L&#8217;octroi compl\u00e9mentaire de d\u00e9lais de gr\u00e2ce pour le surplus de la dette et la suspension des effets de la clause<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Le tribunal judiciaire de Ch\u00e2lons-en-Champagne, par un jugement du 27 mars 2026 (n\u00b026\/00107), a \u00e9t\u00e9 amen\u00e9 \u00e0 se prononcer sur l&#8217;articulation entre une proc\u00e9dure de surendettement et l&#8217;acquisition d&#8217;une clause r\u00e9solutoire dans un bail d&#8217;habitation. Un bailleur social a d\u00e9livr\u00e9 un commandement de payer visant la clause r\u00e9solutoire le 23 octobre 2024. Les locataires n&#8217;ont pas r\u00e9gl\u00e9 les sommes dues dans le d\u00e9lai de six semaines, de sorte que la clause r\u00e9solutoire \u00e9tait acquise au 5 d\u00e9cembre 2024. Toutefois, les locataires ont \u00e9t\u00e9 d\u00e9clar\u00e9s recevables \u00e0 une proc\u00e9dure de surendettement le 29 juillet 2025 et un plan de d\u00e9sendettement a \u00e9t\u00e9 approuv\u00e9. Le bailleur a saisi le juge des contentieux de la protection pour voir constater l&#8217;acquisition de la clause r\u00e9solutoire et obtenir la condamnation des locataires au paiement de la dette locative. Les locataires ont invoqu\u00e9 l&#8217;existence de la proc\u00e9dure de surendettement pour faire obstacle \u00e0 la r\u00e9siliation. Le tribunal a constat\u00e9 que la clause r\u00e9solutoire \u00e9tait acquise en raison de l&#8217;infructuosit\u00e9 du commandement de payer, la recevabilit\u00e9 au surendettement \u00e9tant post\u00e9rieure \u00e0 cette acquisition. Il a cependant accord\u00e9 aux locataires des d\u00e9lais de paiement conformes au plan de surendettement et, pour le surplus, des d\u00e9lais de gr\u00e2ce, suspendant ainsi les effets de la clause r\u00e9solutoire. La question de droit pos\u00e9e \u00e9tait de savoir si l&#8217;existence d&#8217;une proc\u00e9dure de surendettement post\u00e9rieure \u00e0 l&#8217;acquisition de la clause r\u00e9solutoire pouvait paralyser cette acquisition ou simplement en suspendre les effets par l&#8217;octroi de d\u00e9lais de paiement. Le tribunal a r\u00e9pondu que la clause r\u00e9solutoire \u00e9tait acquise, mais que ses effets pouvaient \u00eatre suspendus par l&#8217;octroi de d\u00e9lais de paiement, combinant ainsi les dispositions de l&#8217;article 24 de la loi du 6 juillet 1989 et celles du code de la consommation relatives au surendettement.<\/p>\n<h2 id=\"i-laffirmation-de-lautonomie-du-constat-de-la-clause-resolutoire-vis-a-vis-du-su\">I. L&#8217;affirmation de l&#8217;autonomie du constat de la clause r\u00e9solutoire vis-\u00e0-vis du surendettement<\/h2>\n<p><\/p>\n<h3 id=\"a-la-stricte-application-des-conditions-legales-dacquisition-de-la-clause-resolu\">A. La stricte application des conditions l\u00e9gales d&#8217;acquisition de la clause r\u00e9solutoire<\/h3>\n<p>Le tribunal rappelle d&#8217;abord le m\u00e9canisme classique de l&#8217;article 24 I de la loi du 6 juillet 1989. Ce texte pr\u00e9voit que la clause r\u00e9solutoire produit effet six semaines apr\u00e8s un commandement de payer demeur\u00e9 infructueux. En l&#8217;esp\u00e8ce, le commandement a \u00e9t\u00e9 d\u00e9livr\u00e9 le 23 octobre 2024 et le d\u00e9lai de six semaines a expir\u00e9 le 5 d\u00e9cembre 2024. Les locataires n&#8217;ayant pas r\u00e9gl\u00e9 les sommes dues dans ce d\u00e9lai, la clause r\u00e9solutoire \u00e9tait acquise \u00e0 cette date. Le tribunal constate que la d\u00e9cision de recevabilit\u00e9 au surendettement est intervenue le 29 juillet 2025, soit post\u00e9rieurement \u00e0 l&#8217;acquisition de la clause r\u00e9solutoire. Il en d\u00e9duit que cette circonstance <em>&#8220;n&#8217;a pas d&#8217;influence sur l&#8217;acquisition de la clause r\u00e9solutoire&#8221;<\/em>. Cette solution est conforme \u00e0 la jurisprudence qui consid\u00e8re que <em>&#8220;la d\u00e9cision de recevabilit\u00e9 \u00e0 la proc\u00e9dure de surendettement ne peut en cons\u00e9quence paralyser l&#8217;application de la clause r\u00e9solutoire&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/677e14af26e046654dc50d87\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Riom, 7 janvier 2025, n\u00b022\/02322)<\/a><\/strong>. Ainsi, le juge distingue nettement le moment de l&#8217;acquisition de la clause r\u00e9solutoire, qui ob\u00e9it aux seules conditions de l&#8217;article 24, de l&#8217;existence d&#8217;une proc\u00e9dure de surendettement ult\u00e9rieure, qui ne peut remettre en cause un droit d\u00e9j\u00e0 acquis.<\/p>\n<h3 id=\"b-le-refus-dune-confusion-entre-le-constat-de-la-clause-et-les-mesures-de-traite\">B. Le refus d&#8217;une confusion entre le constat de la clause et les mesures de traitement du surendettement<\/h3>\n<p>Le tribunal op\u00e8re une distinction m\u00e9thodologique entre le constat de l&#8217;acquisition de la clause r\u00e9solutoire et les effets de la proc\u00e9dure de surendettement. Il affirme que la recevabilit\u00e9 au surendettement n&#8217;a pas d&#8217;effet r\u00e9troactif sur les droits du bailleur n\u00e9s avant cette recevabilit\u00e9. Cette position s&#8217;inscrit dans la logique de l&#8217;article L. 721-4 du code de la consommation, qui fixe la date de recevabilit\u00e9 comme point de d\u00e9part des mesures protectrices. En l&#8217;esp\u00e8ce, la clause r\u00e9solutoire \u00e9tant acquise avant cette date, le principe de l&#8217;acquisition est maintenu. Le tribunal refuse donc de faire du surendettement un obstacle \u00e0 la reconnaissance de la r\u00e9siliation du bail. Il suit en cela une approche chronologique stricte : la clause r\u00e9solutoire \u00e9tant n\u00e9e avant la proc\u00e9dure de surendettement, elle ne peut \u00eatre an\u00e9antie par celle-ci. Cette solution garantit la s\u00e9curit\u00e9 juridique du bailleur, qui peut se pr\u00e9valoir d&#8217;un droit acquis avant l&#8217;ouverture de la proc\u00e9dure de surendettement.<\/p>\n<h2 id=\"ii-lassouplissement-des-effets-de-la-clause-resolutoire-par-loctroi-de-delais-de\">II. L&#8217;assouplissement des effets de la clause r\u00e9solutoire par l&#8217;octroi de d\u00e9lais de paiement<\/h2>\n<p><\/p>\n<h3 id=\"a-lapplication-des-dispositions-protectrices-de-larticle-24-vi-2-de-la-loi-du-6-\">A. L&#8217;application des dispositions protectrices de l&#8217;article 24 VI 2\u00b0 de la loi du 6 juillet 1989<\/h3>\n<p>Apr\u00e8s avoir constat\u00e9 l&#8217;acquisition de la clause r\u00e9solutoire, le tribunal met en \u0153uvre les dispositions de l&#8217;article 24 VI 2\u00b0 de la loi du 6 juillet 1989. Ce texte pr\u00e9voit que, lorsqu&#8217;un plan conventionnel de redressement a \u00e9t\u00e9 approuv\u00e9, <em>&#8220;le juge accorde les d\u00e9lais et modalit\u00e9s de paiement de la dette locative contenus dans le plan ou impos\u00e9s par la commission de surendettement&#8221;<\/em>. Cette disposition est imp\u00e9rative : le juge ne dispose d&#8217;aucun pouvoir d&#8217;appr\u00e9ciation lorsque les conditions sont r\u00e9unies, notamment la reprise du paiement des loyers courants. En l&#8217;esp\u00e8ce, le plan de d\u00e9sendettement a \u00e9t\u00e9 approuv\u00e9 le 29 juillet 2025 et les locataires ont repris le paiement des loyers courants, comme l&#8217;atteste le d\u00e9compte produit. Le tribunal applique donc strictement ce texte, en autorisant les locataires \u00e0 s&#8217;acquitter de la dette conform\u00e9ment au plan. Il reprend ainsi la solution selon laquelle, dans une telle hypoth\u00e8se, le juge <em>&#8220;accorde les d\u00e9lais et modalit\u00e9s de paiement de la dette locative contenus dans le plan&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67aee48774f5133eff49ce70\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Bordeaux, 13 f\u00e9vrier 2025, n\u00b024\/03170)<\/a><\/strong>. Cette application de l&#8217;article 24 VI 2\u00b0 permet de concilier le constat de la clause r\u00e9solutoire avec l&#8217;objectif de maintien dans les lieux des d\u00e9biteurs de bonne foi.<\/p>\n<h3 id=\"b-loctroi-complementaire-de-delais-de-grace-pour-le-surplus-de-la-dette-et-la-su\">B. L&#8217;octroi compl\u00e9mentaire de d\u00e9lais de gr\u00e2ce pour le surplus de la dette et la suspension des effets de la clause<\/h3>\n<p>Pour le surplus de la dette non couvert par le plan de surendettement, le tribunal recourt \u00e0 l&#8217;article 24 V de la loi du 6 juillet 1989. Ce texte permet au juge d&#8217;accorder des d\u00e9lais de paiement dans la limite de trois ann\u00e9es et de suspendre les effets de la clause r\u00e9solutoire pendant ces d\u00e9lais. En l&#8217;esp\u00e8ce, le tribunal constate que la dette locative fix\u00e9e par la commission de surendettement (4.341,38 euros) est inf\u00e9rieure \u00e0 celle constat\u00e9e dans la proc\u00e9dure (3.618 euros apr\u00e8s d\u00e9duction), mais qu&#8217;un solde de 846,14 euros subsiste en dehors du plan. Pour cette somme, le tribunal accorde trois \u00e9ch\u00e9ances mensuelles suppl\u00e9mentaires, suspendant ainsi les effets de la clause r\u00e9solutoire. Il pr\u00e9cise que si les d\u00e9lais accord\u00e9s sont respect\u00e9s, <em>&#8220;la clause r\u00e9solutoire sera r\u00e9put\u00e9e n&#8217;avoir jamais \u00e9t\u00e9 acquise&#8221;<\/em>. Cette solution combine harmonieusement les deux dispositifs l\u00e9gaux : le plan de surendettement pour la part fix\u00e9e par la commission, et les d\u00e9lais de gr\u00e2ce pour le surplus. Le tribunal assure ainsi une protection compl\u00e8te du d\u00e9biteur tout en pr\u00e9servant les int\u00e9r\u00eats du bailleur par une clause de caducit\u00e9 en cas de non-paiement.
