L&#8217;impossibilit\u00e9 d&#8217;ordonner une d\u00e9molition en l&#8217;absence de trouble d\u00e9montr\u00e9<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Par un arr\u00eat rendu le 27 avril 2026, la premi\u00e8re chambre civile de la Cour d&#8217;appel de Basse-Terre a eu \u00e0 se prononcer sur les conditions de mise en \u0153uvre de la th\u00e9orie des troubles anormaux de voisinage, et plus pr\u00e9cis\u00e9ment sur le point de savoir si la seule violation des r\u00e8gles d&#8217;urbanisme suffit \u00e0 caract\u00e9riser un tel trouble justifiant une mesure de d\u00e9molition.<\/p>\n<p>Des \u00e9poux, propri\u00e9taires d&#8217;une parcelle situ\u00e9e \u00e0 Baie-Mahault, ont assign\u00e9 la propri\u00e9taire d&#8217;une parcelle voisine et l&#8217;occupant de celle-ci devant le tribunal judiciaire de Pointe-\u00e0-Pitre. Ils sollicitaient la d\u00e9molition d&#8217;un cabanon \u00e9rig\u00e9 en limite de propri\u00e9t\u00e9, se pr\u00e9valant d&#8217;un rapport d&#8217;expertise judiciaire d\u00e9pos\u00e9 le 5 ao\u00fbt 2023. Ils invoquaient des nuisances sonores, des \u00e9manations de poussi\u00e8res, la pr\u00e9sence de rongeurs, une obstruction de la vue et le non-respect des prescriptions du plan local d&#8217;urbanisme.<\/p>\n<p>Par jugement du 27 f\u00e9vrier 2025, le tribunal judiciaire de Pointe-\u00e0-Pitre a rejet\u00e9 l&#8217;ensemble de leurs demandes et les a condamn\u00e9s aux d\u00e9pens. Les \u00e9poux ont interjet\u00e9 appel de cette d\u00e9cision.<\/p>\n<p>La question de droit soumise \u00e0 la cour d&#8217;appel \u00e9tait la suivante : le non-respect des r\u00e8gles d&#8217;urbanisme constitue-t-il, \u00e0 lui seul, un trouble anormal de voisinage de nature \u00e0 fonder une action en d\u00e9molition de la construction illicite ?<\/p>\n<p>Par l&#8217;arr\u00eat comment\u00e9, la Cour d&#8217;appel de Basse-Terre a confirm\u00e9 le jugement de premi\u00e8re instance en toutes ses dispositions, d\u00e9butant les appelants de leurs demandes de d\u00e9molition et de condamnation sous astreinte.<\/p>\n<h2 id=\"i-laffirmation-de-lautonomie-de-la-theorie-du-trouble-anormal-de-voisinage\">I. L&#8217;affirmation de l&#8217;autonomie de la th\u00e9orie du trouble anormal de voisinage<\/h2>\n<p><\/p>\n<h3 id=\"a-la-dissociation-entre-lillegalite-urbanistique-et-le-trouble-anormal\">A. La dissociation entre l&#8217;ill\u00e9galit\u00e9 urbanistique et le trouble anormal<\/h3>\n<p>La cour d&#8217;appel a clairement op\u00e9r\u00e9 une distinction entre l&#8217;ill\u00e9galit\u00e9 administrative d&#8217;une construction et l&#8217;existence d&#8217;un trouble anormal de voisinage. Elle \u00e9nonce que <em>&#8220;le non respect des r\u00e8gles d&#8217;urbanisme est insuffisant \u00e0 fonder la demande de d\u00e9molition mais l&#8217;action en d\u00e9molition se fondant sur le trouble anormal du voisinage est ind\u00e9pendante de l&#8217;action administrative&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67ecc5c5955548e0aba48f38\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Basse-Terre, le 28 mars 2025, n\u00b023\/00404)<\/a><\/strong>. Cette affirmation est essentielle : elle rappelle que le juge judiciaire n&#8217;agit pas comme un juge de l&#8217;urbanisme. La violation d&#8217;une prescription du plan local d&#8217;urbanisme, si elle peut donner lieu \u00e0 des poursuites p\u00e9nales ou \u00e0 une action administrative, ne saurait automatiquement ouvrir droit \u00e0 une r\u00e9paration sur le fondement des troubles anormaux de voisinage. La cour pr\u00e9cise ainsi que <em>&#8220;le non respect des prescriptions d&#8217;urbanisme ne suffit pas \u00e0 justifier d&#8217;ordonner la d\u00e9molition du cabanon&#8221;<\/em>.<\/p>\n<p>Les juges du fond ont donc v\u00e9rifi\u00e9 si, ind\u00e9pendamment de l&#8217;ill\u00e9galit\u00e9, le voisin subissait un inconv\u00e9nient exc\u00e9dant les inconv\u00e9nients normaux de voisinage. Ils ont constat\u00e9 que l&#8217;expertise mettait en \u00e9vidence que <em>&#8220;la cl\u00f4ture en grillage a \u00e9t\u00e9 remplac\u00e9e par un mur de cl\u00f4ture, de sorte que le cabanon disgracieux n&#8217;est plus visible depuis la parcelle des appelants&#8221;<\/em>. La perte de vue all\u00e9gu\u00e9e n&#8217;\u00e9tait donc plus caract\u00e9ris\u00e9e. En outre, les appelants n&#8217;ont apport\u00e9 la preuve d&#8217;aucune nuisance sonore, ni d&#8217;\u00e9manation de poussi\u00e8res, ni de pr\u00e9sence de rongeurs. La seule affirmation d&#8217;une privation d&#8217;ensoleillement ou d&#8217;une obstruction de la vue, sans d\u00e9monstration concr\u00e8te, ne peut suffire.<\/p>\n<h3 id=\"b-la-necessite-dun-prejudice-specifique-et-actuel\">B. La n\u00e9cessit\u00e9 d&#8217;un pr\u00e9judice sp\u00e9cifique et actuel<\/h3>\n<p>La cour rappelle que l&#8217;article 1240 du code civil, dans son alin\u00e9a premier, institue une responsabilit\u00e9 de plein droit pour le propri\u00e9taire ou l&#8217;occupant qui est <em>&#8220;\u00e0 l&#8217;origine d&#8217;un trouble exc\u00e9dant les inconv\u00e9nients normaux de voisinage&#8221;<\/em>. Ce texte exige donc un trouble qui, par son intensit\u00e9, sa dur\u00e9e ou sa nature, d\u00e9passe ce que tout voisin est raisonnablement tenu de supporter dans un contexte d&#8217;habitat group\u00e9. En l&#8217;esp\u00e8ce, les appelants n&#8217;ont pas d\u00e9montr\u00e9 que le cabanon, m\u00eame ill\u00e9gal, leur causait un pr\u00e9judice actuel. L&#8217;expert judiciaire indiquait que <em>&#8220;M. [P] propose de d\u00e9molir la partie non r\u00e9glementaire du cabanon&#8221;<\/em>, ce qui montre que seule une partie de la construction \u00e9tait irr\u00e9guli\u00e8re. La cour en d\u00e9duit que l&#8217;absence de trouble d\u00e9montr\u00e9 emp\u00eache toute condamnation.<\/p>\n<p>Cette position s&#8217;inscrit dans une tendance jurisprudentielle constante : <em>&#8220;Ces infractions \u00e0 la l\u00e9gislation et \u00e0 la r\u00e9glementation de l&#8217;urbanisme ont \u00e9t\u00e9 relev\u00e9es par la direction d\u00e9partementale des territoires et de la mer [&#8230;] Le trouble anormal de voisinage est caract\u00e9ris\u00e9&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/679331db31df9338379d2823\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Montpellier, le 23 janvier 2025, n\u00b021\/02394)<\/a><\/strong>. Dans cette affaire, le trouble \u00e9tait caract\u00e9ris\u00e9 par une perte de vue effective et d\u00e9montr\u00e9e. En l&#8217;esp\u00e8ce, au contraire, la vue a \u00e9t\u00e9 r\u00e9tablie par la construction d&#8217;un mur, et les autres nuisances ne sont pas prouv\u00e9es. La cour distingue donc les situations o\u00f9 l&#8217;ill\u00e9galit\u00e9 cause un pr\u00e9judice sp\u00e9cifique de celles o\u00f9 elle n&#8217;en cause pas.<\/p>\n<h2 id=\"ii-les-exigences-probatoires-et-les-limites-de-la-demolition\">II. Les exigences probatoires et les limites de la d\u00e9molition<\/h2>\n<p><\/p>\n<h3 id=\"a-la-charge-de-la-preuve-incombant-au-demandeur-a-laction\">A. La charge de la preuve incombant au demandeur \u00e0 l&#8217;action<\/h3>\n<p>La cour rappelle un principe fondamental de proc\u00e9dure : <em>&#8220;Mme [T] [W] et M. [Z] supportent la charge de la preuve du trouble anormal de voisinage.&#8221;<\/em> Les appelants ne peuvent se contenter d&#8217;invoquer la violation des r\u00e8gles d&#8217;urbanisme pour obtenir gain de cause. Ils doivent d\u00e9montrer, par tout moyen, l&#8217;existence d&#8217;un pr\u00e9judice actuel, sp\u00e9cifique et anormal. En l&#8217;esp\u00e8ce, les pi\u00e8ces produites <em>&#8220;ne rapportent la preuve ni d&#8217;\u00e9manation de poussi\u00e8res, ni d&#8217;\u00e9mission de bruit, ni de la pr\u00e9sence de rongeurs attir\u00e9s par la construction r\u00e9alis\u00e9e&#8221;<\/em>. La cour ajoute que les appelants <em>&#8220;ne d\u00e9montrent pas que la construction ill\u00e9gale prive leur propri\u00e9t\u00e9 d&#8217;ensoleillement ou qu&#8217;elle enferme leur construction ou qu&#8217;elle cr\u00e9e une vue sur leur parcelle ou qu&#8217;elle obstrue une vue dont ils disposaient auparavant&#8221;<\/em>.<\/p>\n<p>Cette exigence probatoire stricte est coh\u00e9rente avec la nature de la responsabilit\u00e9 de plein droit. Le trouble anormal de voisinage est une responsabilit\u00e9 sans faute, mais il n&#8217;en requiert pas moins une preuve du dommage. Le simple fait qu&#8217;une construction soit ill\u00e9gale ne dispense pas le demandeur de prouver qu&#8217;elle lui cause un inconv\u00e9nient exc\u00e9dant les inconv\u00e9nients normaux de voisinage. La cour fait ainsi application d&#8217;une jurisprudence bien \u00e9tablie selon laquelle <em>&#8220;le juge judiciaire peut ordonner la d\u00e9molition d&#8217;une construction qui cause un trouble anormal du voisinage, dont la d\u00e9monstration incombe \u00e0 la partie qui l&#8217;all\u00e8gue&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67ecc5c5955548e0aba48f38\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Basse-Terre, le 28 mars 2025, n\u00b023\/00404)<\/a><\/strong>.<\/p>\n<h3 id=\"b-limpossibilite-dordonner-une-demolition-en-labsence-de-trouble-demontre\">B. L&#8217;impossibilit\u00e9 d&#8217;ordonner une d\u00e9molition en l&#8217;absence de trouble d\u00e9montr\u00e9<\/h3>\n<p>En cons\u00e9quence de l&#8217;absence de preuve d&#8217;un trouble anormal, la cour \u00e9carte la demande de d\u00e9molition et de condamnation sous astreinte. Elle rel\u00e8ve que <em>&#8220;si M. [P] a indiqu\u00e9 devant l&#8217;expert qu&#8217;il ne s&#8217;opposait pas \u00e0 la mise en conformit\u00e9, en absence de preuve d&#8217;un trouble anormal de voisinage, il ne peut \u00eatre condamn\u00e9 au titre d&#8217;une obligation de faire, sous astreinte&#8221;<\/em>. Cette solution est logique : la d\u00e9molition est une mesure radicale qui ne peut \u00eatre ordonn\u00e9e que si elle est n\u00e9cessaire pour faire cesser un trouble r\u00e9el et actuel. Or, en l&#8217;esp\u00e8ce, le trouble n&#8217;\u00e9tant pas \u00e9tabli, la demande de d\u00e9molition est rejet\u00e9e.<\/p>\n<p>La cour ajoute, de mani\u00e8re surabondante, qu&#8217;<em>&#8220;il n&#8217;existe aucun droit \u00e0 la vue&#8221;<\/em>. Cette pr\u00e9cision est importante : elle rappelle que le droit de propri\u00e9t\u00e9 n&#8217;inclut pas un droit subjectif \u00e0 conserver une vue d\u00e9gag\u00e9e sur le paysage environnant. Si la perte de vue peut constituer un trouble anormal lorsqu&#8217;elle est excessive, elle ne saurait \u00eatre automatiquement sanctionn\u00e9e. La d\u00e9molition n&#8217;est donc pas une sanction automatique de l&#8217;ill\u00e9galit\u00e9 urbanistique ; elle reste subordonn\u00e9e \u00e0 la d\u00e9monstration d&#8217;un pr\u00e9judice sp\u00e9cifique. La cour confirme ainsi le jugement en toutes ses dispositions et condamne les appelants au paiement des d\u00e9pens d&#8217;appel ainsi qu&#8217;\u00e0 une indemnit\u00e9 de 2000 euros au titre de l&#8217;article 700 du code de proc\u00e9dure civile.<\/p>\n<p><h2 id=\"jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/h2>\n<p><\/p>\n<ul class=\"jurisprudences-rag-sources\">\n<li><a href=\"https:\/\/www.courdecassation.fr\/decision\/679331db31df9338379d2823\" rel=\"nofollow\" target=\"_blank\">Cour d&#x27;appel de Montpellier, le 23 janvier 2025, n\u00b021\/02394<\/a><\/li>\n<li><a href=\"https:\/\/www.courdecassation.fr\/decision\/67ecc5c5955548e0aba48f38\" rel=\"nofollow\" target=\"_blank\">Cour d&#x27;appel de Basse-Terre, le 28 mars 2025, n\u00b023\/00404<\/a><\/li>\n<\/ul>\n<\/div>\n<style scoped>.fondements-juridiques{margin:40px 0 0;padding:0}.fondements-juridiques>h2{font-size:22px;color:#1a1a1a;border-bottom:2px solid #2c5f8a;padding-bottom:10px;margin-bottom:20px}.fj-article{background:#fdfdfd;border:1px solid #e8e8e8;border-radius:6px;padding:20px;margin-bottom:16px}.fj-article h3{font-size:17px;color:#2c5f8a;margin:0 0 12px;font-weight:600}.fj-texte{font-size:15px;line-height:1.7;color:#333}.fj-texte p{margin:8px 0}.fj-badge{font-size:11px;padding:2px 8px;border-radius:3px;margin-left:8px;font-weight:500;vertical-align:middle}.fj-en-vigueur{background:#e8f5e9;color:#2e7d32}.fj-abroge{background:#ffebee;color:#c62828}.fj-modifie{background:#fff3e0;color:#e65100}<\/style>\n<section class=\"fondements-juridiques\">\n<h2 id=\"fondements-juridiques\">Fondements juridiques<\/h2>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006410109\" rel=\"nofollow\" target=\"_blank\">Article 16 du Code de proc\u00e9dure civile<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">\n<p>   Le juge doit, en toutes circonstances, faire observer et observer lui-m\u00eame le principe de la contradiction.<\/p>\n<\/p>\n<p>   Il ne peut retenir, dans sa d\u00e9cision, les moyens, les explications et les documents invoqu\u00e9s ou produits par les parties que si celles-ci ont \u00e9t\u00e9 \u00e0 m\u00eame d&#8217;en d\u00e9battre contradictoirement.<\/p>\n<\/p>\n<p>   Il ne peut fonder sa d\u00e9cision sur les moyens de droit qu&#8217;il a relev\u00e9s d&#8217;office sans avoir au pr\u00e9alable invit\u00e9 les parties \u00e0 pr\u00e9senter leurs observations.<\/p>\n<\/div>\n<\/div>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032041571\" rel=\"nofollow\" target=\"_blank\">Article 1240 du Code civil<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">Tout fait quelconque de l&#8217;homme, qui cause \u00e0 autrui un dommage, oblige celui par la faute duquel il est arriv\u00e9 \u00e0 le r\u00e9parer. <\/div>\n<\/div>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000045268436\" rel=\"nofollow\" target=\"_blank\">Article 700 du Code de proc\u00e9dure civile<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">\n<p>Le juge condamne la partie tenue aux d\u00e9pens ou qui perd son proc\u00e8s \u00e0 payer :<\/p>\n<p>1\u00b0 A l&#8217;autre partie la somme qu&#8217;il d\u00e9termine, au titre des frais expos\u00e9s et non compris dans les d\u00e9pens ;<\/p>\n<p>2\u00b0 Et, le cas \u00e9ch\u00e9ant, \u00e0 l&#8217;avocat du b\u00e9n\u00e9ficiaire de l&#8217;aide juridictionnelle partielle ou totale une somme au titre des honoraires et frais, non compris dans les d\u00e9pens, que le b\u00e9n\u00e9ficiaire de l&#8217;aide aurait expos\u00e9s s&#8217;il n&#8217;avait pas eu cette aide. Dans ce cas, il est proc\u00e9d\u00e9 comme il est dit aux  alin\u00e9as 3 et 4 de l&#8217;article 37 de la loi n\u00b0 91-647 du 10 juillet 1991 .<\/p>\n<p>Dans tous les cas, le juge tient compte de l&#8217;\u00e9quit\u00e9 ou de la situation \u00e9conomique de la partie condamn\u00e9e. Il peut, m\u00eame d&#8217;office, pour des raisons tir\u00e9es des m\u00eames consid\u00e9rations, dire qu&#8217;il n&#8217;y a pas lieu \u00e0 ces condamnations.<\/p>\n<p>Les parties peuvent produire les justificatifs des sommes qu&#8217;elles demandent.<\/p>\n<\/p>\n<p> La somme allou\u00e9e au titre du 2\u00b0 ne peut \u00eatre inf\u00e9rieure \u00e0 la part contributive de l&#8217;Etat major\u00e9e de 50 %.<\/p>\n<\/p>\n<\/div>\n<\/div>\n<\/section>\n<section class=\"closing\" id=\"envoyer-pieces\" style=\"margin:48px 0 36px;padding:48px 36px;text-align:center;border-radius:24px;background:radial-gradient(circle at 50% 0%,rgba(0,0,204,0.08) 0%,transparent 60%),rgba(255,255,255,0.72);border:1px solid rgba(10,10,10,0.08);\">\n<div class=\"closing-heading\" role=\"heading\" aria-level=\"2\" style=\"font-size:clamp(30px,4vw,44px);line-height:1.18;font-weight:700;margin:0 0 18px;letter-spacing:-0.022em;color:#1B1B1B;font-family:Lato,sans-serif;\">Envoyez vos pi\u00e8ces.
