La conciliation entre la protection du d\u00e9biteur surendett\u00e9 et les droits du cr\u00e9ancier<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Le jugement rendu le 27 mars 2026 par le p\u00f4le des saisies immobili\u00e8res du tribunal judiciaire de Versailles pr\u00e9sente un int\u00e9r\u00eat certain pour l&#8217;articulation entre les proc\u00e9dures de saisie immobili\u00e8re et de surendettement. Le cr\u00e9ancier poursuivant, une soci\u00e9t\u00e9 de cautionnement, avait obtenu un jugement condamnant la d\u00e9bitrice au paiement d&#8217;une somme de 62 658,91 euros, signifi\u00e9 en novembre 2021 et devenu d\u00e9finitif apr\u00e8s certificat de non-appel. Le 31 ao\u00fbt 2023, la commission de surendettement avait impos\u00e9 une suspension des remboursements pour vingt-quatre mois, d\u00e9lai expir\u00e9 au jour de l&#8217;audience.<\/p>\n<p>La d\u00e9bitrice, r\u00e9guli\u00e8rement cit\u00e9e mais non comparante, avait adress\u00e9 un courrier au greffe post\u00e9rieurement \u00e0 l&#8217;audience, affirmant avoir d\u00e9pos\u00e9 un nouveau dossier de surendettement le 23 f\u00e9vrier 2026, sans en justifier. Le cr\u00e9ancier poursuivant demandait l&#8217;orientation en vente forc\u00e9e. La question de droit \u00e9tait de savoir si l&#8217;all\u00e9gation d&#8217;un d\u00e9p\u00f4t de dossier de surendettement, non justifi\u00e9e et non pr\u00e9sent\u00e9e \u00e0 l&#8217;audience, pouvait faire obstacle \u00e0 la poursuite de la saisie immobili\u00e8re.<\/p>\n<p>Le juge a valid\u00e9 la proc\u00e9dure de saisie, fix\u00e9 la cr\u00e9ance \u00e0 71 561,81 euros et ordonn\u00e9 la vente forc\u00e9e, rappelant la possibilit\u00e9 d&#8217;une vente de gr\u00e9 \u00e0 gr\u00e9 ult\u00e9rieure. La solution consacre la pr\u00e9\u00e9minence de la r\u00e9gularit\u00e9 proc\u00e9durale sur des all\u00e9gations non v\u00e9rifi\u00e9es.<\/p>\n<h2 id=\"i-la-regularite-de-la-procedure-de-saisie-immobiliere-nonobstant-levocation-dune\">I. La r\u00e9gularit\u00e9 de la proc\u00e9dure de saisie immobili\u00e8re nonobstant l&#8217;\u00e9vocation d&#8217;une nouvelle proc\u00e9dure de surendettement<\/h2>\n<p><\/p>\n<h3 id=\"a-lexigence-de-justification-du-depot-dun-dossier-de-surendettement\">A. L&#8217;exigence de justification du d\u00e9p\u00f4t d&#8217;un dossier de surendettement<\/h3>\n<p>Le juge de l&#8217;ex\u00e9cution a constat\u00e9 que la d\u00e9bitrice ne justifiait pas du d\u00e9p\u00f4t de son dossier de surendettement all\u00e9gu\u00e9. Le courrier transmis apr\u00e8s l&#8217;audience ne pouvait suppl\u00e9er l&#8217;absence de pi\u00e8ces justificatives. Cette exigence de preuve s&#8217;inscrit dans une logique de s\u00e9curit\u00e9 juridique. Une simple affirmation ne saurait paralyser une proc\u00e9dure d\u00e9j\u00e0 engag\u00e9e. La jurisprudence confirme cette rigueur : <em>&#8220;Il convient de relever que moins de quatre mois apr\u00e8s la d\u00e9cision du premier juge [&#8230;] celle-ci a d\u00e9pos\u00e9 un nouveau dossier de surendettement [&#8230;] sans informer la commission [&#8230;] et alors qu&#8217;elle ne justifiait aucunement d&#8217;un changement dans sa situation personnelle&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67b819f10f66d9c033b92357\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Paris, 20 f\u00e9vrier 2025, n\u00b023\/00318)<\/a><\/strong>. L&#8217;absence de changement de situation et l&#8217;absence d&#8217;information de la commission sont ici transposables \u00e0 l&#8217;esp\u00e8ce, o\u00f9 la d\u00e9bitrice n&#8217;a fourni aucun \u00e9l\u00e9ment nouveau.<\/p>\n<h3 id=\"b-la-necessaire-comparution-du-debiteur-pour-contredire-la-demande-dorientation\">B. La n\u00e9cessaire comparution du d\u00e9biteur pour contredire la demande d&#8217;orientation<\/h3>\n<p>La d\u00e9bitrice, bien que r\u00e9guli\u00e8rement cit\u00e9e, ne s&#8217;est pas pr\u00e9sent\u00e9e \u00e0 l&#8217;audience. Cette absence a emp\u00each\u00e9 toute contradiction sur sa situation personnelle. Le juge a relev\u00e9 qu&#8217;<em>&#8220;elle ne s&#8217;est pas pr\u00e9sent\u00e9e \u00e0 l&#8217;audience pour expliquer sa situation de sorte qu&#8217;aucun \u00e9l\u00e9ment du dossier ne permet de contredire la demande d&#8217;orientation en vente forc\u00e9e&#8221;<\/em>. La d\u00e9faillance de la partie saisie renforce la force probante des \u00e9l\u00e9ments produits par le cr\u00e9ancier. L&#8217;article R. 322-15 du code des proc\u00e9dures civiles d&#8217;ex\u00e9cution impose au juge de statuer au vu des pi\u00e8ces et des observations des parties. En l&#8217;esp\u00e8ce, faute d&#8217;observations orales ou \u00e9crites suffisantes, la demande du cr\u00e9ancier \u00e9tait bien fond\u00e9e. Cette solution rappelle que le contradictoire est une garantie pour le d\u00e9biteur, mais qu&#8217;il doit en user \u00e0 peine de perdre le b\u00e9n\u00e9fice de ses moyens.<\/p>\n<h2 id=\"ii-la-portee-de-la-decision-au-regard-du-principe-de-bonne-foi-et-de-larticulati\">II. La port\u00e9e de la d\u00e9cision au regard du principe de bonne foi et de l&#8217;articulation des proc\u00e9dures<\/h2>\n<p><\/p>\n<h3 id=\"a-lexigence-delements-nouveaux-pour-rouvrir-une-procedure-de-surendettement\">A. L&#8217;exigence d&#8217;\u00e9l\u00e9ments nouveaux pour rouvrir une proc\u00e9dure de surendettement<\/h3>\n<p>La d\u00e9cision comment\u00e9e s&#8217;inscrit dans le prolongement d&#8217;une jurisprudence constante exigeant de v\u00e9ritables changements dans la situation du d\u00e9biteur pour que le d\u00e9p\u00f4t d&#8217;un nouveau dossier fasse \u00e9chec \u00e0 une proc\u00e9dure en cours. La d\u00e9bitrice ne d\u00e9montrait aucune modification de ses ressources ou de ses charges depuis la suspension de vingt-quatre mois. La cour d&#8217;appel de Douai rappelle que <em>&#8220;la d\u00e9ch\u00e9ance du d\u00e9biteur du b\u00e9n\u00e9fice des dispositions l\u00e9gales sur le surendettement ne fait pas obstacle \u00e0 une nouvelle demande de traitement de sa situation de surendettement si, outre la bonne foi du requ\u00e9rant, il existe des \u00e9l\u00e9ments nouveaux de nature \u00e0 conduire \u00e0 une analyse diff\u00e9rente de sa situation&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/680b1a6c2364a383b77475f8\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Douai, 24 avril 2025, n\u00b024\/03705)<\/a><\/strong>. En l&#8217;absence de tels \u00e9l\u00e9ments, la poursuite de la saisie immobili\u00e8re est l\u00e9gitime.<\/p>\n<h3 id=\"b-la-conciliation-entre-la-protection-du-debiteur-surendette-et-les-droits-du-cr\">B. La conciliation entre la protection du d\u00e9biteur surendett\u00e9 et les droits du cr\u00e9ancier<\/h3>\n<p>Le juge a rappel\u00e9 la possibilit\u00e9 d&#8217;une vente de gr\u00e9 \u00e0 gr\u00e9 apr\u00e8s l&#8217;orientation en vente forc\u00e9e, conform\u00e9ment \u00e0 l&#8217;article L. 322-1 alin\u00e9a 2 du code des proc\u00e9dures civiles d&#8217;ex\u00e9cution. Cette facult\u00e9 permet d&#8217;\u00e9viter la vente aux ench\u00e8res si un accord intervient. La d\u00e9cision ne ferme donc pas toute perspective amiable. Elle concilie la protection du d\u00e9biteur, qui peut encore n\u00e9gocier, avec le droit du cr\u00e9ancier de recouvrer sa cr\u00e9ance. La solution est \u00e9quilibr\u00e9e : l&#8217;absence de bonne foi active de la d\u00e9bitrice (non comparution, absence de preuve) justifie la rigueur, mais l&#8217;audience d&#8217;adjudication n&#8217;est pas encore fix\u00e9e d\u00e9finitivement, laissant place \u00e0 une \u00e9ventuelle ex\u00e9cution n\u00e9goci\u00e9e.
