L\u2019insuffisance des \u00e9l\u00e9ments avanc\u00e9s par l\u2019employeur pour justifier une mesure d\u2019expertise judiciaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Par un jugement contradictoire en date du 27 mars 2026, le p\u00f4le social du tribunal judiciaire de Lyon a \u00e9t\u00e9 saisi d\u2019un litige opposant une employeur \u00e0 la caisse primaire d\u2019assurance maladie du Rh\u00f4ne. Un salari\u00e9, victime le 20 septembre 2018 d\u2019un accident du travail ayant occasionn\u00e9 une contusion \u00e0 la main gauche, a b\u00e9n\u00e9fici\u00e9 d\u2019arr\u00eats de travail prolong\u00e9s jusqu\u2019au 28 f\u00e9vrier 2020. L\u2019employeur, sans contester la mat\u00e9rialit\u00e9 de l\u2019accident, a sollicit\u00e9 l\u2019inopposabilit\u00e9 de la prise en charge de l\u2019ensemble des arr\u00eats de travail et, \u00e0 titre subsidiaire, une expertise m\u00e9dicale judiciaire. La CPAM a conclu au rejet de l\u2019ensemble de ces pr\u00e9tentions.<br \/>\u00c0 l\u2019issue d\u2019un recours pr\u00e9alable aupr\u00e8s de la commission m\u00e9dicale de recours amiable, l\u2019employeur a saisi le tribunal. Il soutenait que l\u2019absence de transmission des certificats m\u00e9dicaux, en particulier les certificats de prolongation, au m\u00e9decin consultant d\u00e9sign\u00e9 par ses soins constituait une violation du contradictoire. Il faisait valoir que cette carence devait entra\u00eener l\u2019inopposabilit\u00e9 de la d\u00e9cision de prise en charge. La CPAM r\u00e9pondait qu\u2019aucune obligation l\u00e9gale ne lui imposait une telle transmission et que le secret m\u00e9dical faisait obstacle \u00e0 cette demande.<br \/>La question de droit soumise au tribunal \u00e9tait double. Premi\u00e8rement, l\u2019absence de communication au m\u00e9decin consultant de l\u2019employeur des pi\u00e8ces m\u00e9dicales d\u00e9tenues par le service du contr\u00f4le m\u00e9dical, au stade du recours amiable, est-elle sanctionn\u00e9e par l\u2019inopposabilit\u00e9 de la d\u00e9cision de prise en charge ? Deuxi\u00e8mement, l\u2019employeur peut-il obtenir une expertise m\u00e9dicale judiciaire pour contester la pr\u00e9somption d\u2019imputabilit\u00e9 des arr\u00eats de travail en se fondant sur de simples doutes ou des \u00e9l\u00e9ments non probants ?<br \/>Le tribunal a rejet\u00e9 l\u2019int\u00e9gralit\u00e9 des demandes de l\u2019employeur. Il a jug\u00e9 que l\u2019absence de transmission des certificats m\u00e9dicaux au m\u00e9decin consultant ne pouvait entra\u00eener l\u2019inopposabilit\u00e9, d\u00e8s lors que l\u2019employeur disposait de la facult\u00e9 de porter son recours devant la juridiction de s\u00e9curit\u00e9 sociale et d\u2019obtenir communication du rapport m\u00e9dical dans ce cadre. Il a \u00e9galement estim\u00e9 que la demande d\u2019expertise n\u2019\u00e9tait pas fond\u00e9e, l\u2019employeur ne rapportant aucun commencement de preuve d\u2019une cause totalement \u00e9trang\u00e8re au travail susceptible de renverser la pr\u00e9somption d\u2019imputabilit\u00e9.<\/p>\n<h2 id=\"i-lopposabilite-maintenue-de-la-decision-de-prise-en-charge-en-depit-de-labsence\">I. L\u2019opposabilit\u00e9 maintenue de la d\u00e9cision de prise en charge en d\u00e9pit de l\u2019absence de transmission m\u00e9dicale au stade amiable<\/h2>\n<p><\/p>\n<h3 id=\"a-labsence-dobligation-de-transmission-sous-peine-dinopposabilite-en-labsence-de\">A. L\u2019absence d\u2019obligation de transmission sous peine d\u2019inopposabilit\u00e9 en l\u2019absence de sanction l\u00e9gale<\/h3>\n<p>Le tribunal a \u00e9cart\u00e9 le moyen d\u2019inopposabilit\u00e9 soulev\u00e9 par l\u2019employeur en relevant qu\u2019aucune disposition l\u00e9gale n\u2019assortit de sanction le d\u00e9faut de transmission du rapport m\u00e9dical au stade du recours amiable. Il a pr\u00e9cis\u00e9 que les d\u00e9lais impartis au praticien-conseil pour transmettre ce rapport \u00e0 la commission m\u00e9dicale de recours amiable ne sont assortis d\u2019aucune sanction. Cette solution est conforme \u00e0 la lettre des textes applicables. Les articles L. 142-6 et R. 142-8-3 du code de la s\u00e9curit\u00e9 sociale organisent la proc\u00e9dure pr\u00e9alable sans pr\u00e9voir de cons\u00e9quences juridiques en cas d\u2019inobservation des d\u00e9lais de transmission. Le tribunal a logiquement d\u00e9duit que l\u2019absence de communication des certificats m\u00e9dicaux au m\u00e9decin consultant de l\u2019employeur ne saurait entra\u00eener l\u2019inopposabilit\u00e9 de la d\u00e9cision de prise en charge.<br \/>La CPAM soutenait que les services administratifs ne disposent pas du rapport m\u00e9dical, d\u00e9tenu par le service m\u00e9dical relevant de la Caisse nationale d\u2019assurance maladie. Le tribunal a valid\u00e9 cette argumentation en soulignant que l\u2019employeur disposait d\u2019autres voies pour exercer son pouvoir de contr\u00f4le. Notamment, il pouvait solliciter une contre-visite m\u00e9dicale ou demander \u00e0 la caisse de d\u00e9clencher un contr\u00f4le m\u00e9dical. Force est de constater que l\u2019employeur n\u2019a utilis\u00e9 aucun de ces moyens. La jurisprudence de la Cour d\u2019appel de Rennes vient confirmer cette analyse en rappelant que <em>&#8220;l&#8217;obligation impos\u00e9e \u00e0 la caisse porte sur l&#8217;ensemble des documents qu&#8217;elle d\u00e9tient en vertu d&#8217;une d\u00e9rogation au secret m\u00e9dical pr\u00e9vue par la loi&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67c0010926e434f8e04c610e\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Rennes, 26 f\u00e9vrier 2025, n\u00b022\/01180)<\/a><\/strong>. L\u2019obligation existe certes, mais son inex\u00e9cution au stade amiable n\u2019est pas sanctionn\u00e9e par l\u2019inopposabilit\u00e9.<\/p>\n<h3 id=\"b-lacces-au-rapport-medical-garanti-par-la-voie-contentieuse-comme-substitut-pro\">B. L\u2019acc\u00e8s au rapport m\u00e9dical garanti par la voie contentieuse comme substitut proc\u00e9dural effectif<\/h3>\n<p>Le tribunal a consid\u00e9r\u00e9 que l\u2019employeur n\u2019est pas d\u00e9pourvu de tout recours. Il peut porter son litige devant la juridiction de s\u00e9curit\u00e9 sociale apr\u00e8s l\u2019expiration du d\u00e9lai de rejet implicite de quatre mois pr\u00e9vu \u00e0 l\u2019article R. 142-8-5 du code de la s\u00e9curit\u00e9 sociale. Dans ce cadre, il peut obtenir la communication du rapport m\u00e9dical dans les conditions des articles L. 142-10 et R. 142-16-3 du m\u00eame code. Cette solution pr\u00e9serve l\u2019\u00e9quilibre entre le principe du contradictoire et le secret m\u00e9dical. La Cour d\u2019appel de Lyon a d\u2019ailleurs rappel\u00e9 que <em>&#8220;l&#8217;article L. 142-10 (&#8230;) pr\u00e9voit que le praticien-conseil transmet \u00e0 l&#8217;expert ou au m\u00e9decin consultant d\u00e9sign\u00e9 par la juridiction comp\u00e9tente (&#8230;) l&#8217;int\u00e9gralit\u00e9 du rapport m\u00e9dical ayant fond\u00e9 sa d\u00e9cision&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67ac3df45a940b7d9cd968b2\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Lyon, 11 f\u00e9vrier 2025, n\u00b022\/03603)<\/a><\/strong>. La garantie proc\u00e9durale est donc effective, mais elle se situe au stade contentieux et non au stade amiable.<br \/>Le tribunal a ainsi op\u00e9r\u00e9 une distinction nette entre deux phases proc\u00e9durales. Au stade du recours amiable, l\u2019absence de transmission ne vicie pas la d\u00e9cision de la caisse. L\u2019employeur conserve la facult\u00e9, en saisissant le tribunal, de faire valoir ses droits dans le respect du contradictoire. Cette solution est pragmatique et conforme \u00e0 la construction l\u00e9gislative. Elle \u00e9vite que la carence d\u2019une commission administrative paralyse la gestion des risques professionnels. En l\u2019esp\u00e8ce, l\u2019employeur n\u2019a pas d\u00e9montr\u00e9 avoir \u00e9t\u00e9 emp\u00each\u00e9 d\u2019acc\u00e9der aux informations m\u00e9dicales utiles dans le cadre de la proc\u00e9dure judiciaire. Le rejet de la demande d\u2019inopposabilit\u00e9 est donc juridiquement fond\u00e9.<\/p>\n<h2 id=\"ii-le-maintien-de-la-presomption-dimputabilite-des-arrets-de-travail-faute-de-pr\">II. Le maintien de la pr\u00e9somption d\u2019imputabilit\u00e9 des arr\u00eats de travail faute de preuve contraire rapport\u00e9e par l\u2019employeur<\/h2>\n<p><\/p>\n<h3 id=\"a-la-continuite-des-symptomes-et-des-soins-comme-fondement-du-benefice-de-la-pre\">A. La continuit\u00e9 des sympt\u00f4mes et des soins comme fondement du b\u00e9n\u00e9fice de la pr\u00e9somption<\/h3>\n<p>Le tribunal a rappel\u00e9 le principe de la pr\u00e9somption d\u2019imputabilit\u00e9 \u00e9dict\u00e9 par l\u2019article L. 411-1 du code de la s\u00e9curit\u00e9 sociale. Cette pr\u00e9somption s\u2019applique \u00e0 l\u2019ensemble des soins et arr\u00eats de travail prescrits \u00e0 la suite d\u2019un accident du travail, d\u00e8s lors que la continuit\u00e9 des sympt\u00f4mes et des soins est \u00e9tablie. En l\u2019esp\u00e8ce, le certificat m\u00e9dical initial du 20 septembre 2018 faisait \u00e9tat d\u2019une contusion \u00e0 la main gauche. Le salari\u00e9 a b\u00e9n\u00e9fici\u00e9 de prolongations d\u2019arr\u00eat ininterrompues jusqu\u2019au 28 f\u00e9vrier 2020. Le tribunal a relev\u00e9 que les l\u00e9sions initiales et les prescriptions \u00e9taient coh\u00e9rentes avec la nature de l\u2019accident, ce qui justifiait l\u2019application de la pr\u00e9somption.<br \/>Il a \u00e9galement soulign\u00e9 que la pr\u00e9somption s\u2019\u00e9tend aux l\u00e9sions nouvelles apparues dans les suites de l\u2019accident, ainsi qu\u2019\u00e0 l\u2019\u00e9tat pathologique ant\u00e9rieur aggrav\u00e9 par celui-ci. Le service m\u00e9dical a jug\u00e9 les arr\u00eats de travail justifi\u00e9s en f\u00e9vrier 2019, et les indemnit\u00e9s journali\u00e8res vers\u00e9es sont toutes rattach\u00e9es \u00e0 l\u2019accident initial jusqu\u2019\u00e0 la consolidation. Cette continuit\u00e9, parfaitement caract\u00e9ris\u00e9e, emp\u00eache l\u2019employeur de remettre en cause l\u2019imputabilit\u00e9 sans rapporter une preuve s\u00e9rieuse. Le tribunal a fait application d\u2019une jurisprudence constante qui impose \u00e0 l\u2019employeur de d\u00e9montrer l\u2019existence d\u2019un \u00e9tat pathologique pr\u00e9existant \u00e9voluant pour son propre compte ou d\u2019une cause post\u00e9rieure totalement \u00e9trang\u00e8re au travail.<\/p>\n<h3 id=\"b-linsuffisance-des-elements-avances-par-lemployeur-pour-justifier-une-mesure-de\">B. L\u2019insuffisance des \u00e9l\u00e9ments avanc\u00e9s par l\u2019employeur pour justifier une mesure d\u2019expertise judiciaire<\/h3>\n<p>L\u2019employeur fondait sa demande d\u2019expertise sur une photographie publi\u00e9e en ao\u00fbt 2019 sur le r\u00e9seau social du salari\u00e9, le montrant participant \u00e0 une reconstitution historique. Il en d\u00e9duisait que le salari\u00e9 n\u2019\u00e9tait pas r\u00e9ellement incapable de travailler. Le tribunal a \u00e9cart\u00e9 cet \u00e9l\u00e9ment avec une grande fermet\u00e9. Il a d\u2019abord relev\u00e9 qu\u2019aucun \u00e9l\u00e9ment ne permettait de dater cette photographie avec certitude. Sa simple apparition en ao\u00fbt 2019 ne prouvait pas que l\u2019activit\u00e9 repr\u00e9sent\u00e9e avait eu lieu \u00e0 cette p\u00e9riode. Ensuite, le tribunal a rappel\u00e9 qu\u2019il revient aux professionnels de sant\u00e9 d\u2019appr\u00e9cier la dur\u00e9e des arr\u00eats de travail, dans le cadre de leurs comp\u00e9tences, et que les r\u00e9f\u00e9rentiels m\u00e9dicaux ne sont qu\u2019indicatifs.<br \/>Le tribunal a fait application de l\u2019article 146 du code de proc\u00e9dure civile, selon lequel une expertise ne peut suppl\u00e9er la carence probatoire d\u2019une partie. Les doutes exprim\u00e9s par l\u2019employeur, m\u00eame nourris par un \u00e9l\u00e9ment visuel non dat\u00e9 et non corrobor\u00e9, ne constituent pas un commencement de preuve suffisant. Aucun \u00e9l\u00e9ment m\u00e9dical s\u00e9rieux ne venait \u00e9tayer l\u2019existence d\u2019une cause totalement \u00e9trang\u00e8re au travail susceptible de renverser la pr\u00e9somption. Le rejet de la demande d\u2019expertise est donc justifi\u00e9. A la demande de l&#8217;employeur, ce rapport est notifi\u00e9 au m\u00e9decin qu&#8217;il mandate \u00e0 cet effet. La victime de l&#8217;accident du travail ou de la maladie professionnelle est inform\u00e9e de cette notification. <\/p>\n<p>Un d\u00e9cret en Conseil d&#8217;Etat d\u00e9termine les conditions d&#8217;application du pr\u00e9sent article.<\/p>\n<\/p>\n<\/div>\n<\/div>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000041404145\" rel=\"nofollow\" target=\"_blank\">Article R. 142-8-3 du Code de la s\u00e9curit\u00e9 sociale<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">\n<p>Lorsque le recours pr\u00e9alable est form\u00e9 par l&#8217;employeur, le secr\u00e9tariat de la commission m\u00e9dicale de recours amiable notifie, dans un d\u00e9lai de dix jours \u00e0 compter de l&#8217;introduction du recours, par tout moyen conf\u00e9rant date certaine, le rapport mentionn\u00e9 \u00e0 l&#8217;article L. 142-6 accompagn\u00e9 de l&#8217;avis au m\u00e9decin mandat\u00e9 par l&#8217;employeur \u00e0 cet effet.
