Pendant longtemps, beaucoup de salari\u00e9s associaient l&#8217;arr\u00eat maladie \u00e0 une interruption pure et simple de l&#8217;acquisition des cong\u00e9s. Depuis la loi du 22 avril 2024, cette lecture n&#8217;est plus tenable. Depuis la Cour de cassation du 21 janvier 2026, le mode de calcul du plafond en cas de maladie non professionnelle est en outre mieux balis\u00e9.<\/p>\n<p>La question utile n&#8217;est donc plus seulement de savoir si l&#8217;arr\u00eat maladie &#8220;compte&#8221;. Elle est plus concr\u00e8te. Combien de jours sont acquis. Quelle diff\u00e9rence entre maladie ordinaire et accident du travail. Quand le report de quinze mois commence-t-il. Et que faire si le compteur affich\u00e9 par l&#8217;employeur reste faux.<\/p>\n<p>Le bon raisonnement tient en quatre blocs : l&#8217;acquisition, le plafond, le report, puis la preuve.<\/p>\n<h2>I. Oui, un arr\u00eat maladie ouvre d\u00e9sormais des droits \u00e0 cong\u00e9s pay\u00e9s<\/h2>\n<p>Le point de d\u00e9part est l&#8217;article L. 3141-5 du code du travail. Il assimile d\u00e9sormais au travail effectif, pour le calcul des cong\u00e9s pay\u00e9s, les p\u00e9riodes d&#8217;arr\u00eat de travail li\u00e9es \u00e0 une maladie ou \u00e0 un accident non professionnels, en plus des accidents du travail et maladies professionnelles<sup id=\"fnref:1\"><a class=\"footnote-ref\" href=\"#fn:1\">1<\/a><\/sup>.<\/p>\n<p>Mais il faut imm\u00e9diatement distinguer deux r\u00e9gimes.<\/p>\n<p>Pour l&#8217;accident du travail ou la maladie professionnelle, on reste dans la logique de droit commun du cong\u00e9 pay\u00e9 : le salari\u00e9 acquiert des droits dans les conditions ordinaires de l&#8217;article L. 3141-3<sup id=\"fnref:2\"><a class=\"footnote-ref\" href=\"#fn:2\">2<\/a><\/sup>.<\/p>\n<p>Pour la maladie ou l&#8217;accident non professionnels, l&#8217;article L. 3141-5-1 introduit une r\u00e8gle sp\u00e9ciale : le salari\u00e9 acquiert deux jours ouvrables par mois, dans la limite de vingt-quatre jours ouvrables par p\u00e9riode de r\u00e9f\u00e9rence<sup id=\"fnref:3\"><a class=\"footnote-ref\" href=\"#fn:3\">3<\/a><\/sup>.<\/p>\n<p>Cette diff\u00e9rence est centrale. Beaucoup d&#8217;erreurs de compteur viennent d&#8217;un m\u00e9lange entre ces deux hypoth\u00e8ses. Le salari\u00e9 qui a \u00e9t\u00e9 arr\u00eat\u00e9 pour une maladie ordinaire ne r\u00e9cup\u00e8re pas m\u00e9caniquement trente jours sur une ann\u00e9e compl\u00e8te d&#8217;absence. Il r\u00e9cup\u00e8re au maximum vingt-quatre jours ouvrables au titre de cette p\u00e9riode de r\u00e9f\u00e9rence.<\/p>\n<p>En pratique, il faut donc toujours commencer par qualifier l&#8217;arr\u00eat :<\/p>\n<ul>\n<li>maladie non professionnelle ;<\/li>\n<li>accident du travail ou maladie professionnelle ;<\/li>\n<li>alternance de p\u00e9riodes de travail et d&#8217;arr\u00eat sur la m\u00eame p\u00e9riode de r\u00e9f\u00e9rence.<\/li>\n<\/ul>\n<p>Sans cette qualification, le chiffrage est faux d\u00e8s la premi\u00e8re ligne.<\/p>\n<h2>II. Le plafond de 24 jours ne se calcule pas n&#8217;importe comment<\/h2>\n<p>Le contentieux s&#8217;est d\u00e9plac\u00e9 sur ce point. L&#8217;employeur admet parfois l&#8217;acquisition pendant la maladie, mais r\u00e9duit ensuite les droits en consid\u00e9rant que des jours report\u00e9s d&#8217;une ann\u00e9e pr\u00e9c\u00e9dente &#8220;mangent&#8221; d\u00e9j\u00e0 le plafond de vingt-quatre jours. C&#8217;est pr\u00e9cis\u00e9ment ce que la chambre sociale a \u00e9cart\u00e9 le 21 janvier 2026, pourvoi n\u00b0 24-22.228<sup id=\"fnref:4\"><a class=\"footnote-ref\" href=\"#fn:4\">4<\/a><\/sup>.<\/p>\n<p>La Cour juge que, pour calculer les vingt-quatre jours ouvrables dus au salari\u00e9 absent pour maladie pendant une p\u00e9riode de r\u00e9f\u00e9rence, il ne faut pas prendre en compte les cong\u00e9s acquis lors d&#8217;une p\u00e9riode ant\u00e9rieure puis simplement report\u00e9s faute d&#8217;avoir pu \u00eatre pris.<\/p>\n<p>La cons\u00e9quence est pratique. Un salari\u00e9 peut cumuler :<\/p>\n<ul>\n<li>des jours acquis sur la p\u00e9riode de r\u00e9f\u00e9rence en cours pendant l&#8217;arr\u00eat maladie ;<\/li>\n<li>et des jours plus anciens report\u00e9s.<\/li>\n<\/ul>\n<p>Autrement dit, le reliquat ancien ne r\u00e9duit pas \u00e0 lui seul le quota nouveau. Le plafond de vingt-quatre jours concerne l&#8217;acquisition li\u00e9e \u00e0 la maladie sur la p\u00e9riode de r\u00e9f\u00e9rence concern\u00e9e. Il ne sert pas \u00e0 effacer m\u00e9caniquement un stock ant\u00e9rieur report\u00e9.<\/p>\n<p>Ce point change le r\u00e9sultat dans les dossiers de longue absence, de reprise tardive, ou de rupture de contrat avec indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s. Il explique aussi pourquoi certains bulletins de paie ou soldes de tout compte \u00e9tablis en 2024 ou 2025 sont discutables.<\/p>\n<h2>III. Le report de quinze mois n&#8217;est pas automatique au hasard : il a un point de d\u00e9part pr\u00e9cis<\/h2>\n<p>L&#8217;autre erreur fr\u00e9quente consiste \u00e0 raisonner comme si les cong\u00e9s acquis pendant l&#8217;arr\u00eat devaient n\u00e9cessairement \u00eatre perdus \u00e0 la fin de la p\u00e9riode de prise. Depuis la loi du 22 avril 2024, l&#8217;article L. 3141-19-1 pr\u00e9voit un report de quinze mois lorsque le salari\u00e9 n&#8217;a pas pu prendre tout ou partie de ses cong\u00e9s pour cause de maladie ou d&#8217;accident<sup id=\"fnref:5\"><a class=\"footnote-ref\" href=\"#fn:5\">5<\/a><\/sup>.<\/p>\n<p>Mais ce d\u00e9lai ne part pas dans le vide. Il commence \u00e0 la date \u00e0 laquelle le salari\u00e9 re\u00e7oit, apr\u00e8s sa reprise, l&#8217;information pr\u00e9vue par l&#8217;article L. 3141-19-3<sup id=\"fnref:6\"><a class=\"footnote-ref\" href=\"#fn:6\">6<\/a><\/sup>.<\/p>\n<p>Ce texte impose \u00e0 l&#8217;employeur, dans le mois qui suit la reprise du travail, d&#8217;informer le salari\u00e9, par un moyen donnant date certaine, de deux \u00e9l\u00e9ments :<\/p>\n<ul>\n<li>le nombre de jours de cong\u00e9 dont il dispose ;<\/li>\n<li>la date limite \u00e0 laquelle ces jours peuvent \u00eatre pris.<\/li>\n<\/ul>\n<p>Cette pr\u00e9cision est d\u00e9cisive. Si l&#8217;information n&#8217;est pas donn\u00e9e proprement, le point de d\u00e9part du d\u00e9lai de report devient contestable. Le dossier bascule alors du simple calcul RH vers un vrai d\u00e9bat probatoire.<\/p>\n<p>Pour le salari\u00e9, cela signifie qu&#8217;il faut conserver :<\/p>\n<ul>\n<li>le premier bulletin de paie ou courrier re\u00e7u apr\u00e8s la reprise ;<\/li>\n<li>le d\u00e9tail du compteur de cong\u00e9s ;<\/li>\n<li>la date limite annonc\u00e9e par l&#8217;employeur ;<\/li>\n<li>la comparaison avec le nombre de jours effectivement dus.<\/li>\n<\/ul>\n<h2>IV. Comment v\u00e9rifier si le compteur est juste<\/h2>\n<p>La v\u00e9rification doit se faire p\u00e9riode de r\u00e9f\u00e9rence par p\u00e9riode de r\u00e9f\u00e9rence.<\/p>\n<p>Il faut d&#8217;abord identifier la p\u00e9riode retenue dans l&#8217;entreprise. Souvent, il s&#8217;agit encore du 1er juin au 31 mai. Parfois, une convention collective ou un accord collectif retient une autre borne.<\/p>\n<p>Il faut ensuite reconstituer, pour chaque p\u00e9riode :<\/p>\n<ul>\n<li>les mois travaill\u00e9s normalement ;<\/li>\n<li>les mois couverts par un arr\u00eat non professionnel ;<\/li>\n<li>les mois couverts par un accident du travail ou une maladie professionnelle ;<\/li>\n<li>les jours d\u00e9j\u00e0 acquis hors arr\u00eat ;<\/li>\n<li>les jours report\u00e9s d&#8217;une p\u00e9riode ant\u00e9rieure.<\/li>\n<\/ul>\n<p>\u00c0 ce stade, trois v\u00e9rifications simples font gagner du temps :<\/p>\n<ol>\n<li>l&#8217;employeur a-t-il bien distingu\u00e9 maladie non professionnelle et accident du travail ;<\/li>\n<li>le plafond de vingt-quatre jours a-t-il \u00e9t\u00e9 appliqu\u00e9 seulement \u00e0 l&#8217;acquisition li\u00e9e \u00e0 la maladie sur la p\u00e9riode concern\u00e9e ;<\/li>\n<li>les jours report\u00e9s ont-ils \u00e9t\u00e9 trait\u00e9s comme un stock distinct au lieu d&#8217;\u00eatre absorb\u00e9s dans ce plafond.<\/li>\n<\/ol>\n<p>Beaucoup de litiges proviennent aussi d&#8217;un d\u00e9faut de chronologie. Le salari\u00e9 re\u00e7oit un nouveau compteur, mais il ne sait pas ce qui rel\u00e8ve de l&#8217;acquisition, du report, du reliquat, ou du paiement \u00e0 la rupture. Sans d\u00e9tail, le contr\u00f4le est impossible.<\/p>\n<h2>V. Que faire si l&#8217;employeur n&#8217;a pas r\u00e9gularis\u00e9<\/h2>\n<p>Le premier r\u00e9flexe est \u00e9crit. Il faut demander le d\u00e9tail du calcul par p\u00e9riode de r\u00e9f\u00e9rence et la base juridique retenue. Une contestation efficace n&#8217;est pas une protestation g\u00e9n\u00e9rale. C&#8217;est une demande de ventilation pr\u00e9cise.<\/p>\n<p>Le deuxi\u00e8me r\u00e9flexe est documentaire. Il faut rassembler :<\/p>\n<ul>\n<li>arr\u00eats de travail ;<\/li>\n<li>bulletins de paie ;<\/li>\n<li>compteur de cong\u00e9s ;<\/li>\n<li>courrier ou mail d&#8217;information apr\u00e8s reprise ;<\/li>\n<li>re\u00e7u pour solde de tout compte si le contrat est rompu.<\/li>\n<\/ul>\n<p>Le troisi\u00e8me r\u00e9flexe est strat\u00e9gique. Si le contrat continue, l&#8217;enjeu porte souvent sur la mise \u00e0 jour du compteur et sur la date limite d&#8217;utilisation des jours report\u00e9s. Si le contrat est rompu, le d\u00e9bat porte plus directement sur l&#8217;indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s.<\/p>\n<p>Lorsque le calcul reste bloqu\u00e9, le dossier peut relever du <a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/\">droit du travail<\/a>, du <a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/avocats-contentieux-prudhommes-paris\/\">contentieux prud&#8217;homal<\/a> et, si la question de la prise des cong\u00e9s se combine avec d&#8217;autres difficult\u00e9s de sortie, de nos analyses sur les <a href=\"https:\/\/kohenavocats.com\/conges-payes-refuses-annules-ou-imposes-delai-dun-mois-circonstances-exceptionnelles-recours-salarie\/\">cong\u00e9s pay\u00e9s refus\u00e9s, annul\u00e9s ou impos\u00e9s<\/a>.<\/p>\n<h2>VI. Le vrai sujet n&#8217;est plus le principe, mais le bon calcul<\/h2>\n<p>Aujourd&#8217;hui, soutenir qu&#8217;un arr\u00eat maladie n&#8217;ouvre aucun droit \u00e0 cong\u00e9s pay\u00e9s est, dans de nombreux dossiers, une mauvaise lecture du droit positif. Le contentieux s\u00e9rieux porte d\u00e9sormais ailleurs : qualification de l&#8217;arr\u00eat, plafond applicable, articulation avec les jours d\u00e9j\u00e0 acquis, report de quinze mois, et information due au salari\u00e9 apr\u00e8s la reprise.<\/p>\n<p>Le salari\u00e9 qui contr\u00f4le ces cinq points reprend la main sur son dossier.<\/p>\n<p>Il sait combien de jours il devait acqu\u00e9rir.<\/p>\n<p>Il sait si des jours plus anciens ont \u00e9t\u00e9 ind\u00fbment absorb\u00e9s.<\/p>\n<p>Il sait si le d\u00e9lai de report a r\u00e9ellement commenc\u00e9.<\/p>\n<p>Et il sait, surtout, quelles pi\u00e8ces demander avant que le compteur erron\u00e9 ne se transforme en perte d\u00e9finitive ou en solde de tout compte sous-\u00e9valu\u00e9.<\/p>\n<h2>Notes<\/h2>\n<div class=\"footnote\">\n<hr>\n<ol>\n<li id=\"fn:1\">\n<p>Code du travail, art.
