L\u2019affirmation de la pr\u00e9somption d\u2019imputabilit\u00e9 en faveur du salari\u00e9<\/h2>\n<p><\/p>\n<h3 id=\"a-la-demonstration-de-la-survenance-dun-fait-accidentel-au-temps-et-au-lieu-du-t\">A. La d\u00e9monstration de la survenance d\u2019un fait accidentel au temps et au lieu du travail<\/h3>\n<p>La pr\u00e9somption d\u2019imputabilit\u00e9 pos\u00e9e par l\u2019article L. 411-1 du code de la s\u00e9curit\u00e9 sociale suppose d\u2019\u00e9tablir un fait pr\u00e9cis survenu soudainement \u00e0 l\u2019occasion du travail. L\u2019arr\u00eat rappelle que la caisse doit d\u00e9montrer <em>&#8220;un \u00e9v\u00e9nement, ou une s\u00e9rie d\u2019\u00e9v\u00e9nements, soudainement survenus \u00e0 une date certaine par le fait ou \u00e0 l\u2019occasion du travail, et dont il est r\u00e9sult\u00e9 une l\u00e9sion corporelle&#8221;<\/em>. En l\u2019esp\u00e8ce, la Cour d\u2019appel de Grenoble retient que l\u2019accident est <em>&#8220;dat\u00e9 avec pr\u00e9cision : le 12 juin 2022 sur le trajet de bus&#8221;<\/em>, que l\u2019employeur a \u00e9t\u00e9 inform\u00e9 le jour m\u00eame \u00e0 17h10, et que le certificat m\u00e9dical initial a \u00e9t\u00e9 \u00e9tabli le lendemain en raison des d\u00e9lais hospitaliers. Ces \u00e9l\u00e9ments objectifs, issus de la d\u00e9claration d\u2019accident et de l\u2019enqu\u00eate administrative, caract\u00e9risent un fait accidentel survenu pendant le temps et sur le lieu de travail. La cour \u00e9carte ainsi les divergences minimes sur l\u2019heure ou le lieu, estimant que <em>&#8220;toutes les d\u00e9clarations correspondent au temps et au lieu du travail&#8221;<\/em>. Cette solution s\u2019inscrit dans une jurisprudence constante qui admet que la preuve du fait accidentel peut \u00eatre rapport\u00e9e par des indices concordants, y compris en l\u2019absence de t\u00e9moin direct.<\/p>\n<h3 id=\"b-le-rejet-des-contestations-de-lemployeur-fondees-sur-labsence-de-temoin-et-les\">B. Le rejet des contestations de l\u2019employeur fond\u00e9es sur l\u2019absence de t\u00e9moin et les incoh\u00e9rences<\/h3>\n<p>L\u2019employeur tentait de renverser la pr\u00e9somption d\u2019imputabilit\u00e9 en invoquant l\u2019absence de t\u00e9moin et des variations dans les d\u00e9clarations du salari\u00e9. La cour \u00e9carte ces arguments en relevant que le salari\u00e9 a \u00e9t\u00e9 constant sur la survenance soudaine d\u2019une douleur lombaire et que les pr\u00e9tendues incoh\u00e9rences portaient sur des <em>&#8220;hypoth\u00e8ses pour comprendre la mani\u00e8re dont s\u2019\u00e9tait manifest\u00e9e sa l\u00e9sion&#8221;<\/em>. La jurisprudence d\u2019appui de la Cour d\u2019appel de Lyon, le 18 f\u00e9vrier 2025, pr\u00e9cise qu\u2019<em>&#8220;une absence de t\u00e9moins ne peut faire obstacle \u00e0 la reconnaissance d\u2019un accident du travail d\u00e8s lors qu\u2019un ensemble de pr\u00e9somptions graves et concordantes permet de corroborer, par des \u00e9l\u00e9ments objectifs, les d\u00e9clarations de la victime&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67b576fc48251af17c170c12\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Lyon, 18 f\u00e9vrier 2025, n\u00b022\/03446)<\/a><\/strong>. En l\u2019esp\u00e8ce, la d\u00e9monstration du fait accidentel par des \u00e9l\u00e9ments objectifs (date certaine, horaires de travail, information rapide de l\u2019employeur) suffit \u00e0 \u00e9tablir la pr\u00e9somption. L\u2019employeur \u00e9choue \u00e0 prouver une cause totalement \u00e9trang\u00e8re au travail, condition n\u00e9cessaire pour renverser la pr\u00e9somption.<\/p>\n<h2 id=\"ii-la-confirmation-des-obligations-de-la-cpam-et-la-portee-de-la-decision\">II. La confirmation des obligations de la CPAM et la port\u00e9e de la d\u00e9cision<\/h2>\n<p><\/p>\n<h3 id=\"a-lappreciation-de-la-suffisance-de-lenquete-de-la-cpam\">A. L\u2019appr\u00e9ciation de la suffisance de l\u2019enqu\u00eate de la CPAM<\/h3>\n<p>L\u2019employeur soutenait que l\u2019instruction de la caisse \u00e9tait insuffisante, faute d\u2019avoir interrog\u00e9 trois personnes cit\u00e9es par le salari\u00e9. La cour rejette ce moyen en retenant que la CPAM a adress\u00e9 un questionnaire \u00e0 l\u2019employeur conform\u00e9ment \u00e0 l\u2019article R. 441-8 du code de la s\u00e9curit\u00e9 sociale, et qu\u2019elle n\u2019\u00e9tait <em>&#8220;nullement tenue d\u2019entendre syst\u00e9matiquement toutes les personnes cit\u00e9es par l\u2019assur\u00e9&#8221;<\/em>. La d\u00e9cision pr\u00e9cise que ces personnes n\u2019\u00e9taient pas des t\u00e9moins des faits mais des personnes ayant aid\u00e9 le salari\u00e9 apr\u00e8s la survenance de la l\u00e9sion. Cette position est conforme \u00e0 la jurisprudence d\u2019appui de la Cour d\u2019appel de Pau, le 9 janvier 2025, selon laquelle <em>&#8220;la sanction ne peut pas \u00eatre l\u2019inopposabilit\u00e9 de la d\u00e9cision de prise en charge car elle n\u2019\u00e9tait pas tenue de proc\u00e9der \u00e0 des investigations puisque l\u2019employeur n\u2019avait pas \u00e9mis de r\u00e9serves et que la victime n\u2019\u00e9tait pas d\u00e9c\u00e9d\u00e9e&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/6780b931b10ab0632f704a02\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Pau, 9 janvier 2025, n\u00b021\/03886)<\/a><\/strong>. La cour rappelle ainsi que l\u2019\u00e9tendue de l\u2019enqu\u00eate de la CPAM est appr\u00e9ci\u00e9e souverainement, sous r\u00e9serve du respect du contradictoire.<\/p>\n<h3 id=\"b-les-consequences-sur-les-rapports-entre-employeur-et-caisse\">B. Les cons\u00e9quences sur les rapports entre employeur et caisse<\/h3>\n<p>La confirmation de l\u2019opposabilit\u00e9 de la d\u00e9cision de prise en charge emporte des cons\u00e9quences financi\u00e8res pour l\u2019employeur, qui devra supporter les majorations de cotisations li\u00e9es \u00e0 cet accident. L\u2019arr\u00eat s\u2019inscrit dans une logique de protection de la pr\u00e9somption l\u00e9gale, qui ne peut \u00eatre \u00e9cart\u00e9e que par une preuve contraire rigoureuse. La port\u00e9e de la d\u00e9cision est double. D\u2019une part, elle r\u00e9affirme que l\u2019absence de t\u00e9moin direct n\u2019est pas un obstacle dirimant \u00e0 la reconnaissance de l\u2019accident du travail, d\u00e8s lors que des \u00e9l\u00e9ments objectifs \u00e9tablissent le lien avec le travail. D\u2019autre part, elle clarifie l\u2019\u00e9tendue des obligations de la CPAM en mati\u00e8re d\u2019enqu\u00eate : la caisse n\u2019est pas tenue d\u2019entendre toutes les personnes mentionn\u00e9es par l\u2019assur\u00e9, sauf si celles-ci sont des t\u00e9moins directs des faits. Ce questionnaire est retourn\u00e9 dans un d\u00e9lai de vingt jours francs \u00e0 compter de sa date de r\u00e9ception. La caisse peut en outre recourir \u00e0 une enqu\u00eate compl\u00e9mentaire. En cas de d\u00e9c\u00e8s de la victime, la caisse proc\u00e8de obligatoirement \u00e0 une enqu\u00eate, sans adresser de questionnaire pr\u00e9alable.<\/p>\n<p> La caisse informe la victime ou ses repr\u00e9sentants ainsi que l&#8217;employeur de la date d&#8217;expiration du d\u00e9lai pr\u00e9vu au premier alin\u00e9a lors de l&#8217;envoi du questionnaire ou, le cas \u00e9ch\u00e9ant, lors de l&#8217;ouverture de l&#8217;enqu\u00eate.<\/p>\n<p> II.-A l&#8217;issue de ses investigations et au plus tard soixante-dix jours francs \u00e0 compter de la date \u00e0 laquelle elle dispose de la d\u00e9claration d&#8217;accident et du certificat m\u00e9dical initial, la caisse met le dossier mentionn\u00e9 \u00e0 l&#8217;article R. 441-14 \u00e0 la disposition de la victime ou de ses repr\u00e9sentants ainsi qu&#8217;\u00e0 celle de l&#8217;employeur. Ceux-ci disposent d&#8217;un d\u00e9lai de dix jours francs pour le consulter et faire conna\u00eetre leurs observations, qui sont annex\u00e9es au dossier. Au terme de ce d\u00e9lai, la victime ou ses repr\u00e9sentants et l&#8217;employeur peuvent consulter le dossier sans formuler d&#8217;observations.<\/p>\n<p> La caisse informe la victime ou ses repr\u00e9sentants et l&#8217;employeur des dates d&#8217;ouverture et de cl\u00f4ture de la p\u00e9riode au cours de laquelle ils peuvent consulter le dossier ainsi que de celle au cours de laquelle ils peuvent formuler des observations, par tout moyen conf\u00e9rant date certaine \u00e0 la r\u00e9ception de cette information et au plus tard dix jours francs avant le d\u00e9but de la p\u00e9riode de consultation.<\/p>\n<\/div>\n<\/div>\n<\/section>\n<section class=\"closing\" id=\"envoyer-pieces\" style=\"margin:48px 0 36px;padding:48px 36px;text-align:center;border-radius:24px;background:radial-gradient(circle at 50% 0%,rgba(0,0,204,0.08) 0%,transparent 60%),rgba(255,255,255,0.72);border:1px solid rgba(10,10,10,0.08);\">\n<div class=\"closing-heading\" role=\"heading\" aria-level=\"2\" style=\"font-size:clamp(30px,4vw,44px);line-height:1.18;font-weight:700;margin:0 0 18px;letter-spacing:-0.022em;color:#1B1B1B;font-family:Lato,sans-serif;\">Envoyez vos pi\u00e8ces.
