La condamnation sur le fondement de l\u2019article 700 du code de proc\u00e9dure civile<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Par une ordonnance de r\u00e9f\u00e9r\u00e9 du 7 avril 2026, le Tribunal des activit\u00e9s \u00e9conomiques de Nanterre a \u00e9t\u00e9 saisi d\u2019une demande de provision form\u00e9e par une soci\u00e9t\u00e9 bailleresse \u00e0 l\u2019encontre d\u2019une soci\u00e9t\u00e9 locataire, en raison de loyers impay\u00e9s et de la r\u00e9siliation du contrat de location. Une soci\u00e9t\u00e9 de location de mat\u00e9riels (ci-apr\u00e8s <em>&#8221; la bailleresse &#8220;<\/em>) avait consenti un contrat de location \u00e0 une soci\u00e9t\u00e9 exploitante (ci-apr\u00e8s <em>&#8221; la locataire &#8220;<\/em>). Des loyers \u00e9tant demeur\u00e9s impay\u00e9s, la bailleresse a adress\u00e9 une mise en demeure le 31 d\u00e9cembre 2025, puis a notifi\u00e9 la r\u00e9siliation du contrat le 21 janvier 2026. Elle a ensuite assign\u00e9 la locataire en r\u00e9f\u00e9r\u00e9 devant le pr\u00e9sident du tribunal aux fins d\u2019obtenir le paiement des loyers impay\u00e9s et \u00e0 \u00e9choir, des p\u00e9nalit\u00e9s, l\u2019indemnit\u00e9 de r\u00e9siliation, la restitution des biens sous astreinte, ainsi qu\u2019une indemnit\u00e9 au titre de l\u2019article 700 du code de proc\u00e9dure civile. La locataire, bien que r\u00e9guli\u00e8rement assign\u00e9e, n\u2019a pas comparu. Le juge des r\u00e9f\u00e9r\u00e9s a fait droit \u00e0 l\u2019int\u00e9gralit\u00e9 des demandes.<\/p>\n<p>La question de droit centrale \u00e9tait de savoir si le juge des r\u00e9f\u00e9r\u00e9s pouvait, en l\u2019absence de contestation s\u00e9rieuse, accorder une provision et ordonner la restitution des biens sous astreinte. Le tribunal a r\u00e9pondu par l\u2019affirmative, retenant que les pi\u00e8ces produites \u00e9tablissaient la r\u00e9alit\u00e9 de la cr\u00e9ance et qu\u2019aucune contestation s\u00e9rieuse n\u2019\u00e9tait \u00e9lev\u00e9e. Il a donc constat\u00e9 la r\u00e9siliation, condamn\u00e9 la locataire \u00e0 restituer les mat\u00e9riels dans un d\u00e9lai de huitaine sous une astreinte de vingt euros par jour et par bien, et l\u2019a condamn\u00e9e \u00e0 payer une provision de 10 476,40 euros TTC, outre 2 000 euros sur le fondement de l\u2019article 700. La d\u00e9cision soul\u00e8ve des enjeux relatifs au pouvoir du juge des r\u00e9f\u00e9r\u00e9s en mati\u00e8re de provision et \u00e0 l\u2019\u00e9tendue des condamnations accessoires.<\/p>\n<h2 id=\"i-laffirmation-de-labsence-de-contestation-serieuse-comme-condition-centrale-de-\">I. L\u2019affirmation de l\u2019absence de contestation s\u00e9rieuse comme condition centrale de la provision<\/h2>\n<p><\/p>\n<h3 id=\"a-la-constatation-de-la-resiliation-et-lexigibilite-des-loyers-impayes\">A. La constatation de la r\u00e9siliation et l\u2019exigibilit\u00e9 des loyers impay\u00e9s<\/h3>\n<p>Le juge des r\u00e9f\u00e9r\u00e9s a estim\u00e9 que le contrat de location \u00e9tait r\u00e9sili\u00e9 aux torts de la locataire. Il s\u2019est fond\u00e9 sur les documents non contest\u00e9s, notamment la mise en demeure et la lettre de r\u00e9siliation. Il a relev\u00e9 que <em>&#8221; les motifs \u00e9nonc\u00e9s en l\u2019assignation, les explications fournies \u00e0 la barre, et les pi\u00e8ces vers\u00e9es aux d\u00e9bats [\u2026] suffisent pour permettre d\u2019accorder la provision sollicit\u00e9e qui ne se heurte \u00e0 aucune contestation s\u00e9rieuse &#8220;<\/em>. Cette formule reprend les conditions de l\u2019article 835, alin\u00e9a 2, du code de proc\u00e9dure civile, qui permet au juge des r\u00e9f\u00e9r\u00e9s d\u2019accorder une provision lorsque l\u2019obligation n\u2019est pas s\u00e9rieusement contestable. En l\u2019esp\u00e8ce, la locataire n\u2019a pas comparu, ce qui \u00e9quivaut \u00e0 une absence de contestation. La jurisprudence rappelle qu\u2019une contestation s\u00e9rieuse suppose une incertitude juridique ou factuelle suffisante : <em>&#8221; Il en r\u00e9sulte une contestation s\u00e9rieuse sur le principe m\u00eame des demandes provisionnelles &#8220;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/679c6a78224343169ba1c138\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Paris, 30 janvier 2025, n\u00b024\/08760)<\/a><\/strong>. Ici, aucune incertitude n\u2019\u00e9tant soulev\u00e9e, le juge a pu constater la r\u00e9siliation et condamner au paiement des loyers impay\u00e9s et \u00e0 \u00e9choir.<\/p>\n<h3 id=\"b-ladmission-des-penalites-contractuelles-et-de-la-clause-penale\">B. L\u2019admission des p\u00e9nalit\u00e9s contractuelles et de la clause p\u00e9nale<\/h3>\n<p>Outre les loyers, le tribunal a \u00e9galement accord\u00e9 des p\u00e9nalit\u00e9s contractuelles de 40 euros HT, une clause p\u00e9nale de 10 % sur les loyers \u00e0 \u00e9choir, soit 608,40 euros TTC, et des int\u00e9r\u00eats au taux BCE major\u00e9 de 10 points. Il s\u2019agit de condamnations provisionnelles qui int\u00e8grent l\u2019int\u00e9gralit\u00e9 des sommes dues en ex\u00e9cution du contrat. La clause p\u00e9nale, pr\u00e9vue \u00e0 l\u2019article 14 des conditions g\u00e9n\u00e9rales, n\u2019a \u00e9t\u00e9 contest\u00e9e par aucun moyen. Le juge n\u2019a donc pas \u00e0 en r\u00e9duire le montant en l\u2019absence de d\u00e9bat sur son caract\u00e8re manifestement excessif. En mati\u00e8re de r\u00e9f\u00e9r\u00e9, le juge peut accorder une provision incluant la clause p\u00e9nale d\u00e8s lors que son principe n\u2019est pas s\u00e9rieusement contestable. La d\u00e9cision confirme ainsi que le juge des r\u00e9f\u00e9r\u00e9s dispose d\u2019un large pouvoir pour liquider l\u2019int\u00e9gralit\u00e9 de la cr\u00e9ance contractuelle, y compris les accessoires.<\/p>\n<h2 id=\"ii-les-consequences-indemnitaires-et-lobligation-de-restitution-sous-astreinte\">II. Les cons\u00e9quences indemnitaires et l\u2019obligation de restitution sous astreinte<\/h2>\n<p><\/p>\n<h3 id=\"a-la-condamnation-provisionnelle-et-la-mesure-de-restitution\">A. La condamnation provisionnelle et la mesure de restitution<\/h3>\n<p>Le tribunal a ordonn\u00e9 la restitution des mat\u00e9riels sous astreinte de vingt euros par jour et par bien, pour une dur\u00e9e de trente jours, et s\u2019est r\u00e9serv\u00e9 la liquidation de cette astreinte. Cette mesure est conforme \u00e0 l\u2019article L. 131-1 du code des proc\u00e9dures civiles d\u2019ex\u00e9cution, qui permet d\u2019assortir une obligation de faire d\u2019une astreinte. En l\u2019esp\u00e8ce, la r\u00e9siliation \u00e9tant constat\u00e9e, la locataire \u00e9tait tenue de restituer les biens. Le juge a assorti cette obligation d\u2019un d\u00e9lai de huitaine et fix\u00e9 une astreinte provisoire. Il a \u00e9galement rappel\u00e9 que la restitution s\u2019effectuerait aux frais du locataire. Cette solution est classique en mati\u00e8re de contrat de location r\u00e9sili\u00e9 pour d\u00e9faut de paiement. La provision de 10 476,40 euros couvre \u00e0 la fois les loyers impay\u00e9s (3 744 euros TTC), les loyers \u00e0 \u00e9choir (6 084 euros TTC) et les p\u00e9nalit\u00e9s. Elle est accord\u00e9e en r\u00e9f\u00e9r\u00e9 car l\u2019obligation de payer n\u2019est pas s\u00e9rieusement contestable.<\/p>\n<h3 id=\"b-la-condamnation-sur-le-fondement-de-larticle-700-du-code-de-procedure-civile\">B. La condamnation sur le fondement de l\u2019article 700 du code de proc\u00e9dure civile<\/h3>\n<p>Le juge a condamn\u00e9 la locataire \u00e0 payer 2 000 euros au titre de l\u2019article 700 du code de proc\u00e9dure civile, au motif que <em>&#8221; le d\u00e9fendeur, en ne r\u00e9glant pas une dette qui n\u2019est pas s\u00e9rieusement contestable, a oblig\u00e9 le demandeur \u00e0 exposer des sommes non comprises dans les d\u00e9pens &#8220;<\/em>. Cette motivation s\u2019inscrit dans la logique de l\u2019\u00e9quit\u00e9. Une jurisprudence r\u00e9cente rappelle que <em>&#8221; l\u2019\u00e9quit\u00e9 commande d\u2019accorder une indemnit\u00e9 sur le fondement de l\u2019article 700 &#8220;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67fde8309b68debe44f7e891\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Paris, 11 avril 2025, n\u00b024\/00595)<\/a><\/strong>. Le montant de 2 000 euros peut para\u00eetre \u00e9lev\u00e9 au regard de la somme due, mais il correspond aux frais expos\u00e9s pour l\u2019assignation et la proc\u00e9dure. L\u2019ordonnance a \u00e9galement rappel\u00e9 l\u2019ex\u00e9cution provisoire de droit et liquid\u00e9 les d\u00e9pens. Dans ce cas, il est proc\u00e9d\u00e9 comme il est dit aux  alin\u00e9as 3 et 4 de l&#8217;article 37 de la loi n\u00b0 91-647 du 10 juillet 1991 .<\/p>\n<p>Dans tous les cas, le juge tient compte de l&#8217;\u00e9quit\u00e9 ou de la situation \u00e9conomique de la partie condamn\u00e9e.
