Puis le blocage arrive au moment administratif : impossible de finaliser la demande sur T\u00e9l\u00e9RC, formulaire Cerfa incomplet, erreur de date, indemnit\u00e9 insuffisante, refus d&#8217;homologation par la DDETS, ou doute sur la transmission r\u00e9elle du dossier.<\/p>\n<p>Ce blocage n&#8217;est pas un d\u00e9tail. En droit du travail, la rupture conventionnelle d&#8217;un CDI n&#8217;est valable que si elle respecte une proc\u00e9dure pr\u00e9cise et si elle est homologu\u00e9e par l&#8217;administration. Sans homologation valable, le contrat de travail n&#8217;est pas rompu par rupture conventionnelle. Le salari\u00e9 ne doit donc pas partir comme si tout \u00e9tait acquis, et l&#8217;employeur ne doit pas solder le dossier comme si la rupture \u00e9tait devenue certaine.<\/p>\n<p>L&#8217;enjeu pratique est simple : identifier rapidement si l&#8217;erreur peut \u00eatre corrig\u00e9e par une nouvelle demande, si le d\u00e9lai de r\u00e9tractation a \u00e9t\u00e9 respect\u00e9, si l&#8217;administration a vraiment re\u00e7u le dossier, et si un recours devant le conseil de prud&#8217;hommes doit \u00eatre envisag\u00e9.<\/p>\n<h2>T\u00e9l\u00e9RC ou Cerfa : quel formulaire utiliser pour une rupture conventionnelle ?<\/h2>\n<p>Pour une rupture conventionnelle individuelle d&#8217;un salari\u00e9 en CDI, la demande d&#8217;homologation passe en principe par le service en ligne T\u00e9l\u00e9RC. Le minist\u00e8re du Travail rappelle que la t\u00e9l\u00e9transmission est le canal normal pour adresser la demande d&#8217;homologation \u00e0 l&#8217;administration.<\/p>\n<p>Le formulaire Cerfa n&#8217;a pas disparu pour autant : T\u00e9l\u00e9RC permet de saisir les informations, de g\u00e9n\u00e9rer un formulaire, puis de le faire signer. Le document sign\u00e9 reste essentiel, car il mat\u00e9rialise l&#8217;accord des parties et les conditions de la rupture. Pour certains cas particuliers, notamment le salari\u00e9 prot\u00e9g\u00e9, le formulaire adapt\u00e9 et la proc\u00e9dure d&#8217;autorisation doivent \u00eatre trait\u00e9s avec une vigilance renforc\u00e9e.<\/p>\n<p>Le point important est le suivant : un formulaire rempli ne suffit pas. La rupture conventionnelle doit \u00eatre sign\u00e9e, le d\u00e9lai de r\u00e9tractation doit expirer, puis la demande doit \u00eatre transmise \u00e0 l&#8217;administration comp\u00e9tente. Tant que cette cha\u00eene n&#8217;est pas compl\u00e8te, la rupture reste fragile.<\/p>\n<h2>Les erreurs qui provoquent un refus ou un blocage<\/h2>\n<p>Un refus d&#8217;homologation peut venir d&#8217;une erreur tr\u00e8s concr\u00e8te. Les plus fr\u00e9quentes sont les suivantes :<\/p>\n<ul>\n<li>une indemnit\u00e9 sp\u00e9cifique de rupture conventionnelle inf\u00e9rieure au minimum l\u00e9gal ou conventionnel ;<\/li>\n<li>une date de rupture fix\u00e9e trop t\u00f4t, avant le lendemain de l&#8217;homologation ;<\/li>\n<li>une demande envoy\u00e9e avant la fin du d\u00e9lai de r\u00e9tractation ;<\/li>\n<li>un formulaire incomplet ou incoh\u00e9rent ;<\/li>\n<li>une erreur sur l&#8217;anciennet\u00e9, le salaire de r\u00e9f\u00e9rence ou la convention collective ;<\/li>\n<li>l&#8217;absence de signature d&#8217;une partie ;<\/li>\n<li>un mauvais service administratif destinataire ;<\/li>\n<li>un dossier qui n&#8217;a jamais \u00e9t\u00e9 r\u00e9ellement transmis malgr\u00e9 ce qui a \u00e9t\u00e9 annonc\u00e9 au salari\u00e9.<\/li>\n<\/ul>\n<p>Ces erreurs n&#8217;ont pas toutes la m\u00eame gravit\u00e9. Certaines peuvent \u00eatre corrig\u00e9es par une nouvelle demande, si l&#8217;accord existe encore et si les parties signent un dossier r\u00e9gulier. D&#8217;autres peuvent r\u00e9v\u00e9ler un probl\u00e8me plus profond : pression sur le salari\u00e9, absence de remise d&#8217;un exemplaire, modification unilat\u00e9rale du document, ou d\u00e9part organis\u00e9 sans homologation valable.<\/p>\n<h2>Le d\u00e9lai de r\u00e9tractation est un point de contr\u00f4le central<\/h2>\n<p>Apr\u00e8s la signature de la convention, chaque partie dispose d&#8217;un d\u00e9lai de r\u00e9tractation de 15 jours calendaires. Ce d\u00e9lai prot\u00e8ge autant le salari\u00e9 que l&#8217;employeur. Il permet de revenir sur l&#8217;accord sans avoir \u00e0 justifier sa d\u00e9cision.<\/p>\n<p>La demande d&#8217;homologation ne doit pas \u00eatre envoy\u00e9e avant l&#8217;expiration de ce d\u00e9lai. Si le dossier est transmis trop t\u00f4t, l&#8217;administration peut refuser l&#8217;homologation. Surtout, une erreur sur la date de fin du d\u00e9lai de r\u00e9tractation peut ensuite nourrir un contentieux sur la validit\u00e9 de la rupture.<\/p>\n<p>En pratique, il faut v\u00e9rifier trois dates :<\/p>\n<ul>\n<li>la date de signature r\u00e9elle de la convention ;<\/li>\n<li>la date de fin du d\u00e9lai de r\u00e9tractation ;<\/li>\n<li>la date \u00e0 laquelle la demande a \u00e9t\u00e9 transmise \u00e0 l&#8217;administration.<\/li>\n<\/ul>\n<p>Il faut aussi conserver les preuves : exemplaire sign\u00e9, accus\u00e9 T\u00e9l\u00e9RC, courrier postal \u00e9ventuel, r\u00e9c\u00e9piss\u00e9 de d\u00e9p\u00f4t, message de refus, capture du dossier, \u00e9changes avec l&#8217;employeur ou le salari\u00e9.<\/p>\n<h2>Que faire si T\u00e9l\u00e9RC bloque avant l&#8217;envoi ?<\/h2>\n<p>Si T\u00e9l\u00e9RC bloque avant la transmission, il ne faut pas improviser une rupture hors proc\u00e9dure. Le bon r\u00e9flexe est de reprendre le dossier ligne par ligne :<\/p>\n<ul>\n<li>identit\u00e9 de l&#8217;employeur et du salari\u00e9 ;<\/li>\n<li>\u00e9tablissement concern\u00e9 ;<\/li>\n<li>convention collective applicable ;<\/li>\n<li>salaire de r\u00e9f\u00e9rence ;<\/li>\n<li>anciennet\u00e9 ;<\/li>\n<li>montant de l&#8217;indemnit\u00e9 sp\u00e9cifique ;<\/li>\n<li>date de signature ;<\/li>\n<li>date envisag\u00e9e de rupture ;<\/li>\n<li>assistance \u00e9ventuelle du salari\u00e9 ou de l&#8217;employeur ;<\/li>\n<li>coh\u00e9rence entre le formulaire et la convention sign\u00e9e.<\/li>\n<\/ul>\n<p>Si le blocage vient d&#8217;une donn\u00e9e erron\u00e9e, il faut corriger avant signature ou refaire signer un document propre. Si le document a d\u00e9j\u00e0 \u00e9t\u00e9 sign\u00e9 avec une erreur substantielle, la prudence consiste souvent \u00e0 recommencer la proc\u00e9dure plut\u00f4t qu&#8217;\u00e0 bricoler une correction manuscrite contestable.<\/p>\n<p>La rupture conventionnelle repose sur un consentement clair. Une modification unilat\u00e9rale du formulaire apr\u00e8s signature peut devenir un argument de contestation, notamment si elle touche les dates, le montant de l&#8217;indemnit\u00e9 ou les conditions de d\u00e9part.<\/p>\n<h2>Que faire si l&#8217;homologation est refus\u00e9e ?<\/h2>\n<p>Si l&#8217;administration refuse l&#8217;homologation, la rupture conventionnelle n&#8217;est pas valid\u00e9e. Le contrat de travail continue. Le salari\u00e9 ne doit pas \u00eatre consid\u00e9r\u00e9 comme sorti des effectifs au seul motif que les parties avaient sign\u00e9 une convention.<\/p>\n<p>Le refus doit \u00eatre lu pr\u00e9cis\u00e9ment. L&#8217;administration indique en principe le motif : indemnit\u00e9 insuffisante, d\u00e9lai non respect\u00e9, dossier incomplet, incoh\u00e9rence des dates, ou autre irr\u00e9gularit\u00e9. Selon le cas, deux options existent.<\/p>\n<p>La premi\u00e8re option est de d\u00e9poser une nouvelle demande r\u00e9guli\u00e8re. C&#8217;est souvent la voie la plus efficace lorsque l&#8217;erreur est mat\u00e9rielle et que les deux parties veulent toujours rompre le contrat.<\/p>\n<p>La seconde option est le contentieux. Les litiges relatifs \u00e0 la convention, \u00e0 l&#8217;homologation ou au refus d&#8217;homologation rel\u00e8vent du conseil de prud&#8217;hommes. Le d\u00e9lai d&#8217;action est strict : les contestations doivent \u00eatre engag\u00e9es dans le d\u00e9lai pr\u00e9vu par le Code du travail. Attendre plusieurs mois sans agir peut faire perdre une marge de manoeuvre importante.<\/p>\n<h2>Et si l&#8217;employeur dit que la DDETS a refus\u00e9, mais ne fournit aucun document ?<\/h2>\n<p>Le salari\u00e9 doit demander une copie du refus ou, au minimum, les r\u00e9f\u00e9rences pr\u00e9cises de la demande. Un refus d&#8217;homologation est un acte administratif concret, pas une formule vague. Si l&#8217;employeur affirme que le dossier a \u00e9t\u00e9 refus\u00e9 mais ne produit aucun courrier ni accus\u00e9, il faut v\u00e9rifier si la demande a bien \u00e9t\u00e9 transmise.<\/p>\n<p>Ce point est important car une rupture conventionnelle non homologu\u00e9e ne produit pas l&#8217;effet attendu. Si le salari\u00e9 a quitt\u00e9 l&#8217;entreprise sur la base d&#8217;un dossier non transmis ou non homologu\u00e9, la situation peut devenir contentieuse : salaires, rupture du contrat, documents de fin de contrat, assurance ch\u00f4mage, consentement du salari\u00e9.<\/p>\n<p>La jurisprudence r\u00e9cente rappelle r\u00e9guli\u00e8rement que l&#8217;homologation n&#8217;est pas une formalit\u00e9 d\u00e9corative. Elle conditionne la validit\u00e9 de la rupture. Dans un arr\u00eat de la cour d&#8217;appel de Paris du 12 juin 2024, la discussion portait notamment sur l&#8217;absence d&#8217;homologation effective apr\u00e8s une pr\u00e9tendue difficult\u00e9 administrative. Dans un arr\u00eat de la cour d&#8217;appel de Montpellier du 20 mai 2026, les juges ont aussi examin\u00e9 la question du d\u00e9lai de r\u00e9tractation et des corrections apport\u00e9es au formulaire.<\/p>\n<p>Pour le salari\u00e9, la priorit\u00e9 est donc de rassembler les preuves plut\u00f4t que de se contenter d&#8217;une explication orale.<\/p>\n<h2>Les pi\u00e8ces \u00e0 r\u00e9unir avant de contester ou de refaire une demande<\/h2>\n<p>Avant de saisir le conseil de prud&#8217;hommes ou de refaire une demande, pr\u00e9parez un dossier simple :<\/p>\n<ul>\n<li>la convention de rupture sign\u00e9e ;<\/li>\n<li>le formulaire T\u00e9l\u00e9RC ou Cerfa g\u00e9n\u00e9r\u00e9 ;<\/li>\n<li>les preuves de remise d&#8217;un exemplaire au salari\u00e9 ;<\/li>\n<li>les \u00e9changes de mails ou SMS sur la n\u00e9gociation ;<\/li>\n<li>l&#8217;accus\u00e9 de d\u00e9p\u00f4t ou de transmission ;<\/li>\n<li>le courrier de refus d&#8217;homologation ;<\/li>\n<li>les bulletins de salaire utiles au calcul de l&#8217;indemnit\u00e9 ;<\/li>\n<li>la convention collective applicable ;<\/li>\n<li>le solde de tout compte s&#8217;il a d\u00e9j\u00e0 \u00e9t\u00e9 remis ;<\/li>\n<li>l&#8217;attestation France Travail si elle a \u00e9t\u00e9 d\u00e9livr\u00e9e ;<\/li>\n<li>toute preuve de pression, menace, urgence impos\u00e9e ou absence de libert\u00e9 de consentement.<\/li>\n<\/ul>\n<p>Cette liste permet de distinguer un simple incident administratif d&#8217;un vrai risque de nullit\u00e9 ou de contestation de la rupture.<\/p>\n<h2>Le cas du salari\u00e9 d\u00e9j\u00e0 parti de l&#8217;entreprise<\/h2>\n<p>Si le salari\u00e9 a d\u00e9j\u00e0 cess\u00e9 de travailler alors que l&#8217;homologation est refus\u00e9e ou inexistante, la situation doit \u00eatre trait\u00e9e rapidement. Il faut v\u00e9rifier si le contrat est toujours en cours, si les salaires restent dus, si une absence injustifi\u00e9e peut \u00eatre reproch\u00e9e, et si l&#8217;employeur a remis les documents de fin de contrat sans base valable.<\/p>\n<p>Il ne faut pas laisser la situation se figer. Un salari\u00e9 qui reste sans salaire, sans emploi et sans rupture valable peut devoir agir vite pour faire constater ses droits. Un employeur qui laisse partir un salari\u00e9 sans homologation valable prend aussi un risque de contentieux prud&#8217;homal.<\/p>\n<p>Dans certains dossiers, la solution la plus propre consiste \u00e0 reprendre la proc\u00e9dure depuis le d\u00e9but. Dans d&#8217;autres, il faut contester la rupture, demander des rappels de salaire ou discuter la qualification de la fin du contrat.<\/p>\n<h2>Paris et \u00cele-de-France : quel service et quel conseil de prud&#8217;hommes ?<\/h2>\n<p>\u00c0 Paris et en \u00cele-de-France, la comp\u00e9tence administrative d\u00e9pend en pratique de l&#8217;\u00e9tablissement employeur concern\u00e9. Le Code du travail rattache la demande \u00e0 l&#8217;autorit\u00e9 administrative comp\u00e9tente du lieu o\u00f9 l&#8217;employeur est \u00e9tabli. Il faut donc v\u00e9rifier l&#8217;adresse de l&#8217;\u00e9tablissement, pas seulement le domicile du salari\u00e9.<\/p>\n<p>En cas de contentieux, le conseil de prud&#8217;hommes comp\u00e9tent d\u00e9pend notamment du lieu de travail, de l&#8217;\u00e9tablissement o\u00f9 le salari\u00e9 \u00e9tait rattach\u00e9 ou des r\u00e8gles proc\u00e9durales applicables. \u00c0 Paris, un dossier mal orient\u00e9 peut faire perdre du temps, surtout si l&#8217;urgence porte sur les salaires, les documents de fin de contrat ou la contestation d&#8217;un refus.<\/p>\n<p>Pour un salari\u00e9 ou un employeur francilien, le bon r\u00e9flexe est donc de pr\u00e9parer un dossier avec les adresses exactes, le num\u00e9ro SIRET de l&#8217;\u00e9tablissement, la convention collective, les documents T\u00e9l\u00e9RC et la chronologie compl\u00e8te.<\/p>\n<h2>Faut-il refaire la rupture conventionnelle ou saisir le conseil de prud&#8217;hommes ?<\/h2>\n<p>La r\u00e9ponse d\u00e9pend de trois questions.<\/p>\n<p>Premi\u00e8re question : les deux parties veulent-elles toujours rompre le contrat ? Si oui, et si l&#8217;erreur est seulement mat\u00e9rielle, une nouvelle demande peut \u00eatre la solution la plus rapide.<\/p>\n<p>Deuxi\u00e8me question : le consentement du salari\u00e9 \u00e9tait-il libre ? Si le salari\u00e9 a \u00e9t\u00e9 pouss\u00e9 \u00e0 signer, priv\u00e9 de son exemplaire, menac\u00e9 ou tromp\u00e9 sur ses droits, refaire un formulaire ne r\u00e8gle pas n\u00e9cessairement le probl\u00e8me.<\/p>\n<p>Troisi\u00e8me question : le contrat a-t-il d\u00e9j\u00e0 \u00e9t\u00e9 rompu en pratique ? Si le salari\u00e9 est sorti des effectifs, si les documents de fin de contrat ont \u00e9t\u00e9 remis ou si France Travail refuse une prise en charge faute d&#8217;homologation, il faut analyser les cons\u00e9quences imm\u00e9diatement.<\/p>\n<p>La rupture conventionnelle est utile lorsqu&#8217;elle est pr\u00e9par\u00e9e proprement.
