Des \u00e9poux locataires depuis plus de vingt ans se sont vu d\u00e9livrer un commandement visant la clause r\u00e9solutoire pour d\u00e9faut de justification d&#8217;une assurance des risques locatifs, ainsi qu&#8217;une mise en demeure de payer un arri\u00e9r\u00e9 locatif. Le tribunal de premi\u00e8re instance a constat\u00e9 la r\u00e9siliation du bail et condamn\u00e9 les locataires au paiement de la dette et d&#8217;une indemnit\u00e9 d&#8217;occupation. Les locataires ont relev\u00e9 appel, invoquant leur bonne foi, l&#8217;absence de gravit\u00e9 du retard de loyer, et un manquement du bailleur \u00e0 son obligation de loyaut\u00e9 pour ne pas avoir souscrit une assurance pour leur compte. La question de droit centrale \u00e9tait de savoir si un locataire peut \u00e9chapper \u00e0 la r\u00e9siliation de plein droit du bail pour d\u00e9faut d&#8217;assurance en se pr\u00e9valant de sa situation personnelle, de son anciennet\u00e9 dans les lieux ou d&#8217;un pr\u00e9tendu devoir de loyaut\u00e9 du bailleur. La cour a confirm\u00e9 le jugement en toutes ses dispositions, estimant que les appelants ne justifiaient ni d&#8217;une assurance couvrant la p\u00e9riode litigieuse, ni d&#8217;un comportement d\u00e9loyal du bailleur. Pour appr\u00e9cier la port\u00e9e de cette solution, il convient d&#8217;examiner la rigueur avec laquelle la cour applique la clause r\u00e9solutoire pour d\u00e9faut d&#8217;assurance (I), avant d&#8217;analyser les limites de la protection accord\u00e9e au locataire dans ce cadre (II).<\/p>\n<h2 id=\"i-la-confirmation-rigoureuse-de-lacquisition-de-la-clause-resolutoire-pour-defau\">I. La confirmation rigoureuse de l&#8217;acquisition de la clause r\u00e9solutoire pour d\u00e9faut d&#8217;assurance<\/h2>\n<p>La cour d&#8217;appel fait pr\u00e9valoir le respect strict des conditions l\u00e9gales de la clause r\u00e9solutoire sur les consid\u00e9rations personnelles du locataire. Elle rappelle d&#8217;abord les prescriptions imp\u00e9ratives de l&#8217;article 7 g de la loi du 6 juillet 1989 avant d&#8217;\u00e9carter les circonstances subjectives invoqu\u00e9es par les appelants.<\/p>\n<h3 id=\"a-le-rappel-des-conditions-imperatives-posees-par-larticle-7-g-de-la-loi-du-6-ju\">A. Le rappel des conditions imp\u00e9ratives pos\u00e9es par l&#8217;article 7 g de la loi du 6 juillet 1989<\/h3>\n<p>La cour souligne que l&#8217;obligation d&#8217;assurance pour le locataire est une condition essentielle du contrat de bail. Elle \u00e9nonce que <em>&#8220;le locataire est tenu de s&#8217;assurer contre les risques dont il doit r\u00e9pondre en sa qualit\u00e9 de locataire et d&#8217;en justifier lors de la remise des cl\u00e9s puis, chaque ann\u00e9e, \u00e0 la demande du bailleur&#8221;<\/em>. Ce rappel du texte est fondamental pour mesurer l&#8217;exigence pos\u00e9e au preneur. Les magistrats insistent sur le fait que la mise en \u0153uvre de la clause r\u00e9solutoire n&#8217;est possible qu&#8217;apr\u00e8s un commandement demeur\u00e9 infructueux pendant un mois, lequel doit reproduire les dispositions l\u00e9gales \u00e0 peine de nullit\u00e9. En l&#8217;esp\u00e8ce, le commandement d\u00e9livr\u00e9 aux locataires \u00e9tait r\u00e9gulier et visait express\u00e9ment la clause r\u00e9solutoire. La cour de c\u00e9ans reprend ainsi une solution constante, mais elle en fait une application particuli\u00e8rement stricte en ne retenant que la date d&#8217;effet de la r\u00e9siliation fix\u00e9e initialement. Elle refuse de consid\u00e9rer la possibilit\u00e9 offerte au bailleur par l&#8217;alin\u00e9a suivant de l&#8217;article 7 g, qui permet \u00e0 ce dernier de souscrire une assurance pour le compte du locataire et de renoncer ainsi \u00e0 la clause r\u00e9solutoire. La cour estime que le bailleur a agi <em>&#8220;sur le double fondement du d\u00e9faut d&#8217;assurance et de l&#8217;arri\u00e9r\u00e9 locatif&#8221;<\/em>, ce qui ne caract\u00e9rise pas une d\u00e9loyaut\u00e9. Cette position confirme que l&#8217;option de souscription d&#8217;assurance par le bailleur est une facult\u00e9, non une obligation.<\/p>\n<h3 id=\"b-lecartement-des-circonstances-personnelles-invoquees-par-les-locataires\">B. L&#8217;\u00e9cartement des circonstances personnelles invoqu\u00e9es par les locataires<\/h3>\n<p>Les appelants tentaient de faire valoir leur situation familiale et professionnelle difficile, leur anciennet\u00e9 de vingt et un ans dans les lieux, et leur absence d&#8217;incident ant\u00e9rieur. Ils soutenaient que ces \u00e9l\u00e9ments devaient conduire \u00e0 \u00e9carter la r\u00e9siliation. La cour oppose une fin de non-recevoir cat\u00e9gorique : elle retient que <em>&#8220;les appelants ne justifient ni d&#8217;une assurance locative couvrant la p\u00e9riode concern\u00e9e par le commandement, ni de la d\u00e9loyaut\u00e9 de la soci\u00e9t\u00e9 Alliade Habitat&#8221;<\/em>. Cette motivation r\u00e9v\u00e8le que le juge se place sur le terrain exclusif de l&#8217;inex\u00e9cution contractuelle objective. La bonne foi du locataire, pourtant reconnue par l&#8217;article 1104 du Code civil, ne saurait suppl\u00e9er l&#8217;absence de justification d&#8217;assurance. Cette approche est coh\u00e9rente avec la jurisprudence ant\u00e9rieure de la Cour d&#8217;appel de Dijon qui, dans un arr\u00eat du 25 f\u00e9vrier 2025, avait d\u00e9j\u00e0 constat\u00e9 la r\u00e9siliation du bail en relevant qu&#8217;<em>&#8220;aucune attestation d&#8217;assurance n&#8217;a \u00e9t\u00e9 fournie aux \u00e9poux [Y], post\u00e9rieurement au 6 d\u00e9cembre 2022&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67beb16523c145b107d5920e\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Dijon, 25 f\u00e9vrier 2025, n\u00b024\/00167)<\/a><\/strong>. De m\u00eame, la Cour d&#8217;appel de Grenoble a jug\u00e9, le 25 mars 2025, que le seul d\u00e9faut de justification d&#8217;assurance suffit \u00e0 entra\u00eener l&#8217;acquisition de la clause r\u00e9solutoire, sans qu&#8217;il soit besoin d&#8217;examiner le d\u00e9faut de paiement <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67e39cf22b19620bb73a2221\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Grenoble, 25 mars 2025, n\u00b024\/02903)<\/a><\/strong>. La cour de Lyon s&#8217;inscrit dans ce mouvement jurisprudentiel rigoureux.<\/p>\n<h2 id=\"ii-les-limites-de-la-protection-du-locataire-face-a-la-rigueur-contractuelle\">II. Les limites de la protection du locataire face \u00e0 la rigueur contractuelle<\/h2>\n<p>Si la r\u00e9siliation est acquise pour d\u00e9faut d&#8217;assurance, la cour op\u00e8re un traitement diff\u00e9renci\u00e9 de l&#8217;arri\u00e9r\u00e9 locatif et \u00e9carte tout manquement du bailleur \u00e0 son devoir de loyaut\u00e9.<\/p>\n<h3 id=\"a-la-distinction-nette-entre-la-dette-de-loyer-et-le-defaut-dassurance\">A. La distinction nette entre la dette de loyer et le d\u00e9faut d&#8217;assurance<\/h3>\n<p>La cour confirme la condamnation des locataires au paiement de l&#8217;arri\u00e9r\u00e9 locatif de 1 078,10 euros, mais elle prend soin de pr\u00e9ciser que <em>&#8220;la r\u00e9siliation du bail n&#8217;est constat\u00e9e qu&#8217;au titre du d\u00e9faut d&#8217;assurance&#8221;<\/em>. Cette distinction est importante : le retard de loyer, m\u00eame ponctuel et de faible ampleur, justifie une condamnation au paiement, mais il n&#8217;est pas la cause de la r\u00e9siliation. Les appelants invoquaient pourtant la modicit\u00e9 de leur arri\u00e9r\u00e9 apr\u00e8s vingt et un ans d&#8217;occupation sans incident. La cour rejette cet argument en relevant qu&#8217;<em>&#8220;ils ne contestent pas leur dette de loyer&#8221;<\/em> et <em>&#8220;ne justifient pas s&#8217;\u00eatre acquitt\u00e9s de la somme demand\u00e9e&#8221;<\/em>. Cette solution r\u00e9v\u00e8le que le juge dissocie strictement les obligations contractuelles : le paiement du loyer et l&#8217;assurance sont deux obligations distinctes, chacune sanctionn\u00e9e selon ses propres r\u00e8gles. Le locataire ne peut donc pas opposer un paiement partiel ou tardif pour se soustraire \u00e0 l&#8217;obligation d&#8217;assurance. Cette position est conforme \u00e0 la lettre de l&#8217;article 7 g, qui ne subordonne pas la r\u00e9siliation pour d\u00e9faut d&#8217;assurance \u00e0 l&#8217;existence d&#8217;un arri\u00e9r\u00e9 locatif.<\/p>\n<h3 id=\"b-le-rejet-du-moyen-tire-de-lobligation-de-loyaute-du-bailleur\">B. Le rejet du moyen tir\u00e9 de l&#8217;obligation de loyaut\u00e9 du bailleur<\/h3>\n<p>Les appelants soutenaient que le bailleur avait manqu\u00e9 \u00e0 son devoir de loyaut\u00e9 en n&#8217;optant pas pour la souscription d&#8217;une assurance pour leur compte, alors qu&#8217;il connaissait leurs difficult\u00e9s avec la langue fran\u00e7aise. La cour \u00e9carte ce moyen en retenant que la bailleresse a agi <em>&#8220;sur le double fondement du d\u00e9faut d&#8217;assurance et de l&#8217;arri\u00e9r\u00e9 locatif&#8221;<\/em>, ce qui ne constitue pas une d\u00e9loyaut\u00e9 contractuelle. Les magistrats estiment que le bailleur n&#8217;est pas tenu de privil\u00e9gier la voie de la souscription d&#8217;assurance plut\u00f4t que celle de la clause r\u00e9solutoire. Cette interpr\u00e9tation est importante car elle d\u00e9limite la port\u00e9e de l&#8217;obligation de loyaut\u00e9 dans les baux d&#8217;habitation. Le bailleur conserve un choix discr\u00e9tionnaire entre les deux options offertes par l&#8217;article 7 g : soit mettre en \u0153uvre la clause r\u00e9solutoire, soit souscrire une assurance pour le compte du locataire. Aucun devoir d&#8217;information renforc\u00e9 ne p\u00e8se sur lui, m\u00eame en pr\u00e9sence de locataires vuln\u00e9rables. La cour souligne en outre que <em>&#8220;les appelants ne justifient [&#8230;] ni de la d\u00e9loyaut\u00e9 de la soci\u00e9t\u00e9 Alliade Habitat&#8221;<\/em>. Cette motivation sugg\u00e8re que la charge de la preuve de la d\u00e9loyaut\u00e9 incombe au locataire, et que celui-ci ne peut se contenter d&#8217;all\u00e9guer des difficult\u00e9s personnelles pour renverser cette charge.
