L\u2019octroi de d\u00e9lais de paiement comme correctif<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Le Tribunal judiciaire de B\u00e9ziers, statuant en sa formation de juge des contentieux de la protection, a rendu le 27 mars 2026 une d\u00e9cision (n\u00b025\/00232) relative \u00e0 la r\u00e9siliation d\u2019un bail d\u2019habitation pour d\u00e9faut de paiement des loyers. Le litige oppose une bailleresse \u00e0 sa locataire, ainsi qu\u2019\u00e0 la caution solidaire de celle-ci. <\/p>\n<p>Un contrat de location a \u00e9t\u00e9 conclu le 16 mai 2019, avec effet au 1er juin 2019, pour un logement situ\u00e9 \u00e0 B\u00e9ziers. Ce bail comportait une clause r\u00e9solutoire pr\u00e9voyant un d\u00e9lai de deux mois apr\u00e8s un commandement de payer rest\u00e9 infructueux. Le 11 octobre 2024, un commandement de payer a \u00e9t\u00e9 d\u00e9livr\u00e9 \u00e0 la locataire, demeurant sans effet. La bailleresse a alors assign\u00e9 la locataire et sa caution devant la juridiction pr\u00e9cit\u00e9e, par acte du 20 mars 2025, afin de voir constater l\u2019acquisition de la clause r\u00e9solutoire et obtenir le paiement des sommes dues.<\/p>\n<p>En premi\u00e8re instance, la locataire a soutenu avoir lib\u00e9r\u00e9 les lieux le 31 mai 2025, sans en justifier. La caution a fait valoir que son engagement, d\u2019une dur\u00e9e maximale de soixante-douze mois \u00e0 compter de la signature du bail, expirait le 1er juin 2025. Le juge a consid\u00e9r\u00e9 que l\u2019action de la bailleresse \u00e9tait recevable, les formalit\u00e9s pr\u00e9vues \u00e0 l\u2019article 24 de la loi du 6 juillet 1989 ayant \u00e9t\u00e9 respect\u00e9es.<\/p>\n<p>La question de droit centrale portait sur l\u2019interpr\u00e9tation de l\u2019article 24 de la loi n\u00b089-462, dans sa r\u00e9daction issue de la loi du 27 juillet 2023, au regard du d\u00e9lai contractuel de deux mois contenu dans la clause r\u00e9solutoire. Il s\u2019agissait de d\u00e9terminer si le nouveau d\u00e9lai l\u00e9gal de six semaines devait s\u2019appliquer \u00e0 un bail en cours avant l\u2019entr\u00e9e en vigueur de la loi modificative.<\/p>\n<p>Le juge a r\u00e9pondu par la n\u00e9gative. Il a constat\u00e9 que les conditions d\u2019acquisition de la clause r\u00e9solutoire \u00e9taient r\u00e9unies le 12 d\u00e9cembre 2024, soit deux mois apr\u00e8s le commandement de payer. Il a condamn\u00e9 solidairement la locataire et la caution au paiement de la somme de 739,23 euros, arr\u00eat\u00e9e au 1er juin 2025, et la locataire seule au paiement de 3120,40 euros pour la p\u00e9riode post\u00e9rieure. Des d\u00e9lais de paiement ont \u00e9t\u00e9 accord\u00e9s aux deux d\u00e9biteurs, avec suspension des effets de la clause r\u00e9solutoire en cas de respect de l\u2019\u00e9ch\u00e9ancier.<\/p>\n<h2 id=\"i-une-application-immediate-mais-circonscrite-de-la-loi-du-27-juillet-2023\">I. Une application imm\u00e9diate mais circonscrite de la loi du 27 juillet 2023<\/h2>\n<p><\/p>\n<h3 id=\"a-le-respect-des-formalites-prealables-a-la-recevabilite-de-laction\">A. Le respect des formalit\u00e9s pr\u00e9alables \u00e0 la recevabilit\u00e9 de l\u2019action<\/h3>\n<p>Avant d\u2019examiner le fond, le juge s\u2019est assur\u00e9 de la recevabilit\u00e9 de la demande. Il a v\u00e9rifi\u00e9 la notification de l\u2019assignation \u00e0 la pr\u00e9fecture de l\u2019H\u00e9rault, conform\u00e9ment \u00e0 l\u2019article 24 III de la loi du 6 juillet 1989. Cette notification a \u00e9t\u00e9 effectu\u00e9e par voie \u00e9lectronique le 25 mars 2025, soit plus de six semaines avant l\u2019audience. En outre, la bailleresse justifiait de la saisine des organismes payeurs des allocations logement le 11 octobre 2024, soit deux mois avant la d\u00e9livrance de l\u2019assignation, en vertu de l\u2019article 24 II de la m\u00eame loi. Le juge a ainsi constat\u00e9 que <em>&#8221; l\u2019action diligent\u00e9e par Madame [O] [K] appara\u00eet recevable &#8220;<\/em>. Ce contr\u00f4le pr\u00e9alable est un imp\u00e9ratif proc\u00e9dural qui garantit la r\u00e9gularit\u00e9 de la proc\u00e9dure en mati\u00e8re de baux d\u2019habitation. Il illustre l\u2019attention port\u00e9e par le l\u00e9gislateur \u00e0 la protection des locataires, en imposant un dialogue avec les autorit\u00e9s administratives avant toute action en r\u00e9siliation. Le juge a donc valid\u00e9 la recevabilit\u00e9, ouvrant la voie \u00e0 l\u2019examen de la clause r\u00e9solutoire.<\/p>\n<h3 id=\"b-la-portee-limitee-de-la-loi-nouvelle-sur-les-clauses-contractuelles-en-cours\">B. La port\u00e9e limit\u00e9e de la loi nouvelle sur les clauses contractuelles en cours<\/h3>\n<p>Le d\u00e9bat portait sur l\u2019application de la loi n\u00b02023-668 du 27 juillet 2023, qui a modifi\u00e9 l\u2019article 24 de la loi de 1989 en imposant un d\u00e9lai de six semaines apr\u00e8s un commandement de payer pour que la clause r\u00e9solutoire produise effet. Le juge a repris l\u2019avis de la Cour de cassation du 13 juin 2024, selon lequel cette loi <em>&#8221; n&#8217;a pas pour effet de modifier les d\u00e9lais figurant dans les clauses contractuelles des baux en cours au jour de l&#8217;entr\u00e9e en vigueur de la loi &#8220;<\/em>. Il en a d\u00e9duit que la loi nouvelle ne s\u2019appliquait qu\u2019aux contrats conclus post\u00e9rieurement \u00e0 son entr\u00e9e en vigueur, ainsi qu\u2019\u00e0 ceux conclus ant\u00e9rieurement dont la clause ne pr\u00e9ciserait aucun d\u00e9lai. En l\u2019esp\u00e8ce, le bail du 16 mai 2019 contenait une clause pr\u00e9voyant un d\u00e9lai de deux mois. Le juge a donc appliqu\u00e9 ce d\u00e9lai contractuel, constatant que le commandement de payer signifi\u00e9 le 11 octobre 2024 \u00e9tait rest\u00e9 infructueux pendant plus de deux mois, et que <em>&#8221; les conditions d\u2019acquisition de la clause r\u00e9solutoire contenue dans le bail \u00e9taient r\u00e9unies \u00e0 la date du 12 d\u00e9cembre 2024 &#8220;<\/em>. Cette solution concilie l\u2019application imm\u00e9diate des lois nouvelles avec le respect de la volont\u00e9 contractuelle des parties.<\/p>\n<h2 id=\"ii-les-consequences-de-la-solution-sur-les-obligations-locatives\">II. Les cons\u00e9quences de la solution sur les obligations locatives<\/h2>\n<p><\/p>\n<h3 id=\"a-la-portee-temporelle-de-lengagement-de-la-caution\">A. La port\u00e9e temporelle de l\u2019engagement de la caution<\/h3>\n<p>La caution avait sign\u00e9 un acte de cautionnement le 16 mai 2019, fixant la dur\u00e9e de son engagement \u00e0 soixante-douze mois, soit jusqu\u2019au 1er juin 2025. Le juge a retenu que la caution restait tenue <em>&#8221; solidairement &#8220;<\/em> pour les dettes n\u00e9es avant cette date. Ainsi, il a condamn\u00e9 solidairement la locataire et la caution au paiement de la somme de 739,23 euros, correspondant \u00e0 l\u2019arri\u00e9r\u00e9 arr\u00eat\u00e9 au 1er juin 2025. Cette condamnation illustre le principe, rappel\u00e9 par la Cour d\u2019appel de Versailles le 14 janvier 2025 : <em>&#8221; le fait que l&#8217;acte de cautionnement fixe une date limite mettant fin \u00e0 l&#8217;obligation de couverture de la caution est sans incidence sur l&#8217;obligation de r\u00e8glement de celle-ci qui reste tenue des dettes n\u00e9es ant\u00e9rieurement \u00e0 cette date et qui peut \u00eatre poursuivie post\u00e9rieurement lorsque la dette est exigible &#8220;<\/em> (n\u00b023\/07848). Le juge a ainsi fait une exacte application de l\u2019article 2292 du code civil, en limitant l\u2019\u00e9tendue du cautionnement aux dettes contract\u00e9es pendant la p\u00e9riode de couverture.<\/p>\n<h3 id=\"b-loctroi-de-delais-de-paiement-comme-correctif\">B. L\u2019octroi de d\u00e9lais de paiement comme correctif<\/h3>\n<p>Le juge a accord\u00e9 des d\u00e9lais de paiement tant \u00e0 la locataire qu\u2019\u00e0 la caution, sur le fondement de l\u2019article 1343-5 du code civil. Il a autoris\u00e9 la locataire \u00e0 s\u2019acquitter de sa dette de 3120,40 euros en vingt-trois mensualit\u00e9s de 130 euros, et la caution \u00e0 payer sa part de 739,23 euros selon un \u00e9ch\u00e9ancier similaire. Il a pr\u00e9cis\u00e9 que <em>&#8221; les effets de la clause r\u00e9solutoire sont suspendus pendant l\u2019ex\u00e9cution des d\u00e9lais accord\u00e9s &#8220;<\/em>, et que le respect int\u00e9gral du plan entra\u00eenerait la r\u00e9putation de non-acquisition de la clause. Cette mesure s\u2019inscrit dans la logique de l\u2019article 24 V de la loi de 1989, qui permet au juge d\u2019am\u00e9nager le paiement de la dette locative. En l\u2019esp\u00e8ce, le juge a estim\u00e9 que la situation de la locataire justifiait cette faveur, tout en m\u00e9nageant les int\u00e9r\u00eats du cr\u00e9ancier. Cependant, il a subordonn\u00e9 cet avantage \u00e0 une condition r\u00e9solutoire : tout impay\u00e9 dans les sept jours suivant une mise en demeure ferait revivre la clause et rendrait le solde imm\u00e9diatement exigible.
