Les enseignements pour la pratique probatoire des acqu\u00e9reurs<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Le 30 mars 2026, le tribunal judiciaire de Marseille, p\u00f4le de proximit\u00e9, a rendu un jugement statuant sur une action en garantie des vices cach\u00e9s cons\u00e9cutive \u00e0 la vente d\u2019un v\u00e9hicule d\u2019occasion.<\/p>\n<p>Au mois d\u2019avril 2023, un particulier a acquis un v\u00e9hicule aupr\u00e8s d\u2019un vendeur pour un prix de 7 400 euros. Se plaignant de multiples d\u00e9sordres apparus d\u00e8s la mise en circulation, l\u2019acqu\u00e9reuse a mandat\u00e9 une soci\u00e9t\u00e9 sp\u00e9cialis\u00e9e qui a diligent\u00e9 une expertise non judiciaire. Le rapport, \u00e9tabli en avril 2024, concluait \u00e0 la dangerosit\u00e9 du v\u00e9hicule et \u00e0 l\u2019ant\u00e9riorit\u00e9 des vices. Par acte du 18 avril 2025, l\u2019acqu\u00e9reuse a assign\u00e9 le vendeur devant le tribunal judiciaire en r\u00e9solution de la vente et en indemnisation de ses pr\u00e9judices. En d\u00e9fense, le vendeur a conclu au d\u00e9bout\u00e9, contestant la valeur probante de l\u2019expertise non contradictoire et opposant le d\u00e9faut de preuve d\u2019un vice cach\u00e9.<\/p>\n<p>Le tribunal devait d\u00e9terminer si l\u2019expertise non judiciaire, r\u00e9alis\u00e9e \u00e0 la demande d\u2019une partie sans la participation effective de l\u2019autre, pouvait constituer une preuve suffisante de l\u2019existence d\u2019un vice cach\u00e9 au sens de l\u2019article 1641 du Code civil. Par son jugement du 30 mars 2026, le tribunal a d\u00e9bout\u00e9 l\u2019acqu\u00e9reuse de l\u2019ensemble de ses demandes, retenant qu\u2019il ne pouvait se fonder exclusivement sur ce rapport et que celle-ci \u00e9tait d\u00e9faillante dans la charge de la preuve.<\/p>\n<p>La d\u00e9cision soul\u00e8ve deux s\u00e9ries d\u2019interrogations. Il convient d\u2019abord d\u2019examiner la rigueur avec laquelle le juge a appr\u00e9ci\u00e9 la valeur probante de l\u2019expertise non judiciaire. Ensuite, une r\u00e9flexion sur les cons\u00e9quences de cette approche restrictive dans l\u2019administration de la preuve des vices s\u2019impose.<\/p>\n<h2 id=\"i-laffirmation-dun-principe-probatoire-restrictif-a-legard-de-lexpertise-non-jud\">I. L\u2019affirmation d\u2019un principe probatoire restrictif \u00e0 l\u2019\u00e9gard de l\u2019expertise non judiciaire<\/h2>\n<p>Le tribunal a rappel\u00e9 que le juge ne peut se fonder exclusivement sur une expertise non judiciaire, f\u00fbt-elle r\u00e9alis\u00e9e en pr\u00e9sence des parties. Ce principe, d\u00e9sormais constant, conduit \u00e0 un contr\u00f4le rigoureux de la preuve rapport\u00e9e.<\/p>\n<h3 id=\"a-le-rappel-du-principe-dinterdiction-du-fondement-exclusif\">A. Le rappel du principe d\u2019interdiction du fondement exclusif<\/h3>\n<p>Le tribunal a express\u00e9ment \u00e9nonc\u00e9 que <em>&#8221; le juge ne peut se fonder exclusivement sur une expertise non judiciaire r\u00e9alis\u00e9e \u00e0 la demande de l\u2019une des parties, peu importe qu\u2019elle l\u2019ait \u00e9t\u00e9 en pr\u00e9sence de celles-ci ou en l\u2019absence d\u2019une partie convoqu\u00e9e par courrier recommand\u00e9 &#8220;<\/em>. Cette formulation reprend la solution d\u00e9gag\u00e9e par la Cour d\u2019appel de Grenoble : <em>&#8221; Il est de principe que le juge ne peut se fonder exclusivement sur les conclusions d\u2019une expertise non judiciaire r\u00e9alis\u00e9e \u00e0 la demande de l\u2019une des parties \u00e0 laquelle l\u2019autre partie a \u00e9t\u00e9 r\u00e9guli\u00e8rement appel\u00e9e &#8220;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/6791dff01c87724b5e69d8bf\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Grenoble, 21 janvier 2025, n\u00b023\/02725)<\/a><\/strong>. Le juge marseillais applique donc strictement cette r\u00e8gle.<\/p>\n<p>En l\u2019esp\u00e8ce, le vendeur avait \u00e9t\u00e9 convoqu\u00e9 par courrier recommand\u00e9 du 6 mars 2024 \u00e0 une r\u00e9union d\u2019expertise fix\u00e9e au 2 avril 2024. Il n\u2019y avait pas particip\u00e9, se bornant \u00e0 demander des pr\u00e9cisions juridiques. Le tribunal a consid\u00e9r\u00e9 que cette situation ne suffisait pas \u00e0 rendre l\u2019expertise contradictoire au sens proc\u00e9dural. La non-participation effective de l\u2019adversaire, m\u00eame convoqu\u00e9, emp\u00eache l\u2019expertise de constituer une preuve d\u00e9cisive.<\/p>\n<h3 id=\"b-lapplication-rigoureuse-du-principe-a-la-charge-de-la-preuve\">B. L\u2019application rigoureuse du principe \u00e0 la charge de la preuve<\/h3>\n<p>En cons\u00e9quence, le juge a estim\u00e9 que l\u2019acqu\u00e9reuse \u00e9tait <em>&#8221; d\u00e9faillante dans la charge de la preuve d\u2019un vice cach\u00e9 &#8220;<\/em>. Il a relev\u00e9 que l\u2019expertise avait \u00e9t\u00e9 \u00e9tablie pr\u00e8s d\u2019un an apr\u00e8s la vente et que les constats techniques, bien qu\u2019ant\u00e9rieurs \u00e0 la vente, n\u2019\u00e9taient pas corrobor\u00e9s par d\u2019autres \u00e9l\u00e9ments. Le rapport mentionnait un kilom\u00e9trage de 37 750 kilom\u00e8tres, mais le certificat de cession en indiquait 37 400. La diff\u00e9rence minime n\u2019a pas \u00e9t\u00e9 jug\u00e9e probante. Le tribunal a \u00e9galement \u00e9cart\u00e9 une capture d\u2019\u00e9cran d\u2019une annonce non dat\u00e9e et non rattachable au litige.<\/p>\n<p>Cette application rigoureuse renforce l\u2019exigence probatoire. L\u2019acqu\u00e9reuse ne produisait aucun autre \u00e9l\u00e9ment, tel un constat d\u2019huissier ou une expertise judiciaire. Le seul rapport amiable, malgr\u00e9 la convocation de l\u2019autre partie, ne pouvait suffire \u00e0 caract\u00e9riser un vice au sens de l\u2019article 1641 du Code civil.<\/p>\n<h2 id=\"ii-les-limites-et-les-consequences-dune-preuve-exclusivement-technique\">II. Les limites et les cons\u00e9quences d\u2019une preuve exclusivement technique<\/h2>\n<p>Si le principe protecteur du contradictoire est l\u00e9gitime, son application stricte peut placer l\u2019acqu\u00e9reur dans une situation probatoire d\u00e9licate. La d\u00e9cision interroge sur l\u2019\u00e9quilibre entre la d\u00e9fense des droits du vendeur et la protection de l\u2019acheteur l\u00e9s\u00e9.<\/p>\n<h3 id=\"a-la-persistance-dune-possibilite-de-preuve-par-lexpertise-non-judiciaire\">A. La persistance d\u2019une possibilit\u00e9 de preuve par l\u2019expertise non judiciaire<\/h3>\n<p>La Cour de cassation a r\u00e9cemment temp\u00e9r\u00e9 la rigueur de ce principe. Elle a jug\u00e9 que <em>&#8221; si le juge ne peut fonder exclusivement sa d\u00e9cision sur un rapport d\u2019expertise non judiciaire, m\u00eame contradictoire, \u00e9tabli \u00e0 la demande d\u2019une partie, il en va diff\u00e9remment si les constatations et conclusions expertales portent sur un fait \u00e9tabli et non discut\u00e9 par les parties &#8220;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/68ef381110fb86995ec6ea66\" rel=\"nofollow\" target=\"_blank\">(Cass. 1\u00e8re civ., 15 octobre 2025, n\u00b024-15.281)<\/a><\/strong>. Cette jurisprudence ouvre une voie pour valoriser une expertise m\u00eame non judiciaire.<\/p>\n<p>En l\u2019esp\u00e8ce, le tribunal n\u2019a pas examin\u00e9 si certains faits relev\u00e9s par l\u2019expert pouvaient \u00eatre consid\u00e9r\u00e9s comme \u00e9tablis et non discut\u00e9s. Le vendeur contestait globalement le rapport, mais ne discutait pas pr\u00e9cis\u00e9ment chaque constatation technique. Par exemple, la fissure du montant de pare-brise, la fuite d\u2019huile ancienne ou le jeu radial de l\u2019amortisseur constituaient des constats mat\u00e9riels objectifs. Une analyse plus fine aurait pu conduire \u00e0 retenir certains de ces \u00e9l\u00e9ments comme des faits non s\u00e9rieusement contest\u00e9s.<\/p>\n<h3 id=\"b-les-enseignements-pour-la-pratique-probatoire-des-acquereurs\">B. Les enseignements pour la pratique probatoire des acqu\u00e9reurs<\/h3>\n<p>Cette d\u00e9cision rappelle la n\u00e9cessit\u00e9 pour l\u2019acqu\u00e9reur de diversifier ses moyens de preuve. L\u2019expertise non judiciaire, m\u00eame organis\u00e9e contradictoirement, ne suffit pas si elle est le seul \u00e9l\u00e9ment vers\u00e9 aux d\u00e9bats. L\u2019acqu\u00e9reur doit compl\u00e9ter son dossier par des constats d\u2019huissier ant\u00e9rieurs, des factures de r\u00e9paration, des t\u00e9moignages ou des diagnostics techniques r\u00e9alis\u00e9s avant l\u2019expertise.<\/p>\n<p>Le jugement du 30 mars 2026 illustre ainsi la difficult\u00e9 de prouver un vice cach\u00e9 dans le cadre d\u2019une vente entre particuliers. Le refus de participation du vendeur \u00e0 l\u2019expertise, suivi du rejet de cette expertise comme preuve exclusive, cr\u00e9e une impasse probatoire. L\u2019acqu\u00e9reur se trouve priv\u00e9 de tout recours efficace si le v\u00e9hicule n\u2019a pas \u00e9t\u00e9 soumis \u00e0 une mesure d\u2019instruction judiciaire dans un d\u00e9lai raisonnable.
