Mais cela ne signifie pas que France Travail paie l&#8217;allocation d\u00e8s le lendemain de la fin du contrat.<\/p>\n<p>Depuis la r\u00e9forme de l&#8217;assurance ch\u00f4mage de 2026, beaucoup de salari\u00e9s regardent surtout la dur\u00e9e future d&#8217;indemnisation et la date du 1er septembre 2026. C&#8217;est utile, mais insuffisant. Le premier risque pratique se situe souvent avant : plusieurs diff\u00e9r\u00e9s peuvent repousser le premier paiement. Une rupture conventionnelle bien n\u00e9goci\u00e9e sur le papier peut donc cr\u00e9er un trou de tr\u00e9sorerie si le d\u00e9lai de carence n&#8217;a pas \u00e9t\u00e9 calcul\u00e9.<\/p>\n<p>Le bon r\u00e9flexe consiste \u00e0 distinguer trois questions. Avez-vous droit \u00e0 l&#8217;ARE apr\u00e8s la rupture conventionnelle ? \u00c0 partir de quelle date France Travail peut-il commencer \u00e0 vous indemniser ? Combien de semaines devez-vous financer sans allocation \u00e0 cause des cong\u00e9s pay\u00e9s, de l&#8217;indemnit\u00e9 supra-l\u00e9gale et du d\u00e9lai d&#8217;attente ?<\/p>\n<p>Cet article r\u00e9pond \u00e0 la deuxi\u00e8me et \u00e0 la troisi\u00e8me question.<\/p>\n<h2>Rupture conventionnelle et ch\u00f4mage : le droit existe, mais le paiement peut attendre<\/h2>\n<p>Service-Public rappelle que la rupture conventionnelle permet \u00e0 l&#8217;employeur et au salari\u00e9 de convenir d&#8217;un commun accord de la rupture du CDI. La convention fixe notamment la date de rupture et l&#8217;indemnit\u00e9 sp\u00e9cifique.<\/p>\n<p>Apr\u00e8s homologation, le salari\u00e9 peut percevoir l&#8217;allocation d&#8217;aide au retour \u00e0 l&#8217;emploi si les conditions d&#8217;assurance ch\u00f4mage sont r\u00e9unies. Il faut notamment s&#8217;inscrire aupr\u00e8s de France Travail, avoir assez travaill\u00e9, \u00eatre apte au travail et rechercher effectivement un emploi.<\/p>\n<p>Le point souvent mal compris est le suivant : l&#8217;ouverture du droit et le versement effectif ne commencent pas toujours au m\u00eame moment.<\/p>\n<p>France Travail applique d&#8217;abord les diff\u00e9r\u00e9s d&#8217;indemnisation. Ces diff\u00e9r\u00e9s ne suppriment pas le droit au ch\u00f4mage. Ils d\u00e9calent le d\u00e9but du paiement.<\/p>\n<p>En pratique, le salari\u00e9 doit donc raisonner en calendrier de tr\u00e9sorerie. La vraie question n&#8217;est pas seulement : &#8220;ai-je droit au ch\u00f4mage ?&#8221; La vraie question est : &#8220;\u00e0 quelle date l&#8217;argent arrivera-t-il sur mon compte ?&#8221;<\/p>\n<h2>Les trois d\u00e9lais \u00e0 additionner<\/h2>\n<p>Apr\u00e8s une rupture conventionnelle, trois m\u00e9canismes peuvent repousser le premier paiement.<\/p>\n<p>Le premier est le diff\u00e9r\u00e9 li\u00e9 aux cong\u00e9s pay\u00e9s. Si le solde de tout compte comprend une indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s, France Travail divise cette indemnit\u00e9 par le salaire journalier de r\u00e9f\u00e9rence. Le r\u00e9sultat donne un nombre de jours de diff\u00e9r\u00e9, arrondi au jour sup\u00e9rieur.<\/p>\n<p>Le deuxi\u00e8me est le diff\u00e9r\u00e9 sp\u00e9cifique d&#8217;indemnisation. Il concerne les indemnit\u00e9s de rupture vers\u00e9es au-del\u00e0 du minimum l\u00e9gal ou conventionnel. C&#8217;est ici que l&#8217;indemnit\u00e9 supra-l\u00e9gale peut avoir un effet important. Le montant pris en compte est divis\u00e9 par 107,9. Le r\u00e9sultat est arrondi au jour sup\u00e9rieur. Ce diff\u00e9r\u00e9 sp\u00e9cifique est plafonn\u00e9 \u00e0 150 jours calendaires, hors licenciement \u00e9conomique.<\/p>\n<p>Le troisi\u00e8me est le d\u00e9lai d&#8217;attente de 7 jours. Il s&#8217;ajoute apr\u00e8s les diff\u00e9r\u00e9s, sauf s&#8217;il a d\u00e9j\u00e0 \u00e9t\u00e9 appliqu\u00e9 au cours des 12 mois pr\u00e9c\u00e9dents.<\/p>\n<p>La formule pratique est donc simple :<\/p>\n<p>diff\u00e9r\u00e9 cong\u00e9s pay\u00e9s + diff\u00e9r\u00e9 sp\u00e9cifique + d\u00e9lai d&#8217;attente de 7 jours = d\u00e9lai avant le premier paiement possible.<\/p>\n<p>Cette formule ne remplace pas le calcul officiel de France Travail, mais elle permet d&#8217;\u00e9viter les erreurs les plus co\u00fbteuses avant signature.<\/p>\n<h2>Exemple de calcul simple<\/h2>\n<p>Prenons un salari\u00e9 qui signe une rupture conventionnelle avec une date de fin de contrat au 31 ao\u00fbt 2026.<\/p>\n<p>Son solde de tout compte comprend 1 200 euros d&#8217;indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s. Son salaire journalier de r\u00e9f\u00e9rence est de 100 euros. Le diff\u00e9r\u00e9 cong\u00e9s pay\u00e9s est donc de 12 jours.<\/p>\n<p>Il re\u00e7oit aussi 8 000 euros au-del\u00e0 de son indemnit\u00e9 minimale obligatoire. Cette somme constitue une indemnit\u00e9 supra-l\u00e9gale. Le diff\u00e9r\u00e9 sp\u00e9cifique est calcul\u00e9 ainsi : 8 000 \/ 107,9 = 74,14. Le r\u00e9sultat est arrondi \u00e0 75 jours.<\/p>\n<p>Il faut ensuite ajouter le d\u00e9lai d&#8217;attente de 7 jours.<\/p>\n<p>Le d\u00e9lai total pr\u00e9visible est donc de 12 + 75 + 7, soit 94 jours.<\/p>\n<p>Dans cet exemple, la rupture intervient le 31 ao\u00fbt, mais le premier paiement France Travail peut n&#8217;arriver qu&#8217;environ trois mois plus tard, sous r\u00e9serve de l&#8217;inscription, de l&#8217;actualisation mensuelle et du traitement du dossier.<\/p>\n<p>Ce r\u00e9sultat ne signifie pas que l&#8217;indemnit\u00e9 supra-l\u00e9gale est mauvaise. Elle peut \u00eatre indispensable. Il signifie seulement qu&#8217;elle doit \u00eatre n\u00e9goci\u00e9e en tenant compte de son effet sur la tr\u00e9sorerie.<\/p>\n<h2>L&#8217;indemnit\u00e9 supra-l\u00e9gale peut \u00eatre utile malgr\u00e9 la carence<\/h2>\n<p>Beaucoup de salari\u00e9s pensent qu&#8217;il faut \u00e9viter toute indemnit\u00e9 supra-l\u00e9gale pour toucher le ch\u00f4mage plus vite. C&#8217;est une erreur.<\/p>\n<p>Une indemnit\u00e9 supra-l\u00e9gale peut compenser un d\u00e9part impos\u00e9, une perte de r\u00e9mun\u00e9ration variable, un risque de p\u00e9riode sans emploi, une pression de l&#8217;employeur, un conflit d\u00e9j\u00e0 ouvert ou la perte de chance li\u00e9e \u00e0 la r\u00e9forme ch\u00f4mage. Elle peut aussi financer pr\u00e9cis\u00e9ment le d\u00e9lai sans allocation.<\/p>\n<p>Le mauvais calcul consiste \u00e0 regarder seulement la date du premier paiement. Le bon calcul consiste \u00e0 comparer deux sc\u00e9narios.<\/p>\n<p>Premier sc\u00e9nario : vous acceptez le minimum l\u00e9gal, France Travail paie plus t\u00f4t, mais vous partez avec peu de tr\u00e9sorerie.<\/p>\n<p>Deuxi\u00e8me sc\u00e9nario : vous n\u00e9gociez une indemnit\u00e9 plus \u00e9lev\u00e9e, France Travail paie plus tard, mais vous disposez d&#8217;une somme permettant de financer plusieurs mois sans allocation.<\/p>\n<p>Le meilleur sc\u00e9nario d\u00e9pend du montant, de votre \u00e2ge, de votre secteur, de votre capacit\u00e9 \u00e0 retrouver un poste, de vos charges fixes, de vos cong\u00e9s pay\u00e9s et de la solidit\u00e9 de vos arguments contre l&#8217;employeur.<\/p>\n<p>Une n\u00e9gociation s\u00e9rieuse doit donc raisonner en &#8220;net utile&#8221;. Ce n&#8217;est pas le montant brut de l&#8217;indemnit\u00e9 qui compte. C&#8217;est ce qu&#8217;il reste, quand, et pendant combien de temps.<\/p>\n<h2>Ce qu&#8217;il faut demander avant de signer<\/h2>\n<p>Avant de signer une rupture conventionnelle, demandez un calendrier \u00e9crit.<\/p>\n<p>Ce calendrier doit mentionner la date de signature envisag\u00e9e, la fin du d\u00e9lai de r\u00e9tractation, la date d&#8217;envoi \u00e0 l&#8217;administration, la date probable d&#8217;homologation et la date de rupture du contrat.<\/p>\n<p>Demandez aussi un projet chiffr\u00e9 de solde de tout compte. Il doit distinguer l&#8217;indemnit\u00e9 sp\u00e9cifique de rupture conventionnelle, les cong\u00e9s pay\u00e9s, les primes, le variable, les remboursements de frais, les \u00e9ventuelles heures suppl\u00e9mentaires et la part supra-l\u00e9gale.<\/p>\n<p>Sans cette ventilation, il est impossible de calculer correctement le diff\u00e9r\u00e9.<\/p>\n<p>Il faut \u00e9galement v\u00e9rifier le minimum applicable. L&#8217;indemnit\u00e9 sp\u00e9cifique de rupture conventionnelle ne peut pas \u00eatre inf\u00e9rieure \u00e0 l&#8217;indemnit\u00e9 l\u00e9gale de licenciement, ou \u00e0 l&#8217;indemnit\u00e9 conventionnelle si elle est plus favorable selon les r\u00e8gles applicables. Un salari\u00e9 peut donc signer trop bas s&#8217;il ne v\u00e9rifie que le formulaire pr\u00e9par\u00e9 par l&#8217;employeur.<\/p>\n<p>Enfin, gardez les \u00e9changes \u00e9crits. Si l&#8217;employeur a propos\u00e9 la rupture pour \u00e9viter un licenciement, si le salari\u00e9 est en arr\u00eat maladie, si un harc\u00e8lement a \u00e9t\u00e9 signal\u00e9 ou si le d\u00e9part est pr\u00e9sent\u00e9 comme obligatoire, le contexte doit \u00eatre conserv\u00e9. Il peut changer toute l&#8217;analyse.<\/p>\n<h2>Les erreurs fr\u00e9quentes<\/h2>\n<p>La premi\u00e8re erreur est de croire que la rupture conventionnelle garantit un paiement imm\u00e9diat de l&#8217;ARE. Elle ouvre une possibilit\u00e9 d&#8217;indemnisation, mais le paiement d\u00e9pend des diff\u00e9r\u00e9s.<\/p>\n<p>La deuxi\u00e8me erreur est de confondre indemnit\u00e9 l\u00e9gale et indemnit\u00e9 supra-l\u00e9gale. Seule la part au-del\u00e0 du minimum l\u00e9gal ou conventionnel est prise en compte dans le diff\u00e9r\u00e9 sp\u00e9cifique.<\/p>\n<p>La troisi\u00e8me erreur est d&#8217;oublier les cong\u00e9s pay\u00e9s. Un salari\u00e9 qui part avec beaucoup de cong\u00e9s non pris peut d\u00e9j\u00e0 subir un diff\u00e9r\u00e9 important, m\u00eame sans indemnit\u00e9 supra-l\u00e9gale \u00e9lev\u00e9e.<\/p>\n<p>La quatri\u00e8me erreur est de signer sans calendrier. En 2026, la date de rupture r\u00e9elle compte, surtout si l&#8217;on cherche \u00e0 s\u00e9curiser une situation avant l&#8217;entr\u00e9e en vigueur de nouvelles r\u00e8gles d&#8217;indemnisation.<\/p>\n<p>La cinqui\u00e8me erreur est de n\u00e9gocier uniquement en brut. Une somme peut sembler \u00e9lev\u00e9e et pourtant \u00eatre insuffisante si elle d\u00e9cale l&#8217;ARE sans couvrir la p\u00e9riode sans paiement.<\/p>\n<h2>Que faire si la proposition est d\u00e9j\u00e0 sur la table ?<\/h2>\n<p>Si l&#8217;employeur a d\u00e9j\u00e0 propos\u00e9 une rupture conventionnelle, ne r\u00e9pondez pas seulement par oui ou non.<\/p>\n<p>Demandez d&#8217;abord le d\u00e9tail du calcul. Puis reconstituez le d\u00e9lai probable avant le premier paiement France Travail.<\/p>\n<p>Si le montant propos\u00e9 ne couvre pas la p\u00e9riode sans allocation, vous pouvez demander une hausse de l&#8217;indemnit\u00e9 supra-l\u00e9gale ou un d\u00e9calage de la date de rupture. Vous pouvez aussi demander le paiement s\u00e9par\u00e9 de sommes d\u00e9j\u00e0 dues : salaire, prime, variable, frais, heures suppl\u00e9mentaires. Ces sommes ne doivent pas \u00eatre masqu\u00e9es dans une enveloppe globale qui rendrait le calcul opaque.<\/p>\n<p>Si la rupture intervient dans un contexte conflictuel, la question n&#8217;est pas seulement financi\u00e8re. Il faut v\u00e9rifier si une autre voie est plus protectrice : licenciement contestable, prise d&#8217;acte, r\u00e9siliation judiciaire, inaptitude, transaction apr\u00e8s rupture ou simple refus de signer.<\/p>\n<p>Une rupture conventionnelle reste un accord. Le salari\u00e9 n&#8217;est pas oblig\u00e9 de l&#8217;accepter.<\/p>\n<h2>Paris et \u00cele-de-France : calculer avant de n\u00e9gocier<\/h2>\n<p>\u00c0 Paris et en \u00cele-de-France, le d\u00e9lai de retour \u00e0 l&#8217;emploi varie fortement selon le secteur.
