La d\u00e9duction des prestations sociales et le plafonnement<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Le 30 avril 2026, la Cour d&#8217;appel de Douai (troisi\u00e8me chambre, n\u00b025\/02597) \u00e9tait saisie d&#8217;un litige opposant un salari\u00e9 int\u00e9rimaire \u00e0 l&#8217;assureur de son employeur au sujet du calcul des prestations dues \u00e0 la suite d&#8217;un accident du travail survenu le 14 septembre 2020.<\/p>\n<p>Le salari\u00e9 avait \u00e9t\u00e9 engag\u00e9 par une entreprise de travail temporaire au moyen de quatre contrats de mission successifs mentionnant un taux horaire de 10,15 euros et une dur\u00e9e hebdomadaire de 39 heures. Victime d&#8217;un accident, il relevait d&#8217;un contrat collectif de pr\u00e9voyance souscrit par son employeur aupr\u00e8s de l&#8217;assureur. Ce dernier calcula les indemnit\u00e9s sur la base d&#8217;un taux horaire de 10,15 euros et d&#8217;une dur\u00e9e de 37,5 heures, en se fondant sur la seule d\u00e9claration de sinistre \u00e9tablie par l&#8217;employeur. Le salari\u00e9 contesta ce calcul et assigna l&#8217;assureur. Par jugement du 13 mars 2025, le tribunal judiciaire de Lille le d\u00e9bouta. Le salari\u00e9 interjeta appel.<\/p>\n<p>La question de droit soumise \u00e0 la cour \u00e9tait de savoir si, pour d\u00e9terminer le montant des prestations d&#8217;assurance collective en cas d&#8217;arr\u00eat de travail, la d\u00e9finition du <em>&#8220;traitement de base&#8221;<\/em> figurant dans la notice d&#8217;information contractuelle pouvait \u00eatre \u00e9cart\u00e9e au profit de celle du <em>&#8220;salaire de base de la mission&#8221;<\/em> pr\u00e9vue par l&#8217;accord de branche du 16 novembre 2018, et si l&#8217;assureur pouvait se pr\u00e9valoir exclusivement des d\u00e9clarations de l&#8217;employeur. La Cour d&#8217;appel de Douai a infirm\u00e9 le jugement et condamn\u00e9 l&#8217;assureur \u00e0 payer une somme de 10 999,45 euros, estimant que la clause contractuelle qui subordonnait le calcul \u00e0 l&#8217;assiette d\u00e9clar\u00e9e par l&#8217;employeur \u00e9tait contraire aux stipulations conventionnelles et devait \u00eatre \u00e9cart\u00e9e au profit de la d\u00e9finition imp\u00e9rative de l&#8217;accord de branche.<\/p>\n<h2 id=\"i-la-primaute-des-normes-conventionnelles-sur-les-stipulations-contractuelles\">I. La primaut\u00e9 des normes conventionnelles sur les stipulations contractuelles<\/h2>\n<p><\/p>\n<h3 id=\"a-lopposition-entre-deux-definitions-du-salaire-de-base\">A. L&#8217;opposition entre deux d\u00e9finitions du salaire de base<\/h3>\n<p>La notice d&#8217;information reprochait au salari\u00e9 de se fonder sur une clause de l&#8217;employeur. La cour a relev\u00e9 que deux dispositions coexistaient dans la notice d&#8217;information. L&#8217;article 14-1 d\u00e9finissait le <em>&#8220;traitement de base&#8221;<\/em> comme <em>&#8220;celui qui a servi d&#8217;assiette des cotisations chez votre employeur au cours des 12 mois civils ayant pr\u00e9c\u00e9d\u00e9 le mois du d\u00e9c\u00e8s ou de l&#8217;interruption du travail&#8221;<\/em>. L&#8217;article 14-2, en revanche, reprenait fid\u00e8lement la d\u00e9finition de l&#8217;article 4-5 de l&#8217;accord de branche en visant <em>&#8220;le salaire brut qu&#8217;aurait per\u00e7u le participant, s&#8217;il avait effectivement travaill\u00e9, calcul\u00e9 au jour de l&#8217;arr\u00eat de travail, en fonction de la dur\u00e9e du travail pr\u00e9vue au contrat de mission&#8221;<\/em>. Cette dualit\u00e9 cr\u00e9ait une contradiction directe. La cour a estim\u00e9 que l&#8217;article 14-1 \u00e9tait <em>&#8220;contraire aux pr\u00e9visions d&#8217;ordre public de l&#8217;article 4-5 de l&#8217;accord&#8221;<\/em> d\u00e8s lors qu&#8217;il fondait le calcul sur une assiette d\u00e9claratoire et non sur le salaire contractuellement pr\u00e9vu. L&#8217;assureur ne pouvait donc se retrancher derri\u00e8re la d\u00e9claration de l&#8217;employeur.<\/p>\n<h3 id=\"b-la-sanction-de-la-clause-contractuelle-contraire-a-laccord-de-branche\">B. La sanction de la clause contractuelle contraire \u00e0 l&#8217;accord de branche<\/h3>\n<p>S&#8217;appuyant sur l&#8217;article L. 912-1 du code de la s\u00e9curit\u00e9 sociale, la Cour d&#8217;appel de Douai a rappel\u00e9 que le contrat d&#8217;assurance collective <em>&#8220;ne peut d\u00e9roger aux stipulations de l&#8217;accord de branche en sens moins favorable pour le salari\u00e9&#8221;<\/em>. L&#8217;accord du 16 novembre 2018 d\u00e9finissait le salaire de base de mani\u00e8re autonome, sans r\u00e9f\u00e9rence aux cotisations ni aux d\u00e9clarations de l&#8217;employeur. En imposant une liquidation fond\u00e9e sur les seules indications de l&#8217;employeur, l&#8217;article 14-1 r\u00e9duisait l&#8217;effectivit\u00e9 des droits de l&#8217;assur\u00e9. La cour a \u00e9cart\u00e9 cette clause pour lui substituer la d\u00e9finition conventionnelle. Cette solution s&#8217;inscrit dans une jurisprudence exigeante sur le respect des normes de branche : la Cour de cassation a d\u00e9j\u00e0 jug\u00e9 qu&#8217;en l&#8217;absence de stipulation expresse, certaines provisions issues des cotisations restent acquises \u00e0 l&#8217;assureur <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/6927fa03011fb71514eb47c1\" rel=\"nofollow\" target=\"_blank\">(<em>&#8220;Ayant exactement retenu qu&#8217;en l&#8217;absence de stipulation contractuelle expresse, la provision pour risque croissant [&#8230;] reste acquise \u00e0 l&#8217;assureur&#8221;<\/em>, Cass. 2e civ., 27 nov. 2025, n\u00b023-18.857)<\/a><\/strong>. Ici, la cour applique le m\u00eame principe \u00e0 rebours : les stipulations expresses de l&#8217;accord de branche l&#8217;emportent sur les clauses contractuelles moins protectrices.<\/p>\n<h2 id=\"ii-les-consequences-indemnitaires-de-la-determination-du-salaire-de-base\">II. Les cons\u00e9quences indemnitaires de la d\u00e9termination du salaire de base<\/h2>\n<p><\/p>\n<h3 id=\"a-le-calcul-du-salaire-de-base-selon-les-elements-objectifs-du-contrat-de-missio\">A. Le calcul du salaire de base selon les \u00e9l\u00e9ments objectifs du contrat de mission<\/h3>\n<p>La cour a retenu une dur\u00e9e hebdomadaire de 39 heures, telle que pr\u00e9vue par les quatre contrats de mission successifs, et non les 37,5 heures d\u00e9clar\u00e9es par l&#8217;employeur. Elle a inclus les majorations pour heures suppl\u00e9mentaires (125 %), l&#8217;indemnit\u00e9 de fin de mission et l&#8217;indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s, conform\u00e9ment \u00e0 l&#8217;article 14-2 et \u00e0 l&#8217;accord de branche. Le salaire journalier brut a ainsi \u00e9t\u00e9 fix\u00e9 \u00e0 97,48 euros. Pour la p\u00e9riode post\u00e9rieure \u00e0 la mission, la cour a appliqu\u00e9 un taux net de 76 euros, correspondant au produit du taux horaire net (7,92 euros) par la dur\u00e9e quotidienne de 7,75 heures, major\u00e9 des primes. La cour a pr\u00e9cis\u00e9 que le salaire net constituait la seule mesure pertinente de la perte de revenu apr\u00e8s la fin de la mission, les cotisations sociales n&#8217;\u00e9tant plus vers\u00e9es. Ce raisonnement \u00e9carte toute r\u00e9f\u00e9rence \u00e0 une assiette d\u00e9clarative et privil\u00e9gie les donn\u00e9es objectives du contrat de mission.<\/p>\n<h3 id=\"b-la-deduction-des-prestations-sociales-et-le-plafonnement\">B. La d\u00e9duction des prestations sociales et le plafonnement<\/h3>\n<p>La Cour d&#8217;appel de Douai a ensuite calcul\u00e9 les prestations dues par l&#8217;assureur en appliquant les taux pr\u00e9vus au tableau de garantie (50 % les 30 premiers jours, 25 % ensuite) sur le salaire de base ainsi d\u00e9termin\u00e9. Elle a d\u00e9duit les indemnit\u00e9s journali\u00e8res de la S\u00e9curit\u00e9 sociale vers\u00e9es au salari\u00e9, en distinguant les p\u00e9riodes selon le caract\u00e8re brut ou net de ces indemnit\u00e9s. Le total des prestations de l&#8217;assureur et des IJSS ne pouvait exc\u00e9der 100 % du salaire net de la derni\u00e8re mission, soit 62 472 euros. Apr\u00e8s d\u00e9duction des sommes d\u00e9j\u00e0 vers\u00e9es (756,59 euros) et des IJSS (49 494,82 euros), le solde d\u00fb s&#8217;\u00e9tablissait \u00e0 12 220,59 euros. Le salari\u00e9 ayant limit\u00e9 sa demande \u00e0 10 999,45 euros, la cour a condamn\u00e9 l&#8217;assureur \u00e0 ce montant avec int\u00e9r\u00eats au taux l\u00e9gal \u00e0 compter de l&#8217;assignation. Cette approche garantit une indemnisation compl\u00e8te et conforme \u00e0 la hi\u00e9rarchie des normes, en neutralisant l&#8217;effet d&#8217;une sous-d\u00e9claration \u00e9ventuelle de l&#8217;employeur.<\/p>\n<p><h2 id=\"jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/h2>\n<p><\/p>\n<ul class=\"jurisprudences-rag-sources\">\n<li><a href=\"https:\/\/www.courdecassation.fr\/decision\/6927fa03011fb71514eb47c1\" rel=\"nofollow\" target=\"_blank\">Cass. Chambre sociale, le 5 f\u00e9vrier 2025, n\u00b023-12.773<\/a><\/li>\n<\/ul>\n<\/div>\n<style scoped>.fondements-juridiques{margin:40px 0 0;padding:0}.fondements-juridiques>h2{font-size:22px;color:#1a1a1a;border-bottom:2px solid #2c5f8a;padding-bottom:10px;margin-bottom:20px}.fj-article{background:#fdfdfd;border:1px solid #e8e8e8;border-radius:6px;padding:20px;margin-bottom:16px}.fj-article h3{font-size:17px;color:#2c5f8a;margin:0 0 12px;font-weight:600}.fj-texte{font-size:15px;line-height:1.7;color:#333}.fj-texte p{margin:8px 0}.fj-badge{font-size:11px;padding:2px 8px;border-radius:3px;margin-left:8px;font-weight:500;vertical-align:middle}.fj-en-vigueur{background:#e8f5e9;color:#2e7d32}.fj-abroge{background:#ffebee;color:#c62828}.fj-modifie{background:#fff3e0;color:#e65100}<\/style>\n<section class=\"fondements-juridiques\">\n<h2 id=\"fondements-juridiques\">Fondements juridiques<\/h2>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000028392662\" rel=\"nofollow\" target=\"_blank\">Article L. 912-1 du Code de la s\u00e9curit\u00e9 sociale<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">\n<p>I.-Les accords professionnels ou interprofessionnels mentionn\u00e9s \u00e0 l&#8217;article L. 911-1 peuvent, dans des conditions fix\u00e9es par d\u00e9cret en Conseil d&#8217;Etat, pr\u00e9voir l&#8217;institution de garanties collectives pr\u00e9sentant un degr\u00e9 \u00e9lev\u00e9 de solidarit\u00e9 et comprenant \u00e0 ce titre des prestations \u00e0 caract\u00e8re non directement contributif, pouvant notamment prendre la forme d&#8217;une prise en charge partielle ou totale de la cotisation pour certains salari\u00e9s ou anciens salari\u00e9s, d&#8217;une politique de pr\u00e9vention ou de prestations d&#8217;action sociale. <\/p>\n<\/p>\n<p>Dans ce cas, les accords peuvent organiser la couverture des risques concern\u00e9s en recommandant un ou plusieurs organismes mentionn\u00e9s \u00e0 l&#8217;article 1er de la loi n\u00b0 89-1009 du 31 d\u00e9cembre 1989 renfor\u00e7ant les garanties offertes aux personnes assur\u00e9es contre certains risques ou une ou plusieurs institutions mentionn\u00e9es \u00e0 l&#8217;article L. 370-1 du code des assurances, sous r\u00e9serve du respect des conditions d\u00e9finies au II du pr\u00e9sent article. <\/p>\n<\/p>\n<p>Le ou les organismes ou institutions adressent annuellement au ministre charg\u00e9 de la s\u00e9curit\u00e9 sociale un rapport sur la mise en \u0153uvre du r\u00e9gime, le contenu des \u00e9l\u00e9ments de solidarit\u00e9 et son \u00e9quilibre, dont le contenu est pr\u00e9cis\u00e9 par d\u00e9cret. <\/p>\n<\/p>\n<p>II.-La recommandation mentionn\u00e9e au I doit \u00eatre pr\u00e9c\u00e9d\u00e9e d&#8217;une proc\u00e9dure de mise en concurrence des organismes ou institutions concern\u00e9s, dans des conditions de transparence, d&#8217;impartialit\u00e9 et d&#8217;\u00e9galit\u00e9 de traitement entre les candidats et selon des modalit\u00e9s pr\u00e9vues par d\u00e9cret. <\/p>\n<\/p>\n<p>Le ou les organismes ou institutions ne peuvent refuser l&#8217;adh\u00e9sion d&#8217;une entreprise relevant du champ d&#8217;application de l&#8217;accord. Ils sont tenus d&#8217;appliquer un tarif unique et d&#8217;offrir des garanties identiques pour toutes les entreprises et pour tous les salari\u00e9s concern\u00e9s. <\/p>\n<\/p>\n<p>III.-Les accords mentionn\u00e9s au I comportent une clause fixant dans quelles conditions et selon quelle p\u00e9riodicit\u00e9, qui ne peut exc\u00e9der cinq ans, les modalit\u00e9s d&#8217;organisation de la recommandation sont r\u00e9examin\u00e9es.
