Dans le secteur social et m\u00e9dico-social, beaucoup de salari\u00e9s relevant de la convention collective du 15 mars 1966 v\u00e9rifient alors leur bulletin de paie : \u00e9ducateur sp\u00e9cialis\u00e9, moniteur-\u00e9ducateur, surveillant de nuit, agent de bureau, psychologue, infirmier, chef de service ou cadre.<\/p>\n<p>La question pratique est simple : le salaire vers\u00e9 correspond-il bien \u00e0 la classification, \u00e0 l&#8217;anciennet\u00e9 et aux \u00e9l\u00e9ments conventionnels applicables ?<\/p>\n<p>Si le salaire est trop bas, le salari\u00e9 peut demander un rappel de salaire. L&#8217;employeur ne peut pas se contenter d&#8217;un intitul\u00e9 de poste approximatif ou d&#8217;une ligne de paie incompl\u00e8te. Il faut comparer le poste r\u00e9el, la classification conventionnelle, le coefficient, la valeur du point applicable dans l&#8217;\u00e9tablissement et les sommes effectivement soumises \u00e0 cotisations.<\/p>\n<p>Cette v\u00e9rification rel\u00e8ve du <a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/\">droit du travail<\/a> et doit \u00eatre men\u00e9e \u00e0 partir des textes conventionnels applicables, des bulletins de paie et des fonctions r\u00e9ellement exerc\u00e9es.<\/p>\n<h2>La convention 66 ne se v\u00e9rifie pas seulement avec l&#8217;intitul\u00e9 du poste<\/h2>\n<p>La convention collective nationale de travail des \u00e9tablissements et services pour personnes inadapt\u00e9es et handicap\u00e9es du 15 mars 1966 est disponible sur <a href=\"https:\/\/www.legifrance.gouv.fr\/conv_coll\/id\/KALICONT000005635407\">Legifrance<\/a>.<\/p>\n<p>Elle comporte un texte de base, des annexes, des textes attach\u00e9s et des textes salaires. La r\u00e9mun\u00e9ration ne se contr\u00f4le donc pas en regardant uniquement la mention &#8220;convention 66&#8221; sur le bulletin.<\/p>\n<p>Il faut d&#8217;abord identifier l&#8217;emploi r\u00e9ellement exerc\u00e9. Un salari\u00e9 peut \u00eatre d\u00e9clar\u00e9 sous une qualification qui ne correspond plus \u00e0 ses t\u00e2ches, \u00e0 son autonomie ou \u00e0 ses responsabilit\u00e9s.<\/p>\n<p>Il faut ensuite retrouver la grille applicable \u00e0 cet emploi. Certaines fonctions rel\u00e8vent d&#8217;annexes ou de d\u00e9roulements de carri\u00e8re sp\u00e9cifiques. Le coefficient peut \u00e9voluer avec l&#8217;anciennet\u00e9, le changement de fonctions ou l&#8217;acc\u00e8s \u00e0 un niveau sup\u00e9rieur.<\/p>\n<p>Il faut enfin v\u00e9rifier les \u00e9l\u00e9ments qui composent la r\u00e9mun\u00e9ration. Le salaire de base, les primes vers\u00e9es r\u00e9guli\u00e8rement, certaines indemnit\u00e9s et les avantages soumis \u00e0 cotisations peuvent entrer dans la comparaison selon les textes applicables. Les remboursements de frais ne doivent pas \u00eatre confondus avec du salaire.<\/p>\n<h2>Comment rep\u00e9rer un salaire convention 66 trop bas<\/h2>\n<p>Le contr\u00f4le commence par quatre documents.<\/p>\n<p>Le contrat de travail donne la qualification initiale, la dur\u00e9e de travail, le salaire convenu et parfois l&#8217;annexe conventionnelle applicable.<\/p>\n<p>Les bulletins de paie montrent le salaire de base, le coefficient, les primes, l&#8217;anciennet\u00e9, les absences et les cotisations.<\/p>\n<p>La convention collective indique les r\u00e8gles de classification, la valeur du point et les textes salaires.<\/p>\n<p>Les plannings, fiches de poste, mails internes et organigrammes permettent de montrer les fonctions r\u00e9ellement exerc\u00e9es.<\/p>\n<p>Un \u00e9cart peut appara\u00eetre dans plusieurs situations.<\/p>\n<p>Le coefficient mentionn\u00e9 sur la fiche de paie est trop bas au regard des t\u00e2ches r\u00e9ellement confi\u00e9es.<\/p>\n<p>La progression d&#8217;anciennet\u00e9 n&#8217;a pas \u00e9t\u00e9 appliqu\u00e9e.<\/p>\n<p>La valeur du point utilis\u00e9e par l&#8217;employeur n&#8217;est pas celle applicable dans l&#8217;\u00e9tablissement.<\/p>\n<p>Une prime conventionnelle ou une indemnit\u00e9 int\u00e9gr\u00e9e au calcul a \u00e9t\u00e9 oubli\u00e9e.<\/p>\n<p>Le salari\u00e9 travaille \u00e0 temps partiel, mais le prorata a \u00e9t\u00e9 mal calcul\u00e9.<\/p>\n<p>Le salari\u00e9 est pass\u00e9 sur des fonctions sup\u00e9rieures sans avenant ni revalorisation.<\/p>\n<p>Dans ces hypoth\u00e8ses, il ne suffit pas de demander &#8220;la grille salaire convention 66&#8221;. Il faut reconstruire le calcul mois par mois.<\/p>\n<h2>Le calcul du rappel de salaire<\/h2>\n<p>La m\u00e9thode la plus solide consiste \u00e0 \u00e9tablir un tableau.<\/p>\n<p>Pour chaque mois, il faut indiquer le coefficient qui aurait d\u00fb \u00eatre appliqu\u00e9, la valeur du point retenue, les \u00e9l\u00e9ments conventionnels dus, le salaire brut effectivement vers\u00e9 et l&#8217;\u00e9cart.<\/p>\n<p>Le rappel de salaire correspond \u00e0 la diff\u00e9rence entre ce qui aurait d\u00fb \u00eatre pay\u00e9 et ce qui a \u00e9t\u00e9 pay\u00e9.<\/p>\n<p>Il faut raisonner en brut. Les cong\u00e9s pay\u00e9s aff\u00e9rents peuvent \u00e9galement \u00eatre r\u00e9clam\u00e9s lorsque le rappel porte sur du salaire.<\/p>\n<p>Il faut aussi v\u00e9rifier les cons\u00e9quences indirectes. Un salaire conventionnel trop bas peut avoir modifi\u00e9 le calcul de certaines indemnit\u00e9s, notamment en cas de licenciement, d&#8217;inaptitude, d&#8217;arr\u00eat maladie avec maintien conventionnel, de rupture conventionnelle ou de solde de tout compte.<\/p>\n<p>La comparaison ne doit pas \u00eatre m\u00e9canique. Dans une d\u00e9cision du 24 avril 2025, la cour d&#8217;appel de Saint-Denis de La R\u00e9union rappelle que &#8220;le salaire minimum conventionnel, qui rev\u00eat un caract\u00e8re obligatoire, r\u00e9sulte de la classification du salari\u00e9 dans la convention collective applicable&#8221; et que l&#8217;employeur peut seulement y d\u00e9roger &#8220;dans un sens plus favorable au salari\u00e9&#8221; (<a href=\"https:\/\/www.courdecassation.fr\/decision\/680b1f9f4d571f883366928c\">CA Saint-Denis de La R\u00e9union, 24 avril 2025, n\u00b0 22\/01781<\/a>).<\/p>\n<p>Cette m\u00eame d\u00e9cision montre aussi qu&#8217;il faut comparer le minimum conventionnel avec les \u00e9l\u00e9ments de salaire pertinents, et non seulement avec une ligne isol\u00e9e du bulletin de paie. Un salari\u00e9 peut avoir un salaire de base inf\u00e9rieur \u00e0 un minimum apparent, mais percevoir d&#8217;autres \u00e9l\u00e9ments fixes ou r\u00e9guliers qui portent sa r\u00e9mun\u00e9ration au-dessus du minimum. \u00c0 l&#8217;inverse, des remboursements de frais ou des primes r\u00e9ellement al\u00e9atoires ne doivent pas masquer un salaire trop bas.<\/p>\n<h2>Le d\u00e9lai pour r\u00e9clamer un rappel de salaire<\/h2>\n<p>Le d\u00e9lai est un point d\u00e9cisif.<\/p>\n<p>L&#8217;article L. 3245-1 du Code du travail pr\u00e9voit que l&#8217;action en paiement ou en r\u00e9p\u00e9tition du salaire se prescrit par trois ans. La demande peut porter sur les sommes dues au titre des trois derni\u00e8res ann\u00e9es ou, lorsque le contrat est rompu, sur les trois ann\u00e9es pr\u00e9c\u00e9dant la rupture.<\/p>\n<p>En pratique, il ne faut pas attendre la fin du contrat pour agir.<\/p>\n<p>Si le salari\u00e9 est encore en poste, une demande \u00e9crite permet de fixer clairement le d\u00e9saccord et de demander une r\u00e9gularisation. Elle doit rester factuelle : classification revendiqu\u00e9e, coefficient, p\u00e9riode concern\u00e9e, calcul mois par mois, pi\u00e8ces jointes.<\/p>\n<p>Si le contrat est rompu, il faut agir vite. Le solde de tout compte ne r\u00e8gle pas automatiquement la question du salaire conventionnel. La signature d&#8217;un re\u00e7u pour solde de tout compte peut toutefois cr\u00e9er des difficult\u00e9s pratiques si le salari\u00e9 ne l&#8217;a pas d\u00e9nonc\u00e9 dans les d\u00e9lais utiles.<\/p>\n<h2>Que faire avant d&#8217;\u00e9crire \u00e0 l&#8217;employeur<\/h2>\n<p>Le salari\u00e9 doit \u00e9viter une contestation trop vague.<\/p>\n<p>Il faut d&#8217;abord t\u00e9l\u00e9charger ou consulter le texte officiel de la convention collective sur Legifrance. Il faut ensuite isoler l&#8217;annexe et la grille correspondant au poste r\u00e9el.<\/p>\n<p>Il faut comparer cette grille aux bulletins de paie. Le plus utile est souvent un tableau simple : mois, coefficient appliqu\u00e9, coefficient revendiqu\u00e9, salaire d\u00fb, salaire vers\u00e9, diff\u00e9rence.<\/p>\n<p>Il faut conserver les preuves des t\u00e2ches r\u00e9ellement exerc\u00e9es. Une fiche de poste ancienne ne suffit pas toujours. Les mails, comptes rendus, d\u00e9l\u00e9gations, plannings, remplacements de coll\u00e8gues, responsabilit\u00e9s d&#8217;\u00e9quipe et validations hi\u00e9rarchiques peuvent devenir d\u00e9terminants.<\/p>\n<p>Il faut enfin v\u00e9rifier si d&#8217;autres salari\u00e9s du m\u00eame \u00e9tablissement occupent des fonctions comparables avec une classification sup\u00e9rieure. La comparaison ne remplace pas l&#8217;analyse juridique, mais elle peut r\u00e9v\u00e9ler une incoh\u00e9rence.<\/p>\n<h2>Comment formuler la demande de r\u00e9gularisation<\/h2>\n<p>La demande doit \u00eatre pr\u00e9cise.<\/p>\n<p>Elle peut rappeler que le salari\u00e9 rel\u00e8ve de la convention collective du 15 mars 1966, indiquer la classification qui figure sur le bulletin, expliquer pourquoi cette classification ne correspond pas aux fonctions exerc\u00e9es, puis demander la r\u00e9gularisation du coefficient et le paiement du rappel de salaire.<\/p>\n<p>Il est pr\u00e9f\u00e9rable de joindre le tableau de calcul.<\/p>\n<p>Le salari\u00e9 peut demander une r\u00e9ponse \u00e9crite dans un d\u00e9lai raisonnable. Il peut aussi solliciter un entretien avec les ressources humaines ou la direction, sans renoncer \u00e0 ses droits.<\/p>\n<p>Si l&#8217;employeur refuse ou ne r\u00e9pond pas, le conseil de prud&#8217;hommes peut \u00eatre saisi. Le juge appr\u00e9ciera les fonctions r\u00e9ellement exerc\u00e9es, les textes conventionnels applicables, les bulletins de paie et le calcul produit.<\/p>\n<h2>Paris et \u00cele-de-France : quel conseil de prud&#8217;hommes saisir<\/h2>\n<p>Pour un salari\u00e9 travaillant \u00e0 Paris ou en \u00cele-de-France, le conseil de prud&#8217;hommes comp\u00e9tent d\u00e9pend en principe du lieu o\u00f9 le travail est effectu\u00e9 ou du si\u00e8ge de l&#8217;employeur, selon la situation.<\/p>\n<p>La question peut se poser dans les associations ou \u00e9tablissements m\u00e9dico-sociaux qui ont plusieurs sites : si\u00e8ge administratif \u00e0 Paris, \u00e9tablissement en Seine-Saint-Denis, service dans le Val-de-Marne, intervention mobile dans plusieurs d\u00e9partements.<\/p>\n<p>Avant d&#8217;agir, il faut identifier le lieu d&#8217;ex\u00e9cution habituel du travail, l&#8217;\u00e9tablissement mentionn\u00e9 sur le contrat, le si\u00e8ge social et l&#8217;adresse figurant sur les bulletins de paie.<\/p>\n<p>Cette v\u00e9rification \u00e9vite de perdre du temps devant une juridiction contest\u00e9e.<\/p>\n<h2>Les erreurs fr\u00e9quentes<\/h2>\n<p>La premi\u00e8re erreur consiste \u00e0 raisonner uniquement avec le salaire net. Le rappel de salaire se calcule en brut.<\/p>\n<p>La deuxi\u00e8me consiste \u00e0 utiliser une grille trouv\u00e9e sur un site non officiel sans v\u00e9rifier sa date, son champ d&#8217;application et les textes salaires applicables.<\/p>\n<p>La troisi\u00e8me consiste \u00e0 confondre valeur du point, coefficient, anciennet\u00e9 et primes. La convention 66 repose sur plusieurs param\u00e8tres.<\/p>\n<p>La quatri\u00e8me consiste \u00e0 oublier la prescription. Trois ans passent vite, surtout quand l&#8217;\u00e9cart est ancien et se r\u00e9p\u00e8te chaque mois.<\/p>\n<p>La cinqui\u00e8me consiste \u00e0 r\u00e9clamer un rappel sans preuve des fonctions r\u00e9ellement exerc\u00e9es. Si le litige porte sur la classification, les pi\u00e8ces de travail sont aussi importantes que les bulletins de paie.<\/p>\n<h2>Les points \u00e0 faire v\u00e9rifier<\/h2>\n<p>Avant toute r\u00e9clamation, il faut contr\u00f4ler la convention collective r\u00e9ellement applicable, la classification, le coefficient, la valeur du point, les primes int\u00e9gr\u00e9es ou exclues du calcul, l&#8217;anciennet\u00e9, le temps de travail, les absences, les p\u00e9riodes prescrites et les cons\u00e9quences sur les indemnit\u00e9s de rupture.<\/p>\n<p>Un \u00e9cart de quelques dizaines d&#8217;euros par mois peut devenir important sur trois ans.<\/p>\n<p>\u00c0 l&#8217;inverse, une demande mal calcul\u00e9e peut affaiblir le dossier.
