L\u2019aggravation de la faute par la dissimulation volontaire de l\u2019incident<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Par un arr\u00eat rendu le 4 mai 2026, la Cour d\u2019appel de Metz, chambre sociale section 1, a statu\u00e9 sur deux questions distinctes soulev\u00e9es par un salari\u00e9 conducteur de poids lourds. L\u2019int\u00e9ress\u00e9 avait \u00e9t\u00e9 licenci\u00e9 pour faute grave apr\u00e8s avoir circul\u00e9 sur une distance de quarante-deux kilom\u00e8tres avec le hayon de son camion ouvert, sans informer sa hi\u00e9rarchie. Il contestait \u00e9galement le refus de son employeur de lui rembourser le prix d\u2019une paire de chaussures de s\u00e9curit\u00e9, achet\u00e9e sur pr\u00e9sentation d\u2019un certificat m\u00e9dical.<\/p>\n<p>En premi\u00e8re instance, la juridiction prud\u2019homale avait d\u00e9bout\u00e9 le salari\u00e9 de sa demande de remboursement et valid\u00e9 le licenciement pour faute grave. Le salari\u00e9 a interjet\u00e9 appel, soutenant que l\u2019employeur avait l\u2019habitude de rembourser ce type de d\u00e9pense et que l\u2019incident du hayon ne relevait pas d\u2019une faute grave. L\u2019employeur a conclu \u00e0 la confirmation du jugement, insistant sur la gravit\u00e9 du manquement et l\u2019absence d\u2019autorisation pr\u00e9alable pour l\u2019achat de chaussures.<\/p>\n<p>La question de droit portait, d\u2019une part, sur la possibilit\u00e9 pour le salari\u00e9 d\u2019obtenir le remboursement d\u2019un \u00e9quipement de s\u00e9curit\u00e9 en l\u2019absence d\u2019instruction de l\u2019employeur mais en pr\u00e9sence d\u2019une pratique ant\u00e9rieure, d\u2019autre part, sur la qualification de faute grave d\u2019un manquement \u00e0 une obligation de s\u00e9curit\u00e9 routi\u00e8re suivi d\u2019une omission d\u2019information.<\/p>\n<p>La cour a infirm\u00e9 le jugement sur le premier point, condamnant l\u2019employeur \u00e0 payer la somme de 105,08 euros au titre des chaussures, et confirm\u00e9 le licenciement pour faute grave. Il conviendra d\u2019examiner successivement l\u2019affirmation de l\u2019obligation de l\u2019employeur de supporter les frais professionnels expos\u00e9s par le salari\u00e9 (I), avant d\u2019analyser la caract\u00e9risation de la faute grave fond\u00e9e sur le manquement d\u00e9lib\u00e9r\u00e9 aux obligations de s\u00e9curit\u00e9 (II).<\/p>\n<h2 id=\"i-laffirmation-de-lobligation-de-lemployeur-de-supporter-les-frais-professionnel\">I. L\u2019affirmation de l\u2019obligation de l\u2019employeur de supporter les frais professionnels expos\u00e9s par le salari\u00e9<\/h2>\n<p>La cour a retenu que le salari\u00e9 pouvait pr\u00e9tendre au remboursement des chaussures de s\u00e9curit\u00e9 malgr\u00e9 l\u2019absence d\u2019instruction pr\u00e9alable. Cette solution repose sur l\u2019existence d\u2019une pratique constante de l\u2019employeur.<\/p>\n<h3 id=\"a-la-reconnaissance-dune-pratique-acceptee-de-remboursement-implicite\">A. La reconnaissance d\u2019une pratique accept\u00e9e de remboursement implicite<\/h3>\n<p>Le salari\u00e9 \u00e9tablissait que l\u2019ann\u00e9e pr\u00e9c\u00e9dente, en 2022, l\u2019employeur lui avait <em>&#8221; rembours\u00e9 directement une facture d\u2019un montant de 89,91 euros, correspondant \u00e0 l\u2019achat d\u2019une paire de chaussures de s\u00e9curit\u00e9 &#8220;<\/em>. Ce remboursement \u00e9tait intervenu apr\u00e8s transmission d\u2019un certificat m\u00e9dical. Cette pratique ant\u00e9rieure cr\u00e9ait une attente l\u00e9gitime pour le salari\u00e9. La cour a consid\u00e9r\u00e9 que le remboursement de 2022 constituait un pr\u00e9c\u00e9dent suffisant pour d\u00e9montrer que l\u2019employeur acceptait de prendre en charge ce type de d\u00e9pense, m\u00eame en l\u2019absence de directive \u00e9crite.<\/p>\n<h3 id=\"b-labsence-de-necessite-dune-instruction-prealable-de-lemployeur\">B. L\u2019absence de n\u00e9cessit\u00e9 d\u2019une instruction pr\u00e9alable de l\u2019employeur<\/h3>\n<p>La soci\u00e9t\u00e9 soutenait que le salari\u00e9 n\u2019avait pas \u00e9t\u00e9 autoris\u00e9 \u00e0 proc\u00e9der directement \u00e0 l\u2019achat. La cour a \u00e9cart\u00e9 cet argument en relevant qu\u2019<em>&#8221; il n\u2019est justifi\u00e9 d\u2019aucune instruction ou directive de l\u2019employeur en ce sens &#8220;<\/em>. La reconnaissance d\u2019un remboursement ant\u00e9rieur, associ\u00e9e \u00e0 un second certificat m\u00e9dical dat\u00e9 du 8 septembre 2023 attestant de l\u00e9sions li\u00e9es au port de chaussures inadapt\u00e9es, suffisait \u00e0 caract\u00e9riser l\u2019int\u00e9r\u00eat professionnel de la d\u00e9pense. Comme l\u2019a rappel\u00e9 la Cour d\u2019appel de Reims, <em>&#8221; les frais qu\u2019un salari\u00e9 expose pour les besoins de son activit\u00e9 professionnelle et dans l\u2019int\u00e9r\u00eat de son employeur doivent \u00eatre support\u00e9s par ce dernier &#8220;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67ca8efeb05f898609a8c122\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Reims, 6 mars 2025, n\u00b024\/00112)<\/a><\/strong>. La solution de la cour s\u2019inscrit donc dans le principe g\u00e9n\u00e9ral de remboursement des frais professionnels, temp\u00e9rant la rigueur formelle d\u2019une autorisation pr\u00e9alable lorsqu\u2019une pratique constante existe.<\/p>\n<h2 id=\"ii-la-caracterisation-dune-faute-grave-fondee-sur-le-manquement-delibere-aux-obl\">II. La caract\u00e9risation d\u2019une faute grave fond\u00e9e sur le manquement d\u00e9lib\u00e9r\u00e9 aux obligations de s\u00e9curit\u00e9<\/h2>\n<p>La cour a confirm\u00e9 le licenciement pour faute grave, en retenant que le salari\u00e9 avait commis un manquement grave \u00e0 ses obligations, aggrav\u00e9 par son absence d\u2019information de l\u2019employeur.<\/p>\n<h3 id=\"a-letablissement-dun-manquement-grave-aux-regles-de-securite-routiere\">A. L\u2019\u00e9tablissement d\u2019un manquement grave aux r\u00e8gles de s\u00e9curit\u00e9 routi\u00e8re<\/h3>\n<p>L\u2019expertise du v\u00e9hicule n\u2019avait relev\u00e9 <em>&#8221; aucune anomalie, ni constat\u00e9 de d\u00e9faillance du mat\u00e9riel &#8220;<\/em>, pr\u00e9cisant qu\u2019<em>&#8221; il est techniquement impossible que le hayon puisse descendre et s\u2019ouvrir seul &#8220;<\/em>. Le salari\u00e9 avait lui-m\u00eame reconnu dans un courriel avoir <em>&#8221; mal mis le crochet &#8220;<\/em>. La cour a estim\u00e9 qu\u2019en sa qualit\u00e9 de chauffeur, il lui appartenait de <em>&#8221; veiller personnellement, avant de reprendre la route apr\u00e8s avoir effectu\u00e9 sa collecte de d\u00e9chets \u00e0 l\u2019h\u00f4pital de [Localit\u00e9 6], \u00e0 ce que le hayon de son camion \u00e9tait correctement ferm\u00e9 &#8220;<\/em>. Cette obligation de s\u00e9curit\u00e9, rappel\u00e9e lors d\u2019une formation obligatoire, \u00e9tait connue du salari\u00e9. La circulation avec un hayon ouvert sur quarante-deux kilom\u00e8tres expose directement les usagers \u00e0 un danger, ce qui constitue une violation particuli\u00e8rement grave des r\u00e8gles de s\u00e9curit\u00e9 routi\u00e8re.<\/p>\n<h3 id=\"b-laggravation-de-la-faute-par-la-dissimulation-volontaire-de-lincident\">B. L\u2019aggravation de la faute par la dissimulation volontaire de l\u2019incident<\/h3>\n<p>Le salari\u00e9 avait omis d\u2019informer sa hi\u00e9rarchie de l\u2019incident survenu le 9 janvier 2024. L\u2019employeur n\u2019en avait eu connaissance que le lendemain par un usager de la route ayant adress\u00e9 une photographie. L\u2019article 5 du r\u00e8glement int\u00e9rieur imposait pourtant aux chauffeurs de <em>&#8221; rendre compte au jour le jour, \u00e0 leur responsable de service, des accidents et incidents survenus au cours de leurs transports &#8220;<\/em>. La cour a soulign\u00e9 que le salari\u00e9 avait <em>&#8221; omis d\u00e9lib\u00e9r\u00e9ment de rendre compte de cet incident \u00e0 son employeur &#8220;<\/em>. Cette dissimulation, combin\u00e9e \u00e0 la gravit\u00e9 du manquement technique, rendait impossible le maintien du salari\u00e9 dans l\u2019entreprise. La jurisprudence, dans une esp\u00e8ce comparable, a jug\u00e9 que la faute grave peut \u00eatre constitu\u00e9e par un <em>&#8221; encha\u00eenement de n\u00e9gligences professionnelles et de manquements graves aux r\u00e8gles de s\u00e9curit\u00e9 &#8220;<\/em> lorsqu\u2019ils exposent autrui \u00e0 un danger <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67e63e68ed04dc45c79a9a26\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Reims, 27 mars 2025, n\u00b024\/00519)<\/a><\/strong>.
