Le rejet de la demande de dommages-int\u00e9r\u00eats distincts<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Par un jugement r\u00e9put\u00e9 contradictoire rendu le 27 mars 2026, le Tribunal judiciaire de Ch\u00e2lons-en-Champagne a \u00e9t\u00e9 saisi par un bailleur social aux fins de r\u00e9siliation judiciaire d\u2019un contrat de bail pour impay\u00e9s locatifs. La locataire, assign\u00e9e, n\u2019a pas comparu. Les faits sont les suivants : un contrat de bail avait \u00e9t\u00e9 conclu le 31 juillet 2024. D\u00e8s le mois de d\u00e9cembre 2024, la locataire a cess\u00e9 de s\u2019acquitter r\u00e9guli\u00e8rement de ses loyers, ne proc\u00e9dant qu\u2019\u00e0 un unique versement de 500 euros post\u00e9rieurement \u00e0 une sommation de payer d\u00e9livr\u00e9e le 22 mai 2025. La dette locative s\u2019\u00e9levait \u00e0 6.641,33 euros au 31 d\u00e9cembre 2025.<\/p>\n<p>Sur le plan proc\u00e9dural, le bailleur justifie avoir saisi la commission de coordination des actions de pr\u00e9vention des expulsions locatives le 26 mai 2025, soit plus de deux mois avant la d\u00e9livrance de l\u2019assignation le 24 novembre 2025, conform\u00e9ment aux exigences l\u00e9gales. L\u2019assignation a \u00e9galement \u00e9t\u00e9 notifi\u00e9e \u00e0 la Pr\u00e9fecture dans le d\u00e9lai requis. Le juge, statuant en l\u2019absence de la d\u00e9fenderesse, a d\u00fb v\u00e9rifier la recevabilit\u00e9 et le bien-fond\u00e9 de la demande. La question de droit centrale consistait \u00e0 d\u00e9terminer si des impay\u00e9s locatifs caract\u00e9risaient un manquement suffisamment grave pour justifier la r\u00e9siliation judiciaire du bail et si le bailleur pouvait pr\u00e9tendre \u00e0 des dommages-int\u00e9r\u00eats distincts des int\u00e9r\u00eats moratoires. Par sa d\u00e9cision, le tribunal a d\u00e9clar\u00e9 l\u2019action recevable, prononc\u00e9 la r\u00e9siliation du bail avec effet au 1er janvier 2026, condamn\u00e9 la locataire au paiement de la dette locative ainsi qu\u2019\u00e0 une indemnit\u00e9 mensuelle d\u2019occupation, mais l\u2019a d\u00e9bout\u00e9 de sa demande de dommages-int\u00e9r\u00eats.<\/p>\n<h2 id=\"i-loffice-du-juge-face-au-defendeur-defaillant-pour-la-resiliation-judiciaire-du\">I. L\u2019office du juge face au d\u00e9fendeur d\u00e9faillant pour la r\u00e9siliation judiciaire du bail<\/h2>\n<p><\/p>\n<h3 id=\"a-la-verification-de-la-regularite-et-de-la-recevabilite-de-la-demande\">A. La v\u00e9rification de la r\u00e9gularit\u00e9 et de la recevabilit\u00e9 de la demande<\/h3>\n<p>En application de l\u2019article 472 du code de proc\u00e9dure civile, lorsque le d\u00e9fendeur ne compara\u00eet pas, le juge ne fait droit \u00e0 la demande que s\u2019il l\u2019estime r\u00e9guli\u00e8re, recevable et bien fond\u00e9e. Le tribunal rappelle ce principe liminaire et constate que le bailleur a respect\u00e9 les obligations impos\u00e9es par l\u2019article 24 de la loi du 6 juillet 1989. Il justifie avoir saisi la commission de coordination des actions de pr\u00e9vention des expulsions locatives par voie \u00e9lectronique le 26 mai 2025, soit plus de deux mois avant la d\u00e9livrance de l\u2019assignation du 24 novembre 2025. Ainsi que le confirme la jurisprudence, <em>&#8220;le bailleur ne peut faire d\u00e9livrer, sous peine d\u2019irrecevabilit\u00e9 de la demande, une assignation aux fins de constat de r\u00e9siliation du bail avant l\u2019expiration d\u2019un d\u00e9lai de deux mois suivant la saisine de la commission&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/6811b37c893ab038bd46605f\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Montpellier, 29 avril 2025, n\u00b022\/05200)<\/a><\/strong>. Le tribunal v\u00e9rifie \u00e9galement la notification de l\u2019assignation \u00e0 la Pr\u00e9fecture plus de six semaines avant l\u2019audience. Ces diligences accomplies, la recevabilit\u00e9 est acquise.<\/p>\n<h3 id=\"b-lappreciation-du-bien-fonde-de-la-resiliation-et-la-prise-en-compte-de-la-bonn\">B. L\u2019appr\u00e9ciation du bien-fond\u00e9 de la r\u00e9siliation et la prise en compte de la bonne foi<\/h3>\n<p>Sur le fond, le tribunal rappelle l\u2019obligation de payer le loyer pr\u00e9vue \u00e0 l\u2019article 7 de la loi du 6 juillet 1989. Il constate que la locataire n\u2019a effectu\u00e9 qu\u2019un seul r\u00e8glement depuis d\u00e9cembre 2024, malgr\u00e9 une sommation de payer. Il estime que ce comportement caract\u00e9rise un manquement suffisamment grave pour justifier la r\u00e9siliation du bail aux torts exclusifs de la locataire, au sens de l\u2019article 1224 du code civil. La date des effets de la r\u00e9siliation est fix\u00e9e au 1er janvier 2026. Le tribunal adopte ici une appr\u00e9ciation stricte de l\u2019inex\u00e9cution contractuelle, sans s\u2019interroger sur une \u00e9ventuelle bonne foi de la locataire absente. Pourtant, la jurisprudence admet que <em>&#8220;la bonne foi du locataire dans l\u2019ex\u00e9cution du contrat peut \u00eatre prise en compte&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67ff3d366d3290e00e0e79be\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Grenoble, 15 avril 2025, n\u00b022\/03086)<\/a><\/strong>. En l\u2019esp\u00e8ce, le d\u00e9faut de comparution prive le juge d\u2019\u00e9l\u00e9ments sur la situation personnelle de la locataire, ce qui justifie qu\u2019il ne retienne que le constat objectif des impay\u00e9s.<\/p>\n<h2 id=\"ii-la-distinction-entre-les-interets-moratoires-et-les-dommages-interets-pour-de\">II. La distinction entre les int\u00e9r\u00eats moratoires et les dommages-int\u00e9r\u00eats pour d\u00e9faut de paiement<\/h2>\n<p><\/p>\n<h3 id=\"a-la-condamnation-a-la-dette-locative-et-a-lindemnite-doccupation\">A. La condamnation \u00e0 la dette locative et \u00e0 l\u2019indemnit\u00e9 d\u2019occupation<\/h3>\n<p>Le tribunal, sur la base du d\u00e9compte produit, condamne la locataire \u00e0 payer la somme de 6.641,33 euros au titre des loyers et charges impay\u00e9s. Il assortit cette condamnation d\u2019int\u00e9r\u00eats au taux l\u00e9gal \u00e0 compter de l\u2019assignation pour la part certaine et \u00e0 compter du jugement pour le surplus. Il condamne \u00e9galement la locataire au paiement d\u2019une indemnit\u00e9 mensuelle d\u2019occupation \u00e9gale au montant du loyer et des charges tel qu\u2019il aurait \u00e9t\u00e9 si le contrat s\u2019\u00e9tait poursuivi, \u00e0 compter de la r\u00e9siliation jusqu\u2019\u00e0 la lib\u00e9ration effective des lieux. Ces mesures r\u00e9parent le pr\u00e9judice subi par le bailleur du fait de l\u2019impay\u00e9 et de l\u2019occupation indue. Le tribunal applique ici le droit commun de la responsabilit\u00e9 contractuelle tel que pr\u00e9vu aux articles 1217 et suivants du code civil, sans difficult\u00e9 particuli\u00e8re.<\/p>\n<h3 id=\"b-le-rejet-de-la-demande-de-dommages-interets-distincts\">B. Le rejet de la demande de dommages-int\u00e9r\u00eats distincts<\/h3>\n<p>Le bailleur sollicitait \u00e9galement des dommages-int\u00e9r\u00eats sur le fondement de l\u2019article 1231-6 du code civil, qui permet d\u2019obtenir une indemnisation distincte des int\u00e9r\u00eats moratoires en cas de mauvaise foi du d\u00e9biteur causant un pr\u00e9judice ind\u00e9pendant du retard. Le tribunal \u00e9carte cette demande, constatant que le bailleur ne justifie ni d\u2019un pr\u00e9judice distinct du simple retard de paiement, ni de la mauvaise foi de la locataire. Cette solution est conforme \u00e0 l\u2019exigence du texte, qui fait de la d\u00e9monstration de la mauvaise foi une condition n\u00e9cessaire \u00e0 l\u2019octroi de tels dommages-int\u00e9r\u00eats. En l\u2019absence d\u2019\u00e9l\u00e9ment en ce sens, le simple impay\u00e9, f\u00fbt-il grave, ne suffit pas \u00e0 caract\u00e9riser la mauvaise foi. Le tribunal distingue ainsi clairement la r\u00e9paration automatique du pr\u00e9judice mat\u00e9riel par les int\u00e9r\u00eats moratoires de l\u2019indemnisation exceptionnelle d\u2019un pr\u00e9judice moral ou compl\u00e9mentaire li\u00e9 \u00e0 une intention malicieuse du d\u00e9biteur.<\/p>\n<p><h2 id=\"jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">   Si le d\u00e9fendeur ne compara\u00eet pas, il est n\u00e9anmoins statu\u00e9 sur le fond.<\/p>\n<p>    Le juge ne fait droit \u00e0 la demande que dans la mesure o\u00f9 il l&#8217;estime r\u00e9guli\u00e8re, recevable et bien fond\u00e9e.<\/p>\n<\/div>\n<\/div>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032041482\" rel=\"nofollow\" target=\"_blank\">Article 1224 du Code civil<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">La r\u00e9solution r\u00e9sulte soit de l&#8217;application d&#8217;une clause r\u00e9solutoire soit, en cas d&#8217;inex\u00e9cution suffisamment grave, d&#8217;une notification du cr\u00e9ancier au d\u00e9biteur ou d&#8217;une d\u00e9cision de justice. <\/div>\n<\/div>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032010133\" rel=\"nofollow\" target=\"_blank\">Article 1231-6 du Code civil<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">\n<p>Les dommages et int\u00e9r\u00eats dus \u00e0 raison du retard dans le paiement d&#8217;une obligation de somme d&#8217;argent consistent dans l&#8217;int\u00e9r\u00eat au taux l\u00e9gal, \u00e0 compter de la mise en demeure.<\/p>\n<p>Ces dommages et int\u00e9r\u00eats sont dus sans que le cr\u00e9ancier soit tenu de justifier d&#8217;aucune perte.<\/p>\n<p>Le cr\u00e9ancier auquel son d\u00e9biteur en retard a caus\u00e9, par sa mauvaise foi, un pr\u00e9judice ind\u00e9pendant de ce retard, peut obtenir des dommages et int\u00e9r\u00eats distincts de l&#8217;int\u00e9r\u00eat moratoire.<\/p>\n<\/div>\n<\/div>\n<\/section>\n","protected":false},"excerpt":{"rendered":"<p>Par un jugement r\u00e9put\u00e9 contradictoire
