L&#8217;absence de sommes dues au bailleur comme condition n\u00e9cessaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Le 28 avril 2026, la Cour d&#8217;appel de Reims (Chambre 2 JCP, n\u00b025\/00575) \u00e9tait saisie d&#8217;un litige opposant un locataire \u00e0 sa bailleresse au sujet de la restitution du d\u00e9p\u00f4t de garantie et du remboursement de frais administratifs. Un bail d&#8217;habitation avait \u00e9t\u00e9 conclu le 15 juillet 2022. Le locataire quittait les lieux le 30 novembre 2022 sans qu&#8217;un \u00e9tat des lieux de sortie contradictoire ne soit \u00e9tabli. Un \u00e9change de courriels attestait du d\u00e9part. La bailleresse, apr\u00e8s mise en demeure, invoquait d&#8217;abord un d\u00e9faut de cl\u00e9s, puis d&#8217;autres griefs (absence \u00e0 l&#8217;\u00e9tat des lieux, consommation d&#8217;eau non r\u00e9gularis\u00e9e, volet roulant d\u00e9fectueux, frais de nettoyage). Le locataire assignait la bailleresse devant le juge des contentieux de la protection du tribunal judiciaire de Reims. Par jugement du 29 ao\u00fbt 2024, cette juridiction rejetait la demande de restitution du d\u00e9p\u00f4t de garantie, estimant que la remise des cl\u00e9s n&#8217;\u00e9tait pas \u00e9tablie, mais condamnait la bailleresse \u00e0 rembourser les frais administratifs. Le locataire interjetait appel. La bailleresse, bien que r\u00e9guli\u00e8rement cit\u00e9e, ne comparaissait pas en appel. La question de droit \u00e9tait de savoir si le premier juge pouvait, en l&#8217;absence du d\u00e9fendeur, \u00e9carter les pi\u00e8ces du demandeur comme insuffisantes sans avoir pr\u00e9alablement requis ses observations, et si la remise des cl\u00e9s \u00e9tait suffisamment prouv\u00e9e pour rendre exigible la restitution du d\u00e9p\u00f4t de garantie. La cour d&#8217;appel a infirm\u00e9 le jugement sur la restitution du d\u00e9p\u00f4t de garantie, condamnant la bailleresse \u00e0 payer 500 euros avec les cons\u00e9quences l\u00e9gales de l&#8217;article 22 de la loi du 6 juillet 1989, et a confirm\u00e9 le remboursement des frais administratifs.<\/p>\n<h2 id=\"i-lexigence-dun-debat-contradictoire-renforce-en-labsence-du-defendeur\">I. L&#8217;exigence d&#8217;un d\u00e9bat contradictoire renforc\u00e9 en l&#8217;absence du d\u00e9fendeur<\/h2>\n<p><\/p>\n<h3 id=\"a-le-rappel-de-lobligation-pour-le-juge-de-solliciter-les-observations-du-demand\">A. Le rappel de l&#8217;obligation pour le juge de solliciter les observations du demandeur<\/h3>\n<p>La cour d&#8217;appel a d&#8217;abord rappel\u00e9 un principe proc\u00e9dural fondamental, \u00e0 titre liminaire dans ses motifs. Elle a \u00e9nonc\u00e9 que le juge, lorsqu&#8217;il est saisi d&#8217;une demande en l&#8217;absence du d\u00e9fendeur, ne saurait rejeter les pr\u00e9tentions du demandeur <em>&#8221; sur l&#8217;analyse des preuves produites, qu&#8217;il estime insuffisantes, sans pr\u00e9alablement requ\u00e9rir les observations du demandeur &#8220;<\/em>. Cette formule de la cour constitue une application rigoureuse du principe de la contradiction, lequel impose que toute partie puisse d\u00e9battre des \u00e9l\u00e9ments sur lesquels le juge entend fonder sa d\u00e9cision. En l&#8217;esp\u00e8ce, le premier juge avait consid\u00e9r\u00e9 que la preuve de la remise des cl\u00e9s n&#8217;\u00e9tait pas rapport\u00e9e, alors m\u00eame que le locataire produisait un \u00e9change de courriels et une attestation. En l&#8217;absence de la bailleresse, le juge aurait d\u00fb, avant d&#8217;\u00e9carter ces pi\u00e8ces, inviter le locataire \u00e0 s&#8217;expliquer sur leur force probante. La cour d&#8217;appel a donc censur\u00e9 cette m\u00e9connaissance du d\u00e9bat contradictoire, rappelant que le d\u00e9faut de comparution du d\u00e9fendeur ne dispense pas le juge d&#8217;un examen diligent des preuves, mais ne l&#8217;autorise pas non plus \u00e0 substituer son appr\u00e9ciation \u00e0 celle des parties sans les avoir entendues. Ce faisant, la cour assure un \u00e9quilibre entre l&#8217;efficacit\u00e9 proc\u00e9durale et les droits de la d\u00e9fense, notamment pour la partie qui se pr\u00e9sente seule.<\/p>\n<h3 id=\"b-la-censure-du-premier-juge-pour-defaut-de-contradiction\">B. La censure du premier juge pour d\u00e9faut de contradiction<\/h3>\n<p>La cour d&#8217;appel a appliqu\u00e9 ce principe aux faits de l&#8217;esp\u00e8ce. Elle a relev\u00e9 que les pi\u00e8ces vers\u00e9es par le locataire (courriels du 28 et 30 novembre 2022 attestant du d\u00e9part, puis correspondances de la bailleresse elle-m\u00eame) montraient que la bailleresse avait accept\u00e9 la reprise de l&#8217;appartement en y faisant proc\u00e9der \u00e0 un nettoyage, et qu&#8217;elle n&#8217;invoquait plus dans son dernier courrier de d\u00e9faut de cl\u00e9s. D\u00e8s lors, <em>&#8221; le premier juge ne pouvait, en l&#8217;absence de contradiction et sans avoir requis les observations du demandeur sur ce point, consid\u00e9rer que la remise des lieux n&#8217;\u00e9tait pas parfaite &#8220;<\/em>. La cour a ainsi estim\u00e9 que le premier juge avait viol\u00e9 le principe de la contradiction en tranchant la question de la remise des cl\u00e9s sans avoir confront\u00e9 le locataire \u00e0 ses propres doutes. Cette solution s&#8217;inscrit dans la continuit\u00e9 de la jurisprudence qui sanctionne les d\u00e9cisions rendues sans respect du d\u00e9bat contradictoire <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67d1266c08d5ab3983c0c59a\" rel=\"nofollow\" target=\"_blank\">(v. not. Cour d&#8217;appel de Montpellier, 11 mars 2025, n\u00b022\/05992, qui rappelle que <em>&#8221; la restitution du d\u00e9p\u00f4t de garantie suppose la remise officielle des cl\u00e9s au bailleur et l&#8217;absence de sommes restant dues par le locataire &#8220;<\/em>)<\/a><\/strong>. Ainsi, la cour d&#8217;appel de Reims a rem\u00e9di\u00e9 \u00e0 cette irr\u00e9gularit\u00e9 proc\u00e9durale en examinant elle-m\u00eame les preuves et en infirmant le jugement sur ce point.<\/p>\n<h2 id=\"ii-laffirmation-des-conditions-de-la-restitution-du-depot-de-garantie\">II. L&#8217;affirmation des conditions de la restitution du d\u00e9p\u00f4t de garantie<\/h2>\n<p><\/p>\n<h3 id=\"a-la-preuve-de-la-remise-des-cles-par-tout-moyen\">A. La preuve de la remise des cl\u00e9s par tout moyen<\/h3>\n<p>La cour d&#8217;appel a ensuite tranch\u00e9 la question de fond relative \u00e0 l&#8217;exigibilit\u00e9 du d\u00e9p\u00f4t de garantie. L&#8217;article 22 de la loi du 6 juillet 1989 dispose que le d\u00e9p\u00f4t de garantie doit \u00eatre restitu\u00e9 dans un d\u00e9lai maximal de deux mois \u00e0 compter de la remise des cl\u00e9s. En l&#8217;esp\u00e8ce, aucun \u00e9tat des lieux de sortie contradictoire n&#8217;avait \u00e9t\u00e9 dress\u00e9. Pour autant, la cour a estim\u00e9 que la remise des cl\u00e9s pouvait \u00eatre prouv\u00e9e par d&#8217;autres moyens. Elle s&#8217;est fond\u00e9e sur l&#8217;attestation d&#8217;une voisine du locataire, qui indiquait avoir repr\u00e9sent\u00e9 ce dernier le 30 novembre 2022 lors de la restitution et avoir remis <em>&#8221; l&#8217;ensemble des cl\u00e9s du logement en ce compris celle de la bo\u00eete aux lettres &#8220;<\/em>. La cour a \u00e9galement relev\u00e9 que la bailleresse, dans sa correspondance du 19 octobre 2023, n&#8217;invoquait plus le d\u00e9faut de cl\u00e9s, ce qui contredisait ses premi\u00e8res all\u00e9gations. La cour a donc jug\u00e9 que la remise des cl\u00e9s \u00e9tait \u00e9tablie, rendant le d\u00e9p\u00f4t de garantie exigible \u00e0 compter du 30 novembre 2022. Cette solution illustre la souplesse probatoire admise en mati\u00e8re locative : en l&#8217;absence d&#8217;\u00e9tat des lieux, tout \u00e9l\u00e9ment s\u00e9rieux peut d\u00e9montrer la restitution des lieux <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/6811aea481f47e994feb25eb\" rel=\"nofollow\" target=\"_blank\">(v. dans le m\u00eame sens Cour d&#8217;appel de Versailles, 29 avril 2025, n\u00b024\/02592, qui rappelle que le d\u00e9lai de restitution court \u00e0 compter de la remise des cl\u00e9s, m\u00eame en l&#8217;absence d&#8217;\u00e9tat des lieux)<\/a><\/strong>. La cour a ainsi fait pr\u00e9valoir la r\u00e9alit\u00e9 mat\u00e9rielle de la remise des cl\u00e9s sur l&#8217;absence de formalisme.<\/p>\n<h3 id=\"b-labsence-de-sommes-dues-au-bailleur-comme-condition-necessaire\">B. L&#8217;absence de sommes dues au bailleur comme condition n\u00e9cessaire<\/h3>\n<p>La cour a parall\u00e8lement v\u00e9rifi\u00e9 qu&#8217;aucune somme n&#8217;\u00e9tait due par le locataire. L&#8217;article 22 pr\u00e9cit\u00e9 pr\u00e9voit que la restitution du d\u00e9p\u00f4t de garantie se fait <em>&#8221; d\u00e9duction faite, le cas \u00e9ch\u00e9ant, des sommes restant dues au bailleur &#8220;<\/em>. La bailleresse avait invoqu\u00e9 des griefs (consommation d&#8217;eau non r\u00e9gularis\u00e9e, volet roulant d\u00e9fectueux, frais de nettoyage). Sur ce point, la cour a estim\u00e9 que la bailleresse, absente en appel, ne justifiait d&#8217;aucune somme restant due. Le locataire contestait ces griefs, et aucune facture ou devis n&#8217;\u00e9tait produit. La cour a donc logiquement consid\u00e9r\u00e9 qu&#8217;aucune d\u00e9duction n&#8217;\u00e9tait justifi\u00e9e. Elle a condamn\u00e9 la bailleresse \u00e0 restituer l&#8217;int\u00e9gralit\u00e9 du d\u00e9p\u00f4t de garantie, soit 500 euros, et \u00e0 supporter la majoration l\u00e9gale de 10 % du loyer mensuel par mois de retard pr\u00e9vue \u00e0 l&#8217;alin\u00e9a 7 de l&#8217;article 22. Cette solution est conforme \u00e0 la jurisprudence qui exige que les retenues op\u00e9r\u00e9es par le bailleur soient d\u00fbment justifi\u00e9es <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67d1266c08d5ab3983c0c59a\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Montpellier, 11 mars 2025, n\u00b022\/05992 : la restitution suppose <em>&#8221; l&#8217;absence de sommes restant dues par le locataire qui ne sont nullement d\u00e9montr\u00e9es &#8220;<\/em>)<\/a><\/strong>. En confirmant le remboursement des frais administratifs (450 euros), non pr\u00e9vus au bail, la cour a \u00e9galement sanctionn\u00e9 une pratique abusive.
