Apr\u00e8s ce classement, il n\u2019a plus re\u00e7u ses fiches de paie et n\u2019a pas \u00e9t\u00e9 convoqu\u00e9 \u00e0 une visite m\u00e9dicale de reprise. En 2019, il a demand\u00e9 la liquidation de sa retraite compl\u00e9mentaire, puis a re\u00e7u ses documents de fin de contrat. En 2022, sur saisine en r\u00e9f\u00e9r\u00e9, une visite de reprise a \u00e9t\u00e9 organis\u00e9e, mais le m\u00e9decin du travail n\u2019a pu \u00e9mettre d\u2019avis. Saisi d\u2019une demande de nullit\u00e9 du licenciement pour discrimination fond\u00e9e sur l\u2019\u00e2ge, le conseil de prud\u2019hommes de Nancy a rejet\u00e9 ses pr\u00e9tentions par jugement du 1er juillet 2025. Le salari\u00e9 a interjet\u00e9 appel.<\/p>\n<p>Devant la cour, le salari\u00e9 soutenait que la rupture lui avait \u00e9t\u00e9 impos\u00e9e par l\u2019employeur en raison de son \u00e2ge, celui-ci ayant remis les documents de fin de contrat d\u00e8s qu\u2019il avait \u00e9t\u00e9 inform\u00e9 de la liquidation de ses droits \u00e0 la retraite. L\u2019employeur r\u00e9pliquait que le salari\u00e9 avait manifest\u00e9 une volont\u00e9 claire et non \u00e9quivoque de partir en retraite en demandant la liquidation de sa retraite compl\u00e9mentaire, et que son placement en invalidit\u00e9 ne l\u2019avait pas emp\u00each\u00e9 de prendre cette initiative.<\/p>\n<p>La question de droit centrale portait sur la qualification de la rupture du contrat de travail d\u2019un salari\u00e9 invalide qui, sans avoir formellement demand\u00e9 son d\u00e9part \u00e0 la retraite, sollicite la liquidation de sa retraite compl\u00e9mentaire apr\u00e8s avoir \u00e9t\u00e9 plac\u00e9 en invalidit\u00e9. Par arr\u00eat contradictoire rendu le 30 avril 2026, la Cour d\u2019appel de Nancy, chambre sociale, a confirm\u00e9 le jugement d\u00e9f\u00e9r\u00e9 en toutes ses dispositions. Elle a jug\u00e9 qu\u2019en demandant la liquidation de ses droits \u00e0 la retraite compl\u00e9mentaire, le salari\u00e9 avait manifest\u00e9 de fa\u00e7on claire et non \u00e9quivoque sa volont\u00e9 de partir en retraite, excluant ainsi toute qualification de licenciement.<\/p>\n<h2 id=\"i-la-qualification-de-la-rupture-par-la-volonte-claire-et-non-equivoque-du-salar\">I. La qualification de la rupture par la volont\u00e9 claire et non \u00e9quivoque du salari\u00e9<\/h2>\n<p><\/p>\n<h3 id=\"a-lexigence-dun-acte-unilateral-non-equivoque-du-salarie\">A. L\u2019exigence d\u2019un acte unilat\u00e9ral non \u00e9quivoque du salari\u00e9<\/h3>\n<p>La cour rappelle que le d\u00e9part \u00e0 la retraite est un acte unilat\u00e9ral par lequel le salari\u00e9 manifeste de fa\u00e7on claire et non \u00e9quivoque sa volont\u00e9 de mettre fin au contrat de travail, conform\u00e9ment \u00e0 l\u2019article L1237-9 du code du travail. En l\u2019esp\u00e8ce, elle constate que le salari\u00e9 a demand\u00e9 la liquidation de sa retraite compl\u00e9mentaire en 2019, sans qu\u2019aucune contrainte ext\u00e9rieure ne soit d\u00e9montr\u00e9e. Elle \u00e9carte ainsi l\u2019argument selon lequel cette demande serait automatique ou impos\u00e9e par l\u2019employeur. La cour retient que l\u2019int\u00e9ress\u00e9 n\u2019a pas saisi la juridiction prud\u2019homale d\u2019une demande de r\u00e9siliation judiciaire du contrat pour manquement de l\u2019employeur \u00e0 son obligation de provoquer une visite de reprise. Ce silence d\u00e9montre, selon elle, une absence de contestation de la poursuite du contrat avant la demande de liquidation.<\/p>\n<h3 id=\"b-la-portee-de-la-demande-de-retraite-complementaire-comme-manifestation-de-volo\">B. La port\u00e9e de la demande de retraite compl\u00e9mentaire comme manifestation de volont\u00e9<\/h3>\n<p>L\u2019article 101 de l\u2019Accord National Interprofessionnel du 17 novembre 2017 pr\u00e9voit que le versement de la retraite compl\u00e9mentaire n\u2019est pas automatique mais doit \u00eatre demand\u00e9 par le salari\u00e9. La cour en d\u00e9duit que la d\u00e9marche de l\u2019appelant ne pouvait \u00eatre interpr\u00e9t\u00e9e comme une simple formalit\u00e9 administrative. Elle souligne qu\u2019il n\u2019a pas d\u00e9montr\u00e9 avoir sollicit\u00e9 un maintien dans l\u2019emploi ou une reprise d\u2019activit\u00e9 apr\u00e8s son placement en invalidit\u00e9. Cette solution s\u2019inscrit dans une ligne jurisprudentielle constante : un arr\u00eat de la Cour d\u2019appel de Paris du 12 f\u00e9vrier 2025 avait d\u00e9j\u00e0 jug\u00e9 que <em>&#8221; l\u2019\u00e2ge de mise en inactivit\u00e9 \u00e0 l\u2019initiative de l\u2019employeur \u00e9tait fix\u00e9 \u00e0 65 ans &#8220;<\/em>, mais en l\u2019esp\u00e8ce, c\u2019est la demande de retraite compl\u00e9mentaire qui constitue l\u2019\u00e9l\u00e9ment d\u00e9terminant. La cour rejette donc la qualification de licenciement, estimant que le salari\u00e9 a librement d\u00e9cid\u00e9 de mettre fin \u00e0 la relation de travail.<\/p>\n<h2 id=\"ii-les-consequences-de-la-qualification-sur-les-obligations-de-lemployeur\">II. Les cons\u00e9quences de la qualification sur les obligations de l\u2019employeur<\/h2>\n<p><\/p>\n<h3 id=\"a-labsence-de-manquement-de-lemployeur-a-son-obligation-de-reprise\">A. L\u2019absence de manquement de l\u2019employeur \u00e0 son obligation de reprise<\/h3>\n<p>Le salari\u00e9 reprochait \u00e0 l\u2019employeur de ne pas avoir organis\u00e9 la visite m\u00e9dicale de reprise apr\u00e8s son placement en invalidit\u00e9. La cour \u00e9carte ce moyen en relevant que l\u2019int\u00e9ress\u00e9 n\u2019a jamais formul\u00e9 de demande en ce sens avant 2022 et n\u2019a pas sollicit\u00e9 la r\u00e9siliation judiciaire du contrat pour ce motif. Elle adopte ainsi une position stricte : l\u2019employeur n\u2019est tenu de provoquer la visite que si le salari\u00e9 manifeste sa volont\u00e9 de reprendre le travail. Cette solution est conforme \u00e0 l\u2019\u00e9tat du droit ant\u00e9rieur \u00e0 2011, \u00e9voqu\u00e9 par l\u2019employeur, et n\u2019est pas remise en cause par les dispositions plus r\u00e9centes. La cour confirme donc que la rupture \u00e9tant un d\u00e9part volontaire, l\u2019employeur n\u2019a pas commis de faute susceptible d\u2019entra\u00eener la nullit\u00e9 du licenciement.<\/p>\n<h3 id=\"b-le-rejet-de-la-demande-de-discrimination-fondee-sur-lage\">B. Le rejet de la demande de discrimination fond\u00e9e sur l\u2019\u00e2ge<\/h3>\n<p>Le salari\u00e9 all\u00e9guait une rupture discriminatoire au motif de son \u00e2ge, l\u2019employeur ayant attendu qu\u2019il atteigne l\u2019\u00e2ge de 62 ans pour lui remettre ses documents de fin de contrat. La cour ne retient pas cette argumentation, car elle estime que la rupture proc\u00e8de de la volont\u00e9 du salari\u00e9 lui-m\u00eame. D\u00e8s lors, aucun \u00e9l\u00e9ment objectif ne permet d\u2019\u00e9tablir que l\u2019employeur a pris l\u2019initiative de la rupture en raison de l\u2019\u00e2ge. Un arr\u00eat de la Cour d\u2019appel de Versailles du 13 mars 2025 avait retenu que des <em>&#8221; faits permettent de constater que la soci\u00e9t\u00e9 s\u2019est engag\u00e9e dans un plan de r\u00e9duction du co\u00fbt horaire et de baisse de l\u2019\u00e2ge moyen des salari\u00e9s &#8220;<\/em>, mais en l\u2019esp\u00e8ce, aucun plan similaire n\u2019est d\u00e9montr\u00e9.
