La port\u00e9e de l&#8217;obligation d&#8217;information et ses limites<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Le 30 avril 2026, la Cour d&#8217;appel de Douai (chambre sociale B, n\u00b024\/02211) \u00e9tait saisie d&#8217;un litige relatif \u00e0 la prescription d&#8217;une action en contestation de la rupture du contrat de travail cons\u00e9cutive \u00e0 l&#8217;adh\u00e9sion \u00e0 un contrat de s\u00e9curisation professionnelle (CSP). Une salari\u00e9e, licenci\u00e9e pour motif \u00e9conomique par une lettre conservatoire dat\u00e9e du 23 avril 2018 et re\u00e7ue le 24 avril suivant, avait adh\u00e9r\u00e9 au CSP le 26 avril 2018 en signant un bulletin d&#8217;acceptation. Elle avait saisi le conseil de prud&#8217;hommes le 14 mai 2019 afin de contester la rupture. L&#8217;employeur avait soulev\u00e9 une fin de non-recevoir tir\u00e9e de la prescription de douze mois pr\u00e9vue par l&#8217;article L.1233-67 du code du travail. Le conseil de prud&#8217;hommes avait rejet\u00e9 cette exception et statu\u00e9 au fond. Les juges d&#8217;appel \u00e9taient donc amen\u00e9s \u00e0 d\u00e9terminer si l&#8217;action \u00e9tait prescrite. La question de droit centrale portait sur le point de d\u00e9part du d\u00e9lai de prescription de l&#8217;action en contestation de la rupture, dans le cadre d&#8217;une adh\u00e9sion au CSP, et sur les conditions d&#8217;opposabilit\u00e9 de ce d\u00e9lai au salari\u00e9. La cour a infirm\u00e9 le jugement et d\u00e9clar\u00e9 irrecevables les pr\u00e9tentions de la salari\u00e9e, consid\u00e9rant que l&#8217;action introduite le 14 mai 2019 \u00e9tait prescrite, le point de d\u00e9part \u00e9tant fix\u00e9 au 26 avril 2018, date de l&#8217;adh\u00e9sion. Le commentaire analysera d&#8217;abord la confirmation du point de d\u00e9part du d\u00e9lai \u00e0 la date d&#8217;adh\u00e9sion au CSP, puis la rigueur de l&#8217;exigence d&#8217;information du salari\u00e9 comme condition d&#8217;opposabilit\u00e9 de ce d\u00e9lai.<\/p>\n<h2 id=\"i-la-fixation-du-point-de-depart-du-delai-de-prescription-a-la-date-dadhesion-au\">I. La fixation du point de d\u00e9part du d\u00e9lai de prescription \u00e0 la date d&#8217;adh\u00e9sion au CSP<\/h2>\n<p><\/p>\n<h3 id=\"a-le-fondement-textuel-et-linterpretation-retenue-par-la-cour\">A. Le fondement textuel et l&#8217;interpr\u00e9tation retenue par la cour<\/h3>\n<p>L&#8217;article L.1233-67 du code du travail dispose que l&#8217;adh\u00e9sion au CSP emporte rupture du contrat de travail et que toute contestation portant sur cette rupture ou son motif se prescrit par douze mois \u00e0 compter de l&#8217;adh\u00e9sion. La cour d&#8217;appel applique strictement ce texte. Elle rel\u00e8ve que la salari\u00e9e a sign\u00e9 le bulletin d&#8217;acceptation le 26 avril 2018 et que ce document mentionne express\u00e9ment qu&#8217;elle accepte le CSP. Elle \u00e9carte l&#8217;argument selon lequel la salari\u00e9e n&#8217;aurait pas eu connaissance de la port\u00e9e de sa signature. La solution est claire : <em>&#8220;l&#8217;adh\u00e9sion au contrat de s\u00e9curisation professionnelle emporte rupture du contrat de travail&#8221;<\/em> et le d\u00e9lai court \u00e0 compter de cette adh\u00e9sion. La cour v\u00e9rifie que la salari\u00e9e a \u00e9t\u00e9 inform\u00e9e du d\u00e9lai, tant par la lettre de licenciement que par le document type d&#8217;information. Cette interpr\u00e9tation litt\u00e9rale est conforme \u00e0 la jurisprudence ant\u00e9rieure. La Cour d&#8217;appel de Toulouse, dans une esp\u00e8ce similaire, avait d\u00e9j\u00e0 jug\u00e9 que <em>&#8220;la lettre de licenciement, qui visait le d\u00e9lai de douze mois, lui avait \u00e9t\u00e9 notifi\u00e9e au plus tard le 23 mars 2013, date qui r\u00e9sulte de ses propres mentions manuscrites sur le formulaire d&#8217;adh\u00e9sion&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/6811aeb381f47e994feb2689\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Toulouse, 29 avril 2025, n\u00b022\/01714)<\/a><\/strong>. La date d&#8217;adh\u00e9sion constitue donc le point de d\u00e9part objectif, sans \u00e9gard \u00e0 la date \u00e0 laquelle la rupture produit ses effets.<\/p>\n<h3 id=\"b-lindifference-du-report-des-effets-de-la-rupture-sur-la-computation-du-delai\">B. L&#8217;indiff\u00e9rence du report des effets de la rupture sur la computation du d\u00e9lai<\/h3>\n<p>La salari\u00e9e soutenait que la rupture n&#8217;\u00e9tait effective qu&#8217;\u00e0 l&#8217;expiration du d\u00e9lai de r\u00e9flexion de vingt et un jours, ce qui aurait report\u00e9 le point de d\u00e9part de la prescription. La cour \u00e9carte cette argumentation en rappelant que <em>&#8220;l&#8217;adh\u00e9sion emporte rupture du contrat de travail dont les effets sont report\u00e9s \u00e0 l&#8217;expiration du d\u00e9lai de r\u00e9flexion de 21 jours, mais que ce report des effets de la rupture n&#8217;a pas d&#8217;incidence sur le point de d\u00e9part du d\u00e9lai de prescription&#8221;<\/em>. Cette distinction entre la rupture-jouissance et la rupture-naissance est fondamentale. Le l\u00e9gislateur a entendu que le d\u00e9lai court d\u00e8s l&#8217;adh\u00e9sion, moment o\u00f9 le salari\u00e9 manifeste sa volont\u00e9. La cour pr\u00e9cise \u00e9galement que la mention erron\u00e9e de la date d&#8217;adh\u00e9sion sur le document de P\u00f4le emploi (17 mai 2018) est indiff\u00e9rente, puisque la salari\u00e9e avait re\u00e7u toutes les informations utiles avant cette date. En fixant le point de d\u00e9part au 26 avril 2018, la cour assure une s\u00e9curit\u00e9 juridique pour l&#8217;employeur, qui peut conna\u00eetre avec certitude le terme du d\u00e9lai. La prescription a donc \u00e9t\u00e9 acquise le 26 avril 2019, rendant l&#8217;action du 14 mai 2019 irrecevable. Cette solution est logique au regard de l&#8217;objectif de c\u00e9l\u00e9rit\u00e9 des contestations des licenciements \u00e9conomiques.<\/p>\n<h2 id=\"ii-lopposabilite-du-delai-subordonnee-a-une-information-prealable-du-salarie\">II. L&#8217;opposabilit\u00e9 du d\u00e9lai subordonn\u00e9e \u00e0 une information pr\u00e9alable du salari\u00e9<\/h2>\n<p><\/p>\n<h3 id=\"a-la-caracterisation-dune-information-suffisante-par-lemployeur\">A. La caract\u00e9risation d&#8217;une information suffisante par l&#8217;employeur<\/h3>\n<p>L&#8217;article L.1233-67 pr\u00e9voit que le d\u00e9lai de douze mois n&#8217;est opposable au salari\u00e9 que s&#8217;il en a \u00e9t\u00e9 fait mention dans la proposition de CSP. La cour examine donc si l&#8217;employeur a rapport\u00e9 la preuve de cette information. Elle constate que la lettre de licenciement du 23 avril 2018 rappelait les dispositions de l&#8217;article L.1233-67 en mati\u00e8re de prescription. De plus, le document type <em>&#8220;information pour le salari\u00e9&#8221;<\/em>, produit en pi\u00e8ce 15, mentionnait express\u00e9ment que <em>&#8220;toute contestation portant sur la rupture du contrat de travail ou son motif se prescrit par 12 mois \u00e0 compter de l&#8217;adh\u00e9sion au contrat de s\u00e9curisation professionnelle&#8221;<\/em>. La cour en d\u00e9duit que la salari\u00e9e <em>&#8220;en avait parfaitement connaissance&#8221;<\/em>. L&#8217;adh\u00e9sion elle-m\u00eame, formalis\u00e9e par la signature du bulletin d&#8217;acceptation, vaut \u00e9galement prise de connaissance des informations contenues dans le document d&#8217;information. Cette approche est rigoureuse : l&#8217;employeur doit non seulement remettre les documents, mais aussi \u00eatre en mesure de d\u00e9montrer que le salari\u00e9 a \u00e9t\u00e9 inform\u00e9 du d\u00e9lai. La Cour d&#8217;appel de Besan\u00e7on, dans un contexte diff\u00e9rent, avait \u00e9galement exig\u00e9 une preuve concr\u00e8te de l&#8217;ex\u00e9cution de l&#8217;obligation d&#8217;information par l&#8217;employeur <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67b5788affd9281fcee24b38\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Besan\u00e7on, 18 f\u00e9vrier 2025, n\u00b023\/00975)<\/a><\/strong>. En l&#8217;esp\u00e8ce, la cour estime que la preuve est suffisante.<\/p>\n<h3 id=\"b-la-portee-de-lobligation-dinformation-et-ses-limites\">B. La port\u00e9e de l&#8217;obligation d&#8217;information et ses limites<\/h3>\n<p>La solution de la cour d&#8217;appel de Douai s&#8217;inscrit dans une lecture protectrice du salari\u00e9, tout en consacrant une opposabilit\u00e9 conditionnelle du d\u00e9lai. Si l&#8217;employeur ne d\u00e9montre pas avoir inform\u00e9 le salari\u00e9 du d\u00e9lai de prescription, celui-ci ne peut lui \u00eatre oppos\u00e9. En revanche, d\u00e8s lors que l&#8217;information est \u00e9tablie, le d\u00e9lai court imp\u00e9rativement \u00e0 compter de l&#8217;adh\u00e9sion. La cour ne fait pas droit \u00e0 l&#8217;argument selon lequel la mention dans la lettre de licenciement serait insuffisante, car elle combine plusieurs \u00e9l\u00e9ments : la lettre, le document d&#8217;information et le bulletin d&#8217;acceptation. Cette exigence d&#8217;information pr\u00e9alable a pour effet de garantir le droit au recours du salari\u00e9, mais elle n&#8217;emp\u00eache pas la prescription de jouer lorsque l&#8217;employeur a rempli son obligation. En l&#8217;esp\u00e8ce, la salari\u00e9e ne pouvait ignorer le d\u00e9lai, d&#8217;autant qu&#8217;elle avait sign\u00e9 un document mentionnant l&#8217;article L.1233-67. La d\u00e9cision est donc conforme \u00e0 la lettre du texte, mais elle laisse une marge d&#8217;appr\u00e9ciation aux juges du fond sur le caract\u00e8re suffisant de l&#8217;information. \u00c0 l&#8217;avenir, il conviendra de s&#8217;interroger sur le contenu pr\u00e9cis de l&#8217;information requise : la simple mention du d\u00e9lai dans un document type annex\u00e9 \u00e0 la proposition est-elle suffisante, ou faut-il une information individualis\u00e9e ? La cour semble admettre une information g\u00e9n\u00e9rique, d\u00e8s lors qu&#8217;elle est port\u00e9e \u00e0 la connaissance du salari\u00e9. Les salari\u00e9s mis \u00e0 disposition ne sont pas \u00e9ligibles dans l&#8217;entreprise utilisatrice. <\/p>\n<p>Les salari\u00e9s mis \u00e0 disposition qui remplissent les conditions mentionn\u00e9es au premier alin\u00e9a choisissent s&#8217;ils exercent leur droit de vote dans l&#8217;entreprise qui les emploie ou l&#8217;entreprise utilisatrice.<\/p>\n<\/div>\n<\/div>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000031014016\" rel=\"nofollow\" target=\"_blank\">Article L. 1233-67 du Code du travail<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">\n<p>L&#8217;adh\u00e9sion du salari\u00e9 au contrat de s\u00e9curisation professionnelle emporte rupture du contrat de travail. Toute contestation portant sur la rupture du contrat de travail ou son motif se prescrit par douze mois \u00e0 compter de l&#8217;adh\u00e9sion au contrat de s\u00e9curisation professionnelle. Ce d\u00e9lai n&#8217;est opposable au salari\u00e9 que s&#8217;il en a \u00e9t\u00e9 fait mention dans la proposition de contrat de s\u00e9curisation professionnelle. <\/p>\n<p>Cette rupture du contrat de travail, qui ne comporte ni pr\u00e9avis ni indemnit\u00e9 compensatrice de pr\u00e9avis ouvre droit \u00e0 l&#8217;indemnit\u00e9 pr\u00e9vue \u00e0 l&#8217;article L. 1234-9 et \u00e0 toute indemnit\u00e9 conventionnelle qui aurait \u00e9t\u00e9 due en cas de licenciement pour motif \u00e9conomique au terme du pr\u00e9avis ainsi que, le cas \u00e9ch\u00e9ant, au solde de ce qu&#8217;aurait \u00e9t\u00e9 l&#8217;indemnit\u00e9 compensatrice de pr\u00e9avis en cas de licenciement et apr\u00e8s d\u00e9falcation du versement de l&#8217;employeur repr\u00e9sentatif de cette indemnit\u00e9 mentionn\u00e9 au 10\u00b0 de l&#8217;article L. 1233-68. Les r\u00e9gimes social et fiscal applicables \u00e0 ce solde sont ceux applicables aux indemnit\u00e9s compensatrices de pr\u00e9avis. <\/p>\n<p>Apr\u00e8s l&#8217;adh\u00e9sion au contrat de s\u00e9curisation professionnelle, le b\u00e9n\u00e9ficiaire peut mobiliser le compte personnel de formation mentionn\u00e9 \u00e0 l&#8217;article L. 6323-1. <\/p>\n<p>Pendant l&#8217;ex\u00e9cution du contrat de s\u00e9curisation professionnelle, le salari\u00e9 est plac\u00e9 sous le statut de stagiaire de la formation professionnelle. <\/p>\n<p>Le contrat de s\u00e9curisation professionnelle peut comprendre des p\u00e9riodes de travail r\u00e9alis\u00e9es dans les conditions pr\u00e9vues au 3\u00b0 de l&#8217;article L. 1233-68.<\/p>\n<\/div>\n<\/div>\n<\/section>\n<section class=\"closing\" id=\"envoyer-pieces\" style=\"margin:48px 0 36px;padding:48px 36px;text-align:center;border-radius:24px;background:radial-gradient(circle at 50% 0%,rgba(0,0,204,0.08) 0%,transparent 60%),rgba(255,255,255,0.72);border:1px solid rgba(10,10,10,0.08);\">\n<div class=\"closing-heading\" role=\"heading\" aria-level=\"2\" style=\"font-size:clamp(30px,4vw,44px);line-height:1.18;font-weight:700;margin:0 0 18px;letter-spacing:-0.022em;color:#1B1B1B;font-family:Lato,sans-serif;\">Envoyez vos pi\u00e8ces.
