L&#8217;exigence d&#8217;une cause totalement \u00e9trang\u00e8re au travail<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Par un arr\u00eat contradictoire du 30 avril 2026, la chambre s\u00e9curit\u00e9 sociale de la Cour d&#8217;appel d&#8217;Angers a eu \u00e0 se prononcer sur l&#8217;\u00e9tendue de la pr\u00e9somption d&#8217;imputabilit\u00e9 des arr\u00eats et soins cons\u00e9cutifs \u00e0 un accident du travail. Le salari\u00e9 avait \u00e9t\u00e9 victime d&#8217;un accident le 20 mai 2021, avec br\u00fblures chimiques au bras gauche et au visage. Un certificat m\u00e9dical initial prescrivait un arr\u00eat jusqu&#8217;au 11 juin 2021, suivi d&#8217;une reprise du travail le 12 juin. La salari\u00e9e a ensuite cess\u00e9 son activit\u00e9 le 25 juin 2021, et des certificats de prolongation ont \u00e9t\u00e9 d\u00e9livr\u00e9s jusqu&#8217;au 22 novembre 2021, mentionnant \u00e0 la fois les br\u00fblures et un \u00e9tat anxiod\u00e9pressif. L&#8217;employeur a contest\u00e9 la prise en charge de ces arr\u00eats et soins au titre de la l\u00e9gislation professionnelle, soutenant qu&#8217;ils \u00e9taient sans lien avec l&#8217;accident initial.<\/p>\n<p>La juridiction de premi\u00e8re instance a fait droit aux pr\u00e9tentions de la caisse et a jug\u00e9 que la pr\u00e9somption d&#8217;imputabilit\u00e9 jouait et n&#8217;\u00e9tait pas renvers\u00e9e. L&#8217;employeur a interjet\u00e9 appel. Devant la cour, il a produit l&#8217;avis de son m\u00e9decin consultant, lequel estimait que les arr\u00eats post\u00e9rieurs au 25 juin 2021 \u00e9taient \u00e9trangers \u00e0 l&#8217;accident, en raison du caract\u00e8re b\u00e9nin des l\u00e9sions initiales et de l&#8217;absence de continuit\u00e9 des sympt\u00f4mes. La cour devait d\u00e9terminer si la pr\u00e9somption d&#8217;imputabilit\u00e9 s&#8217;applique en l&#8217;absence de continuit\u00e9 m\u00e9dicale et quelles sont les exigences probatoires pesant sur l&#8217;employeur pour la renverser.<\/p>\n<p>La cour rappelle que la combinaison des articles 1353 du code civil et L. 411-1 du code de la s\u00e9curit\u00e9 sociale instaure une pr\u00e9somption d&#8217;imputabilit\u00e9 pour toute l\u00e9sion survenue au temps et au lieu du travail, tant que la consolidation ou la gu\u00e9rison n&#8217;est pas intervenue. Elle \u00e9carte l&#8217;argument tir\u00e9 de l&#8217;absence de continuit\u00e9 des sympt\u00f4mes et soins, et pr\u00e9cise que la pr\u00e9somption s&#8217;applique d\u00e8s lors qu&#8217;un arr\u00eat de travail a \u00e9t\u00e9 initialement prescrit. L&#8217;employeur doit prouver que les soins et arr\u00eats sont exclusivement imputables \u00e0 une cause totalement \u00e9trang\u00e8re au travail. En l&#8217;esp\u00e8ce, l&#8217;avis du m\u00e9decin consultant, non document\u00e9, et l&#8217;existence d&#8217;un \u00e9tat anxiod\u00e9pressif invoqu\u00e9 parall\u00e8lement ne suffisent pas \u00e0 d\u00e9truire la pr\u00e9somption, d&#8217;autant que les certificats m\u00e9dicaux mentionnent toujours les br\u00fblures. La cour confirme le jugement et condamne l&#8217;employeur aux d\u00e9pens.<\/p>\n<h2 id=\"i-laffirmation-renforcee-de-la-presomption-dimputabilite-des-arrets-et-soins-a-l\">I. L&#8217;affirmation renforc\u00e9e de la pr\u00e9somption d&#8217;imputabilit\u00e9 des arr\u00eats et soins \u00e0 l&#8217;accident du travail<\/h2>\n<p><\/p>\n<h3 id=\"a-le-champ-etendu-de-la-presomption-legale-dimputabilite\">A. Le champ \u00e9tendu de la pr\u00e9somption l\u00e9gale d&#8217;imputabilit\u00e9<\/h3>\n<p>La cour rappelle que, conform\u00e9ment \u00e0 une jurisprudence constante, la pr\u00e9somption d&#8217;imputabilit\u00e9 couvre non seulement les l\u00e9sions initiales mais aussi leurs complications, l&#8217;aggravation d&#8217;un \u00e9tat ant\u00e9rieur et les soins destin\u00e9s \u00e0 pr\u00e9venir une aggravation, pendant toute la p\u00e9riode pr\u00e9c\u00e9dant la gu\u00e9rison ou la consolidation. Elle \u00e9tend cette pr\u00e9somption \u00e0 <em>&#8221; toute la dur\u00e9e d&#8217;incapacit\u00e9 de travail pr\u00e9c\u00e9dant soit la gu\u00e9rison compl\u00e8te, soit la consolidation de l&#8217;\u00e9tat de la victime &#8220;<\/em>. En l&#8217;esp\u00e8ce, la caisse a produit l&#8217;int\u00e9gralit\u00e9 des certificats m\u00e9dicaux, du certificat initial du 22 mai 2021 jusqu&#8217;\u00e0 la prolongation du 22 octobre 2021, tous visant les br\u00fblures d&#8217;origine chimique. La cour constate que les soins ont \u00e9t\u00e9 continus, m\u00eame si l&#8217;arr\u00eat de travail a connu une interruption entre le 12 et le 24 juin 2021. Cette interruption n&#8217;affecte pas le jeu de la pr\u00e9somption, car les certificats de prolongation post\u00e9rieurs mentionnent toujours les l\u00e9sions initiales. Ainsi, la pr\u00e9somption s&#8217;applique ind\u00e9pendamment d&#8217;une parfaite continuit\u00e9 temporelle des arr\u00eats, pourvu que les soins soient en lien avec l&#8217;accident.<\/p>\n<h3 id=\"b-le-role-limite-de-la-continuite-des-symptomes-et-soins\">B. Le r\u00f4le limit\u00e9 de la continuit\u00e9 des sympt\u00f4mes et soins<\/h3>\n<p>L&#8217;employeur soutenait que l&#8217;absence de continuit\u00e9 des sympt\u00f4mes et des soins entre le 12 juin et le 25 juin 2021 d\u00e9montrait l&#8217;absence d&#8217;imputabilit\u00e9. La cour \u00e9carte cet argument de mani\u00e8re nette, en citant le principe selon lequel <em>&#8221; l&#8217;absence de continuit\u00e9 des sympt\u00f4mes et soins est impropre \u00e0 \u00e9carter la pr\u00e9somption d&#8217;imputabilit\u00e9 \u00e0 l&#8217;accident du travail des soins et arr\u00eats de travail litigieux &#8220;<\/em>. Elle pr\u00e9cise que la pr\u00e9somption s&#8217;applique d\u00e8s lors qu&#8217;un arr\u00eat de travail a \u00e9t\u00e9 initialement prescrit ou que le certificat m\u00e9dical initial est assorti d&#8217;un arr\u00eat de travail. La seule p\u00e9riodicit\u00e9 des certificats de prolongation importe peu, tant que les l\u00e9sions d\u00e9crites sont en relation avec l&#8217;accident initial. En cons\u00e9quence, la charge de la preuve ne p\u00e8se pas sur la caisse, qui n&#8217;a pas \u00e0 justifier d&#8217;une continuit\u00e9 ininterrompue. Cette solution conforte la s\u00e9curit\u00e9 juridique du salari\u00e9 et de la caisse, en \u00e9vitant que de simples variations dans la prescription d&#8217;arr\u00eats ne remettent en cause l&#8217;imputabilit\u00e9 globale.<\/p>\n<h2 id=\"ii-la-rigueur-de-la-charge-de-la-preuve-pesant-sur-lemployeur\">II. La rigueur de la charge de la preuve pesant sur l&#8217;employeur<\/h2>\n<p><\/p>\n<h3 id=\"a-limpossibilite-de-renverser-la-presomption-par-des-arguments-non-documentes\">A. L&#8217;impossibilit\u00e9 de renverser la pr\u00e9somption par des arguments non document\u00e9s<\/h3>\n<p>L&#8217;employeur produisait l&#8217;avis d&#8217;un m\u00e9decin consultant qui, sans produire d&#8217;\u00e9l\u00e9ments m\u00e9dicaux objectifs, affirmait que les arr\u00eats post\u00e9rieurs au 25 juin 2021 \u00e9taient sans lien avec l&#8217;accident. La cour juge que <em>&#8221; ces arguments non document\u00e9s sur le plan m\u00e9dical [\u2026] ne sont pas de nature \u00e0 renverser la pr\u00e9somption d&#8217;imputabilit\u00e9 &#8220;<\/em>. Elle ajoute que l&#8217;article 146 alin\u00e9a 2 du code de proc\u00e9dure civile interdit de suppl\u00e9er la carence d&#8217;une partie par une mesure d&#8217;instruction. Ainsi, l&#8217;employeur ne peut se contenter d&#8217;une simple affirmation ; il doit apporter une preuve positive, par exemple un \u00e9tat pathologique pr\u00e9existant \u00e9voluant pour son propre compte. La jurisprudence d&#8217;appui de la Cour d&#8217;appel de Nancy, le 27 janvier 2025, illustre que, dans un contexte similaire, il est n\u00e9cessaire de v\u00e9rifier l&#8217;existence d&#8217;un lien de causalit\u00e9 par une expertise, mais ici l&#8217;employeur n&#8217;a pas sollicit\u00e9 une telle mesure alors qu&#8217;il en avait la possibilit\u00e9. Il s&#8217;expose donc au rejet de sa contestation.<\/p>\n<h3 id=\"b-lexigence-dune-cause-totalement-etrangere-au-travail\">B. L&#8217;exigence d&#8217;une cause totalement \u00e9trang\u00e8re au travail<\/h3>\n<p>La cour rappelle que pour renverser la pr\u00e9somption, l&#8217;employeur doit d\u00e9montrer que les soins et arr\u00eats sont <em>&#8221; exclusivement imputables \u00e0 une cause totalement \u00e9trang\u00e8re au travail &#8220;<\/em>. En l&#8217;esp\u00e8ce, l&#8217;employeur invoquait l&#8217;\u00e9tat anxiod\u00e9pressif de la salari\u00e9e, lequel ressortait des certificats m\u00e9dicaux. Cependant, la cour constate que les br\u00fblures directement li\u00e9es \u00e0 l&#8217;accident sont toujours mentionn\u00e9es dans ces certificats, et que l&#8217;\u00e9tat anxiod\u00e9pressif n&#8217;a pas \u00e9t\u00e9 reconnu comme imputable \u00e0 l&#8217;accident. D\u00e8s lors, ce dernier ne constitue pas une cause \u00e9trang\u00e8re exclusive. La cour souligne que <em>&#8221; l&#8217;existence d&#8217;un \u00e9tat anxiod\u00e9pressif n&#8217;a pas exclusivement justifi\u00e9 la prescription d&#8217;arr\u00eats de travail et de soins &#8220;<\/em>. Par ailleurs, la jurisprudence d&#8217;appui de la Cour d&#8217;appel de Paris, le 6 f\u00e9vrier 2025, montre qu&#8217;en mati\u00e8re de pr\u00e9judice corporel, une expertise coll\u00e9giale peut \u00eatre ordonn\u00e9e pour \u00e9valuer les liens de causalit\u00e9, mais en l&#8217;esp\u00e8ce l&#8217;employeur n&#8217;a pas d\u00e9montr\u00e9 que les arr\u00eats \u00e9taient totalement ind\u00e9pendants du travail. Il peut \u00eatre \u00e9tabli selon les formes que les parties contractantes d\u00e9cident d&#8217;adopter.<\/p>\n<\/p>\n<\/div>\n<\/div>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000036762081\" rel=\"nofollow\" target=\"_blank\">Article L. 1233-3 du Code du travail<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">\n<p>Constitue un licenciement pour motif \u00e9conomique le licenciement effectu\u00e9 par un employeur pour un ou plusieurs motifs non inh\u00e9rents \u00e0 la personne du salari\u00e9 r\u00e9sultant d&#8217;une suppression ou transformation d&#8217;emploi ou d&#8217;une modification, refus\u00e9e par le salari\u00e9, d&#8217;un \u00e9l\u00e9ment essentiel du contrat de travail, cons\u00e9cutives notamment :<\/p>\n<p>1\u00b0 A des difficult\u00e9s \u00e9conomiques caract\u00e9ris\u00e9es soit par l&#8217;\u00e9volution significative d&#8217;au moins un indicateur \u00e9conomique tel qu&#8217;une baisse des commandes ou du chiffre d&#8217;affaires, des pertes d&#8217;exploitation ou une d\u00e9gradation de la tr\u00e9sorerie ou de l&#8217;exc\u00e9dent brut d&#8217;exploitation, soit par tout autre \u00e9l\u00e9ment de nature \u00e0 justifier de ces difficult\u00e9s.<\/p>\n<p>Une baisse significative des commandes ou du chiffre d&#8217;affaires est constitu\u00e9e d\u00e8s lors que la dur\u00e9e de cette baisse est, en comparaison avec la m\u00eame p\u00e9riode de l&#8217;ann\u00e9e pr\u00e9c\u00e9dente, au moins \u00e9gale \u00e0 :<\/p>\n<p>a) Un trimestre pour une entreprise de moins de onze salari\u00e9s ;<\/p>\n<p>b) Deux trimestres cons\u00e9cutifs pour une entreprise d&#8217;au moins onze salari\u00e9s et de moins de cinquante salari\u00e9s ;<\/p>\n<p>c) Trois trimestres cons\u00e9cutifs pour une entreprise d&#8217;au moins cinquante salari\u00e9s et de moins de trois cents salari\u00e9s ;<\/p>\n<p>d) Quatre trimestres cons\u00e9cutifs pour une entreprise de trois cents salari\u00e9s et plus ;<\/p>\n<p>2\u00b0 A des mutations technologiques ;<\/p>\n<p>3\u00b0 A une r\u00e9organisation de l&#8217;entreprise n\u00e9cessaire \u00e0 la sauvegarde de sa comp\u00e9titivit\u00e9 ;<\/p>\n<p>4\u00b0 A la cessation d&#8217;activit\u00e9 de l&#8217;entreprise.<\/p>\n<p>La mat\u00e9rialit\u00e9 de la suppression, de la transformation d&#8217;emploi ou de la modification d&#8217;un \u00e9l\u00e9ment essentiel du contrat de travail s&#8217;appr\u00e9cie au niveau de l&#8217;entreprise.<\/p>\n<p>Les difficult\u00e9s \u00e9conomiques, les mutations technologiques ou la n\u00e9cessit\u00e9 de sauvegarder la comp\u00e9titivit\u00e9 de l&#8217;entreprise s&#8217;appr\u00e9cient au niveau de cette entreprise si elle n&#8217;appartient pas \u00e0 un groupe et, dans le cas contraire, au niveau du secteur d&#8217;activit\u00e9 commun \u00e0 cette entreprise et aux entreprises du groupe auquel elle appartient, \u00e9tablies sur le territoire national, sauf fraude.<\/p>\n<p>Pour l&#8217;application du pr\u00e9sent article, la notion de groupe d\u00e9signe le groupe form\u00e9 par une entreprise appel\u00e9e entreprise dominante et les entreprises qu&#8217;elle contr\u00f4le dans les conditions d\u00e9finies \u00e0 l&#8217;article L. 233-1, aux I et II de l&#8217;article L. 233-3 et \u00e0 l&#8217;article L. 233-16 du code de commerce.<\/p>\n<p>Le secteur d&#8217;activit\u00e9 permettant d&#8217;appr\u00e9cier la cause \u00e9conomique du licenciement est caract\u00e9ris\u00e9, notamment, par la nature des produits biens ou services d\u00e9livr\u00e9s, la client\u00e8le cibl\u00e9e, ainsi que les r\u00e9seaux et modes de distribution, se rapportant \u00e0 un m\u00eame march\u00e9.<\/p>\n<p>Les dispositions du pr\u00e9sent chapitre sont applicables \u00e0 toute rupture du contrat de travail r\u00e9sultant de l&#8217;une des causes \u00e9nonc\u00e9es au pr\u00e9sent article, \u00e0 l&#8217;exclusion de la rupture conventionnelle vis\u00e9e aux articles L. 1237-11 et suivants et de la rupture d&#8217;un commun accord dans le cadre d&#8217;un accord collectif vis\u00e9e aux articles L. 1237-17 et suivants.<\/p>\n<\/div>\n<\/div>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032042341\" rel=\"nofollow\" target=\"_blank\">Article 1353 du Code civil<\/a> <span class=\"fj-badge fj-en-vigueur\">En
