Le rejet de l&#8217;argument tir\u00e9 de la faute personnelle du dirigeant<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Le 30 avril 2026, la Cour d&#8217;appel de Douai (chambre sociale, salle 2, n\u00b025\/00214) a statu\u00e9 sur le litige opposant un salari\u00e9 \u00e0 l&#8217;Association pour la gestion du r\u00e9gime de Garantie des cr\u00e9ances des Salari\u00e9s (AGS), dans le cadre d&#8217;une proc\u00e9dure collective ouverte \u00e0 l&#8217;encontre de la soci\u00e9t\u00e9 employeur. Les faits remontent au 11 juillet 2022, date \u00e0 laquelle le salari\u00e9 a d\u00e9but\u00e9 une relation de travail non formalis\u00e9e avec la soci\u00e9t\u00e9, avant qu&#8217;un contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e ne soit r\u00e9gularis\u00e9 \u00e0 compter du 22 ao\u00fbt suivant. La rupture du contrat est intervenue le 1er septembre 2022. Le 16 novembre 2023, un jugement de liquidation judiciaire a \u00e9t\u00e9 prononc\u00e9 \u00e0 l&#8217;encontre de la soci\u00e9t\u00e9. Le conseil de prud&#8217;hommes, saisi par le salari\u00e9, a notamment requalifi\u00e9 la relation en contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e, requalifi\u00e9 la rupture en licenciement sans cause r\u00e9elle et s\u00e9rieuse, fix\u00e9 des cr\u00e9ances au passif et allou\u00e9 une indemnit\u00e9 forfaitaire pour travail dissimul\u00e9 sur le fondement des articles L.8221-5 et L.8223-1 du code du travail. L&#8217;AGS a interjet\u00e9 appel, demandant \u00e0 la cour d&#8217;exclure cette indemnit\u00e9 de sa garantie. Le salari\u00e9 a soulev\u00e9 une fin de non-recevoir, arguant du caract\u00e8re nouveau de cette demande en appel. La question de droit centrale est de savoir si l&#8217;indemnit\u00e9 forfaitaire pour travail dissimul\u00e9, n\u00e9e de la rupture du contrat de travail ant\u00e9rieure au jugement d&#8217;ouverture, est couverte par la garantie de l&#8217;AGS, nonobstant l&#8217;intention frauduleuse de l&#8217;employeur et la faute personnelle invoqu\u00e9e du dirigeant. La cour d&#8217;appel a rejet\u00e9 la fin de non-recevoir, confirm\u00e9 le jugement en toutes ses dispositions, et d\u00e9bout\u00e9 l&#8217;AGS de sa demande tendant \u00e0 exclure de sa garantie les sommes allou\u00e9es au titre de l&#8217;indemnit\u00e9 pour travail dissimul\u00e9.<\/p>\n<h2 id=\"i-la-confirmation-de-la-caracterisation-du-travail-dissimule-et-de-ses-consequen\">I. La confirmation de la caract\u00e9risation du travail dissimul\u00e9 et de ses cons\u00e9quences indemnitaires<\/h2>\n<p><\/p>\n<h3 id=\"a-lelement-materiel-et-intentionnel-du-travail-dissimule-etabli-par-la-cour\">A. L&#8217;\u00e9l\u00e9ment mat\u00e9riel et intentionnel du travail dissimul\u00e9 \u00e9tabli par la cour<\/h3>\n<p>La cour rappelle que la relation de travail salari\u00e9e a d\u00e9but\u00e9 le 11 juillet 2022, comme le constatent les chefs du jugement devenus d\u00e9finitifs. Le mandataire liquidateur, non comparant, ne rapporte la preuve ni d&#8217;une d\u00e9claration pr\u00e9alable \u00e0 l&#8217;embauche, ni de la d\u00e9livrance de bulletins de salaire pour la p\u00e9riode du 11 juillet au 21 ao\u00fbt 2022. L&#8217;employeur, en formalisant ult\u00e9rieurement un contrat de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e \u00e0 compter du 22 ao\u00fbt 2022 et en \u00e9ditant des bulletins de salaire \u00e0 partir de cette date, d\u00e9montre qu&#8217;il n&#8217;ignorait pas les formalit\u00e9s requises. La cour en d\u00e9duit que l&#8217;absence de r\u00e9gularisation de la relation de travail entre le 11 juillet et le 21 ao\u00fbt 2022 <em>&#8220;caract\u00e9rise l&#8217;intention de dissimuler l&#8217;emploi salari\u00e9&#8221;<\/em> de l&#8217;int\u00e9ress\u00e9 au cours de cette p\u00e9riode. Elle \u00e9carte ainsi toute absence d&#8217;intention frauduleuse, contrairement \u00e0 ce que retient une autre formation dans une esp\u00e8ce o\u00f9 l&#8217;employeur avait \u00e9tabli un contrat \u00e9crit et n&#8217;avait pas vers\u00e9 de salaire sur une p\u00e9riode tr\u00e8s br\u00e8ve, jugeant que <em>&#8220;l&#8217;intention de M. [P] [F] de commettre le d\u00e9lit de travail dissimul\u00e9 n&#8217;\u00e9tait pas suffisamment d\u00e9montr\u00e9e&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67d128017f5c3e60b8906270\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Colmar, le 11 mars 2025, n\u00b022\/02875)<\/a><\/strong>. En l&#8217;esp\u00e8ce, le comportement de l&#8217;employeur \u2013 connaissance des formalit\u00e9s, absence de r\u00e9gularisation malgr\u00e9 la formalisation ult\u00e9rieure \u2013 \u00e9tablit l&#8217;\u00e9l\u00e9ment intentionnel requis.<\/p>\n<h3 id=\"b-lindemnite-forfaitaire-justifiee-comme-consequence-de-la-rupture-du-contrat\">B. L&#8217;indemnit\u00e9 forfaitaire justifi\u00e9e comme cons\u00e9quence de la rupture du contrat<\/h3>\n<p>La cour, apr\u00e8s avoir constat\u00e9 la rupture du contrat de travail intervenue le 1er septembre 2022, confirme l&#8217;allocation de l&#8217;indemnit\u00e9 forfaitaire pr\u00e9vue \u00e0 l&#8217;article L.8223-1 du code du travail, \u00e9gale \u00e0 six mois de salaire. Cette indemnit\u00e9 est la cons\u00e9quence directe du travail dissimul\u00e9. Elle n&#8217;est pas discut\u00e9e en son quantum en cause d&#8217;appel. En confirmant le jugement sur ce point, la cour applique la r\u00e8gle selon laquelle le salari\u00e9 victime de travail dissimul\u00e9 b\u00e9n\u00e9ficie d&#8217;une indemnit\u00e9 forfaitaire automatique, ind\u00e9pendante du pr\u00e9judice subi. La cr\u00e9ance indemnitaire trouve ainsi son origine dans la p\u00e9riode de travail dissimul\u00e9e et sa rupture. Le rejet de l&#8217;appel incident sur ce chef conforte la protection renforc\u00e9e accord\u00e9e aux salari\u00e9s face aux pratiques frauduleuses de l&#8217;employeur. La cour v\u00e9rifie que les conditions de l&#8217;article L.8221-5 sont r\u00e9unies : absence de d\u00e9claration pr\u00e9alable et absence de bulletins de paie, intentionnellement dissimul\u00e9es. Le montant de l&#8217;indemnit\u00e9 est donc justifi\u00e9 et son caract\u00e8re forfaitaire ne saurait \u00eatre remis en cause par l&#8217;AGS.<\/p>\n<h2 id=\"ii-letendue-de-la-garantie-de-lags-sur-lindemnite-pour-travail-dissimule\">II. L&#8217;\u00e9tendue de la garantie de l&#8217;AGS sur l&#8217;indemnit\u00e9 pour travail dissimul\u00e9<\/h2>\n<p><\/p>\n<h3 id=\"a-la-recevabilite-de-la-demande-de-lags-et-le-principe-de-couverture-des-creance\">A. La recevabilit\u00e9 de la demande de l&#8217;AGS et le principe de couverture des cr\u00e9ances n\u00e9es avant le jugement d&#8217;ouverture<\/h3>\n<p>L&#8217;AGS soul\u00e8ve devant la cour une demande visant \u00e0 exclure l&#8217;indemnit\u00e9 pour travail dissimul\u00e9 de sa garantie. Le salari\u00e9 oppose une fin de non-recevoir tir\u00e9e du caract\u00e8re nouveau de cette demande en appel. La cour rejette cette fin de non-recevoir en application de l&#8217;article 565 du code de proc\u00e9dure civile, retenant que la demande de l&#8217;AGS tend aux m\u00eames fins que celle pr\u00e9sent\u00e9e devant les premiers juges, \u00e0 savoir limiter sa garantie. La recevabilit\u00e9 de l&#8217;appel est donc \u00e9tablie, ce qui s&#8217;inscrit dans la logique selon laquelle l&#8217;AGS, partie intervenante, peut faire valoir ses moyens pour d\u00e9limiter l&#8217;\u00e9tendue de sa garantie. La cour rappelle ensuite que, selon l&#8217;article L.3253-8 1\u00b0 du code du travail, la garantie de l&#8217;AGS couvre les sommes dues au salari\u00e9 \u00e0 la date du jugement d&#8217;ouverture de la proc\u00e9dure collective. En l&#8217;esp\u00e8ce, la cr\u00e9ance d&#8217;indemnit\u00e9 forfaitaire pour travail dissimul\u00e9 est n\u00e9e de la rupture du contrat de travail intervenue le 1er septembre 2022, ant\u00e9rieurement au jugement de liquidation judiciaire du 16 novembre 2023. Cette cr\u00e9ance entre donc dans le champ de la garantie, sans que puissent \u00eatre oppos\u00e9es au salari\u00e9 l&#8217;intention frauduleuse de l&#8217;employeur ou les dispositions de l&#8217;article L.113-1 du code des assurances. La solution est conforme \u00e0 la jurisprudence ant\u00e9rieure selon laquelle <em>&#8220;le d\u00e9bat devant la cour \u00e9tant limit\u00e9 \u00e0 la question du champ d&#8217;application de la garantie de l&#8217;AGS, il importe peu que la soci\u00e9t\u00e9 plac\u00e9e en liquidation judiciaire ne soit pas appel\u00e9e \u00e0 la cause&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/6809c93a1f1ed98b447f438a\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel d&#8217;Amiens, le 2 avril 2025, n\u00b024\/01407)<\/a><\/strong>.<\/p>\n<h3 id=\"b-le-rejet-de-largument-tire-de-la-faute-personnelle-du-dirigeant\">B. Le rejet de l&#8217;argument tir\u00e9 de la faute personnelle du dirigeant<\/h3>\n<p>L&#8217;AGS soutenait que l&#8217;indemnit\u00e9 devrait \u00eatre mise \u00e0 la charge du seul dirigeant de la personne morale, en raison d&#8217;une faute personnelle d\u00e9tachable de ses fonctions, engageant sa responsabilit\u00e9 d\u00e9lictuelle. La cour rejette cet argument en observant que le dirigeant <em>&#8220;n&#8217;a nullement \u00e9t\u00e9 attrait dans la cause&#8221;<\/em>. En cons\u00e9quence, la demande de l&#8217;AGS ne peut prosp\u00e9rer sur ce fondement. La cour affirme que l&#8217;employeur au sens des articles L.8221-5 et L.8223-1 du code du travail est la soci\u00e9t\u00e9, personne morale, et non son dirigeant. L&#8217;indemnit\u00e9 pour travail dissimul\u00e9 constitue une cr\u00e9ance n\u00e9e du contrat de travail et est fix\u00e9e au passif de la proc\u00e9dure collective de la soci\u00e9t\u00e9. La faute personnelle du dirigeant, \u00e0 la supposer \u00e9tablie, n&#8217;affecte pas la qualification de l&#8217;employeur ni la garantie l\u00e9gale de l&#8217;AGS. La solution prot\u00e8ge ainsi le salari\u00e9 contre le risque d&#8217;insolvabilit\u00e9 du dirigeant et maintient la garantie de l&#8217;AGS dans le cadre de la proc\u00e9dure collective. <\/p>\n<p>2\u00b0 Soit de se soustraire intentionnellement \u00e0 la d\u00e9livrance d&#8217;un bulletin de paie ou d&#8217;un document \u00e9quivalent d\u00e9fini par voie r\u00e9glementaire, ou de mentionner sur le bulletin de paie ou le document \u00e9quivalent un nombre d&#8217;heures de travail inf\u00e9rieur \u00e0 celui r\u00e9ellement accompli, si cette mention ne r\u00e9sulte pas d&#8217;une convention ou d&#8217;un accord collectif d&#8217;am\u00e9nagement du temps de travail conclu en application du titre II du livre Ier de la troisi\u00e8me partie ;
