Un salari\u00e9 Syntec, m\u00e9tallurgie, HCR, commerce, propret\u00e9 ou transport ne doit pas seulement v\u00e9rifier le Code du travail. Il doit aussi lire les r\u00e8gles conventionnelles sur le maintien de salaire, les absences, la p\u00e9riode de r\u00e9f\u00e9rence, les cong\u00e9s suppl\u00e9mentaires, les primes et parfois la reprise apr\u00e8s maladie.<\/p>\n<p>La question pratique est simple : si vous avez \u00e9t\u00e9 en arr\u00eat maladie, votre convention collective peut-elle vous donner plus de droits que le Code du travail sur les cong\u00e9s pay\u00e9s, le report ou l&#8217;indemnisation ?<\/p>\n<p>La r\u00e9ponse est oui, mais pas toujours l\u00e0 o\u00f9 le salari\u00e9 l&#8217;attend.<\/p>\n<h2>Le Code du travail fixe le socle minimal<\/h2>\n<p>Depuis le 24 avril 2024, l&#8217;arr\u00eat maladie non professionnelle permet d&#8217;acqu\u00e9rir des cong\u00e9s pay\u00e9s. Le salari\u00e9 acquiert deux jours ouvrables par mois d&#8217;absence, dans la limite de vingt-quatre jours ouvrables par p\u00e9riode de r\u00e9f\u00e9rence.<\/p>\n<p>En accident du travail ou maladie professionnelle, les r\u00e8gles sont plus favorables : l&#8217;absence est assimil\u00e9e \u00e0 du temps de travail effectif pour l&#8217;acquisition des cong\u00e9s pay\u00e9s.<\/p>\n<p>Ces r\u00e8gles sont pr\u00e9vues par le Code du travail, notamment aux articles L. 3141-5, L. 3141-5-1, L. 3141-19-1 et L. 3141-19-3. Elles fixent le minimum que l&#8217;employeur doit respecter.<\/p>\n<p>Le point le plus souvent oubli\u00e9 concerne l&#8217;information apr\u00e8s la reprise. L&#8217;employeur doit indiquer au salari\u00e9 le nombre de jours disponibles et la date jusqu&#8217;\u00e0 laquelle ces cong\u00e9s peuvent \u00eatre pris. Cette information doit intervenir dans le mois qui suit la reprise du travail, par un moyen permettant d&#8217;en conserver la trace.<\/p>\n<p>Sans cette information, la perte des cong\u00e9s devient contestable.<\/p>\n<p>Le salari\u00e9 ne doit donc pas se contenter d&#8217;une ligne sur le bulletin de paie. Il doit comprendre quels jours ont \u00e9t\u00e9 acquis avant l&#8217;arr\u00eat, quels jours ont \u00e9t\u00e9 acquis pendant l&#8217;arr\u00eat, quels jours ont d\u00e9j\u00e0 \u00e9t\u00e9 pris, et quels jours sont soumis \u00e0 un d\u00e9lai de report.<\/p>\n<h2>La convention collective peut am\u00e9liorer le r\u00e9sultat<\/h2>\n<p>La convention collective ne peut pas retirer le socle l\u00e9gal. Elle peut en revanche pr\u00e9voir des garanties plus favorables.<\/p>\n<p>Dans certaines branches, la convention organise un maintien de salaire plus favorable pendant l&#8217;arr\u00eat maladie. Cela ne cr\u00e9e pas automatiquement plus de cong\u00e9s pay\u00e9s, mais cela peut changer le calcul de l&#8217;indemnit\u00e9 de cong\u00e9s, du salaire de r\u00e9f\u00e9rence ou du solde de tout compte.<\/p>\n<p>Dans d&#8217;autres branches, la convention pr\u00e9voit des cong\u00e9s suppl\u00e9mentaires li\u00e9s \u00e0 l&#8217;anciennet\u00e9, \u00e0 l&#8217;\u00e2ge, au handicap, aux enfants \u00e0 charge ou \u00e0 certaines situations familiales. Ces jours ne se confondent pas toujours avec les cong\u00e9s acquis pendant la maladie. Ils doivent \u00eatre v\u00e9rifi\u00e9s s\u00e9par\u00e9ment.<\/p>\n<p>La convention peut aussi pr\u00e9voir des r\u00e8gles de pr\u00e9venance, des p\u00e9riodes de prise des cong\u00e9s, des priorit\u00e9s familiales ou des r\u00e8gles internes de fixation des dates. Ces r\u00e8gles comptent si l&#8217;employeur impose brutalement des jours au retour d&#8217;un arr\u00eat long.<\/p>\n<p>Le bon r\u00e9flexe consiste donc \u00e0 poser trois questions.<\/p>\n<p>La convention pr\u00e9voit-elle une garantie de maintien de salaire pendant l&#8217;arr\u00eat ?<\/p>\n<p>Pr\u00e9voit-elle des cong\u00e9s suppl\u00e9mentaires ou des jours conventionnels ?<\/p>\n<p>Pr\u00e9voit-elle des r\u00e8gles particuli\u00e8res sur la prise, le report ou l&#8217;ordre des d\u00e9parts ?<\/p>\n<p>Si la r\u00e9ponse est oui, le dossier ne se r\u00e8gle pas seulement avec le compteur affich\u00e9 par le logiciel RH.<\/p>\n<h2>Exemple fr\u00e9quent : salari\u00e9 Syntec apr\u00e8s un arr\u00eat long<\/h2>\n<p>Un salari\u00e9 relevant de la convention Syntec revient apr\u00e8s plusieurs mois d&#8217;arr\u00eat maladie. Son bulletin mentionne des cong\u00e9s acquis pendant l&#8217;absence. L&#8217;employeur lui indique qu&#8217;une partie du compteur est plafonn\u00e9e et qu&#8217;il doit poser rapidement les jours report\u00e9s.<\/p>\n<p>Le salari\u00e9 doit d&#8217;abord v\u00e9rifier le fondement du plafonnement. Pour une maladie non professionnelle, le Code du travail limite l&#8217;acquisition \u00e0 vingt-quatre jours ouvrables par p\u00e9riode de r\u00e9f\u00e9rence. Ce plafond ne signifie pas que tous les jours au-del\u00e0 disparaissent automatiquement. Il faut regarder la p\u00e9riode concern\u00e9e, les jours acquis avant l&#8217;arr\u00eat, les jours acquis pendant l&#8217;arr\u00eat et les jours d\u00e9j\u00e0 report\u00e9s.<\/p>\n<p>Il faut ensuite v\u00e9rifier l&#8217;information donn\u00e9e apr\u00e8s la reprise. Si l&#8217;employeur n&#8217;a jamais inform\u00e9 le salari\u00e9 de la date limite de prise des cong\u00e9s, la perte des jours sera plus difficile \u00e0 d\u00e9fendre.<\/p>\n<p>Enfin, il faut relire la convention collective applicable. Elle peut contenir des garanties sur l&#8217;indemnisation de l&#8217;arr\u00eat, l&#8217;anciennet\u00e9, les absences assimil\u00e9es ou les jours suppl\u00e9mentaires. Ces garanties peuvent modifier le chiffrage du solde de tout compte ou la strat\u00e9gie prud&#8217;homale.<\/p>\n<p>Le salari\u00e9 doit \u00e9viter une erreur : r\u00e9clamer globalement tous les jours affich\u00e9s sans distinguer leur origine. La demande doit \u00eatre ventil\u00e9e. Un juge prud&#8217;homal raisonne rarement sur un compteur global. Il v\u00e9rifie les p\u00e9riodes, les textes, les bulletins et la preuve de l&#8217;information.<\/p>\n<h2>Exemple fr\u00e9quent : m\u00e9tallurgie, arr\u00eat maladie et solde de tout compte<\/h2>\n<p>Dans la m\u00e9tallurgie, un salari\u00e9 peut avoir un r\u00e9gime conventionnel pr\u00e9cis sur la maladie, l&#8217;anciennet\u00e9, la r\u00e9mun\u00e9ration et certains compl\u00e9ments.<\/p>\n<p>Apr\u00e8s un arr\u00eat long, le solde de tout compte peut m\u00e9langer plusieurs lignes : indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s, maintien de salaire, compl\u00e9ment employeur, prime, anciennet\u00e9, absences, IJSS subrog\u00e9es ou non subrog\u00e9es.<\/p>\n<p>Ce m\u00e9lange cr\u00e9e des erreurs.<\/p>\n<p>Un salari\u00e9 peut croire qu&#8217;il lui manque des cong\u00e9s alors que le litige porte plut\u00f4t sur la base de calcul de l&#8217;indemnit\u00e9. \u00c0 l&#8217;inverse, l&#8217;employeur peut solder des jours ordinaires tout en oubliant des droits conventionnels ou des cong\u00e9s report\u00e9s.<\/p>\n<p>Il faut donc reconstituer le calcul ligne par ligne.<\/p>\n<p>La premi\u00e8re \u00e9tape consiste \u00e0 obtenir tous les bulletins de paie de la p\u00e9riode d&#8217;arr\u00eat et de reprise.<\/p>\n<p>La deuxi\u00e8me consiste \u00e0 comparer les compteurs de cong\u00e9s avant l&#8217;arr\u00eat, pendant l&#8217;arr\u00eat et apr\u00e8s la reprise.<\/p>\n<p>La troisi\u00e8me consiste \u00e0 relire la convention collective applicable \u00e0 la date de l&#8217;arr\u00eat, puis \u00e0 la date de rupture si le contrat a pris fin.<\/p>\n<p>La quatri\u00e8me consiste \u00e0 v\u00e9rifier si l&#8217;employeur a bien inform\u00e9 le salari\u00e9 du nombre de jours disponibles et de la date limite de prise.<\/p>\n<p>Sans cette m\u00e9thode, le salari\u00e9 risque de r\u00e9clamer la mauvaise somme. L&#8217;employeur, lui, risque de croire que le paiement du solde de tout compte suffit \u00e0 \u00e9teindre un droit mal calcul\u00e9.<\/p>\n<h2>L&#8217;employeur peut-il imposer les cong\u00e9s report\u00e9s ?<\/h2>\n<p>L&#8217;employeur conserve en principe le pouvoir d&#8217;organiser les d\u00e9parts en cong\u00e9s. Les cong\u00e9s acquis ou report\u00e9s apr\u00e8s un arr\u00eat maladie ne deviennent pas des jours que le salari\u00e9 poserait seul, \u00e0 la carte.<\/p>\n<p>Mais l&#8217;employeur doit respecter les r\u00e8gles de fixation des cong\u00e9s, les d\u00e9lais de pr\u00e9venance, les r\u00e8gles conventionnelles et la situation concr\u00e8te du salari\u00e9.<\/p>\n<p>Une reprise apr\u00e8s arr\u00eat long n&#8217;est pas une p\u00e9riode neutre. Il peut y avoir une visite de reprise, un temps partiel th\u00e9rapeutique, une restriction m\u00e9dicale, un am\u00e9nagement de poste ou une discussion sur l&#8217;inaptitude. Imposer imm\u00e9diatement plusieurs semaines de cong\u00e9s sans explication peut devenir contestable.<\/p>\n<p>Le salari\u00e9 doit r\u00e9pondre par \u00e9crit. Il peut indiquer qu&#8217;il ne refuse pas le principe des cong\u00e9s, mais qu&#8217;il demande le d\u00e9tail du compteur, la date de d\u00e9but du d\u00e9lai de report, les r\u00e8gles conventionnelles appliqu\u00e9es et la justification des dates impos\u00e9es.<\/p>\n<p>Cette nuance est importante.<\/p>\n<p>Un refus sec expose le salari\u00e9 \u00e0 un reproche disciplinaire. Une demande pr\u00e9cise oblige l&#8217;employeur \u00e0 documenter sa d\u00e9cision.<\/p>\n<h2>Quels documents demander ?<\/h2>\n<p>Le salari\u00e9 doit r\u00e9unir les bulletins de paie des douze derniers mois, voire davantage si l&#8217;arr\u00eat a \u00e9t\u00e9 long.<\/p>\n<p>Il doit conserver les arr\u00eats de travail, les prolongations, les avis du m\u00e9decin du travail, les courriels RH, le r\u00e8glement int\u00e9rieur, les notes de service sur les cong\u00e9s et les relev\u00e9s de compteur.<\/p>\n<p>Il doit demander la convention collective exacte appliqu\u00e9e par l&#8217;entreprise. Le code IDCC figure souvent sur le bulletin de paie. Cette mention est utile, mais elle ne suffit pas toujours. Il faut v\u00e9rifier l&#8217;intitul\u00e9, les avenants applicables et la version en vigueur au moment des faits.<\/p>\n<p>Il doit enfin demander un d\u00e9compte \u00e9crit.<\/p>\n<p>Ce d\u00e9compte doit distinguer les cong\u00e9s acquis avant l&#8217;arr\u00eat, les cong\u00e9s acquis pendant l&#8217;arr\u00eat, les cong\u00e9s pris, les cong\u00e9s perdus selon l&#8217;employeur, les cong\u00e9s report\u00e9s et les cong\u00e9s pay\u00e9s au solde de tout compte.<\/p>\n<p>Une r\u00e9ponse floue est d\u00e9j\u00e0 une information utile. Elle montre que l&#8217;employeur n&#8217;a pas forc\u00e9ment ma\u00eetris\u00e9 son propre calcul.<\/p>\n<h2>Que r\u00e9clamer aux prud&#8217;hommes ?<\/h2>\n<p>La demande d\u00e9pend de l&#8217;erreur.<\/p>\n<p>Si des jours de cong\u00e9s n&#8217;ont pas \u00e9t\u00e9 pay\u00e9s \u00e0 la rupture, le salari\u00e9 peut r\u00e9clamer une indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s.<\/p>\n<p>Si les cong\u00e9s ont \u00e9t\u00e9 impos\u00e9s dans des conditions abusives, mais ont \u00e9t\u00e9 effectivement pris et pay\u00e9s, il faut \u00e9viter de demander deux fois les m\u00eames jours. La demande peut alors viser un pr\u00e9judice distinct : d\u00e9sorganisation de la reprise, non-respect des r\u00e8gles conventionnelles, absence d&#8217;information, manquement \u00e0 l&#8217;ex\u00e9cution loyale du contrat ou atteinte au droit au repos.<\/p>\n<p>Si l&#8217;erreur vient de la convention collective, la demande peut porter sur un rappel de salaire, une r\u00e9gularisation du solde de tout compte, une indemnit\u00e9 de cong\u00e9s pay\u00e9s recalcul\u00e9e ou des dommages-int\u00e9r\u00eats.<\/p>\n<p>Le plus important est de ne pas m\u00e9langer les fondements.<\/p>\n<p>Un dossier bien pr\u00e9sent\u00e9 distingue le droit l\u00e9gal, le droit conventionnel, le compteur RH et la somme r\u00e9clam\u00e9e.<\/p>\n<h2>Paris et \u00cele-de-France : pourquoi le calcul doit \u00eatre pr\u00e9par\u00e9 avant l&#8217;audience<\/h2>\n<p>Devant les conseils de prud&#8217;hommes de Paris, Nanterre, Bobigny, Cr\u00e9teil, Versailles ou Boulogne-Billancourt, les litiges de cong\u00e9s pay\u00e9s se gagnent rarement par une affirmation g\u00e9n\u00e9rale.<\/p>\n<p>Il faut produire un tableau clair.<\/p>\n<p>Ce tableau doit reprendre chaque p\u00e9riode de r\u00e9f\u00e9rence, les jours acquis, les jours pris, les jours report\u00e9s, les jours perdus selon l&#8217;employeur, les textes applicables et le montant r\u00e9clam\u00e9.<\/p>\n<p>Il faut aussi produire la convention collective ou les extraits utiles. Un salari\u00e9 qui invoque Syntec, m\u00e9tallurgie, HCR ou toute autre convention doit montrer pr\u00e9cis\u00e9ment la clause invoqu\u00e9e. Il ne suffit pas de dire que la convention serait plus favorable.<\/p>\n<p>Lorsque le contrat est rompu, il faut agir vite. Les acc\u00e8s au logiciel RH peuvent \u00eatre coup\u00e9s. Les plannings peuvent dispara\u00eetre.
