La cons\u00e9cration d&#8217;une approche protectrice du locataire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Le Tribunal judiciaire de Ch\u00e2lons-en-Champagne, en sa formation de juge des contentieux de la protection, a rendu le 27 mars 2026 un jugement (n\u00b025\/03278) relatif \u00e0 l&#8217;acquisition d&#8217;une clause r\u00e9solutoire dans un bail d&#8217;habitation et un bail de garage. La question centrale portait sur le respect des formalit\u00e9s pr\u00e9alables \u00e0 l&#8217;action en r\u00e9siliation et sur l&#8217;articulation des d\u00e9lais contractuels et proc\u00e9duraux.<\/p>\n<p>Une soci\u00e9t\u00e9 bailleresse, personne morale, avait consenti deux baux \u00e0 une locataire : l&#8217;un pour un logement d&#8217;habitation conclu le 17 novembre 2022, l&#8217;autre pour une place de stationnement conclu le 22 d\u00e9cembre 2022. Des loyers \u00e9tant demeur\u00e9s impay\u00e9s, la bailleresse fit signifier un commandement de payer visant la clause r\u00e9solutoire le 23 avril 2025, mentionnant un d\u00e9lai de deux mois pour r\u00e9gulariser. La locataire ne comparaissant pas, le tribunal devait se prononcer sur la r\u00e9gularit\u00e9 de la proc\u00e9dure et sur les effets de ce commandement.<\/p>\n<p>La proc\u00e9dure avait \u00e9t\u00e9 respect\u00e9e : la bailleresse justifiait avoir saisi la commission de coordination des actions de pr\u00e9vention des expulsions locatives le 24 avril 2025, soit deux mois avant l&#8217;assignation d\u00e9livr\u00e9e le 24 novembre 2025. Cette assignation avait \u00e9t\u00e9 notifi\u00e9e \u00e0 la pr\u00e9fecture le 25 novembre 2025, plus de six semaines avant l&#8217;audience. Le tribunal d\u00e9clara l&#8217;action recevable et constata l&#8217;acquisition de la clause r\u00e9solutoire au 24 juin 2025 pour les deux baux, condamnant la locataire au paiement de l&#8217;arri\u00e9r\u00e9 locatif et d&#8217;une indemnit\u00e9 d&#8217;occupation.<\/p>\n<p>La question de droit \u00e9tait double. D&#8217;une part, il s&#8217;agissait de d\u00e9terminer si les conditions de recevabilit\u00e9 de l&#8217;action du bailleur social, notamment la saisine pr\u00e9alable de la commission de coordination, avaient \u00e9t\u00e9 remplies. D&#8217;autre part, il fallait trancher le sort de la clause r\u00e9solutoire lorsque le commandement de payer mentionne un d\u00e9lai sup\u00e9rieur \u00e0 celui pr\u00e9vu par la clause contractuelle.<\/p>\n<p>Le tribunal a apport\u00e9 une solution nuanc\u00e9e, distinguant le bail d&#8217;habitation, soumis au d\u00e9lai l\u00e9gal de deux mois, du bail de garage, pour lequel il a retenu le d\u00e9lai effectivement mentionn\u00e9 dans l&#8217;acte. Cette d\u00e9cision m\u00e9rite une analyse approfondie, tant dans son explication que dans sa port\u00e9e.<\/p>\n<h2 id=\"i-laffirmation-des-conditions-procedurales-de-laction-en-constat-de-resiliation\">I. L&#8217;affirmation des conditions proc\u00e9durales de l&#8217;action en constat de r\u00e9siliation<\/h2>\n<p><\/p>\n<h3 id=\"a-la-validation-des-formalites-prealables-imposees-au-bailleur-social\">A. La validation des formalit\u00e9s pr\u00e9alables impos\u00e9es au bailleur social<\/h3>\n<p>Le tribunal a v\u00e9rifi\u00e9 scrupuleusement le respect des obligations impos\u00e9es au bailleur personne morale par l&#8217;article 24 de la loi du 6 juillet 1989. Il rel\u00e8ve que <em>&#8220;la soci\u00e9t\u00e9 Plurial Novilia justifie avoir saisi la Commission de coordination des actions de pr\u00e9vention des expulsions locatives par la voie \u00e9lectronique le 24 avril 2025, soit deux mois au moins avant la d\u00e9livrance de l&#8217;assignation&#8221;<\/em>. Cette saisine constitue une condition de recevabilit\u00e9 de l&#8217;action, comme le rappelle la jurisprudence : <em>&#8220;Il r\u00e9sulte de l&#8217;article 24 II de la loi du 6 juillet 1989 que les bailleurs personnes morales autres qu&#8217;une soci\u00e9t\u00e9 civile constitu\u00e9e exclusivement entre parents et alli\u00e9s jusqu&#8217;au quatri\u00e8me degr\u00e9 inclus ne peuvent faire d\u00e9livrer, sous peine d&#8217;irrecevabilit\u00e9 de la demande, une assignation aux fins de constat de r\u00e9siliation du bail avant l&#8217;expiration d&#8217;un d\u00e9lai de 2 mois suivant la saisine de la commission de coordination des actions de pr\u00e9vention des expulsions locatives&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67c7e8b1910b2f913559dcf2\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Versailles, 4 mars 2025, n\u00b023\/07059)<\/a><\/strong>.<\/p>\n<p>Le juge constate \u00e9galement que <em>&#8220;une copie de l&#8217;assignation a \u00e9t\u00e9 notifi\u00e9e \u00e0 la Pr\u00e9fecture de la Marne par la voie \u00e9lectronique le 25 novembre 2025, soit plus de six semaines avant l&#8217;audience&#8221;<\/em>. Cette notification, exig\u00e9e par l&#8217;article 24 III de la loi, est contr\u00f4l\u00e9e dans son d\u00e9lai par rapport \u00e0 la date d&#8217;audience. La rigueur de ce contr\u00f4le s&#8217;explique par la finalit\u00e9 sociale de ces formalit\u00e9s : permettre aux services pr\u00e9fectoraux de mettre en \u0153uvre les mesures de pr\u00e9vention des expulsions. Le tribunal en d\u00e9duit logiquement que <em>&#8220;l&#8217;action est donc recevable&#8221;<\/em>.<\/p>\n<h3 id=\"b-larticulation-du-delai-contractuel-et-du-delai-legal-dans-le-commandement-de-p\">B. L&#8217;articulation du d\u00e9lai contractuel et du d\u00e9lai l\u00e9gal dans le commandement de payer<\/h3>\n<p>Le tribunal op\u00e8re une distinction importante entre le bail d&#8217;habitation et le bail de garage. Pour le logement, il applique strictement l&#8217;article 24 I de la loi du 6 juillet 1989, qui pr\u00e9voit que la clause r\u00e9solutoire <em>&#8220;ne produit effet que deux mois apr\u00e8s un commandement de payer demeur\u00e9 infructueux&#8221;<\/em>. Le commandement du 23 avril 2025 \u00e9tant rest\u00e9 infructueux, la r\u00e9siliation est acquise au 24 juin 2025.<\/p>\n<p>Pour le garage, la situation est plus d\u00e9licate. La clause r\u00e9solutoire du contrat stipulait un d\u00e9lai d&#8217;un mois, mais le commandement de payer signifi\u00e9 mentionnait express\u00e9ment un d\u00e9lai de deux mois. Le tribunal retient ce dernier, estimant qu&#8217;<em>&#8220;il y a donc lieu de retenir ce d\u00e9lai de deux mois express\u00e9ment vis\u00e9 par le commandement de payer, et non pas d&#8217;un mois&#8221;<\/em>. Cette solution, a priori surprenante, s&#8217;explique par la volont\u00e9 de ne pas pi\u00e9ger le locataire : le commandement, acte unilat\u00e9ral du cr\u00e9ancier, fixe les modalit\u00e9s de la mise en demeure. Si le bailleur accorde un d\u00e9lai plus long, il ne peut ensuite se pr\u00e9valoir d&#8217;un d\u00e9lai contractuel plus court. Le tribunal fait pr\u00e9valoir la s\u00e9curit\u00e9 juridique et la loyaut\u00e9 proc\u00e9durale sur la rigueur contractuelle.<\/p>\n<h2 id=\"ii-une-appreciation-mesuree-des-consequences-indemnitaires\">II. Une appr\u00e9ciation mesur\u00e9e des cons\u00e9quences indemnitaires<\/h2>\n<p><\/p>\n<h3 id=\"a-la-fixation-de-lindemnite-doccupation-et-lexclusion-des-dommages-interets\">A. La fixation de l&#8217;indemnit\u00e9 d&#8217;occupation et l&#8217;exclusion des dommages-int\u00e9r\u00eats<\/h3>\n<p>Le tribunal fixe l&#8217;indemnit\u00e9 d&#8217;occupation due \u00e0 compter de la r\u00e9siliation au montant des loyers et charges qui auraient \u00e9t\u00e9 dus si le bail s&#8217;\u00e9tait poursuivi. Cette solution, classique, repose sur l&#8217;article 1240 du code civil : le maintien sans droit constitue une faute causant un pr\u00e9judice au propri\u00e9taire priv\u00e9 de la jouissance de son bien.<\/p>\n<p>En revanche, le juge rejette la demande de dommages-int\u00e9r\u00eats form\u00e9e par la bailleresse. Il rappelle que l&#8217;article 1231-6 du code civil subordonne l&#8217;octroi de dommages-int\u00e9r\u00eats distincts des int\u00e9r\u00eats moratoires \u00e0 la d\u00e9monstration d&#8217;un pr\u00e9judice ind\u00e9pendant du retard et d&#8217;une mauvaise foi du d\u00e9biteur. Or, <em>&#8220;la soci\u00e9t\u00e9 Plurial Novilia ne justifie pas de ce que le retard de paiement des loyers lui ait caus\u00e9 un pr\u00e9judice ind\u00e9pendant&#8221;<\/em> ni de <em>&#8220;la mauvaise foi de la locataire&#8221;<\/em>. Ce rejet est coh\u00e9rent avec la jurisprudence qui exige une faute lourde ou dolosive pour ouvrir droit \u00e0 une telle r\u00e9paration. Le tribunal rappelle ainsi que le simple impay\u00e9 locatif, m\u00eame prolong\u00e9, ne suffit pas \u00e0 caract\u00e9riser un pr\u00e9judice moral ou commercial autonome pour un bailleur institutionnel.<\/p>\n<h3 id=\"b-la-consecration-dune-approche-protectrice-du-locataire\">B. La cons\u00e9cration d&#8217;une approche protectrice du locataire<\/h3>\n<p>En retenant le d\u00e9lai de deux mois mentionn\u00e9 dans le commandement pour le garage, le tribunal fait preuve d&#8217;une certaine faveur pour le locataire. Cette solution \u00e9vite que celui-ci ne soit sanctionn\u00e9 par un d\u00e9lai plus court que celui qui lui avait \u00e9t\u00e9 notifi\u00e9. Elle s&#8217;inscrit dans la logique protectrice du droit au logement, qui commande d&#8217;interpr\u00e9ter les clauses r\u00e9solutoires de mani\u00e8re restrictive.<\/p>\n<p>Par ailleurs, le tribunal \u00e9carte du d\u00e9compte de la dette les <em>&#8220;frais de proc\u00e9dure&#8221;<\/em> (86,58 euros) et une <em>&#8220;p\u00e9nalit\u00e9 enqu\u00eate sociale&#8221;<\/em> de 7,62 euros qui apparaissait en double. Cette v\u00e9rification minutieuse du relev\u00e9 de compte, alors m\u00eame que la locataire \u00e9tait absente, illustre le r\u00f4le actif du juge dans la protection des parties vuln\u00e9rables. Il ne se contente pas d&#8217;ent\u00e9riner les demandes du bailleur mais contr\u00f4le leur bien-fond\u00e9, conform\u00e9ment \u00e0 l&#8217;article 472 du code de proc\u00e9dure civile qui impose au juge de ne faire droit \u00e0 la demande que s&#8217;il l&#8217;estime <em>&#8220;r\u00e9guli\u00e8re, recevable et bien fond\u00e9e&#8221;<\/em>.
