Les modalit\u00e9s de l\u2019\u00e9chelonnement et la port\u00e9e de la d\u00e9cision<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Par jugement rendu le 30 mars 2026, le tribunal judiciaire de Lyon (P\u00f4le de la proximit\u00e9 et de la protection, PPP circuit long S3) avait \u00e0 conna\u00eetre d\u2019un litige locatif opposant une soci\u00e9t\u00e9 d\u2019\u00e9conomie mixte, bailleresse, \u00e0 un locataire. Un bail d\u2019habitation avait \u00e9t\u00e9 conclu le 29 juin 2023. Des loyers \u00e9tant demeur\u00e9s impay\u00e9s, un commandement de payer visant la clause r\u00e9solutoire fut d\u00e9livr\u00e9 le 18 mars 2024. Le locataire quitta les lieux le 15 novembre 2024. Par acte du 10 d\u00e9cembre 2024, la bailleresse assigna le locataire devant le juge des contentieux de la protection afin d\u2019obtenir le paiement des loyers impay\u00e9s et d\u2019une indemnit\u00e9 d\u2019occupation jusqu\u2019\u00e0 lib\u00e9ration effective. \u00c0 l\u2019audience du 16 d\u00e9cembre 2025, la bailleresse actualisa sa cr\u00e9ance \u00e0 7 983,16 euros. Le locataire ne contesta pas le montant et sollicita des d\u00e9lais de paiement. Le tribunal, par le jugement comment\u00e9, condamna le locataire \u00e0 payer cette somme, d\u00e9bouta la bailleresse de sa demande d\u2019indemnit\u00e9 d\u2019occupation au motif que les lieux avaient \u00e9t\u00e9 lib\u00e9r\u00e9s avant l\u2019assignation, et autorisa le locataire \u00e0 se lib\u00e9rer par vingt-trois mensualit\u00e9s de 330 euros et une derni\u00e8re \u00e9gale au solde, sur le fondement de l\u2019article 1343-5 du code civil. La question de droit principale \u00e9tait de savoir si le juge pouvait, apr\u00e8s le d\u00e9part volontaire du locataire et en l\u2019absence de r\u00e9siliation judiciaire du bail, \u00e0 la fois condamner ce dernier au paiement des loyers \u00e9chus, refuser l\u2019indemnit\u00e9 d\u2019occupation, et lui accorder des d\u00e9lais de paiement selon le droit commun. Le tribunal r\u00e9pond par l\u2019affirmative en faisant application de l\u2019article 1343-5 du code civil, et non de la loi du 6 juillet 1989.<\/p>\n<h2 id=\"i-la-liquidation-de-la-creance-locative-et-lincidence-du-depart-du-locataire\">I. La liquidation de la cr\u00e9ance locative et l\u2019incidence du d\u00e9part du locataire<\/h2>\n<p>Le tribunal fixe le montant de la dette locative et \u00e9carte la demande d\u2019indemnit\u00e9 d\u2019occupation, confirmant ainsi la port\u00e9e de la lib\u00e9ration des lieux sur l\u2019\u00e9tendue des obligations du locataire.<\/p>\n<h3 id=\"a-la-condamnation-au-paiement-des-loyers-impayes-sur-le-fondement-contractuel\">A. La condamnation au paiement des loyers impay\u00e9s sur le fondement contractuel<\/h3>\n<p>Le juge rappelle que l\u2019article 7 a) de la loi du 6 juillet 1989 impose au locataire l\u2019obligation de payer le loyer et les charges aux termes convenus. La bailleresse produit le contrat de bail et un d\u00e9compte final, duquel il ressort que le d\u00e9p\u00f4t de garantie a \u00e9t\u00e9 rembours\u00e9 et les frais non imputables au locataire d\u00e9duits. Le locataire reconna\u00eet lui-m\u00eame \u00eatre redevable de la somme demand\u00e9e. En cons\u00e9quence, le tribunal le condamne \u00e0 payer 7 983,16 euros. Cette solution est classique : la preuve de la cr\u00e9ance est rapport\u00e9e par le bailleur, et le juge applique strictement l\u2019obligation contractuelle. Il n\u2019y a pas de contestation s\u00e9rieuse. Le tribunal se fonde sur les \u00e9l\u00e9ments comptables fournis et sur la reconnaissance de dette du locataire, ce qui \u00e9vite toute discussion sur le quantum.<\/p>\n<h3 id=\"b-le-rejet-de-lindemnite-doccupation-consequence-de-la-restitution-des-lieux\">B. Le rejet de l\u2019indemnit\u00e9 d\u2019occupation, cons\u00e9quence de la restitution des lieux<\/h3>\n<p>La bailleresse sollicitait une indemnit\u00e9 d\u2019occupation jusqu\u2019\u00e0 la lib\u00e9ration effective. Or, le locataire a quitt\u00e9 les lieux le 15 novembre 2024, soit avant l\u2019assignation du 10 d\u00e9cembre 2024. Le tribunal rel\u00e8ve que <em>&#8220;l\u2019ensemble des sommes dues en application du contrat de bail sont incluses dans la demande principale en paiement, et il n\u2019est pas justifi\u00e9 d\u2019un maintien dans les lieux justifiant sa condamnation au paiement d\u2019une indemnit\u00e9 d\u2019occupation&#8221;<\/em>. Cette motivation rejoint la position de la Cour d\u2019appel d\u2019Aix-en-Provence, selon laquelle <em>&#8220;la restitution des locaux a lieu au moment o\u00f9 le propri\u00e9taire est mis en mesure de reprendre les lieux. Elle se distingue du simple fait consistant, pour le locataire, \u00e0 quitter mat\u00e9riellement le logement&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/680b1db82c124f4fd8d67356\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel d\u2019Aix-en-Provence, 24 avril 2025, n\u00b022\/13494)<\/a><\/strong>. Ici, le d\u00e9part du locataire a permis au bailleur de reprendre possession, de sorte qu\u2019aucune occupation post\u00e9rieure au 15 novembre 2024 n\u2019est justifi\u00e9e. Le tribunal refuse donc logiquement une indemnit\u00e9 d\u2019occupation, la dette locative \u00e9tant d\u00e9j\u00e0 arr\u00eat\u00e9e au jour du d\u00e9part.<\/p>\n<h2 id=\"ii-loctroi-de-delais-de-paiement-sous-lempire-du-droit-commun\">II. L\u2019octroi de d\u00e9lais de paiement sous l\u2019empire du droit commun<\/h2>\n<p>Le tribunal choisit d\u2019appliquer l\u2019article 1343-5 du code civil plut\u00f4t que les dispositions sp\u00e9cifiques de la loi de 1989, ce qui d\u00e9termine le r\u00e9gime et la port\u00e9e des d\u00e9lais accord\u00e9s.<\/p>\n<h3 id=\"a-le-fondement-retenu-larticle-1343-5-du-code-civil-a-lexclusion-de-la-loi-du-6-\">A. Le fondement retenu : l\u2019article 1343-5 du code civil, \u00e0 l\u2019exclusion de la loi du 6 juillet 1989<\/h3>\n<p>Le juge fonde sa d\u00e9cision sur l\u2019article 1343-5 du code civil, qui permet au juge, <em>&#8220;compte tenu de la situation du d\u00e9biteur et en consid\u00e9ration des besoins du cr\u00e9ancier, [de] reporter ou \u00e9chelonner, dans la limite de deux ann\u00e9es, le paiement des sommes dues&#8221;<\/em>. Il n\u2019est pas fait r\u00e9f\u00e9rence \u00e0 l\u2019article 24 V de la loi du 6 juillet 1989, qui ouvre au juge la facult\u00e9 d\u2019accorder des d\u00e9lais dans la limite de trois ann\u00e9es, par d\u00e9rogation \u00e0 l\u2019article 1343-5, <em>&#8220;\u00e0 la condition que le locataire soit en situation de r\u00e9gler sa dette locative et qu\u2019il ait repris le versement int\u00e9gral du loyer courant avant la date de l\u2019audience&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67b42596957d109ca3764306\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Colmar, 17 f\u00e9vrier 2025, n\u00b023\/04288)<\/a><\/strong>. En l\u2019esp\u00e8ce, le bail \u00e9tait r\u00e9sili\u00e9 par l\u2019effet de la clause r\u00e9solutoire ? Non, car le commandement de payer visant la clause r\u00e9solutoire avait \u00e9t\u00e9 d\u00e9livr\u00e9, mais le locataire a quitt\u00e9 les lieux avant l\u2019expiration du d\u00e9lai de deux mois et avant toute d\u00e9cision constatant la r\u00e9siliation. Le tribunal n\u2019a pas constat\u00e9 la r\u00e9siliation du bail. D\u00e8s lors, les conditions de l\u2019article 24 V (reprise du paiement int\u00e9gral du loyer courant) n\u2019\u00e9taient pas remplies. Le juge applique donc le droit commun des d\u00e9lais, dans la limite de deux ans, ce qui est plus protecteur pour le cr\u00e9ancier en termes de dur\u00e9e maximale. Il retient que le locataire per\u00e7oit environ 2 000 euros par mois et propose des mensualit\u00e9s de 330 euros, permettant un apurement dans les deux ans. Ce choix est juridiquement fond\u00e9 : en l\u2019absence de r\u00e9siliation judiciaire et de maintien dans les lieux, le r\u00e9gime sp\u00e9cial de la loi de 1989 n\u2019est pas applicable.<\/p>\n<h3 id=\"b-les-modalites-de-lechelonnement-et-la-portee-de-la-decision\">B. Les modalit\u00e9s de l\u2019\u00e9chelonnement et la port\u00e9e de la d\u00e9cision<\/h3>\n<p>Le tribunal accorde vingt-trois mensualit\u00e9s de 330 euros et une vingt-quatri\u00e8me \u00e9gale au solde, avec une clause de d\u00e9ch\u00e9ance du terme en cas de d\u00e9faut de paiement d\u2019une mensualit\u00e9 apr\u00e8s mise en demeure. Le dispositif mentionne que le premier versement doit intervenir dans le mois suivant la signification du jugement. Cette solution s\u2019inscrit dans la jurisprudence classique relative aux d\u00e9lais de gr\u00e2ce. Le tribunal ne pr\u00e9cise pas si la dette porte int\u00e9r\u00eats, mais l\u2019article 1343-5 du code civil pr\u00e9voit que les sommes dues portent int\u00e9r\u00eat au taux l\u00e9gal. En accordant ces d\u00e9lais, le juge fait preuve de pragmatisme social, tout en pr\u00e9servant les droits du bailleur par une clause r\u00e9solutoire de l\u2019\u00e9chelonnement. La port\u00e9e de cette d\u00e9cision est double : d\u2019une part, elle confirme que le d\u00e9part volontaire du locataire avant toute d\u00e9cision de justice ne prive pas le juge de son pouvoir d\u2019accorder des d\u00e9lais de paiement sur le fondement du droit commun, m\u00eame en mati\u00e8re locative ; d\u2019autre part, elle illustre la subsidiarit\u00e9 de la loi sp\u00e9ciale par rapport au code civil lorsque les conditions de l\u2019article 24 V ne sont pas r\u00e9unies.
