L&#8217;absence de preuve d&#8217;un abus de confiance de la part du salari\u00e9<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Le 23 avril 2026, la chambre sociale de la Cour d&#8217;appel de Limoges a rendu un arr\u00eat (n\u00b025\/00566) relatif aux effets de la d\u00e9mission du salari\u00e9 sur une demande de r\u00e9siliation judiciaire du contrat de travail et sur les demandes indemnitaires subs\u00e9quentes. Un salari\u00e9, engag\u00e9 par une soci\u00e9t\u00e9, a saisi le conseil de prud&#8217;hommes d&#8217;une demande de r\u00e9siliation judiciaire aux torts de l&#8217;employeur pour manquements \u00e0 ses obligations. Parall\u00e8lement, il a sollicit\u00e9 des indemnit\u00e9s de rupture et des dommages-int\u00e9r\u00eats pour ex\u00e9cution d\u00e9loyale du contrat. La soci\u00e9t\u00e9 a \u00e9galement form\u00e9 une demande reconventionnelle pour ex\u00e9cution d\u00e9loyale. Le conseil de prud&#8217;hommes a fait droit \u00e0 la demande de dommages-int\u00e9r\u00eats du salari\u00e9. La soci\u00e9t\u00e9 a interjet\u00e9 appel. En cause d&#8217;appel, il est apparu que le salari\u00e9 avait d\u00e9missionn\u00e9 le 9 d\u00e9cembre 2024, soit ant\u00e9rieurement \u00e0 la saisine du conseil. La cour a d\u00fb d\u00e9terminer si cette d\u00e9mission rendait sans objet la demande de r\u00e9siliation judiciaire et quelles \u00e9taient les cons\u00e9quences sur les pr\u00e9tentions indemnitaires des parties. Elle a infirm\u00e9 le jugement, d\u00e9boutant le salari\u00e9 de l&#8217;ensemble de ses demandes et rejetant la demande reconventionnelle de l&#8217;employeur.<\/p>\n<p>La solution retenue par la cour conduit \u00e0 s&#8217;interroger sur la charge de la preuve en mati\u00e8re de paiement des salaires et sur l&#8217;appr\u00e9ciation des griefs li\u00e9s \u00e0 l&#8217;ex\u00e9cution d\u00e9loyale du contrat de travail. L&#8217;arr\u00eat distingue nettement le sort de la r\u00e9siliation judiciaire, devenue sans objet, de celui des demandes indemnitaires accessoires, subordonn\u00e9es \u00e0 la d\u00e9monstration d&#8217;un pr\u00e9judice distinct.<\/p>\n<h2 id=\"i-labsence-dobjet-de-la-resiliation-judiciaire-et-le-rejet-des-indemnites-de-rup\">I. L&#8217;absence d&#8217;objet de la r\u00e9siliation judiciaire et le rejet des indemnit\u00e9s de rupture<\/h2>\n<p>La cour a estim\u00e9 que la d\u00e9mission du salari\u00e9, intervenue avant que le juge ne statue, privait d&#8217;objet la demande de r\u00e9siliation judiciaire et, par voie de cons\u00e9quence, les demandes d&#8217;indemnit\u00e9s li\u00e9es \u00e0 la rupture.<\/p>\n<h3 id=\"a-la-demission-du-salarie-cause-de-disparition-de-lobjet-de-la-demande\">A. La d\u00e9mission du salari\u00e9, cause de disparition de l&#8217;objet de la demande<\/h3>\n<p>La motivation de l&#8217;arr\u00eat rappelle que <em>&#8220;lorsque, au moment o\u00f9 le juge statue sur une action du salari\u00e9 tendant \u00e0 la r\u00e9siliation judiciaire de son contrat de travail aux torts de l&#8217;employeur, le contrat de travail a pris fin par la d\u00e9mission du salari\u00e9, sa demande de r\u00e9siliation devient sans objet&#8221;<\/em>. La cour a constat\u00e9 que le salari\u00e9 avait remis \u00e0 l&#8217;employeur un document manuscrit dat\u00e9 du 9 d\u00e9cembre 2024, sign\u00e9, attestant de la fin de son contrat de travail. La signature du salari\u00e9 correspondait \u00e0 celle figurant sur le contrat de travail initial. D\u00e8s lors, la rupture \u00e9tait imputable au seul salari\u00e9, et non \u00e0 un manquement de l&#8217;employeur. La cour a ainsi \u00e9cart\u00e9 la possibilit\u00e9 de requalifier cette d\u00e9mission en prise d&#8217;acte, \u00e0 la diff\u00e9rence de la jurisprudence de la Cour d&#8217;appel de Rennes qui, dans un contexte de pressions, avait jug\u00e9 que <em>&#8220;la d\u00e9mission est \u00e9quivoque et s&#8217;analyse en une prise d&#8217;acte de la rupture du contrat de travail&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/679c6a5e224343169ba1bfde\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Rennes, 30 janvier 2025, n\u00b022\/01770)<\/a><\/strong>. Ici, aucun \u00e9l\u00e9ment ne permettait d&#8217;\u00e9tablir un vice du consentement ou des circonstances \u00e9quivoques. La d\u00e9mission \u00e9tait claire et non contest\u00e9e dans son authenticit\u00e9. La cour en a d\u00e9duit que la demande de r\u00e9siliation judiciaire, introduite post\u00e9rieurement \u00e0 cette d\u00e9mission, \u00e9tait n\u00e9cessairement sans objet. Le jugement de premi\u00e8re instance a donc \u00e9t\u00e9 infirm\u00e9 sur ce point.<\/p>\n<h3 id=\"b-le-rejet-des-demandes-indemnitaires-consecutives-a-la-rupture\">B. Le rejet des demandes indemnitaires cons\u00e9cutives \u00e0 la rupture<\/h3>\n<p>Puisque le contrat de travail avait pris fin par une d\u00e9mission, la cour a logiquement d\u00e9bout\u00e9 le salari\u00e9 de ses demandes d&#8217;indemnit\u00e9 l\u00e9gale de licenciement, d&#8217;indemnit\u00e9 de pr\u00e9avis et de dommages-int\u00e9r\u00eats pour licenciement sans cause r\u00e9elle et s\u00e9rieuse. La d\u00e9mission ne donne droit \u00e0 aucune de ces indemnit\u00e9s, sauf \u00e0 \u00eatre requalifi\u00e9e en prise d&#8217;acte, ce qui n&#8217;a pas \u00e9t\u00e9 retenu. La solution est conforme au droit commun de la rupture du contrat de travail. La cour a \u00e9galement infirm\u00e9 le jugement sur les frais irr\u00e9p\u00e9tibles, condamnant le salari\u00e9, partie succombante, aux d\u00e9pens et \u00e0 payer une somme \u00e0 l&#8217;employeur. Ce faisant, elle a appliqu\u00e9 la r\u00e8gle selon laquelle la partie qui perd supporte les frais. L&#8217;arr\u00eat illustre ainsi la rigueur avec laquelle la cour traite les demandes indemnitaires lorsque la rupture est imputable au salari\u00e9, sans qu&#8217;aucun manquement grave de l&#8217;employeur ne soit \u00e9tabli en lien avec cette rupture.<\/p>\n<h2 id=\"ii-le-rejet-des-demandes-de-dommages-interets-pour-execution-deloyale-du-contrat\">II. Le rejet des demandes de dommages-int\u00e9r\u00eats pour ex\u00e9cution d\u00e9loyale du contrat de travail<\/h2>\n<p>La cour a rejet\u00e9 tant la demande du salari\u00e9 que celle de l&#8217;employeur, faute pour chacun de rapporter la preuve d&#8217;une faute contractuelle ayant caus\u00e9 un pr\u00e9judice.<\/p>\n<h3 id=\"a-labsence-de-preuve-dun-prejudice-distinct-pour-le-salarie\">A. L&#8217;absence de preuve d&#8217;un pr\u00e9judice distinct pour le salari\u00e9<\/h3>\n<p>Le salari\u00e9 soutenait que l&#8217;employeur avait ex\u00e9cut\u00e9 le contrat de mani\u00e8re d\u00e9loyale, en ne lui versant pas les salaires \u00e0 partir de juillet 2024 et en ne lui d\u00e9livrant pas les bulletins de paie. La cour a rappel\u00e9 le principe selon lequel <em>&#8220;c&#8217;est \u00e0 l&#8217;employeur, d\u00e9biteur du paiement du salaire \u00e0 son salari\u00e9, de prouver qu&#8217;il s&#8217;est lib\u00e9r\u00e9 de sa dette ; la d\u00e9livrance d&#8217;un bulletin de salaire ne fait pas pr\u00e9sumer de son paiement&#8221;<\/em> (Soc., 16 juin 2021, n\u00b019-25.344). En l&#8217;esp\u00e8ce, l&#8217;employeur produisait des bulletins de salaire pour la p\u00e9riode d&#8217;ao\u00fbt \u00e0 d\u00e9cembre 2024, mais n&#8217;apportait pas la preuve du paiement en esp\u00e8ces qu&#8217;il invoquait. La cour a donc constat\u00e9 que l&#8217;employeur n&#8217;avait pas d\u00e9montr\u00e9 s&#8217;\u00eatre lib\u00e9r\u00e9 de sa dette salariale. Cependant, pour obtenir des dommages-int\u00e9r\u00eats pour ex\u00e9cution d\u00e9loyale, le salari\u00e9 doit \u00e9tablir l&#8217;existence d&#8217;un pr\u00e9judice distinct du simple retard de paiement, lequel ouvre droit aux int\u00e9r\u00eats moratoires. La cour a relev\u00e9 que <em>&#8220;M. [T] ne fournit aucune indication ni \u00e9l\u00e9ment de preuve sur l&#8217;existence d&#8217;un pr\u00e9judice distinct caus\u00e9 par cette absence de paiement&#8221;<\/em>. En cons\u00e9quence, la demande de dommages-int\u00e9r\u00eats a \u00e9t\u00e9 rejet\u00e9e. La solution est conforme \u00e0 la jurisprudence de la Cour de cassation selon laquelle <em>&#8220;le salari\u00e9, auquel l&#8217;employeur d\u00e9faillant a caus\u00e9, par sa mauvaise foi, un pr\u00e9judice, peut obtenir des dommages-int\u00e9r\u00eats distincts de l&#8217;int\u00e9r\u00eat moratoire&#8221;<\/em> (Soc., 13 d\u00e9cembre 2023, n\u00b022-19.121). \u00c0 d\u00e9faut de preuve d&#8217;une faute ou d&#8217;un pr\u00e9judice distinct, la demande ne peut prosp\u00e9rer.<\/p>\n<h3 id=\"b-labsence-de-preuve-dun-abus-de-confiance-de-la-part-du-salarie\">B. L&#8217;absence de preuve d&#8217;un abus de confiance de la part du salari\u00e9<\/h3>\n<p>La soci\u00e9t\u00e9 employeur r\u00e9clamait des dommages-int\u00e9r\u00eats pour ex\u00e9cution d\u00e9loyale, reprochant au salari\u00e9 d&#8217;avoir utilis\u00e9 la carte bancaire de l&#8217;entreprise pour des achats personnels et de s&#8217;\u00eatre pr\u00e9sent\u00e9 comme le patron. La cour a examin\u00e9 les pi\u00e8ces produites. Elle a constat\u00e9 que selon les propres conclusions du repr\u00e9sentant de la soci\u00e9t\u00e9, le salari\u00e9 <em>&#8220;\u00e9tait destin\u00e9 \u00e0 terme \u00e0 \u00eatre cog\u00e9rant et associ\u00e9&#8221;<\/em>, qu&#8217;il <em>&#8220;assurait la responsabilit\u00e9 de l&#8217;\u00e9tablissement&#8221;<\/em>, et que le g\u00e9rant <em>&#8220;avait laiss\u00e9 carte blanche&#8221;<\/em> au salari\u00e9 en lui confiant la carte bancaire. La place d\u00e9terminante du salari\u00e9 r\u00e9sultait donc de la volont\u00e9 commune des parties. Les attestations de clients mentionnant des paiements en liquide n&#8217;\u00e9tablissaient pas que ces fonds avaient \u00e9t\u00e9 d\u00e9tourn\u00e9s par le salari\u00e9. L&#8217;attestation de la fille du g\u00e9rant, qui \u00e9voquait des anomalies, a \u00e9t\u00e9 jug\u00e9e de faible valeur probante en raison du lien de parent\u00e9, et n&#8217;\u00e9tait corrobor\u00e9e par aucun autre \u00e9l\u00e9ment. Les relev\u00e9s bancaires mentionnant des achats dans divers commerces n&#8217;\u00e9tablissaient pas davantage un abus de confiance. La cour a ainsi rejet\u00e9 la demande de la soci\u00e9t\u00e9, faute de preuve suffisante d&#8217;une faute contractuelle imputable au salari\u00e9.
