Proc\u00e9dure"},"content":{"rendered":"<div class=\"kji-decision\">\n<div class=\"kji-full-text\">\n<p>Mati\u00e8res : Lienciement<\/p>\n<p>Mots cl\u00e9s : licenciement \u2013 salari\u00e9 \u2013 pasteur<\/p>\n<p>La proc\u00e9dure de licenciement d\u2019un salari\u00e9 doit toujours respect\u00e9e les r\u00e8gles impos\u00e9es par la loi.<\/p>\n<p>Cassation : Ordinaire<\/p>\n<p>Nature : Civile<\/p>\n<p>Solution : Cassation<\/p>\n<p>ARRET N\u00b0 453 du 21 juillet 2017<\/p>\n<p>Dossier : 859\/12-SOC<\/p>\n<p>LICENCIEMENT \u2013 SALARI\u00c9 \u2013 PASTEUR<\/p>\n<p>\u00ab La proc\u00e9dure de licenciement d\u2019un salari\u00e9 doit toujours respect\u00e9e les r\u00e8gles impos\u00e9es par la loi \u00bb.<\/p>\n<p>FIKAMBANANA APOKALYPSY eto MADAGASIKARA<\/p>\n<p>R\u00c9PUBLIQUE DE MADAGASCAR<\/p>\n<p>COUR DE CASSATION<\/p>\n<p>CHAMBRE CIVILE COMMERCIALE SOCIALE<\/p>\n<p>La Cour de Cassation, Chambre Civile Commerciale Sociale en son audience publique ordinaire du vendredi vingt et un juillet deux mille dix-sept, tenue au Palais de Justice \u00e0 Anosy, a rendu l&#039;arr\u00eat dont la teneur suit :<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>Statuant sur le pourvoi du FIKAMBANANA APOKALYPSY eto MADAGASIKARA (FAM), sis [Adresse 1] contre l\u2019arr\u00eat n\u00b0 227 rendu le 20 septembre 2012 par la Chambre Sociale de la Cour d\u2019Appel d\u2019Antananarivo, dans la proc\u00e9dure qui l\u2019oppose \u00e0 R.P ;<\/p>\n<p>Vu les m\u00e9moires en demande et en d\u00e9fense produits ;<\/p>\n<p>Sur le moyen unique de cassation tir\u00e9 des articles 25 et 26 de la Loi organique n\u00b02004.036 du 1er octobre 2004 sur la Cour Supr\u00eame, pris de la violation de l\u2019article 20 du Code du Travail, des articles 133 et suivants du R\u00e8glement Int\u00e9rieur de la FAM, pour d\u00e9naturation des \u00e9crits et document, contradiction de motif, fausse application et fausse interpr\u00e9tation de la loi, en ce que l\u2019arr\u00eat attaqu\u00e9 a confirm\u00e9 le jugement entrepris en retenant que la r\u00e9vocation d\u2019un pasteur est d\u00e9cid\u00e9 par le Comit\u00e9 Pastoral et que les dispositions du r\u00e8glement int\u00e9rieur du FAM n\u2019ont pas \u00e9t\u00e9 observ\u00e9es lors de la r\u00e9vocation suivie de licenciement de R.P ; que le licenciement aurait d\u00fb \u00eatre d\u00e9cid\u00e9 par le Comit\u00e9 National et non pas pour le Comit\u00e9 Pastoral et qu\u2019ainsi en application de l\u2019article 20 du Code de Travail, le licenciement est abusif alors que la r\u00e9vocation et le licenciement de R.P ont \u00e9t\u00e9 d\u00e9cid\u00e9s par le Comit\u00e9 National de FAM ; que la d\u00e9cision du 05 mars 2009 a \u00e9t\u00e9 sign\u00e9e par le Secr\u00e9taire G\u00e9n\u00e9ral par int\u00e9rim, au nom du Comit\u00e9 National et contresign\u00e9 par le vice-pr\u00e9sident du Comit\u00e9 Pastoral ; que la d\u00e9cision de r\u00e9vocation a \u00e9t\u00e9 faite conform\u00e9ment aux dispositions de l\u2019article 20 du Code de Travail ;<\/p>\n<p>Attendu que la Cour d\u2019Appel a tir\u00e9 cons\u00e9quence de l\u2019inobservation des r\u00e8gles de forme pour qualifier le licenciement d\u2019abusif sans retenir dans la d\u00e9cision attaqu\u00e9e des motifs sur le licenciement au fond ;<\/p>\n<p>Qu\u2019il y a insuffisance de motifs ne permettant pas \u00e0 la Cour de Cassation d\u2019exercer son contr\u00f4le ;
