Le rejet des dommages-int\u00e9r\u00eats pour absence de pr\u00e9judice distinct<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Le Tribunal judiciaire de Marseille, statuant selon la proc\u00e9dure acc\u00e9l\u00e9r\u00e9e au fond par jugement du 30 mars 2026, a \u00e9t\u00e9 saisi par le syndicat des copropri\u00e9taires d\u2019un immeuble pour obtenir le paiement de charges de copropri\u00e9t\u00e9 impay\u00e9es \u00e0 l\u2019encontre d\u2019un copropri\u00e9taire. Ce dernier, bien que r\u00e9guli\u00e8rement assign\u00e9, n\u2019a pas comparu. Le syndicat avait adress\u00e9 une mise en demeure le 28 juillet 2025, rest\u00e9e infructueuse. La question de droit centrale porte sur les conditions de mise en \u0153uvre de l\u2019article 19-2 de la loi du 10 juillet 1965, qui permet au pr\u00e9sident du tribunal de condamner un copropri\u00e9taire d\u00e9faillant au paiement des provisions exigibles et des sommes dues au titre des exercices ant\u00e9rieurs, ainsi que sur l\u2019\u00e9tendue de la condamnation aux frais de recouvrement et aux dommages-int\u00e9r\u00eats. Le tribunal a condamn\u00e9 le copropri\u00e9taire \u00e0 payer 2.629,85 \u20ac de charges \u00e9chues, 502,42 \u20ac de provisions \u00e0 \u00e9choir devenues exigibles, et 121,25 \u20ac de frais de recouvrement, mais a rejet\u00e9 la demande de dommages-int\u00e9r\u00eats et celle relative aux frais d\u2019ex\u00e9cution forc\u00e9e.<\/p>\n<h2 id=\"i-laffirmation-du-mecanisme-dexigibilite-anticipee-des-charges-de-copropriete\">I. L\u2019affirmation du m\u00e9canisme d\u2019exigibilit\u00e9 anticip\u00e9e des charges de copropri\u00e9t\u00e9<\/h2>\n<p><\/p>\n<h3 id=\"a-les-conditions-de-la-procedure-acceleree-au-fond-et-de-lexigibilite-immediate\">A. Les conditions de la proc\u00e9dure acc\u00e9l\u00e9r\u00e9e au fond et de l\u2019exigibilit\u00e9 imm\u00e9diate<\/h3>\n<p>Le tribunal a fait application de l\u2019article 472 du code de proc\u00e9dure civile, selon lequel le juge ne fait droit \u00e0 la demande que s\u2019il l\u2019estime r\u00e9guli\u00e8re, recevable et bien fond\u00e9e en l\u2019absence du d\u00e9fendeur. Il a ensuite v\u00e9rifi\u00e9 la recevabilit\u00e9 au regard de l\u2019article 19-2 de la loi du 10 juillet 1965. Ce texte dispose qu\u2019\u00e0 d\u00e9faut de versement d\u2019une provision due au titre de l\u2019article 14-1, et apr\u00e8s mise en demeure rest\u00e9e infructueuse pass\u00e9 un d\u00e9lai de trente jours, les provisions non encore \u00e9chues deviennent imm\u00e9diatement exigibles. Le tribunal a constat\u00e9 que la mise en demeure du 28 juillet 2025 \u00e9tait rest\u00e9e sans effet dans le d\u00e9lai l\u00e9gal, ouvrant la voie \u00e0 la proc\u00e9dure acc\u00e9l\u00e9r\u00e9e au fond. Cette solution est conforme \u00e0 la lettre de l\u2019article 19-2, mais le juge a \u00e9galement exig\u00e9 la production des proc\u00e8s-verbaux d\u2019assembl\u00e9e g\u00e9n\u00e9rale approuvant les comptes et le budget pr\u00e9visionnel, ainsi qu\u2019un d\u00e9compte pr\u00e9cis. En retenant ces \u00e9l\u00e9ments, il a fait preuve de rigueur : il ne s\u2019est pas content\u00e9 de la simple affirmation du syndicat, mais a impos\u00e9 la d\u00e9monstration de l\u2019approbation des charges ant\u00e9rieures et du vote du budget. Cette exigence s\u2019inscrit dans la logique protectrice de la loi, qui subordonne la condamnation \u00e0 la preuve d\u2019une cr\u00e9ance certaine, liquide et exigible.<\/p>\n<h3 id=\"b-lapplication-de-lexigibilite-aux-provisions-a-echoir-et-aux-charges-echues\">B. L\u2019application de l\u2019exigibilit\u00e9 aux provisions \u00e0 \u00e9choir et aux charges \u00e9chues<\/h3>\n<p>Le tribunal a distingu\u00e9 les charges \u00e9chues, fond\u00e9es sur les comptes approuv\u00e9s en assembl\u00e9e g\u00e9n\u00e9rale, des provisions \u00e0 \u00e9choir pour l\u2019exercice en cours. Pour les premi\u00e8res, il a rappel\u00e9 que l\u2019approbation des comptes rend la cr\u00e9ance certaine, liquide et exigible, le copropri\u00e9taire n\u2019ayant pas contest\u00e9 la d\u00e9cision dans le d\u00e9lai de l\u2019article 42 de la loi de 1965. Cette position est classique et rappel\u00e9e par la Cour d\u2019appel de Basse-Terre dans un arr\u00eat du 20 f\u00e9vrier 2025, selon lequel <em>&#8221; l\u2019approbation des comptes par l\u2019assembl\u00e9e g\u00e9n\u00e9rale rendait la cr\u00e9ance certaine, liquide et exigible &#8220;<\/em> et que le copropri\u00e9taire qui n\u2019a pas contest\u00e9 n\u2019est <em>&#8221; pas fond\u00e9 \u00e0 refuser de payer les sommes r\u00e9clam\u00e9es &#8220;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67c000ee26e434f8e04c5fe6\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Basse-Terre, 20 f\u00e9vrier 2025, n\u00b023\/00166)<\/a><\/strong>. Pour les provisions \u00e0 \u00e9choir, le tribunal a appliqu\u00e9 la lettre de l\u2019article 19-2 : la mise en demeure infructueuse a entra\u00een\u00e9 l\u2019exigibilit\u00e9 imm\u00e9diate des provisions trimestrielles non encore \u00e9chues. Il a ainsi condamn\u00e9 le copropri\u00e9taire \u00e0 502,42 \u20ac pour la p\u00e9riode du 15 ao\u00fbt au 31 d\u00e9cembre 2025. Cette solution est conforme au dispositif l\u00e9gal, mais elle soul\u00e8ve une question de proportionnalit\u00e9 : l\u2019exigibilit\u00e9 imm\u00e9diate porte sur des charges futures dont la r\u00e9alit\u00e9 d\u00e9pendra des d\u00e9penses effectives. La Cour de cassation, dans un arr\u00eat du 15 janvier 2026, a pr\u00e9cis\u00e9 que l\u2019article 19-2 s\u2019applique <em>&#8221; apr\u00e8s avoir constat\u00e9, selon le cas, l\u2019approbation par l\u2019assembl\u00e9e g\u00e9n\u00e9rale du budget pr\u00e9visionnel &#8220;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/6968b986cdc6046d475f29dc\" rel=\"nofollow\" target=\"_blank\">(Cass. 3e civ., 15 janvier 2026, n\u00b024-10.778)<\/a><\/strong>. Le tribunal a bien v\u00e9rifi\u00e9 cette approbation. Il a ainsi fait une application orthodoxe du m\u00e9canisme, tout en limitant la condamnation aux seules provisions non encore \u00e9chues et justifi\u00e9es.<\/p>\n<h2 id=\"ii-la-regulation-des-demandes-accessoires-et-lencadrement-de-la-reparation\">II. La r\u00e9gulation des demandes accessoires et l\u2019encadrement de la r\u00e9paration<\/h2>\n<p><\/p>\n<h3 id=\"a-la-limitation-des-frais-de-recouvrement-aux-actes-necessaires-et-justifies\">A. La limitation des frais de recouvrement aux actes n\u00e9cessaires et justifi\u00e9s<\/h3>\n<p>Le tribunal a strictement encadr\u00e9 la demande du syndicat au titre des frais de recouvrement, en se fondant sur l\u2019article 10-1 de la loi de 1965. Il a rappel\u00e9 que seuls sont imputables au copropri\u00e9taire les frais n\u00e9cessaires expos\u00e9s pour le recouvrement de la cr\u00e9ance. Il a \u00e9cart\u00e9 les frais relevant de la gestion courante, les honoraires non justifi\u00e9s et les actes inutiles. En l\u2019esp\u00e8ce, le syndicat r\u00e9clamait 1.648,25 \u20ac, mais le tribunal n\u2019a retenu que 121,25 \u20ac correspondant au co\u00fbt du commandement de payer. Cette solution est s\u00e9v\u00e8re pour le syndicat, mais elle traduit une volont\u00e9 de prot\u00e9ger le copropri\u00e9taire contre des frais excessifs ou non d\u00e9montr\u00e9s. Le juge a exig\u00e9 des pi\u00e8ces justificatives pr\u00e9cises, ce qui est conforme \u00e0 l\u2019exigence de proportionnalit\u00e9. En ne faisant pas droit \u00e0 la totalit\u00e9 de la demande, il a sanctionn\u00e9 l\u2019impr\u00e9cision du d\u00e9compte. Cette approche est coh\u00e9rente avec la jurisprudence ant\u00e9rieure qui distingue les frais n\u00e9cessaires des frais de gestion courante. Elle incite les syndics \u00e0 ne faire supporter au copropri\u00e9taire que les actes r\u00e9ellement indispensables, et non une somme forfaitaire de suivi contentieux.<\/p>\n<h3 id=\"b-le-rejet-des-dommages-interets-pour-absence-de-prejudice-distinct\">B. Le rejet des dommages-int\u00e9r\u00eats pour absence de pr\u00e9judice distinct<\/h3>\n<p>Le tribunal a rejet\u00e9 la demande de dommages-int\u00e9r\u00eats de 2.000 \u20ac, au motif que le syndicat ne d\u00e9montrait pas l\u2019existence d\u2019un pr\u00e9judice distinct de celui r\u00e9par\u00e9 par les int\u00e9r\u00eats moratoires. Il a rappel\u00e9 le principe de l\u2019article 1231-6 du code civil, selon lequel le retard dans le paiement d\u2019une somme d\u2019argent est r\u00e9par\u00e9 par les int\u00e9r\u00eats au taux l\u00e9gal, et que des dommages-int\u00e9r\u00eats suppl\u00e9mentaires n\u00e9cessitent une preuve de mauvaise foi et d\u2019un pr\u00e9judice ind\u00e9pendant. En l\u2019esp\u00e8ce, le syndicat n\u2019a fourni aucun \u00e9l\u00e9ment \u00e9tablissant un trouble anormal ou une r\u00e9sistance abusive. Cette d\u00e9cision est conforme \u00e0 une jurisprudence constante qui exige que le cr\u00e9ancier prouve un pr\u00e9judice distinct. Le rejet de cette demande n\u2019est donc pas surprenant, mais il souligne la rigueur du juge qui ne se contente pas d\u2019allouer des dommages-int\u00e9r\u00eats de fa\u00e7on automatique. Sur ce point, la d\u00e9cision s\u2019inscrit dans une tendance protectrice du copropri\u00e9taire d\u00e9biteur. Elle envoie un message clair aux syndicats : la simple d\u00e9faillance de paiement ne suffit pas \u00e0 justifier des dommages-int\u00e9r\u00eats. Le tribunal a \u00e9galement \u00e9cart\u00e9 la demande relative aux frais d\u2019ex\u00e9cution forc\u00e9e, les jugeant pr\u00e9matur\u00e9s.
