Un locataire, apr\u00e8s avoir occup\u00e9 les lieux en vertu de deux baux successifs de trois mois prenant fin le 7 juillet 2021, s\u2019y est maintenu sans nouveau contrat \u00e9crit. Pendant deux ans, le bailleur n\u2019a pas r\u00e9agi, jusqu\u2019\u00e0 ce qu\u2019en juin 2023 il mette en demeure le locataire de payer les loyers impay\u00e9s. Un commandement de payer a \u00e9t\u00e9 signifi\u00e9 le 18 juillet 2023, rest\u00e9 infructueux. Le bailleur a alors assign\u00e9 le locataire devant le juge des contentieux de la protection aux fins de constat de la r\u00e9siliation du bail et d\u2019expulsion. Le locataire contestait l\u2019existence d\u2019un bail verbal et sollicitait des d\u00e9lais de paiement ainsi qu\u2019une expertise sur l\u2019\u00e9tat du logement.<\/p>\n<p>Le tribunal devait trancher deux questions principales. D\u2019une part, le maintien dans les lieux apr\u00e8s l\u2019expiration du dernier contrat \u00e9crit pouvait-il caract\u00e9riser un bail verbal soumis \u00e0 la loi du 6 juillet 1989 ? D\u2019autre part, \u00e0 d\u00e9faut de clause r\u00e9solutoire contractuelle, le bailleur pouvait-il se pr\u00e9valoir du m\u00e9canisme de r\u00e9siliation de plein droit pr\u00e9vu \u00e0 l\u2019article 24 de cette loi, dans sa r\u00e9daction issue de la loi du 27 juillet 2023 ? Par son jugement, le tribunal a jug\u00e9 qu\u2019un bail verbal avait \u00e9t\u00e9 consenti \u00e0 compter du 7 juillet 2021, que la clause r\u00e9solutoire l\u00e9gale \u00e9tait acquise au 30 ao\u00fbt 2023 et a condamn\u00e9 le locataire \u00e0 payer l\u2019arri\u00e9r\u00e9 locatif de 17 914 euros, tout en rejetant ses demandes reconventionnelles.<\/p>\n<h2 id=\"i-la-reconnaissance-dun-bail-verbal-implicite-par-la-passivite-du-bailleur\">I. La reconnaissance d\u2019un bail verbal implicite par la passivit\u00e9 du bailleur<\/h2>\n<p><\/p>\n<h3 id=\"a-la-qualification-de-bail-verbal-fondee-sur-la-tolerance-et-les-actes-positifs-\">A. La qualification de bail verbal fond\u00e9e sur la tol\u00e9rance et les actes positifs du bailleur<\/h3>\n<p>Le tribunal a \u00e9cart\u00e9 l\u2019argument selon lequel l\u2019absence de contrat \u00e9crit interdirait de retenir l\u2019existence d\u2019une location soumise \u00e0 la loi de 1989. Il a relev\u00e9 que le locataire s\u2019\u00e9tait maintenu dans les lieux apr\u00e8s le 7 juillet 2021 sans qu\u2019aucune mise en demeure de quitter les lieux ne lui soit adress\u00e9e par le bailleur pendant deux ans. Cette inaction, jointe \u00e0 l\u2019envoi par le bailleur d\u2019une mise en demeure de payer les loyers impay\u00e9s le 7 juin 2023, d\u00e9montre que le bailleur a implicitement accept\u00e9 la poursuite de la relation locative. La jurisprudence admet que la preuve d\u2019un bail verbal peut \u00eatre rapport\u00e9e par tout moyen, comme le rappelle la Cour d\u2019appel de Saint-Denis de la R\u00e9union : <em>&#8220;Conform\u00e9ment \u00e0 l&#8217;article 1715 du code civil, d\u00e8s lors que Mme [M] [U] est install\u00e9e dans les lieux, elle peut prouver l&#8217;existence d&#8217;un bail verbal par tout moyen.&#8221;<\/em> (25 avril 2025, n\u00b023\/01120). En l\u2019esp\u00e8ce, la simple passivit\u00e9 ne suffirait pas, mais la demande de paiement constitue un acte positif r\u00e9v\u00e9lant la volont\u00e9 du bailleur de maintenir le contrat. \u00c0 l\u2019inverse, la Cour d\u2019appel de Grenoble a pu \u00e9carter l\u2019existence d\u2019un bail verbal lorsque seul le versement d\u2019une somme correspondant \u00e0 un loyer \u00e9tait \u00e9tabli, sans autre \u00e9l\u00e9ment d\u2019acceptation : <em>&#8220;Le fait que l&#8217;intim\u00e9e ait r\u00e9gl\u00e9 la somme mensuelle de 2.779,45 euros \u00e0 l&#8217;appelante entre septembre et d\u00e9cembre 2023, dont le montant correspond au moment d&#8217;un loyer, ne permet pas de constater l&#8217;existence d&#8217;un bail verbal, faute d&#8217;autres \u00e9l\u00e9ments permettant de constater que la soci\u00e9t\u00e9 Groupe Invest Immo France a accept\u00e9 un tel contrat&#8221;<\/em> (17 avril 2025, n\u00b024\/03103). Ici, les actes du bailleur vont au-del\u00e0 de la simple perception de sommes ; ils manifestent une intention contractuelle claire.<\/p>\n<h3 id=\"b-lapplication-de-plein-droit-du-statut-protecteur-de-la-loi-du-6-juillet-1989\">B. L\u2019application de plein droit du statut protecteur de la loi du 6 juillet 1989<\/h3>\n<p>Une fois le bail verbal constat\u00e9, le tribunal lui a appliqu\u00e9 l\u2019ensemble des r\u00e8gles d\u2019ordre public de la loi du 6 juillet 1989, sans qu\u2019il soit n\u00e9cessaire que les parties les aient express\u00e9ment stipul\u00e9es. Le juge a notamment retenu que le bail verbal \u00e9tait soumis aux dispositions relatives au loyer, aux charges et \u00e0 la r\u00e9siliation. Cette solution est coh\u00e9rente avec la finalit\u00e9 protectrice du statut locatif, qui vise \u00e0 encadrer toute location d\u2019habitation, m\u00eame informelle. En l\u2019esp\u00e8ce, le bail verbal \u00e9tant r\u00e9put\u00e9 conclu pour une dur\u00e9e ind\u00e9termin\u00e9e, le jeu de la clause r\u00e9solutoire l\u00e9gale devenait applicable. Le tribunal a ainsi pu se r\u00e9f\u00e9rer \u00e0 l\u2019article 24 de la loi pour constater la r\u00e9siliation de plein droit, apr\u00e8s commandement de payer demeur\u00e9 infructueux. Cette qualification permet \u00e9galement de fixer le montant du loyer et des charges, que le locataire ne contestait d\u2019ailleurs pas.<\/p>\n<h2 id=\"ii-la-mise-en-uvre-du-mecanisme-de-resiliation-de-plein-droit-adapte-a-labsence-\">II. La mise en \u0153uvre du m\u00e9canisme de r\u00e9siliation de plein droit adapt\u00e9 \u00e0 l\u2019absence de clause contractuelle<\/h2>\n<p><\/p>\n<h3 id=\"a-lapplication-de-la-clause-resolutoire-legale-en-labsence-de-stipulation-contra\">A. L\u2019application de la clause r\u00e9solutoire l\u00e9gale en l\u2019absence de stipulation contractuelle<\/h3>\n<p>Le bail verbal ne contenait aucune clause r\u00e9solutoire. Le tribunal a alors fait application de l\u2019article 24 de la loi du 6 juillet 1989, dans sa version issue de la loi du 27 juillet 2023. Cette disposition pr\u00e9voit que la clause r\u00e9solutoire ne produit effet que six semaines apr\u00e8s un commandement de payer demeur\u00e9 infructueux. Le juge a pr\u00e9cis\u00e9, en se r\u00e9f\u00e9rant \u00e0 l\u2019avis de la Cour de cassation du 13 juin 2024, que ce nouveau d\u00e9lai ne s\u2019applique qu\u2019aux contrats conclus apr\u00e8s l\u2019entr\u00e9e en vigueur de la loi ou aux contrats ant\u00e9rieurs dont la clause r\u00e9solutoire ne pr\u00e9voit aucun d\u00e9lai. En l\u2019esp\u00e8ce, le bail verbal \u00e9tant ant\u00e9rieur \u00e0 la loi du 27 juillet 2023 et ne contenant aucun d\u00e9lai contractuel, le tribunal a estim\u00e9 que le d\u00e9lai de six semaines devait s\u2019appliquer. Cette interpr\u00e9tation permet de concilier le principe de non-r\u00e9troactivit\u00e9 des lois avec la n\u00e9cessit\u00e9 de prot\u00e9ger le locataire. Elle conduit \u00e0 constater la r\u00e9siliation au 30 ao\u00fbt 2023, soit six semaines apr\u00e8s le commandement du 18 juillet 2023. Le raisonnement est rigoureux et conforme \u00e0 l\u2019\u00e9tat du droit positif.<\/p>\n<h3 id=\"b-les-consequences-de-la-resiliation-expulsion-et-indemnisation\">B. Les cons\u00e9quences de la r\u00e9siliation : expulsion et indemnisation<\/h3>\n<p>La r\u00e9siliation \u00e9tant acquise, le tribunal a ordonn\u00e9 l\u2019expulsion du locataire devenu occupant sans droit ni titre, conform\u00e9ment aux articles L. 433-1 et suivants du code des proc\u00e9dures civiles d\u2019ex\u00e9cution. Il a \u00e9galement condamn\u00e9 le locataire au paiement d\u2019une indemnit\u00e9 d\u2019occupation mensuelle \u00e9gale au montant du loyer et des charges, \u00e0 compter du 30 ao\u00fbt 2023 jusqu\u2019\u00e0 la lib\u00e9ration des lieux. Cette indemnit\u00e9 compense le pr\u00e9judice subi par le bailleur du fait de l\u2019occupation irr\u00e9guli\u00e8re. En outre, le tribunal a rejet\u00e9 la demande de d\u00e9lais de paiement, estimant que le locataire ne justifiait pas de capacit\u00e9s financi\u00e8res suffisantes pour apurer la dette en vingt-quatre mois tout en payant le loyer courant. La demande d\u2019expertise a \u00e9t\u00e9 \u00e9cart\u00e9e faute de commencement de preuve des d\u00e9sordres all\u00e9gu\u00e9s. Enfin, le bailleur a \u00e9t\u00e9 partiellement d\u00e9bout\u00e9 de sa demande de dommages-int\u00e9r\u00eats pour perte de temps, celle-ci n\u2019\u00e9tant pas suffisamment justifi\u00e9e.
