Possession"},"content":{"rendered":"<div class=\"kji-decision\">\n<div class=\"kji-full-text\">\n<p>Mati\u00e8res : Foncier<\/p>\n<p>Mots cl\u00e9s : Cessation de trouble \u2013 occupation \u2013 terrain \u2013 cession<\/p>\n<p>En d\u00e9clarant irrecevable la demande de cessation de trouble, la Cour d\u2019Appel laisse le droit par une des parties d\u2019occuper le terrain litigieux empi\u00e9tant ainsi le pouvoir conf\u00e9r\u00e9 par la loi 2008-014 du 23 juillet 2008 \u00e0 l\u2019Administration de la facult\u00e9 d\u2019appr\u00e9cier l\u2019opportunit\u00e9 de toute cession d\u2019une partie du domaine priv\u00e9.<\/p>\n<p>Cassation : Ordinaire<\/p>\n<p>Nature : Civile<\/p>\n<p>Solution : Cassation<\/p>\n<p>ARRET N\u00b0 498 du 25 juillet 2017<\/p>\n<p>Dossier : 1043\/14-CO<\/p>\n<p>CESSATION DE TROUBLE \u2013 OCCUPATION \u2013 TERRAIN \u2013 CESSION<\/p>\n<p>\u00ab En d\u00e9clarant irrecevable la demande de cessation de trouble, la Cour d\u2019Appel laisse le droit par une des parties d\u2019occuper le terrain litigieux empi\u00e9tant ainsi le pouvoir conf\u00e9r\u00e9 par la loi 2008-014 du 23 juillet 2008 \u00e0 l\u2019Administration de la facult\u00e9 d\u2019appr\u00e9cier l\u2019opportunit\u00e9 de toute cession d\u2019une partie du domaine priv\u00e9 \u00bb.<\/p>\n<p>REPUBLIQUE DE MADAGASCAR<\/p>\n<p>COUR DE CASSATION<\/p>\n<p>CHAMBRE CIVILE COMMERCIALE ET SOCIALE<\/p>\n<p>La Cour de Cassation, Chambre Civile Commerciale et Sociale, en son audience publique ordinaire du vendredi cinq juillet deux mille dix sept, tenue au palais de Justice \u00e0 Anosy, a rendu l&#039;arr\u00eat dont la teneur suit:<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi;<\/p>\n<p>Statuant sur le pourvoi de J.R, demeurant au lot [Adresse 1] mais \u00e9lisant domicile au [Adresse 2], contre l&#039;arr\u00eat n\u00b0 388 du 05 novembre 2014 de la Chambre Civile de la Cour d&#039;Appel de Fianarantsoa, rendu dans le litige l&#039;opposant \u00e0 Z.A ;<\/p>\n<p>Vu les m\u00e9moires en demande et en d\u00e9fense ;<\/p>\n<p>Sur le moyen unique de cassation pris de la violation de l&#039;article 28 de la loi 2008.014 du 23 juillet 2008, pour violation de la loi, et fausse application de la loi, en ce que l&#039;arr\u00eat attaqu\u00e9 n&#039;a aucunement pris en consid\u00e9ration la loi 2006.031 du 24 novembre 2006 en ses articles 25 et 26 auxquels s&#039;est r\u00e9f\u00e9r\u00e9 le premier juge dans le jugement n\u00b0 21 C du 27 f\u00e9vrier 2014 avec toutes ses cons\u00e9quences de droit, de m\u00eame les conclusions tir\u00e9es de la descente sur les lieux et les d\u00e9positions consign\u00e9es des t\u00e9moignages recueillis ;<\/p>\n<p>Alors que la d\u00e9cision de la Cour d&#039;Appel para\u00eet &quot; malsaine &quot; au d\u00e9triment de la longue (36 ans) et paisible occupation du terrain objet de l&#039;affaire 4171 G inscrite au nom du demandeur au pourvoi ; il s&#039;en suit d&#039;apr\u00e8s toutes ces pr\u00e9tentions et preuves \u00e0 l&#039;appui que ses droits se trouvent totalement bafou\u00e9s ; <\/p>\n<p>Vu les textes de loi vis\u00e9s au moyen ;<\/p>\n<p>Attendu qu&#039;il ressort des \u00e9l\u00e9ments constants de la proc\u00e9dure que les parties au proc\u00e8s ont chacune d\u00e9pos\u00e9 une demande d&#039;acquisition du terrain litigieux aupr\u00e8s des Services Administratifs comp\u00e9tents (AFF N\u00b04171 AG et 4292 AG) ;<\/p>\n<p>Attendu qu&#039;il s&#039;en suit que la juridiction judiciaire n&#039;avait pas \u00e0 se prononcer sur les demandes portant sur les troubles de jouissance, l&#039;Administration \u00e9tant seule comp\u00e9tente pour statuer sur les demandes et droits des parties et seul juge du refus article 28 de la loi 2008.014 du 23 juillet 2008 sur le domaine priv\u00e9 de l&#039;Etat ; <\/p>\n<p>Attendu qu&#039;en d\u00e9clarant irrecevable la demande de cessation de trouble, la Cour d&#039;Appel laisse ainsi le droit par une des parties d&#039;occuper n\u00e9cessairement le terrain litigieux et ce en attente de la d\u00e9cision de l&#039;Administration, propri\u00e9taire et qui conserve la facult\u00e9 d&#039;appr\u00e9cier l&#039;opportunit\u00e9 de toute cession d&#039;une partie du domaine priv\u00e9, ainsi pr\u00e9cis\u00e9 par l&#039;article 28 sus sp\u00e9cifi\u00e9 ; alors que l&#039;incomp\u00e9tence est donc de droit ;<\/p>\n<p>Attendu ainsi que la cassation est encourue, et sans renvoi, plus rien n&#039;\u00e9tant \u00e0 juger sur le fond du litige devant la juridiction judiciaire ; <\/p>\n<p>CASSE ET ANNULE sans renvoi l&#039;arr\u00eat n\u00b0 388 du 05 novembre 2014 de la Chambre Civile de la Cour d&#039;Appel de Fianarantsoa ;<\/p>\n<p>Condamne le demandeur \u00e0 l&#039;amende et aux d\u00e9pens.<\/p>\n<p>Ainsi jug\u00e9 et prononc\u00e9 par Cour, Chambre les jour, mois et an que dessus.<\/p>\n<p>O\u00f9 \u00e9taient pr\u00e9sents :<\/p>\n<p>Messieurs et Mesdames<\/p>\n<p>&#8211;
