Le partage des charges et des responsabilit\u00e9s entre les parties<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Par un arr\u00eat du 4 mai 2026, la premi\u00e8re chambre civile de la Cour d&#8217;appel de Bordeaux (n\u00b023\/03769) \u00e9tait appel\u00e9e \u00e0 se prononcer sur la qualification d&#8217;une occupation et sur les cons\u00e9quences juridiques de l&#8217;absence de contrat \u00e9crit dans le cadre d&#8217;une location meubl\u00e9e. Un propri\u00e9taire avait mis \u00e0 disposition un chalet, habituellement lou\u00e9 via la plateforme Airbnb pour de courts s\u00e9jours, au profit d&#8217;un p\u00e8re de famille accompagn\u00e9 de son enfant, \u00e0 compter du 29 janvier 2023. Aucun contrat \u00e9crit ne fut sign\u00e9, mais le propri\u00e9taire remit une attestation de loyer destin\u00e9e \u00e0 la caisse d&#8217;allocations familiales, permettant \u00e0 l&#8217;occupant de percevoir une aide au logement. L&#8217;accord verbal portait sur une occupation jusqu&#8217;au 28 mai 2023. \u00c0 cette date, le propri\u00e9taire vida le logement des affaires de l&#8217;occupant, lequel saisit le juge des contentieux de la protection du tribunal judiciaire de Bordeaux. Par jugement, le premier juge condamna le propri\u00e9taire \u00e0 remettre un contrat de bail d&#8217;une dur\u00e9e d&#8217;un an, \u00e0 r\u00e9int\u00e9grer les lieux sous astreinte, et \u00e0 payer 3 000 euros de dommages et int\u00e9r\u00eats. Le propri\u00e9taire interjeta appel, contestant l&#8217;existence d&#8217;un bail soumis \u00e0 la loi du 6 juillet 1989 et invoquant des manoeuvres dolosives de l&#8217;occupant. Ce dernier sollicitait la confirmation du jugement, soutenant que le logement constituait sa r\u00e9sidence principale. La cour d&#8217;appel infirma partiellement le jugement, enjoignant au propri\u00e9taire de soumettre un contrat de bail pour la seule p\u00e9riode du 28 janvier au 28 mai 2023, r\u00e9duisant les dommages \u00e0 500 euros, condamnant l&#8217;occupant \u00e0 payer un solde de loyer de 260,23 euros et partageant les d\u00e9pens. La question centrale \u00e9tait de savoir si l&#8217;occupation d&#8217;un logement meubl\u00e9, en l&#8217;absence de contrat \u00e9crit et sur la base d&#8217;un accord verbal limit\u00e9, relevait du statut protecteur de la loi de 1989 et, dans l&#8217;affirmative, quelles en \u00e9taient les cons\u00e9quences sur la dur\u00e9e du bail et les obligations des parties. La solution retenue par la cour illustre une application nuanc\u00e9e du droit des baux meubl\u00e9s.<\/p>\n<h2 id=\"i-la-consecration-de-lapplication-du-statut-des-baux-meubles-en-labsence-decrit\">I. La cons\u00e9cration de l&#8217;application du statut des baux meubl\u00e9s en l&#8217;absence d&#8217;\u00e9crit<\/h2>\n<p><\/p>\n<h3 id=\"a-loccupation-a-titre-de-residence-principale-comme-fait-generateur-du-statut\">A. L&#8217;occupation \u00e0 titre de r\u00e9sidence principale comme fait g\u00e9n\u00e9rateur du statut<\/h3>\n<p>La cour rappelle que l&#8217;article 25-3 de la loi du 6 juillet 1989 dispose que ses dispositions s&#8217;appliquent aux contrats de location de logements meubl\u00e9s d\u00e8s lors qu&#8217;ils constituent la r\u00e9sidence principale du locataire. Elle souligne que la location saisonni\u00e8re se caract\u00e9rise par une mise \u00e0 disposition \u00e0 une client\u00e8le de passage pour une dur\u00e9e maximale de quatre-vingt-dix jours cons\u00e9cutifs. En l&#8217;esp\u00e8ce, le chalet \u00e9tait certes habituellement lou\u00e9 via Airbnb pour des s\u00e9jours de courte dur\u00e9e, mais le propri\u00e9taire a \u00e9tabli une attestation de loyer le 29 janvier 2023 afin que l&#8217;occupant b\u00e9n\u00e9ficie de l&#8217;aide au logement, prestation vers\u00e9e directement au propri\u00e9taire. La cour en d\u00e9duit que <em>&#8220;ce dernier ne pouvait donc ignorer que ce logement meubl\u00e9 allait constituer, m\u00eame temporairement, la r\u00e9sidence principale de M. [P]&#8221;<\/em> (CA Bordeaux, 4 mai 2026, n\u00b023\/03769). Cette qualification emporte application des dispositions d&#8217;ordre public du titre Ier de la loi de 1989, ind\u00e9pendamment de l&#8217;absence de contrat \u00e9crit. La jurisprudence d&#8217;appui de la Cour d&#8217;appel de Poitiers, le 4 f\u00e9vrier 2025 (n\u00b024\/00114), avait d\u00e9j\u00e0 soulign\u00e9 l&#8217;importance des documents sign\u00e9s par les parties pour caract\u00e9riser une location meubl\u00e9e soumise \u00e0 la loi, en relevant que <em>&#8220;le contrat litigieux, sign\u00e9 par les parties, porte l&#8217;intitul\u00e9 d&#8217;un contrat de location meubl\u00e9e avec prestations para-h\u00f4teli\u00e8res, mentionne qu&#8217;il est exclu du champ d&#8217;application de la loi du 6 juillet 1989&#8221;<\/em> mais que les annexes sign\u00e9es pouvaient \u00e9tablir la nature du contrat. Ici, l&#8217;attestation de loyer sign\u00e9e par le propri\u00e9taire a constitu\u00e9 un indice d\u00e9terminant de la volont\u00e9 de conf\u00e9rer au logement le caract\u00e8re de r\u00e9sidence principale.<\/p>\n<h3 id=\"b-les-obligations-decoulant-de-lapplication-de-la-loi-necessite-dun-ecrit-et-dur\">B. Les obligations d\u00e9coulant de l&#8217;application de la loi : n\u00e9cessit\u00e9 d&#8217;un \u00e9crit et dur\u00e9e du bail<\/h3>\n<p>L&#8217;article 25-7 de la loi de 1989 impose que le contrat de location soit \u00e9tabli par \u00e9crit et respecte un contrat type, et qu&#8217;il soit conclu pour une dur\u00e9e d&#8217;au moins un an, avec tacite reconduction. La cour constate qu&#8217;aucun contrat \u00e9crit n&#8217;a \u00e9t\u00e9 sign\u00e9, et enjoint au propri\u00e9taire d&#8217;en soumettre un \u00e0 l&#8217;occupant. Cependant, elle \u00e9carte la dur\u00e9e d&#8217;un an retenue par le premier juge. Elle rel\u00e8ve que l&#8217;accord verbal initial portait sur une occupation jusqu&#8217;au 28 mai 2023 et que l&#8217;occupant lui-m\u00eame a d\u00e9clar\u00e9 aux services de police que <em>&#8220;on s&#8217;\u00e9tait entendu verbalement pour occuper ce logement comme \u00e9tant ma r\u00e9sidence principale (&#8230;) du 28\/01\/2023 au 28\/05\/2023&#8221;<\/em> (CA Bordeaux). La cour consid\u00e8re que <em>&#8220;l&#8217;accord des parties portait donc sur une occupation inf\u00e9rieure \u00e0 un an que la qualification a posteriori \u00e0 titre de r\u00e9sidence principale ne saurait remettre en question&#8221;<\/em>. Ainsi, l&#8217;injonction est limit\u00e9e \u00e0 la p\u00e9riode convenue, soit du 28 janvier au 28 mai 2023, sans astreinte ni obligation de r\u00e9int\u00e9gration. Cette solution concilie le respect du formalisme protecteur avec la r\u00e9alit\u00e9 de l&#8217;accord des parties, \u00e9vitant d&#8217;imposer une dur\u00e9e l\u00e9gale au-del\u00e0 de la commune intention.<\/p>\n<h2 id=\"ii-la-determination-des-consequences-de-la-relation-contractuelle-et-le-partage-\">II. La d\u00e9termination des cons\u00e9quences de la relation contractuelle et le partage des responsabilit\u00e9s<\/h2>\n<p><\/p>\n<h3 id=\"a-la-limitation-de-la-duree-du-bail-a-laccord-initial-et-ses-implications\">A. La limitation de la dur\u00e9e du bail \u00e0 l&#8217;accord initial et ses implications<\/h3>\n<p>La cour op\u00e8re une distinction nette entre la qualification de r\u00e9sidence principale, qui ouvre droit au statut, et la dur\u00e9e du bail, qui peut \u00eatre fix\u00e9e par accord des parties si elle est inf\u00e9rieure \u00e0 un an. En l&#8217;esp\u00e8ce, l&#8217;absence de contrat \u00e9crit ne permet pas d&#8217;invoquer la tacite reconduction au-del\u00e0 du terme convenu. La cour \u00e9carte ainsi l&#8217;id\u00e9e d&#8217;un bail d&#8217;un an renouvelable, pr\u00e9f\u00e9rant s&#8217;en tenir \u00e0 la p\u00e9riode convenue. Cette approche pragmatique \u00e9vite de faire produire \u00e0 la protection l\u00e9gale des effets contraires \u00e0 la volont\u00e9 initiale des parties. Par ailleurs, la cour rejette la demande de l&#8217;occupant tendant \u00e0 la r\u00e9int\u00e9gration des lieux et \u00e0 la jouissance paisible, puisque le bail avait pris fin le 28 mai 2023. Le propri\u00e9taire, en vidant le logement ce jour-l\u00e0, n&#8217;a pas m\u00e9connu une obligation en cours, mais sa m\u00e9thode a \u00e9t\u00e9 jug\u00e9e fautive. La cour retient que <em>&#8220;cette situation est constitutive d&#8217;un manquement du bailleur qui a caus\u00e9 un pr\u00e9judice moral au locataire&#8221;<\/em>, qu&#8217;elle \u00e9value \u00e0 500 euros, contre 3 000 euros en premi\u00e8re instance. Elle r\u00e9duit donc l&#8217;indemnit\u00e9, estimant que le pr\u00e9judice est limit\u00e9 compte tenu de la fin du bail.<\/p>\n<h3 id=\"b-le-partage-des-charges-et-des-responsabilites-entre-les-parties\">B. Le partage des charges et des responsabilit\u00e9s entre les parties<\/h3>\n<p>Sur le plan financier, la cour examine les loyers et indemnit\u00e9s. Elle constate que l&#8217;occupant a produit des quittances pour les mois de f\u00e9vrier \u00e0 mai 2023, mais s&#8217;interroge sur l&#8217;authenticit\u00e9 de celle de mai, notant une contradiction entre les d\u00e9clarations de l&#8217;occupant (paiement en esp\u00e8ces) et un ch\u00e8que de 350 euros revenu impay\u00e9. Elle en d\u00e9duit que les loyers de mars et avril sont r\u00e9put\u00e9s pay\u00e9s, mais que pour mai, il reste d\u00fb 260,23 euros apr\u00e8s d\u00e9duction de l&#8217;allocation logement per\u00e7ue par le propri\u00e9taire. Ce dernier est condamn\u00e9 \u00e0 rembourser \u00e0 la CAF l&#8217;indu per\u00e7u, mais la cour pr\u00e9cise que <em>&#8220;cela ne peut \u00eatre imput\u00e9 \u00e0 M. [P]&#8221;<\/em>. La demande reconventionnelle du propri\u00e9taire pour perte de revenus Airbnb est rejet\u00e9e, faute de preuve, la cour notant qu&#8217;il a choisi de louer \u00e0 l&#8217;occupant et qu&#8217;il a pu relouer le chalet apr\u00e8s juillet 2023. Enfin, la demande de dommages pour pr\u00e9judice moral du propri\u00e9taire, fond\u00e9e sur des attestations de comportements agressifs, est rejet\u00e9e en raison du contexte et surtout du fait que le propri\u00e9taire a lui-m\u00eame commis une voie de fait en vidant les lieux sans d\u00e9cision de justice. Les d\u00e9pens sont partag\u00e9s par moiti\u00e9, marquant une responsabilit\u00e9 \u00e9quilibr\u00e9e. Il peut \u00eatre \u00e9tabli selon les formes que les parties contractantes d\u00e9cident d&#8217;adopter.<\/p>\n<\/p>\n<\/div>\n<\/div>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000036762081\" rel=\"nofollow\" target=\"_blank\">Article L. 1233-3 du Code du travail<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">\n<p>Constitue un licenciement pour motif \u00e9conomique le licenciement effectu\u00e9 par un employeur pour un ou plusieurs motifs non inh\u00e9rents \u00e0 la personne du salari\u00e9 r\u00e9sultant d&#8217;une suppression ou transformation d&#8217;emploi ou d&#8217;une modification, refus\u00e9e par le salari\u00e9, d&#8217;un \u00e9l\u00e9ment essentiel du contrat de travail, cons\u00e9cutives notamment :<\/p>\n<p>1\u00b0 A des difficult\u00e9s \u00e9conomiques caract\u00e9ris\u00e9es soit par l&#8217;\u00e9volution significative d&#8217;au moins un indicateur \u00e9conomique tel qu&#8217;une baisse des commandes ou du chiffre d&#8217;affaires, des pertes d&#8217;exploitation ou une d\u00e9gradation de la tr\u00e9sorerie ou de l&#8217;exc\u00e9dent brut d&#8217;exploitation, soit par tout autre \u00e9l\u00e9ment de nature \u00e0 justifier de ces difficult\u00e9s.<\/p>\n<p>Une baisse significative des commandes ou du chiffre d&#8217;affaires est constitu\u00e9e d\u00e8s lors que la dur\u00e9e de cette baisse est, en comparaison avec la m\u00eame p\u00e9riode de l&#8217;ann\u00e9e pr\u00e9c\u00e9dente, au moins \u00e9gale \u00e0 :<\/p>\n<p>a) Un trimestre pour une entreprise de moins de onze salari\u00e9s ;<\/p>\n<p>b) Deux trimestres cons\u00e9cutifs pour une entreprise d&#8217;au moins onze salari\u00e9s et de moins de cinquante salari\u00e9s ;<\/p>\n<p>c) Trois trimestres cons\u00e9cutifs pour une entreprise d&#8217;au moins cinquante salari\u00e9s et de moins de trois cents salari\u00e9s ;<\/p>\n<p>d) Quatre trimestres cons\u00e9cutifs pour une entreprise de trois cents salari\u00e9s et plus ;<\/p>\n<p>2\u00b0 A des mutations technologiques ;<\/p>\n<p>3\u00b0 A une r\u00e9organisation de l&#8217;entreprise n\u00e9cessaire \u00e0 la sauvegarde de sa comp\u00e9titivit\u00e9 ;<\/p>\n<p>4\u00b0 A la cessation d&#8217;activit\u00e9 de l&#8217;entreprise.<\/p>\n<p>La mat\u00e9rialit\u00e9 de la suppression, de la transformation d&#8217;emploi ou de la modification d&#8217;un \u00e9l\u00e9ment essentiel du contrat de travail s&#8217;appr\u00e9cie au niveau de l&#8217;entreprise.<\/p>\n<p>Les difficult\u00e9s \u00e9conomiques, les mutations technologiques ou la n\u00e9cessit\u00e9 de sauvegarder la comp\u00e9titivit\u00e9 de l&#8217;entreprise s&#8217;appr\u00e9cient au niveau de cette entreprise si elle n&#8217;appartient pas \u00e0 un groupe et, dans le cas contraire, au niveau du secteur d&#8217;activit\u00e9 commun \u00e0 cette entreprise et aux entreprises du groupe auquel elle appartient, \u00e9tablies sur le territoire national, sauf fraude.<\/p>\n<p>Pour l&#8217;application du pr\u00e9sent article, la notion de groupe d\u00e9signe le groupe form\u00e9 par une entreprise appel\u00e9e entreprise dominante et les entreprises qu&#8217;elle contr\u00f4le dans les conditions d\u00e9finies \u00e0 l&#8217;article L. 233-1, aux I et II de l&#8217;article L. 233-3 et \u00e0 l&#8217;article L. 233-16 du code de commerce.<\/p>\n<p>Le secteur d&#8217;activit\u00e9 permettant d&#8217;appr\u00e9cier la cause \u00e9conomique du licenciement est caract\u00e9ris\u00e9, notamment, par la nature des produits biens ou services d\u00e9livr\u00e9s, la client\u00e8le cibl\u00e9e, ainsi que les r\u00e9seaux et modes de distribution, se rapportant \u00e0 un m\u00eame march\u00e9.<\/p>\n<p>Les dispositions du pr\u00e9sent chapitre sont applicables \u00e0 toute rupture du contrat de travail r\u00e9sultant de l&#8217;une des causes \u00e9nonc\u00e9es au pr\u00e9sent article, \u00e0 l&#8217;exclusion de la rupture conventionnelle vis\u00e9e aux articles L. 1237-11 et suivants et de la rupture d&#8217;un
