 1], ayant pour conseils Me Ravelojaona Zanakandriambary M et Me Raveloson Harinirina, Avocats, contre l&#039;arr\u00eat n\u00b0CATO 169\/CIV\/12 du 03 juillet 2012 de la Chambre civile de la Cour d&#039;Appel de Toamasina rendu dans la proc\u00e9dure qui les oppose aux H\u00e9ritiers d&#039;A.C ;<\/p>\n<p>Vu les m\u00e9moires en demande et en d\u00e9fense produits ;<\/p>\n<p>Sur le moyen unique de cassation tir\u00e9 de la violation des articles 34, 35 et 36 de la Loi n\u00b02005-019 du 17 octobre 2005 fixant les principes r\u00e9gissant les statuts des terres,<\/p>\n<p>En ce que la Cour d&#039;Appel de Toamasina a infirm\u00e9 le jugement entrepris et a d\u00e9clar\u00e9 que R.S.P et R.J.D sont irrecevables en leur revendication car ils ne justifient d&#039;aucun droit ni titre et qu&#039;en l&#039;\u00e9tat actuel des faits, rien ne prouve qu&#039;ils sont propri\u00e9taires d&#039;une parcelle d\u00e9pendante de la propri\u00e9t\u00e9 dite \u00ab FANOMEZANA \u00bb et un droit \u00e9ventuel ne leur permet pas de remettre en cause la situation juridique actuelle de cette propri\u00e9t\u00e9,<\/p>\n<p>Alors qu&#039;ils occupent depuis 1972 les terrains litigieux en vertu d&#039;un droit de propri\u00e9t\u00e9 non titr\u00e9e ; que la reconnaissance et la constatation de mise en valeur a \u00e9t\u00e9 faite par le Service des Domaines le 21 octobre 1997 et qu&#039;un avis favorable a \u00e9t\u00e9 \u00e9mis pour la cession \u00e0 l&#039;amiable sous conditions r\u00e9solutoires ; or, le terrain demand\u00e9 est englob\u00e9 dans la propri\u00e9t\u00e9 \u00ab FANOMEZANA \u00bb TN\u00b0 7767- BA et empi\u00e8te en outre sur les propri\u00e9t\u00e9s dites : \u00ab GAELLE RICA \u00bb TN\u00b012 863-BA et \u00ab SAMI \u00bb TN\u00b0 12 918-BA issue du titre N\u00b07767-BA ;<\/p>\n<p>Vu lesdits textes ;<\/p>\n<p>Attendu que les textes de loi vis\u00e9s au moyen fixent uniquement le r\u00e9gime juridique des terrains d\u00e9tenus en vertu d&#039;un droit de propri\u00e9t\u00e9 non titr\u00e9 comprenant la proc\u00e9dure \u00e0 observer pour l&#039;obtention d&#039;un acte domanial ;<\/p>\n<p>Attendu que les demandeurs au pourvoi n&#039;en justifient pas ; que le d\u00e9p\u00f4t d&#039;une demande ne peut cr\u00e9er aucun droit surtout qu&#039;en l&#039;esp\u00e8ce, l&#039;Administration a octroy\u00e9 \u00e0 un tiers des droits sur le terrain revendiqu\u00e9 ;<\/p>\n<p>Qu&#039;en effet, l&#039;Administration est seule juge d&#039;appr\u00e9cier l&#039;opportunit\u00e9 ou non de l&#039;attribution des terres domaniales ;<\/p>\n<p>Qu&#039;en c\u00e9dant le terrain en cause en cause \u00e0 A.C, l&#039;Administration a implicitement mais n\u00e9cessairement rejet\u00e9 la demande des consorts R.J.D ;<\/p>\n<p>D&#039;o\u00f9 il suit que l&#039;arr\u00eat attaqu\u00e9, en retenant que \u00ab le seul espoir de voir aboutir leur demande d&#039;acquisition ne leur octroie pas le droit de remettre en cause la situation juridique actuelle de cette propri\u00e9t\u00e9 qui, selon le certificat de situation juridique produit, appartient en exclusivit\u00e9 \u00e0 d&#039;autres personnes \u00bb, a exactement appliqu\u00e9 la loi ;<\/p>\n<p>Que le moyen manquant en droit est irrecevable ;<\/p>\n<p>REJETTE le pourvoi ;<\/p>\n<p>Condamne les demandeurs \u00e0 l&#039;amende et aux d\u00e9pens.<\/p>\n<p>Ainsi jug\u00e9 et prononc\u00e9 par la Cour de Cassation, Chambre civile Commerciale et Sociale, en son audience
