The delivery of this card is expressly conditioned on the prior obtention of a work authorization under the Labour Code. The practical consequence is that an incomplete application \u2014 one lacking the requisite work authorization \u2014 does not even constitute an appealable decision, because the <em>pr\u00e9fecture<\/em> (prefecture) is under no obligation to examine a file that cannot be processed.<\/p>\n<p>Article R. 5221-1 of the <em>Code du travail<\/em> (Labour Code), in its current version effective since 1 September 2024, specifies who must hold a work authorization: &#8220;pour exercer une activit\u00e9 professionnelle salari\u00e9e en France, les personnes suivantes doivent d\u00e9tenir une autorisation de travail lorsqu&#8217;elles sont employ\u00e9es conform\u00e9ment aux dispositions du pr\u00e9sent code : 1\u00b0 \u00c9tranger non ressortissant d&#8217;un \u00c9tat membre de l&#8217;Union europ\u00e9enne, d&#8217;un autre \u00c9tat partie \u00e0 l&#8217;Espace \u00e9conomique europ\u00e9en ou de la Conf\u00e9d\u00e9ration suisse&#8221; \u2014 non-EU\/EEA\/Swiss nationals must hold a work authorization to engage in salaried employment in France (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049999770\">C. trav., art. R. 5221-1<\/a>). The provision further clarifies that every new employment contract triggers the need for a new work authorization application.<\/p>\n<h3>B. The Criteria and Procedure for Obtaining Work Authorization<\/h3>\n<p>The work authorization is not a mere formality. Article R. 5221-20 of the Labour Code lays down cumulative conditions that must be met for the authorization to be granted. Article R. 5221-15 of the Labour Code provides that &#8220;la demande d&#8217;autorisation de travail mentionn\u00e9e au I de l&#8217;article R. 5221-1 est adress\u00e9e au moyen d&#8217;un t\u00e9l\u00e9service au pr\u00e9fet du d\u00e9partement dans lequel l&#8217;\u00e9tablissement employeur a son si\u00e8ge ou le particulier employeur sa r\u00e9sidence&#8221; \u2014 the application is submitted via a dedicated online platform to the prefect of the department where the employer&#8217;s establishment is located (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043320674\">C. trav., art. R. 5221-15<\/a>).<\/p>\n<p>The <em>Cour administrative d&#8217;appel de Paris<\/em> (Paris Administrative Court of Appeal) recently summarized the prefect&#8217;s role in this process, stating that the prefect must take into consideration &#8220;l&#8217;anciennet\u00e9 et la stabilit\u00e9 de l&#8217;insertion professionnelle du demandeur, le niveau de sa r\u00e9mun\u00e9ration, sa qualification, son exp\u00e9rience et ses dipl\u00f4mes, la nature de l&#8217;activit\u00e9 exerc\u00e9e au regard des besoins de recrutement, les d\u00e9marches effectu\u00e9es par son employeur pour soutenir sa r\u00e9gularisation&#8221; \u2014 the length and stability of the applicant&#8217;s professional integration, their remuneration level, qualifications, experience, and diplomas, the nature of the activity in light of recruitment needs, and the steps taken by the employer to support regularization (<a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000054207117\">CAA Paris, 4 June 2026, n\u00b0 25PA05821<\/a>). This list, while not exhaustive, illustrates the breadth of the prefect&#8217;s examination.<\/p>\n<p>It is in this context \u2014 a system already built on a rigorous dual framework \u2014 that the two draft decrees examined on 8 July 2026 by the <em>Commission nationale de la n\u00e9gociation collective, de l&#8217;emploi et de la formation professionnelle<\/em> (CNNCEFP) seek to intervene.<\/p>\n<h2>II. The July 2026 Draft Decrees and Judicial Oversight<\/h2>\n<h3>A. What the Two Draft Decrees Would Change<\/h3>\n<p>The first draft decree, which modifies the CESEDA, aims to redefine the categories of residence permits linked to employment. The <em>Cour administrative d&#8217;appel de Nantes<\/em> (Nantes Administrative Court of Appeal) has repeatedly affirmed:<\/p>\n<blockquote>\n<p>La circonstance qu&#8217;un travailleur \u00e9tranger dispose d&#8217;une autorisation de travail d\u00e9livr\u00e9e par le minist\u00e8re de l&#8217;int\u00e9rieur ne fait pas obstacle \u00e0 ce que l&#8217;autorit\u00e9 comp\u00e9tente refuse de lui d\u00e9livrer un visa d&#8217;entr\u00e9e en France en se fondant, sous le contr\u00f4le du juge de l&#8217;exc\u00e8s de pouvoir, sur tout motif d&#8217;int\u00e9r\u00eat g\u00e9n\u00e9ral. (<a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000050625614\">CAA Nantes, 18 November 2024, n\u00b0 23NT02476<\/a>)<\/p>\n<\/blockquote>\n<p>In English: the fact that a foreign worker holds a work authorization does not prevent the competent authority from refusing to issue an entry visa on any ground of public interest, subject to judicial review. This settled principle, which the same court has reiterated in multiple subsequent rulings (notably <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000051476689\">CAA Nantes, 14 April 2025, n\u00b0 24NT01983<\/a>), means that a work authorization is only one link in a longer administrative chain. The administration retains the authority to deny a visa or a residence permit even where a work authorization has been issued, provided it can demonstrate a &#8220;risque av\u00e9r\u00e9 de d\u00e9tournement de l&#8217;objet du visa&#8221; \u2014 an established risk that the visa would be used for purposes other than those declared.<\/p>\n<p>As the court explained in a judgment of 30 June 2026, this risk is established &#8220;lorsque l&#8217;administration \u00e9tablit que le motif indiqu\u00e9 dans la demande ne correspond manifestement pas \u00e0 la finalit\u00e9 r\u00e9elle du s\u00e9jour de l&#8217;\u00e9tranger en France&#8221; \u2014 when the administration shows that the stated purpose of the application manifestly does not correspond to the real purpose of the foreign national&#8217;s stay (<a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000054370436\">CAA Nantes, 30 June 2026, n\u00b0 24NT03025<\/a>).<\/p>\n<p>The same judgment clarified the intensity of judicial review in such cases: &#8220;le juge de l&#8217;exc\u00e8s de pouvoir exerce un contr\u00f4le normal sur l&#8217;appr\u00e9ciation port\u00e9e par l&#8217;administration en cas de refus de visa fond\u00e9 exclusivement ou notamment sur l&#8217;absence d&#8217;ad\u00e9quation de la qualification et de l&#8217;exp\u00e9rience professionnelle du demandeur avec l&#8217;emploi propos\u00e9&#8221; \u2014 the judge exercises normal (full) review over the administration&#8217;s assessment when a visa is refused exclusively or primarily on the ground that the applicant&#8217;s qualifications and professional experience are not adequate for the employment proposed. This means the court will independently verify whether the administration&#8217;s reasoning holds up, rather than merely checking for manifest error.<\/p>\n<h3>B. The Administrative Judge as Guardian of Foreign Workers&#8217; Rights<\/h3>\n<p>The July 2026 draft decrees are likely to intensify litigation before the French administrative courts, and the jurisprudence of the past three years provides a clear picture of how judges will approach these cases.<\/p>\n<p>One of the most important procedural tools available to the administration \u2014 and one that foreign workers and their counsel must be prepared to counter \u2014 is the <em>substitution de motifs<\/em> (substitution of grounds). The <em>Cour administrative d&#8217;appel de Nantes<\/em> has articulated the conditions for this technique, which allows the administration to replace an inadequate or unlawful ground for refusal with a new ground during the course of litigation:<\/p>\n<blockquote>\n<p>Il appartient au juge, apr\u00e8s avoir mis \u00e0 m\u00eame l&#8217;auteur du recours de pr\u00e9senter ses observations sur la substitution ainsi sollicit\u00e9e, de rechercher si un tel motif est de nature \u00e0 fonder l\u00e9galement la d\u00e9cision, puis d&#8217;appr\u00e9cier s&#8217;il r\u00e9sulte de l&#8217;instruction que l&#8217;administration aurait pris la m\u00eame d\u00e9cision si elle s&#8217;\u00e9tait fond\u00e9e initialement sur ce motif. Dans l&#8217;affirmative il peut proc\u00e9der \u00e0 la substitution demand\u00e9e, sous r\u00e9serve toutefois qu&#8217;elle ne prive pas le requ\u00e9rant d&#8217;une garantie proc\u00e9durale li\u00e9e au motif substitu\u00e9. (<a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000050792881\">CAA Nantes, 17 December 2024, n\u00b0 24NT01111<\/a>)<\/p>\n<\/blockquote>\n<p>In practice, this means the judge must first invite the applicant to comment on the proposed new ground, then verify that the new ground is capable of legally justifying the decision, and then assess whether the administration would have taken the same decision based on that ground. The substitution may only proceed if it does not deprive the applicant of a procedural guarantee linked to the substituted ground. For foreign workers and their employers, this doctrine means that even a poorly reasoned refusal can be &#8220;rescued&#8221; by the administration mid-litigation \u2014 making it essential for applicants to prepare a robust defence from the outset.<\/p>\n<p>Beyond procedural review, the administrative judge exercises substantive control over both the legality and the proportionality of work-related immigration decisions. The <em>Cour administrative d&#8217;appel de Lyon<\/em> (Lyon Administrative Court of Appeal) has confirmed that a work authorization, even when accompanied by a firm job offer, does not create a right to residence:<\/p>\n<blockquote>\n<p>Alors m\u00eame que cet \u00e9tranger peut se pr\u00e9valoir d&#8217;une autorisation de travail et d&#8217;une promesse d&#8217;embauche, la pr\u00e9f\u00e8te de la Dr\u00f4me a pu, sans commettre d&#8217;erreur de droit ni d&#8217;erreur manifeste d&#8217;appr\u00e9ciation de la situation de M. A&#8230; au regard de l&#8217;exercice de son pouvoir discr\u00e9tionnaire, refuser son admission au s\u00e9jour. (<a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000048512401\">CAA Lyon, 29 November 2023, n\u00b0 22LY03202<\/a>)<\/p>\n<\/blockquote>\n<p>Even where a foreign national can demonstrate possession of a work authorization and a promise of employment, the prefect may lawfully exercise discretionary power to refuse admission to residence, provided this does not rest on an error of law or a manifest error of appreciation. This discretionary power is not unlimited, however. The <em>Cour administrative d&#8217;appel de Nancy<\/em> (Nancy Administrative Court of Appeal) has held that the prefect must conduct a thorough examination of the individual&#8217;s situation: &#8220;il appartient \u00e0 l&#8217;autorit\u00e9 administrative, sous le contr\u00f4le du juge, d&#8217;examiner, notamment, si la qualification, l&#8217;exp\u00e9rience et les dipl\u00f4mes de l&#8217;\u00e9tranger ainsi que les caract\u00e9ristiques de l&#8217;emploi auquel il postule, de m\u00eame que tout \u00e9l\u00e9ment de sa situation personnelle, constituent un motif exceptionnel d&#8217;admission au s\u00e9jour&#8221; \u2014 the administration must examine whether the foreign national&#8217;s qualifications, experience, diplomas, the characteristics of the employment sought, and any element of their personal situation constitute an exceptional ground for admission to residence (CAA Nancy, 27 February 2025, n\u00b0 23NC03595). The administration cannot rely on generic or automatic grounds; it must engage with the specific circumstances of each case.<\/p>\n<p>The practical consequences for applicants are significant. A refusal may be challenged before the <em>tribunal administratif<\/em> (administrative court) of the applicant&#8217;s place of residence. The time limit for lodging an appeal is two months from notification of the decision \u2014 or two months from the implicit rejection if the administration remains silent for four months (for residence permit applications) or two months (for visa appeals before the <em>Commission de recours contre les d\u00e9cisions de refus de visa<\/em>). The administrative judge will verify not only the legal basis of the refusal but also the adequacy of the administration&#8217;s factual investigation, the proportionality of the decision in light of the applicant&#8217;s right to respect for private and family life under Article 8 of the European Convention on Human Rights, and the regularity of the procedure followed.<\/p>\n<p>For employers, the stakes are equally high. A refusal of work authorization can deprive a company of a needed employee. An employer who hires a foreign national without the requisite authorization faces criminal sanctions under Article L. 8256-2 of the Labour Code \u2014 including imprisonment and fines of up to \u20ac15,000 per illegally employed worker \u2014 as well as administrative fines of up to \u20ac20,750 per worker, a ban on employing foreign workers, and the suspension or withdrawal of public subsidies. The obligation to verify the existence of a valid work authorization before the commencement of employment lies squarely with the employer. The timeline for processing a work authorization application varies by <em>pr\u00e9fecture<\/em> but generally ranges from two to four months.
