Indivision"},"content":{"rendered":"<div class=\"kji-decision\">\n<div class=\"kji-full-text\">\n<p>Mati\u00e8res : Biens<\/p>\n<p>Mots cl\u00e9s : Vente \u2013 partage \u2013 terrain \u2013 indivision \u2013 consentement \u2013 coh\u00e9ritiers<\/p>\n<p>La vente et le partage d\u2019un terrain qui se trouve en indivision n\u00e9cessitent le consentement de tous les coh\u00e9ritiers<\/p>\n<p>Cassation : Ordinaire<\/p>\n<p>Nature : Civile<\/p>\n<p>Solution : Rejet<\/p>\n<p>ARRET N\u00b0 438 du 07 juillet 2017<\/p>\n<p>Dossier : 1060\/11-CO <\/p>\n<p>VENTE \u2013 PARTAGE \u2013 TERRAIN \u2013 INDIVISION \u2013 CONSENTEMENT \u2013 COH\u00c9RITIERS<\/p>\n<p>\u00ab La vente et le partage d\u2019un terrain qui se trouve en indivision n\u00e9cessitent le consentement de tous les coh\u00e9ritiers \u00bb.<\/p>\n<p>H\u00e9ritiers R.S et consorts<\/p>\n<p>REPUBLIQUE DE MADAGASCAR<\/p>\n<p>COUR DE CASSATION<\/p>\n<p>CHAMBRE CIVILE COMMERCIALE ET SOCIALE<\/p>\n<p>La Cour de Cassation, Chambre Civile Commerciale et Sociale, en son audience publique ordinaire du vendredi sept juillet deux mille dix-sept, tenue au Palais de Justice \u00e0 Anosy, a rendu l&#039;arr\u00eat dont la teneur suit :<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>Statuant sur le pourvoi de R.B demeurant au lot [Adresse 1] ayant pour conseil Ma\u00eetres Mamihasina Razakatiana et Mihaliharilanto Ramanitra avocats, contre l&#039;arr\u00eat n\u00b0443 du 06 avril 2011 rendu par la Chambre Civile 5\u00e8me Section qui l&#039;oppose aux h\u00e9ritiers R.S, A., B., C., D., E., les h\u00e9ritiers F., les h\u00e9ritiers G. et H. ;<\/p>\n<p>Vu le m\u00e9moire en demande produit ;<\/p>\n<p>Sur le moyen unique de cassation tir\u00e9 de l&#039;article 26 de la Loi organique n\u00b02004.036 du 1er octobre 2004 sur la Cour Supr\u00eame, et pris de la violation des articles 1583 du Code Civil, articles 012 des dispositions liminaires du Code de Proc\u00e9dure Civile et 77 de la loi n\u00b068.012 du 04 juillet 1968 relative aux Successions, testaments et donation pour violation de la loi, mauvaise application de la loi et pour d\u00e9faut de r\u00e9ponse \u00e0 conclusion ;<\/p>\n<p>en ce que l&#039;arr\u00eat attaqu\u00e9 a confirm\u00e9 le jugement n\u00b004 du 04 janvier 2007 et d\u00e9bout\u00e9 R.B de ses demandes aux motifs que ce dernier n&#039;a pas pu pr\u00e9senter d&#039;autres moyens pour appuyer son recours mais se contente d&#039;affirmer que tous les h\u00e9ritiers des propri\u00e9taires inscrits ont \u00e9t\u00e9 repr\u00e9sent\u00e9s pour dresser les actes de partage et de vente ;<\/p>\n<p>Que la propri\u00e9t\u00e9 dite &quot; Miarinarivo &quot; est encore en \u00e9tat d&#039;indivision ;<\/p>\n<p>Que les actes de vente et de partage n&#039;ayant pas re\u00e7u le consentement de tous ne peuvent \u00eatre homologu\u00e9s ;<\/p>\n<p>Alors que la Cour n&#039;a pas pris en compte la reconnaissance de la vente de leurs parts \u00e0 R.B par C. demeurant \u00e0 Masomanga-Ampaneva et C. habitant \u00e0 Tanambao-Ampaneva, et n&#039;a pas r\u00e9pondu aux conclusions en date du 30 juin 2010 de R.B mettant en \u00e9chec les pr\u00e9tentions des intim\u00e9s ;<\/p>\n<p>Que chaque co-indivisaire est ma\u00eetre de sa quote-part et peut la vendre ;<\/p>\n<p>Vu lesdits textes ;<\/p>\n<p>Attendu que pour confirmer le jugement entrepris, la Cour a \u00e9nonc\u00e9 :<\/p>\n<p>\u00ab Attendu que deux parmi les coh\u00e9ritiers, en l&#039;occurrence H. et A. encore vivant lors de l&#039;\u00e9tablissement desdits actes et qui repr\u00e9sentent plusieurs coh\u00e9ritiers, ont contest\u00e9 la validit\u00e9 des actes en cause ;<\/p>\n<p>Attendu que la propri\u00e9t\u00e9 dite &quot; Miarinarivo III &quot; TF n\u00b02014 est encore en indivision jusqu&#039;\u00e0 ce jour ;<\/p>\n<p>Que le consentement de tous les coh\u00e9ritiers est indispensable ;<\/p>\n<p>Qu&#039;en cons\u00e9quence, les actes de vente et de partage n&#039;ayant pas re\u00e7u le consentement de tous ne peuvent \u00eatre homologu\u00e9s \u00bb ;<\/p>\n<p>Attendu en l&#039;\u00e9tat de ces \u00e9nonciations, en d\u00e9boutant R.B de sa demande d&#039;homologation d&#039;acte de partage et de vente, la Cour a implicitement mais n\u00e9cessairement r\u00e9pondu \u00e0 ses conclusions du 30 juin 2010 ;<\/p>\n<p>Attendu que le moyen a soulev\u00e9 que la Cour n&#039;a pas pris en compte la reconnaissance de la vente de leurs parts \u00e0 R.B par les deux C. ;<\/p>\n<p>Attendu que les juges du fond disposent d&#039;un pouvoir souverain pour appr\u00e9cier les \u00e9l\u00e9ments de fait et de preuve soumis \u00e0 leur examen, et le moyen qui tente de remettre en cause cette appr\u00e9ciation souveraine des faits par les juges du fond ne saurait \u00eatre accueilli ;<\/p>\n<p>REJETTE le pourvoi ;<\/p>\n<p>Condamne le demandeur \u00e0 l&#039;amende et aux d\u00e9pens.<\/p>\n<p> Ainsi jug\u00e9 et prononc\u00e9 par la Cour de Cassation, Chambre civile Commerciale et Sociale les jour, mois et an que dessus.<\/p>\n<p>O\u00f9 \u00e9taient pr\u00e9sents :<\/p>\n<p>Mesdames et Messieurs :<\/p>\n<p>&#8211;
