La d\u00e9cision examine \u00e9galement une demande en responsabilit\u00e9 pour proc\u00e9dure abusive formul\u00e9e par la propri\u00e9taire. Le tribunal refuse l&#8217;octroi de d\u00e9lais et \u00e9carte la qualification d&#8217;abus de proc\u00e9dure.<\/p>\n<p>La bonne foi conditionnant l&#8217;octroi de d\u00e9lais<\/p>\n<p>L&#8217;appr\u00e9ciation souveraine de la bonne volont\u00e9 de l&#8217;occupant<\/p>\n<p>Le juge proc\u00e8de \u00e0 une pes\u00e9e globale des circonstances personnelles et financi\u00e8res des parties. Il reconna\u00eet la situation m\u00e9dicale grave et l&#8217;\u00e2ge avanc\u00e9 de la locataire, \u00e9l\u00e9ments habituellement favorables. Toutefois, il oppose \u00e0 ces facteurs l&#8217;anciennet\u00e9 et l&#8217;ampleur de la dette locative, constatant l&#8217;absence de paiement depuis plusieurs ann\u00e9es. La d\u00e9cision souligne qu&#8217;un effacement de dette ant\u00e9rieur n&#8217;a pas permis de r\u00e9tablir une situation locative saine. Ainsi, &#8220;en d\u00e9pit de la situation m\u00e9dicale de Mme [U] [P], l\u2019\u00e9tat et l\u2019anciennet\u00e9 de sa dette, qui s\u2019accro\u00eet encore aujourd\u2019hui, ne permet pas de caract\u00e9riser la bonne foi n\u00e9cessaire \u00e0 l\u2019attribution de d\u00e9lais pour quitter les lieux.&#8221; (Motifs) Le crit\u00e8re de bonne foi devient ainsi un \u00e9l\u00e9ment central et autonome, pouvant neutraliser des circonstances personnelles pourtant dignes d&#8217;int\u00e9r\u00eat.<\/p>\n<p>La port\u00e9e restrictive de la notion de bonne foi<\/p>\n<p>Cette interpr\u00e9tation restrictive de la bonne foi limite la port\u00e9e protectrice des articles L. 412-3 et L. 412-4 du CPCE. Le juge estime que la persistance d&#8217;une dette importante, malgr\u00e9 des efforts de relogement et un dossier de surendettement, d\u00e9note un manque de volont\u00e9. La solution insiste sur la n\u00e9cessit\u00e9 d&#8217;une coop\u00e9ration active du d\u00e9biteur \u00e0 l&#8217;ex\u00e9cution de ses obligations, au-del\u00e0 de la simple justification de difficult\u00e9s personnelles. Elle rappelle que le l\u00e9gislateur a subordonn\u00e9 l&#8217;octroi de d\u00e9lais \u00e0 une appr\u00e9ciation d&#8217;ensemble, o\u00f9 la situation du cr\u00e9ancier, ici une propri\u00e9taire aux revenus modestes, est \u00e9galement prise en compte. Cette analyse pr\u00e9vaut sur le droit \u00e0 un logement d\u00e9cent invoqu\u00e9 par la locataire.<\/p>\n<p>L&#8217;abus de proc\u00e9dure distinct du rejet au fond<\/p>\n<p>Le rejet de la demande ne vaut pas abus de droit<\/p>\n<p>Le juge \u00e9carte la demande de la propri\u00e9taire visant \u00e0 engager la responsabilit\u00e9 de la locataire pour proc\u00e9dure abusive. Il \u00e9tablit une distinction nette entre l&#8217;\u00e9chec d&#8217;une demande et son caract\u00e8re abusif. La simple circonstance que la requ\u00eate en d\u00e9lais soit d\u00e9bout\u00e9e ne suffit pas \u00e0 caract\u00e9riser un d\u00e9tournement du droit d&#8217;agir. Cette solution est conforme \u00e0 une jurisprudence constante qui exige des \u00e9l\u00e9ments sp\u00e9cifiques. Comme le rappelle la Cour d&#8217;appel de Paris, &#8220;Le principe du droit d&#8217;agir implique que la d\u00e9cision judiciaire de retenir le caract\u00e8re non fond\u00e9 des pr\u00e9tentions ne suffit pas \u00e0 caract\u00e9riser l&#8217;abus de l&#8217;exercice du droit.&#8221; (Cour d&#8217;appel de Paris, le 28 septembre 2023, n\u00b023\/02147) L&#8217;absence de malice ou d&#8217;acharnement proc\u00e9dural est ainsi pr\u00e9sum\u00e9e en l&#8217;esp\u00e8ce.<\/p>\n<p>Les exigences probatoires pour caract\u00e9riser la mauvaise foi<\/p>\n<p>La d\u00e9cision confirme la charge de preuve \u00e9lev\u00e9e pesant sur celui qui invoque un abus de proc\u00e9dure. La propri\u00e9taire n&#8217;a pas rapport\u00e9 la d\u00e9monstration d&#8217;une intention malicieuse ou d&#8217;une man\u0153uvre dilatoire de la part de la locataire. La demande de d\u00e9lais, bien que jug\u00e9e non fond\u00e9e, s&#8217;appuyait sur des \u00e9l\u00e9ments objectifs tels qu&#8217;un \u00e9tat de sant\u00e9 grave et une demande de logement social. Cette approche rejoint celle d&#8217;un tribunal qui a jug\u00e9 que des \u00e9l\u00e9ments peu \u00e9tay\u00e9s &#8220;ne sont pas suffisants pour caract\u00e9riser la mauvaise foi&#8221; dans l&#8217;exercice d&#8217;une action en justice (Tribunal judiciaire de Saint-Denis de La R\u00e9union, le 30 janvier 2025, n\u00b024\/01899).
