Le syndicat demandait \u00e9galement le rejet d\u2019une demande de d\u00e9lais de paiement formul\u00e9e par la copropri\u00e9taire d\u00e9faillante. Le juge a accueilli la demande principale tout en accordant des d\u00e9lais de paiement et a pr\u00e9cis\u00e9ment encadr\u00e9 la r\u00e9clamation des frais de recouvrement.<\/p>\n<p>Le cadre strict de l\u2019exigibilit\u00e9 des charges<\/p>\n<p>Le juge rappelle les conditions l\u00e9gales de l\u2019exigibilit\u00e9 des provisions. L\u2019approbation des comptes et des budgets par l\u2019assembl\u00e9e g\u00e9n\u00e9rale est un pr\u00e9alable n\u00e9cessaire \u00e0 la condamnation. Le m\u00e9canisme de d\u00e9ch\u00e9ance du terme de l\u2019article 19-2 de la loi du 10 juillet 1965 est ensuite strictement appliqu\u00e9. &#8220;Il appartient au juge charg\u00e9 d\u2019appliquer l\u2019article 19-2 de la loi du 10 juillet 1965 de constater le vote du budget pr\u00e9visionnel par l\u2019assembl\u00e9e g\u00e9n\u00e9rale de la copropri\u00e9t\u00e9 ainsi que la d\u00e9ch\u00e9ance du terme, avant de condamner le copropri\u00e9taire d\u00e9faillant au versement des provisions&#8221; (Motifs, point 1). Cette v\u00e9rification est une condition de fond qui garantit la r\u00e9gularit\u00e9 de la cr\u00e9ance syndicale.<\/p>\n<p>La port\u00e9e de cette analyse est de s\u00e9curiser le recouvrement pour le syndicat. Elle confirme une jurisprudence constante sur la n\u00e9cessit\u00e9 de justifier des d\u00e9cisions collectives. Le juge op\u00e8re ainsi un contr\u00f4le rigoureux des conditions de mise en \u0153uvre de la proc\u00e9dure acc\u00e9l\u00e9r\u00e9e au fond, prot\u00e9geant le d\u00e9biteur d\u2019une exigibilit\u00e9 arbitraire.<\/p>\n<p>Un contr\u00f4le rigoureux des frais r\u00e9clam\u00e9s au titre de l\u2019article 10-1<\/p>\n<p>Le second apport concerne l\u2019imputation des frais de recouvrement au copropri\u00e9taire d\u00e9faillant. Le juge rappelle le principe de l\u2019article 10-1 : ces frais doivent \u00eatre justifi\u00e9s et n\u00e9cessaires. Il en op\u00e8re un examen critique au cas par cas, \u00e9cartant les d\u00e9penses non \u00e9tay\u00e9es ou superflues. &#8220;la mise en demeure du 28 avril 2025 n\u2019appara\u00eet pas n\u00e9cessaire&#8221; et &#8220;la constitution du dossier transmis \u00e0 l\u2019auxiliaire de justice n\u2019est factur\u00e9e qu\u2019en cas de diligences exceptionnelles dont il n\u2019est pas justifi\u00e9 en l\u2019esp\u00e8ce&#8221; (Motifs, point 1).<\/p>\n<p>La valeur de cette motivation est de pr\u00e9venir les abus dans le recouvrement. Elle rappelle que ces frais, bien que mis \u00e0 la charge du d\u00e9biteur, ne sont pas un forfait et doivent r\u00e9pondre \u00e0 un imp\u00e9ratif de n\u00e9cessit\u00e9. Cette analyse restrictive prot\u00e8ge le copropri\u00e9taire d\u00e9faillant de charges excessives et encadre strictement l\u2019action syndicale.<\/p>\n<p>L\u2019octroi conditionn\u00e9 des d\u00e9lais de paiement<\/p>\n<p>Le juge fait application de l\u2019article 1343-5 du code civil pour accorder des d\u00e9lais. Il retient deux crit\u00e8res principaux : l\u2019absence de mauvaise foi du d\u00e9biteur et l\u2019existence de difficult\u00e9s financi\u00e8res et personnelles. &#8220;compte tenu des propositions de r\u00e8glement formul\u00e9es par la d\u00e9fenderesse qui n\u2019appara\u00eet pas \u00eatre de mauvaise foi et qui invoque des difficult\u00e9s financi\u00e8res et personnelles il convient de faire droit \u00e0 sa demande de d\u00e9lais&#8221; (Motifs, point 2). Cette appr\u00e9ciation souveraine ouvre la voie \u00e0 un am\u00e9nagement.<\/p>\n<p>La port\u00e9e de cette d\u00e9cision est humaniser le recouvrement forc\u00e9. Elle aligne la jurisprudence sur l\u2019objectif de l\u2019article 1343-5, qui est d\u2019\u00e9viter l\u2019asphyxie du d\u00e9biteur de bonne foi. Cette solution rejoint celle d\u2019un tribunal qui avait d\u00e9j\u00e0 accord\u00e9 des d\u00e9lais &#8220;mais sous une stricte condition du paiement des charges courants et des arri\u00e9r\u00e9s&#8221; (Tribunal judiciaire, le 27 mai 2025, n\u00b025\/00022). Elle concilie ainsi les besoins du cr\u00e9ancier et la situation du d\u00e9biteur.<\/p>\n<p>Le caract\u00e8re strictement conditionnel de la mesure<\/p>\n<p>L\u2019octroi de d\u00e9lais n\u2019est cependant pas une lib\u00e9ration. Le juge le subordonne express\u00e9ment au paiement rigoureux des \u00e9ch\u00e9ances nouvelles et \u00e0 la continuation du paiement des charges courantes. &#8220;ces d\u00e9lais supposent le paiement, en sus, des charges courantes \u00e0 leur \u00e9ch\u00e9ance, faute de quoi les d\u00e9lais accord\u00e9s seront caducs et les poursuites pourront reprendre pour le tout&#8221; (Motifs, point 2). Cette condition est une garantie essentielle pour le syndicat.<\/p>\n<p>La valeur de cette condition est de pr\u00e9server l\u2019\u00e9quilibre de la d\u00e9cision. Elle emp\u00eache que l\u2019am\u00e9nagement n\u2019aggrave la situation du cr\u00e9ancier en g\u00e9n\u00e9rant de nouveaux impay\u00e9s.
