Le rejet de la demande de dommages et int\u00e9r\u00eats pour pr\u00e9judice non distinct<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Le Tribunal judiciaire de Marseille, statuant en r\u00e9f\u00e9r\u00e9 le 30 mars 2026, \u00e9tait saisi par le syndicat des copropri\u00e9taires d\u2019un ensemble immobilier. Le syndicat poursuivait le paiement de charges de copropri\u00e9t\u00e9 impay\u00e9es, de provisions \u00e0 \u00e9choir devenues exigibles et de frais de recouvrement. Une copropri\u00e9taire d\u00e9bitrice avait \u00e9t\u00e9 mise en demeure par lettre recommand\u00e9e du 20 juin 2025, rest\u00e9e infructueuse. Les assembl\u00e9es g\u00e9n\u00e9rales des 19 septembre 2023 et 10 d\u00e9cembre 2024 avaient approuv\u00e9 les comptes et vot\u00e9 les budgets pr\u00e9visionnels sans contestation dans le d\u00e9lai de l\u2019article 42 de la loi du 10 juillet 1965. Le syndicat r\u00e9clamait en justice le paiement de 2859,82 euros au titre des charges \u00e9chues, 465,62 euros pour les provisions \u00e0 \u00e9choir et 91,16 euros de frais de recouvrement, outre des dommages et int\u00e9r\u00eats. La question de droit portait sur la facult\u00e9 pour le pr\u00e9sident du tribunal, statuant selon la proc\u00e9dure acc\u00e9l\u00e9r\u00e9e au fond, de condamner un copropri\u00e9taire d\u00e9faillant au paiement des charges et provisions, y compris celles non encore \u00e9chues, et sur le contr\u00f4le judiciaire des frais de recouvrement et de la demande de dommages et int\u00e9r\u00eats. Le juge a condamn\u00e9 la copropri\u00e9taire \u00e0 verser 2859,82 euros de charges \u00e9chues, 465,62 euros de provisions \u00e0 \u00e9choir devenues imm\u00e9diatement exigibles, 45 euros de frais de recouvrement, a rejet\u00e9 la demande de dommages et int\u00e9r\u00eats, et l\u2019a condamn\u00e9e aux d\u00e9pens ainsi qu\u2019\u00e0 1405 euros sur le fondement de l\u2019article 700 du code de proc\u00e9dure civile.<\/p>\n<h2 id=\"i-lexigibilite-des-creances-de-charges-au-cur-du-dispositif-accelere\">I. L\u2019exigibilit\u00e9 des cr\u00e9ances de charges au c\u0153ur du dispositif acc\u00e9l\u00e9r\u00e9<\/h2>\n<p><\/p>\n<h3 id=\"a-la-constatation-de-la-defaillance-du-coproprietaire-au-regard-des-charges-echu\">A. La constatation de la d\u00e9faillance du copropri\u00e9taire au regard des charges \u00e9chues<\/h3>\n<p>Le juge a fond\u00e9 sa condamnation sur l\u2019approbation non contest\u00e9e des comptes par l\u2019assembl\u00e9e g\u00e9n\u00e9rale. Les proc\u00e8s-verbaux des 19 septembre 2023 et 10 d\u00e9cembre 2024 rendent la cr\u00e9ance certaine, liquide et exigible. Le copropri\u00e9taire qui n\u2019a pas attaqu\u00e9 la d\u00e9lib\u00e9ration dans le d\u00e9lai de deux mois pr\u00e9vu \u00e0 l\u2019article 42 de la loi du 10 juillet 1965 ne peut refuser le paiement. Le juge a v\u00e9rifi\u00e9 la r\u00e9gularit\u00e9 de la mise en demeure du 20 juin 2025, les d\u00e9comptes produits et le relev\u00e9 de compte arr\u00eat\u00e9 au 24 juillet 2025. Il a ainsi constat\u00e9 la d\u00e9faillance et condamn\u00e9 au paiement de 2859,82 euros avec int\u00e9r\u00eats de droit \u00e0 compter de la mise en demeure. Cette solution est conforme au m\u00e9canisme de la proc\u00e9dure acc\u00e9l\u00e9r\u00e9e au fond, qui exige seulement le constat de l\u2019approbation des comptes et de la d\u00e9faillance. La Cour de cassation rappelle que, dans ce cadre, <em>&#8221; le pr\u00e9sident du tribunal judiciaire statuant selon la proc\u00e9dure acc\u00e9l\u00e9r\u00e9e au fond, apr\u00e8s avoir constat\u00e9 [\u2026] l\u2019approbation par l\u2019assembl\u00e9e g\u00e9n\u00e9rale des copropri\u00e9taires du budget pr\u00e9visionnel, des travaux ou des comptes annuels, ainsi que la d\u00e9faillance du copropri\u00e9taire, condamne ce dernier au paiement des provisions ou sommes exigibles &#8220;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/6968b986cdc6046d475f29dc\" rel=\"nofollow\" target=\"_blank\">(Cass. Troisi\u00e8me chambre civile, 15 janvier 2026, n\u00b024-10.778)<\/a><\/strong>. Le juge n\u2019a donc pas exc\u00e9d\u00e9 ses pouvoirs.<\/p>\n<h3 id=\"b-lexigibilite-anticipee-des-provisions-a-echoir-sur-le-fondement-de-larticle-19\">B. L\u2019exigibilit\u00e9 anticip\u00e9e des provisions \u00e0 \u00e9choir sur le fondement de l\u2019article 19-2<\/h3>\n<p>Le jugement a \u00e9galement condamn\u00e9 la copropri\u00e9taire \u00e0 payer 465,62 euros correspondant aux provisions trimestrielles du 1er octobre au 31 d\u00e9cembre 2025. Le juge a fait application de l\u2019article 19-2 de la loi du 10 juillet 1965, qui dispose que, \u00e0 d\u00e9faut de versement d\u2019une provision due apr\u00e8s une mise en demeure rest\u00e9e infructueuse pendant trente jours, les provisions non encore \u00e9chues deviennent imm\u00e9diatement exigibles. En l\u2019esp\u00e8ce, la mise en demeure du 20 juin 2025 \u00e9tait rest\u00e9e sans effet au-del\u00e0 du d\u00e9lai de trente jours. L\u2019assembl\u00e9e g\u00e9n\u00e9rale du 10 d\u00e9cembre 2024 avait approuv\u00e9 le budget pr\u00e9visionnel pour 2025, ce qui rendait les provisions dues. Le juge a donc pu constater la d\u00e9faillance sur le fondement de la premi\u00e8re provision impay\u00e9e et \u00e9tendre l\u2019exigibilit\u00e9 \u00e0 l\u2019int\u00e9gralit\u00e9 des provisions \u00e0 \u00e9choir. La Cour d\u2019appel d\u2019Aix-en-Provence rappelle que ce m\u00e9canisme permet au juge de <em>&#8221; condamne[r] ce dernier au paiement des provisions ou sommes exigibles &#8220;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/6780be27780de3a214879ece\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel d\u2019Aix-en-Provence, 9 janvier 2025, n\u00b024\/03528)<\/a><\/strong>. Ce dispositif renforce l\u2019efficacit\u00e9 du recouvrement en \u00e9vitant la multiplication des proc\u00e9dures. Il sanctionne le copropri\u00e9taire d\u00e9faillant en rendant imm\u00e9diatement exigibles l\u2019ensemble des charges futures de l\u2019exercice.<\/p>\n<h2 id=\"ii-le-controle-des-accessoires-de-la-creance-par-le-juge-des-referes\">II. Le contr\u00f4le des accessoires de la cr\u00e9ance par le juge des r\u00e9f\u00e9r\u00e9s<\/h2>\n<p><\/p>\n<h3 id=\"a-la-limitation-des-frais-de-recouvrement-aux-seuls-frais-necessaires\">A. La limitation des frais de recouvrement aux seuls frais n\u00e9cessaires<\/h3>\n<p>Le syndicat r\u00e9clamait 91,16 euros au titre des frais de recouvrement sur le fondement de l\u2019article 10-1 de la loi du 10 juillet 1965. Le juge a op\u00e9r\u00e9 un contr\u00f4le strict de ces frais. Il a \u00e9cart\u00e9 la relance du 24 juillet 2025 faute de justification. Il a \u00e9galement rejet\u00e9 la relance du 6 septembre 2024, estimant qu\u2019elle n\u2019avait \u00e9t\u00e9 suivie ni d\u2019un paiement effectif ni d\u2019une proc\u00e9dure contentieuse, et que son utilit\u00e9 n\u2019\u00e9tait pas d\u00e9montr\u00e9e. En revanche, il a retenu la relance du 31 mars 2025 \u00e0 hauteur de 45 euros, la jugeant justifi\u00e9e et n\u00e9cessaire. Le juge applique ainsi une triple condition : le frais doit \u00eatre r\u00e9ellement expos\u00e9, inhabituel et n\u00e9cessaire au recouvrement. Seuls les actes utiles \u00e0 la poursuite de la cr\u00e9ance sont imputables au copropri\u00e9taire d\u00e9faillant. Cette appr\u00e9ciation souveraine permet d\u2019\u00e9viter que le syndicat ne facture des frais de gestion courante ou des relances inefficaces. Le montant final de 45 euros illustre la s\u00e9v\u00e9rit\u00e9 du contr\u00f4le judiciaire.<\/p>\n<h3 id=\"b-le-rejet-de-la-demande-de-dommages-et-interets-pour-prejudice-non-distinct\">B. Le rejet de la demande de dommages et int\u00e9r\u00eats pour pr\u00e9judice non distinct<\/h3>\n<p>Le syndicat sollicitait des dommages et int\u00e9r\u00eats en invoquant la mauvaise foi du copropri\u00e9taire. Le juge a rejet\u00e9 cette demande en application de l\u2019article 1231-6 du code civil. Ce texte dispose que les int\u00e9r\u00eats moratoires r\u00e9parent le pr\u00e9judice r\u00e9sultant du retard de paiement. Pour obtenir des dommages et int\u00e9r\u00eats suppl\u00e9mentaires, le cr\u00e9ancier doit justifier d\u2019un pr\u00e9judice distinct, ind\u00e9pendant du simple retard. En l\u2019esp\u00e8ce, le syndicat n\u2019a produit aucune pi\u00e8ce \u00e9tablissant une difficult\u00e9 financi\u00e8re particuli\u00e8re de la copropri\u00e9t\u00e9 ou une situation de tr\u00e9sorerie compromise. La simple affirmation de mauvaise foi ne suffit pas. Le juge a ainsi cantonn\u00e9 la r\u00e9paration au seul int\u00e9r\u00eat au taux l\u00e9gal. Cette solution est conforme \u00e0 la rigueur exig\u00e9e par le droit commun des obligations. Elle \u00e9vite que les syndicats de copropri\u00e9taires ne cumulent les int\u00e9r\u00eats moratoires et des dommages-int\u00e9r\u00eats sans d\u00e9montrer un pr\u00e9judice sp\u00e9cifique, pr\u00e9servant ainsi l\u2019\u00e9quilibre entre les parties.<\/p>\n<p><h2 id=\"jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/h2>\n<p><\/p>\n<ul class=\"jurisprudences-rag-sources\">\n<li><a href=\"https:\/\/www.courdecassation.fr\/decision\/6968b986cdc6046d475f29dc\" rel=\"nofollow\" target=\"_blank\">Cass. Dans ce cas, il est proc\u00e9d\u00e9 comme il est dit aux  alin\u00e9as 3 et 4 de l&#8217;article 37 de la loi n\u00b0 91-647 du 10 juillet 1991 .<\/p>\n<p>Dans tous les cas, le juge tient compte de l&#8217;\u00e9quit\u00e9 ou de la situation \u00e9conomique de la partie condamn\u00e9e. Il peut, m\u00eame d&#8217;office, pour des raisons tir\u00e9es des m\u00eames consid\u00e9rations, dire qu&#8217;il n&#8217;y a pas lieu \u00e0 ces condamnations.<\/p>\n<p>Les parties peuvent produire les justificatifs des sommes qu&#8217;elles demandent.<\/p>\n<\/p>\n<p> La somme allou\u00e9e au titre du 2\u00b0 ne peut \u00eatre inf\u00e9rieure \u00e0 la part contributive de l&#8217;Etat major\u00e9e de 50 %.<\/p>\n<\/p>\n<\/div>\n<\/div>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032010133\" rel=\"nofollow\" target=\"_blank\">Article 1231-6 du Code civil<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">\n<p>Les dommages et int\u00e9r\u00eats dus \u00e0 raison du retard dans le paiement d&#8217;une obligation de somme d&#8217;argent consistent dans l&#8217;int\u00e9r\u00eat au taux l\u00e9gal, \u00e0 compter de la mise en demeure.<\/p>\n<p>Ces dommages et int\u00e9r\u00eats sont dus sans que le cr\u00e9ancier soit tenu de justifier d&#8217;aucune perte.<\/p>\n<p>Le cr\u00e9ancier auquel son d\u00e9biteur en retard a caus\u00e9, par sa mauvaise foi, un pr\u00e9judice ind\u00e9pendant de ce retard, peut obtenir des dommages et int\u00e9r\u00eats distincts de l&#8217;int\u00e9r\u00eat moratoire.<\/p>\n<\/div>\n<\/div>\n<\/section>\n","protected":false},"excerpt":{"rendered":"<p>Le Tribunal judiciaire de Marseille, statuant en r\u00e9f\u00e9r\u00e9 le 30 mars 2026, \u00e9tait saisi par le syndicat des copropri\u00e9taires d\u2019un ensemble immobilier.
