Le rejet des demandes accessoires et la prise en compte de la dette locative<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Par un arr\u00eat du 30 avril 2026, la Cour d&#8217;appel de Douai, chambre 8 section 4 (n\u00b024\/00147), \u00e9tait saisie d&#8217;un litige opposant un bailleur \u00e0 ses locataires au sujet de l&#8217;ind\u00e9cence d&#8217;un logement. Des d\u00e9sordres avaient \u00e9t\u00e9 constat\u00e9s par le service communal d&#8217;hygi\u00e8ne depuis le 13 novembre 2014, conduisant le pr\u00e9fet \u00e0 prendre un arr\u00eat\u00e9 de mise en demeure le 19 ao\u00fbt 2022, puis un arr\u00eat\u00e9 d&#8217;insalubrit\u00e9 le 7 juin 2023. Par jugement du 6 novembre 2023, le tribunal judiciaire avait constat\u00e9 que le bailleur avait manqu\u00e9 \u00e0 son obligation de d\u00e9livrance, l&#8217;avait condamn\u00e9 \u00e0 r\u00e9aliser des travaux sous astreinte et \u00e0 payer 34 840 euros de dommages-int\u00e9r\u00eats pour le pr\u00e9judice de jouissance subi du 13 novembre 2014 au 1er septembre 2022. Le bailleur a interjet\u00e9 appel, contestant sa responsabilit\u00e9 et le montant de l&#8217;indemnisation, tandis que les locataires, par appel incident, ont demand\u00e9 que la p\u00e9riode d&#8217;indemnisation soit prolong\u00e9e jusqu&#8217;\u00e0 leur relogement effectif intervenu le 7 juillet 2025. La question centrale \u00e9tait donc de d\u00e9terminer, d&#8217;une part, si l&#8217;ind\u00e9cence du logement \u00e9tait imputable au bailleur et, d&#8217;autre part, sur quelle p\u00e9riode devait \u00eatre indemnis\u00e9 le trouble de jouissance en d\u00e9pit de l&#8217;exon\u00e9ration du paiement du loyer. La cour d&#8217;appel a confirm\u00e9 la responsabilit\u00e9 du bailleur et la condamnation aux travaux, mais a infirm\u00e9 le jugement sur la p\u00e9riode d&#8217;indemnisation en allouant 43 215 euros pour la p\u00e9riode du 13 novembre 2014 au 7 juillet 2025, tout en condamnant solidairement les locataires \u00e0 payer 1 341 euros de loyers impay\u00e9s et en rejetant leurs demandes accessoires.<\/p>\n<h2 id=\"i-la-confirmation-de-la-responsabilite-du-bailleur-pour-manquement-a-lobligation\">I. La confirmation de la responsabilit\u00e9 du bailleur pour manquement \u00e0 l&#8217;obligation de d\u00e9livrance<\/h2>\n<p><\/p>\n<h3 id=\"a-letablissement-de-lindecence-du-logement-par-la-conjugaison-des-constats-sanit\">A. L&#8217;\u00e9tablissement de l&#8217;ind\u00e9cence du logement par la conjugaison des constats sanitaires et de l&#8217;arr\u00eat\u00e9 pr\u00e9fectoral<\/h3>\n<p>La cour d&#8217;appel a rappel\u00e9 que l&#8217;article 6 de la loi du 6 juillet 1989 impose au bailleur de remettre un logement d\u00e9cent ne laissant pas appara\u00eetre de risques pour la sant\u00e9 ou la s\u00e9curit\u00e9. Elle a soulign\u00e9 que l&#8217;article 5 du d\u00e9cret du 30 janvier 2002 pr\u00e9cise qu&#8217;un logement frapp\u00e9 d&#8217;un arr\u00eat\u00e9 d&#8217;insalubrit\u00e9 ne peut \u00eatre consid\u00e9r\u00e9 comme d\u00e9cent. En l&#8217;esp\u00e8ce, les locataires produisaient de multiples rapports du service communal d&#8217;hygi\u00e8ne, des 13 novembre 2014, 14 octobre 2019, 6 octobre 2021, 24 mai 2022, 28 juin 2022 et 23 f\u00e9vrier 2023, qui r\u00e9v\u00e9laient des infiltrations, une installation \u00e9lectrique non conforme, une absence de dispositifs de retenue aux escaliers et fen\u00eatres, une insuffisance de chauffage, un d\u00e9faut d&#8217;\u00e9tanch\u00e9it\u00e9 des toitures et une ventilation non r\u00e9glementaire. Le pr\u00e9fet avait pris un premier arr\u00eat\u00e9 le 19 ao\u00fbt 2022 pour faire cesser un danger imminent, puis un second le 7 juin 2023 d\u00e9clarant le logement insalubre et ordonnant son interdiction d&#8217;habiter. Le bailleur invoquait un d\u00e9faut d&#8217;entretien imputable aux locataires, s&#8217;appuyant sur un rapport mentionnant des odeurs naus\u00e9abondes et des encombrants. La cour a toutefois \u00e9cart\u00e9 cet argument en consid\u00e9rant que <em>&#8220;la nature des d\u00e9sordres relev\u00e9s et les travaux prescrits par les autorit\u00e9s sanitaires dans leurs rapports \u00e9tablissent suffisamment que l&#8217;\u00e9tat d&#8217;ind\u00e9cence du logement ne r\u00e9sulte pas d&#8217;un manque d&#8217;entretien des lieux par les locataires&#8221;<\/em>. Elle s&#8217;est \u00e9galement r\u00e9f\u00e9r\u00e9e \u00e0 la jurisprudence selon laquelle <em>&#8220;l&#8217;obligation de d\u00e9livrance \u00e0 laquelle le bailleur est tenu en vertu de l&#8217;article 6 de la loi du 6 juillet 1989, l&#8217;oblige \u00e0 d\u00e9livrer au locataire un logement d\u00e9cent [&#8230;] exempt de toute infestation d&#8217;esp\u00e8ces nuisibles et parasites&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67f755c2d8218d22f82bd45e\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Lyon, 9 avril 2025, n\u00b023\/00591)<\/a><\/strong>. La preuve \u00e9tait ainsi rapport\u00e9e que les d\u00e9sordres pr\u00e9existaient et relevaient de la v\u00e9tust\u00e9, non d&#8217;un d\u00e9faut d&#8217;entretien des locataires.<\/p>\n<h3 id=\"b-la-condamnation-aux-travaux-necessaires-et-le-maintien-de-lastreinte\">B. La condamnation aux travaux n\u00e9cessaires et le maintien de l&#8217;astreinte<\/h3>\n<p>La cour a confirm\u00e9 le jugement en ce qu&#8217;il avait ordonn\u00e9 au bailleur de r\u00e9aliser les travaux list\u00e9s par l&#8217;arr\u00eat\u00e9 pr\u00e9fectoral du 7 juin 2023, incluant la suppression des fuites de toiture, la remise en \u00e9tat des surfaces ab\u00eem\u00e9es, la mise en conformit\u00e9 des installations \u00e9lectriques et de ventilation, l&#8217;\u00e9quipement d&#8217;un cabinet d&#8217;aisance int\u00e9rieur et l&#8217;installation de d\u00e9tecteurs de fum\u00e9e. Elle a relev\u00e9 que le bailleur, qui avait fait r\u00e9aliser certains travaux entre mars et juillet 2024, ne contestait pas leur insuffisance et ne justifiait d&#8217;aucune mainlev\u00e9e de l&#8217;arr\u00eat\u00e9 d&#8217;insalubrit\u00e9. La cour a donc maintenu l&#8217;astreinte provisoire de 70 euros par jour pendant deux mois, pass\u00e9 un d\u00e9lai de six mois suivant la signification du jugement, consid\u00e9rant que la persistance des d\u00e9sordres apr\u00e8s le prononc\u00e9 du jugement justifiait de ne pas all\u00e9ger la contrainte. Elle a ainsi rappel\u00e9 que l&#8217;obligation de mise en conformit\u00e9 pesant sur le bailleur en vertu de l&#8217;article 20-1 de la loi du 6 juillet 1989 est une obligation de r\u00e9sultat, et que le seul ach\u00e8vement partiel des travaux ne suffit pas \u00e0 l&#8217;\u00e9teindre.<\/p>\n<h2 id=\"ii-lindemnisation-du-prejudice-de-jouissance-et-ses-limites\">II. L&#8217;indemnisation du pr\u00e9judice de jouissance et ses limites<\/h2>\n<p><\/p>\n<h3 id=\"a-lextension-de-la-periode-dindemnisation-jusquau-relogement-effectif-des-locata\">A. L&#8217;extension de la p\u00e9riode d&#8217;indemnisation jusqu&#8217;au relogement effectif des locataires<\/h3>\n<p>Le premier juge avait fix\u00e9 la p\u00e9riode d&#8217;indemnisation du 13 novembre 2014 au 1er septembre 2022, date \u00e0 laquelle les locataires avaient \u00e9t\u00e9 exon\u00e9r\u00e9s du paiement du loyer par l&#8217;effet de l&#8217;arr\u00eat\u00e9 pr\u00e9fectoral. La cour d&#8217;appel a consid\u00e9r\u00e9 que cette exon\u00e9ration \u00e9tait sans incidence sur le droit \u00e0 r\u00e9paration du trouble de jouissance, d\u00e8s lors que les locataires avaient continu\u00e9 d&#8217;habiter le logement ind\u00e9cent en l&#8217;absence de toute offre de relogement de la part du bailleur, alors que l&#8217;arr\u00eat\u00e9 du 7 juin 2023 lui imposait d&#8217;en proposer une avant le 1er juillet 2023. Elle a relev\u00e9 que les locataires justifiaient, par des \u00e9changes de sms et des photographies, de la persistance des d\u00e9sordres apr\u00e8s le jugement, notamment des infiltrations d&#8217;eau. Les locataires n&#8217;ont finalement \u00e9t\u00e9 relog\u00e9s que le 7 juillet 2025 par un organisme social. La cour a donc allou\u00e9 la somme de 43 215 euros pour la p\u00e9riode totale de 10 ans et 9 mois, correspondant \u00e0 la moiti\u00e9 du loyer mensuel de 335 euros, en estimant que cette \u00e9valuation \u00e9tait justifi\u00e9e par l&#8217;ampleur des troubles. Elle s&#8217;est inscrite dans la ligne de la jurisprudence selon laquelle la p\u00e9riode d&#8217;indemnisation doit \u00eatre fix\u00e9e en fonction de la dur\u00e9e r\u00e9elle du pr\u00e9judice, ind\u00e9pendamment des mesures administratives <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67cbde5de543846c04847e39\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Rouen, 6 mars 2025, n\u00b025\/00046, \u00e9voquant la fixation motiv\u00e9e de la p\u00e9riode d&#8217;indemnisation)<\/a><\/strong>.<\/p>\n<h3 id=\"b-le-rejet-des-demandes-accessoires-et-la-prise-en-compte-de-la-dette-locative\">B. Le rejet des demandes accessoires et la prise en compte de la dette locative<\/h3>\n<p>La cour a \u00e9cart\u00e9 la demande des locataires tendant \u00e0 obtenir 335 euros par mois jusqu&#8217;\u00e0 leur relogement effectif, au motif qu&#8217;ils n&#8217;avaient d\u00e9velopp\u00e9 aucun moyen dans leurs conclusions \u00e9crites pour \u00e9tayer cette pr\u00e9tention. Elle a ainsi rappel\u00e9 le principe selon lequel les conclusions doivent \u00eatre discut\u00e9es dans le corps de l&#8217;argumentation, et non seulement formul\u00e9es dans le dispositif. Par ailleurs, elle a fait droit \u00e0 la demande reconventionnelle du bailleur en condamnant solidairement les locataires \u00e0 payer 1 341 euros de loyers et charges impay\u00e9s d&#8217;ao\u00fbt 2022, en application de l&#8217;article 7 a) de la loi du 6 juillet 1989, apr\u00e8s avoir constat\u00e9 que les locataires ne prouvaient pas leur lib\u00e9ration. La cour a rejet\u00e9 la demande de d\u00e9lais de paiement du bailleur, faute pour lui de justifier de sa situation financi\u00e8re, ainsi que sa demande de r\u00e9\u00e9valuation de l&#8217;indemnit\u00e9 pour r\u00e9sistance abusive, estimant que les 800 euros allou\u00e9s en premi\u00e8re instance suffisaient \u00e0 r\u00e9parer le pr\u00e9judice subi par les locataires contraints d&#8217;agir en justice en raison de l&#8217;inertie du bailleur.
