Le rejet de la demande d\u2019acquisition du d\u00e9p\u00f4t de garantie : une comp\u00e9tence r\u00e9serv\u00e9e au juge du fond<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Le Tribunal judiciaire de Bobigny, dans son ordonnance de r\u00e9f\u00e9r\u00e9 du 30 mars 2026 (n\u00b0 RG 26\/00023), \u00e9tait saisi par le bailleur d\u2019un local commercial d\u2019une demande tendant au constat de la r\u00e9siliation de plein droit du bail, \u00e0 l\u2019expulsion de la locataire d\u00e9faillante et au paiement d\u2019une provision au titre des loyers impay\u00e9s. Un commandement de payer avait \u00e9t\u00e9 d\u00e9livr\u00e9 le 7 novembre 2025 pour une somme de 9450,35 euros, rest\u00e9 infructueux dans le d\u00e9lai d\u2019un mois. La locataire, assign\u00e9e en l\u2019\u00e9tude du commissaire de justice, n\u2019a pas comparu. La question de droit centrale \u00e9tait de savoir si le juge des r\u00e9f\u00e9r\u00e9s pouvait, sur le fondement des articles 834 et 835 du Code de proc\u00e9dure civile, constater l\u2019acquisition d\u2019une clause r\u00e9solutoire ins\u00e9r\u00e9e dans un bail commercial et allouer une provision au bailleur, tout en statuant sur le sort du d\u00e9p\u00f4t de garantie. Le juge a fait droit \u00e0 la demande de constat de r\u00e9siliation, ordonn\u00e9 l\u2019expulsion, condamn\u00e9 la locataire au paiement d\u2019une provision de 6465,15 euros et d\u2019une indemnit\u00e9 d\u2019occupation, mais a rejet\u00e9 la demande tendant \u00e0 voir d\u00e9clarer acquis le d\u00e9p\u00f4t de garantie. La d\u00e9cision m\u00e9rite d\u2019\u00eatre analys\u00e9e dans son affirmation du pouvoir du juge des r\u00e9f\u00e9r\u00e9s de constater la r\u00e9siliation de plein droit (I), puis dans la d\u00e9limitation de ce m\u00eame pouvoir quant aux cons\u00e9quences p\u00e9cuniaires du contrat (II).<\/p>\n<h2 id=\"i-la-consecration-du-constat-de-resiliation-de-plein-droit-en-refere\">I. La cons\u00e9cration du constat de r\u00e9siliation de plein droit en r\u00e9f\u00e9r\u00e9<\/h2>\n<p><\/p>\n<h3 id=\"a-les-conditions-de-mise-en-uvre-de-la-clause-resolutoire\">A. Les conditions de mise en \u0153uvre de la clause r\u00e9solutoire<\/h3>\n<p>Le juge rappelle, en premier lieu, le cadre l\u00e9gal fix\u00e9 par l\u2019article L.145-41 du code de commerce, aux termes duquel toute clause ins\u00e9r\u00e9e dans le bail pr\u00e9voyant la r\u00e9siliation de plein droit ne produit effet qu\u2019un mois apr\u00e8s un commandement demeur\u00e9 infructueux. Cette r\u00e8gle imp\u00e9rative commande que le commandement soit r\u00e9gulier en la forme et reproduise les termes de l\u2019article L.145-41 ainsi que ceux de la clause r\u00e9solutoire elle-m\u00eame. En l\u2019esp\u00e8ce, le juge v\u00e9rifie que le commandement du 7 novembre 2025 satisfait \u00e0 ces exigences et que le d\u00e9compte des sommes r\u00e9clam\u00e9es est conforme aux stipulations du bail. Il constate ensuite que la somme n\u2019a pas \u00e9t\u00e9 int\u00e9gralement pay\u00e9e dans le mois, \u00e9tablissant ainsi l\u2019infructuosit\u00e9 du commandement. La Cour d\u2019appel d\u2019Aix-en-Provence a d\u2019ailleurs confirm\u00e9 que, sauf preuve du contraire, une clause claire et pr\u00e9cise produit effet apr\u00e8s le d\u00e9lai l\u00e9gal : <em>&#8221; Aux termes de l\u2019article L.145-41 du code de commerce toute clause ins\u00e9r\u00e9e dans le bail pr\u00e9voyant la r\u00e9siliation de plein droit ne produit effet qu\u2019un mois apr\u00e8s un commandement demeur\u00e9 infructueux &#8220;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67ad912a668940826449c158\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel d\u2019Aix-en-Provence, 12 f\u00e9vrier 2025, n\u00b024\/01627)<\/a><\/strong>. Le juge des r\u00e9f\u00e9r\u00e9s n\u2019a d\u00e8s lors qu\u2019\u00e0 constater l\u2019application automatique de la clause, sans avoir \u00e0 appr\u00e9cier l\u2019urgence ou le trouble manifestement illicite.<\/p>\n<h3 id=\"b-loffice-du-juge-des-referes-face-a-la-clause-resolutoire\">B. L\u2019office du juge des r\u00e9f\u00e9r\u00e9s face \u00e0 la clause r\u00e9solutoire<\/h3>\n<p>Le juge des r\u00e9f\u00e9r\u00e9s dispose d\u2019un pouvoir de constatation, non de r\u00e9siliation judiciaire, ce qui le distingue du juge du fond. Il s\u2019agit d\u2019une comp\u00e9tence sp\u00e9cifique lorsqu\u2019aucune contestation s\u00e9rieuse ne s\u2019\u00e9l\u00e8ve sur l\u2019existence de la clause, la r\u00e9gularit\u00e9 du commandement et l\u2019absence de paiement. En l\u2019esp\u00e8ce, la locataire n\u2019a pas comparu, de sorte que le juge n\u2019a relev\u00e9 aucune contestation de nature \u00e0 faire obstacle au constat. La Cour d\u2019appel de Lyon a pr\u00e9cis\u00e9 que <em>&#8221; en application des articles 834 et 835 du Code de proc\u00e9dure civile, il est possible, en r\u00e9f\u00e9r\u00e9, de constater la r\u00e9siliation de plein droit d\u2019un contrat de bail en application d\u2019une clause r\u00e9solutoire, sans qu\u2019il soit besoin de caract\u00e9riser une quelconque urgence ou un trouble manifestement illicite, s\u2019agissant du simple constat de l\u2019application d\u2019une clause claire et pr\u00e9cise &#8220;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67ee178651255e24994fc4f5\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Lyon, 2 avril 2025, n\u00b024\/06080)<\/a><\/strong>. Le juge de Bobigny applique cette solution sans s\u2019\u00e9carter de la lettre des textes. Il fixe la date de r\u00e9siliation au 7 d\u00e9cembre 2025, soit un mois apr\u00e8s le commandement, conform\u00e9ment \u00e0 la clause.<\/p>\n<h2 id=\"ii-les-limites-de-lintervention-du-juge-des-referes-en-matiere-de-consequences-l\">II. Les limites de l\u2019intervention du juge des r\u00e9f\u00e9r\u00e9s en mati\u00e8re de cons\u00e9quences locatives<\/h2>\n<p><\/p>\n<h3 id=\"a-loctroi-dune-provision-fondee-sur-lobligation-non-serieusement-contestable\">A. L\u2019octroi d\u2019une provision fond\u00e9e sur l\u2019obligation non s\u00e9rieusement contestable<\/h3>\n<p>Le juge des r\u00e9f\u00e9r\u00e9s peut, en vertu de l\u2019article 835 du Code de proc\u00e9dure civile, allouer une provision au cr\u00e9ancier si l\u2019obligation n\u2019est pas s\u00e9rieusement contestable. En l\u2019esp\u00e8ce, la dette locative au jour de la r\u00e9siliation s\u2019\u00e9levait \u00e0 6465,15 euros, dernier trimestre 2025 inclus. Le juge consid\u00e8re que l\u2019obligation de payer les loyers \u00e9chus est certaine et non contest\u00e9e, la locataire \u00e9tant d\u00e9faillante. Il accorde donc une provision \u00e0 hauteur de ce montant. En outre, pour la p\u00e9riode post\u00e9rieure \u00e0 la r\u00e9siliation, il fixe une indemnit\u00e9 d\u2019occupation mensuelle \u00e9gale \u00e0 un douzi\u00e8me du loyer annuel contractuel, \u00e0 compter du 1er janvier 2026 jusqu\u2019\u00e0 lib\u00e9ration effective. Cette indemnit\u00e9 compense le pr\u00e9judice caus\u00e9 par le maintien sans droit dans les lieux. La solution est classique et conforme \u00e0 la pratique des r\u00e9f\u00e9r\u00e9s en mati\u00e8re de baux commerciaux.<\/p>\n<h3 id=\"b-le-rejet-de-la-demande-dacquisition-du-depot-de-garantie-une-competence-reserv\">B. Le rejet de la demande d\u2019acquisition du d\u00e9p\u00f4t de garantie : une comp\u00e9tence r\u00e9serv\u00e9e au juge du fond<\/h3>\n<p>Le bailleur sollicitait que le d\u00e9p\u00f4t de garantie lui soit d\u00e9clar\u00e9 acquis. Le juge des r\u00e9f\u00e9r\u00e9s rejette cette demande au motif qu\u2019<em>&#8221; il n\u2019y a pas lieu en r\u00e9f\u00e9r\u00e9 de d\u00e9clarer le d\u00e9p\u00f4t de garantie acquis au bailleur &#8220;<\/em>. Cette d\u00e9cision repose sur une distinction entre les pouvoirs du juge de l\u2019\u00e9vident et ceux du juge du fond. L\u2019acquisition du d\u00e9p\u00f4t de garantie suppose un examen au fond, notamment pour v\u00e9rifier l\u2019existence d\u2019une faute contractuelle ou l\u2019imputation des d\u00e9gradations \u00e9ventuelles. En l\u2019absence de contestation, mais dans le cadre d\u2019une proc\u00e9dure non contradictoire, le juge estime que cette question d\u00e9passe la comp\u00e9tence du r\u00e9f\u00e9r\u00e9. Il se limite \u00e0 constater la r\u00e9siliation et \u00e0 ordonner les mesures provisoires n\u00e9cessaires. Ce rejet s\u2019inscrit dans une conception restrictive des pouvoirs du juge des r\u00e9f\u00e9r\u00e9s, qui ne peut trancher des droits d\u00e9finitifs. Le commandement doit, \u00e0 peine de nullit\u00e9, mentionner ce d\u00e9lai.<\/p>\n<p>Les juges saisis d&#8217;une demande pr\u00e9sent\u00e9e dans les formes et conditions pr\u00e9vues \u00e0 l&#8217;article 1343-5 du code civil peuvent, en accordant des d\u00e9lais, suspendre la r\u00e9alisation et les effets des clauses r\u00e9solutoires, lorsque la r\u00e9siliation n&#8217;est pas constat\u00e9e ou prononc\u00e9e par une d\u00e9cision de justice ayant acquis l&#8217;autorit\u00e9 de la chose jug\u00e9e.
