Elle est probatoire. L&#8217;\u00e9lectricien peut relever des anomalies graves. Encore faut-il d\u00e9montrer que ces anomalies existaient avant la vente et que le vendeur en avait connaissance. Sans cela, le vendeur r\u00e9pondra qu&#8217;il s&#8217;agit d&#8217;une vieille installation, que vous avez achet\u00e9 un bien ancien, ou que le probl\u00e8me est apparu apr\u00e8s votre entr\u00e9e dans les lieux.<\/p>\n<p>La m\u00e9thode utile consiste donc \u00e0 s\u00e9parer deux questions.<\/p>\n<p>Premi\u00e8re question : l&#8217;installation \u00e9tait-elle d\u00e9j\u00e0 dangereuse au jour de la vente ?<\/p>\n<p>Deuxi\u00e8me question : quels indices permettent d&#8217;affirmer que le vendeur le savait ?<\/p>\n<h2>I. La connaissance du vendeur se prouve rarement par un aveu direct<\/h2>\n<p>En pratique, le vendeur n&#8217;\u00e9crit presque jamais : &#8220;je savais que l&#8217;installation \u00e9tait dangereuse&#8221;. Le dossier se gagne donc par faisceaux d&#8217;indices.<\/p>\n<p>Le premier bloc d&#8217;indices est documentaire :<\/p>\n<ul>\n<li>devis d&#8217;\u00e9lectricien \u00e9tablis avant la vente ;<\/li>\n<li>factures de d\u00e9pannage r\u00e9p\u00e9t\u00e9es ;<\/li>\n<li>remplacement partiel du tableau ou de protections sans traitement global ;<\/li>\n<li>\u00e9changes \u00e9crits sur des coupures, un \u00e9chauffement, des prises qui &#8220;sautent&#8221;, une odeur de br\u00fbl\u00e9 ou un circuit inutilisable ;<\/li>\n<li>diagnostics ou contr\u00f4les techniques ant\u00e9rieurs non transmis ;<\/li>\n<li>questionnaires vendeur remplis de mani\u00e8re rassurante alors que des anomalies \u00e9taient d\u00e9j\u00e0 connues.<\/li>\n<\/ul>\n<p>Le deuxi\u00e8me bloc d&#8217;indices est mat\u00e9riel :<\/p>\n<ul>\n<li>raccordements bricol\u00e9s ;<\/li>\n<li>dominos ou connexions enfouis derri\u00e8re un cache r\u00e9cent ;<\/li>\n<li>fils nus dissimul\u00e9s dans un doublage ;<\/li>\n<li>tableau apparemment refait mais circuits anciens laiss\u00e9s dangereux ;<\/li>\n<li>zones fra\u00eechement referm\u00e9es ou repeintes apr\u00e8s intervention ;<\/li>\n<li>ajout de prises ou d&#8217;\u00e9quipements sans logique d&#8217;ensemble.<\/li>\n<\/ul>\n<p>Le troisi\u00e8me bloc d&#8217;indices tient au comportement du vendeur lui-m\u00eame :<\/p>\n<ul>\n<li>il a lui-m\u00eame r\u00e9alis\u00e9 une partie des travaux ;<\/li>\n<li>il a dirig\u00e9 ou fait ex\u00e9cuter des reprises partielles ;<\/li>\n<li>il a minimis\u00e9 des difficult\u00e9s anciennes pendant les visites ;<\/li>\n<li>il a mis en avant un diagnostic rassurant sans r\u00e9v\u00e9ler les incidents connus.<\/li>\n<\/ul>\n<h2>II. La jurisprudence utile : ce qui \u00e9tait visible n&#8217;\u00e9tait pas forc\u00e9ment connu dans sa gravit\u00e9<\/h2>\n<p>L&#8217;arr\u00eat le plus parlant est celui de la <a href=\"https:\/\/www.courdecassation.fr\/decision\/60797e359ba5988459c4a257\">Cour de cassation, 3e civ., 25 juin 2014, n\u00b0 13-17.254<\/a>. L&#8217;installation \u00e9lectrique pr\u00e9sentait un caract\u00e8re &#8220;bricol\u00e9&#8221; visible. Pourtant, la cour d&#8217;appel, approuv\u00e9e sur ce point, a pu retenir que sa dangerosit\u00e9 constituait un vice cach\u00e9 pour des acqu\u00e9reurs profanes.<\/p>\n<p>Deux enseignements pratiques en sortent.<\/p>\n<p>Le premier : un sympt\u00f4me visible n&#8217;\u00e9puise pas le d\u00e9bat. Voir des fils, des raccords ou un tableau ancien ne signifie pas comprendre qu&#8217;il existe un risque s\u00e9rieux pour la s\u00e9curit\u00e9 des personnes.<\/p>\n<p>Le second : lorsque le vendeur a lui-m\u00eame r\u00e9alis\u00e9 une partie des travaux \u00e9lectriques sur une installation ancienne, l&#8217;argument d&#8217;ignorance devient plus fragile. Dans l&#8217;affaire jug\u00e9e en 2014, ce fait a compt\u00e9 dans l&#8217;appr\u00e9ciation.<\/p>\n<p>Autrement dit, le dossier probatoire ne doit pas se laisser enfermer par la formule : &#8220;vous avez bien vu que ce n&#8217;\u00e9tait pas neuf&#8221;. Ce qu&#8217;il faut d\u00e9montrer, ce n&#8217;est pas la v\u00e9tust\u00e9 apparente. C&#8217;est la dangerosit\u00e9 cach\u00e9e dans sa port\u00e9e r\u00e9elle.<\/p>\n<h2>III. Un diagnostic annex\u00e9 \u00e0 l&#8217;acte ne blanchit pas automatiquement le vendeur<\/h2>\n<p>Beaucoup de vendeurs opposent imm\u00e9diatement le diagnostic \u00e9lectricit\u00e9 annex\u00e9 \u00e0 la vente. C&#8217;est une pi\u00e8ce importante. Ce n&#8217;est pas un couperet absolu.<\/p>\n<p>Le r\u00e9gime des diagnostics immobiliers n&#8217;est pas uniforme.<\/p>\n<p>Dans l&#8217;arr\u00eat du <a href=\"https:\/\/www.courdecassation.fr\/decision\/5fca624c7eeb384a40cafb8f\">21 novembre 2019, n\u00b0 18-23.251<\/a>, la Cour de cassation a rappel\u00e9 que le DPE n&#8217;a qu&#8217;une valeur informative.<\/p>\n<p>Dans l&#8217;arr\u00eat du <a href=\"https:\/\/www.courdecassation.fr\/decision\/679b2035b4b66853bd28e6cc\">30 janvier 2025, n\u00b0 23-14.029<\/a>, elle a retenu au contraire que l&#8217;\u00e9tat amiante annex\u00e9 \u00e0 la vente garantit l&#8217;acqu\u00e9reur contre le risque concern\u00e9.<\/p>\n<p>Pour l&#8217;\u00e9lectricit\u00e9, la bonne m\u00e9thode n&#8217;est donc pas de raisonner par slogan. Il faut comparer :<\/p>\n<ul>\n<li>ce que disait pr\u00e9cis\u00e9ment l&#8217;\u00e9tat annex\u00e9 ;<\/li>\n<li>ce que l&#8217;expert ou l&#8217;\u00e9lectricien d\u00e9couvre ensuite ;<\/li>\n<li>et ce que le vendeur savait, ind\u00e9pendamment du document.<\/li>\n<\/ul>\n<p>Si le vendeur connaissait d\u00e9j\u00e0 des incidents, des reprises ou des travaux dangereux, il ne pourra pas toujours se r\u00e9fugier derri\u00e8re un document annexe.<\/p>\n<p>L&#8217;arr\u00eat du <a href=\"https:\/\/www.courdecassation.fr\/decision\/60795d8d9ba5988459c49583\">13 janvier 2010, n\u00b0 08-21.677<\/a>, rendu \u00e0 propos des termites, reste tr\u00e8s utile sur ce point. La Cour y valide la r\u00e9ticence dolosive du vendeur qui avait laiss\u00e9 ins\u00e9rer \u00e0 l&#8217;acte une mention rassurante alors que sa connaissance du vice pouvait \u00eatre retenue. La logique est transposable : un papier rassurant n&#8217;efface pas une connaissance pr\u00e9alable.<\/p>\n<h2>IV. Les preuves qui p\u00e8sent le plus dans un dossier d&#8217;\u00e9lectricit\u00e9 cach\u00e9e<\/h2>\n<p>Les meilleures pi\u00e8ces ne sont pas toujours les plus impressionnantes. Ce sont les plus dat\u00e9es et les plus coh\u00e9rentes.<\/p>\n<p>Les pi\u00e8ces les plus fortes sont souvent :<\/p>\n<ul>\n<li>un rapport d&#8217;\u00e9lectricien qui explique pourquoi les anomalies sont anciennes ;<\/li>\n<li>des photos prises imm\u00e9diatement apr\u00e8s la d\u00e9couverte, avant toute d\u00e9pose ;<\/li>\n<li>des factures de mat\u00e9riel ou de d\u00e9pannage ant\u00e9rieures \u00e0 la vente ;<\/li>\n<li>des messages o\u00f9 le vendeur \u00e9voque une panne, un fusible qui saute, un circuit d\u00e9faillant ou un artisan d\u00e9j\u00e0 intervenu ;<\/li>\n<li>une chronologie montrant que les anomalies apparaissent d\u00e8s les premiers jours ;<\/li>\n<li>des traces de reprises locales r\u00e9v\u00e9lant une intervention ant\u00e9rieure ;<\/li>\n<li>des attestations d&#8217;artisans ou de voisins ayant connaissance d&#8217;incidents.<\/li>\n<\/ul>\n<p>Quand le vendeur a touch\u00e9 lui-m\u00eame \u00e0 l&#8217;installation, il faut le documenter. Une simple affirmation ne suffit pas. Il faut chercher :<\/p>\n<ul>\n<li>les factures de mat\u00e9riaux ;<\/li>\n<li>les messages sur des travaux &#8220;faits maison&#8221; ;<\/li>\n<li>les photographies de chantier ;<\/li>\n<li>les incoh\u00e9rences entre l&#8217;ancien et le neuf ;<\/li>\n<li>les zones o\u00f9 un cache r\u00e9cent recouvre une connexion dangereuse.<\/li>\n<\/ul>\n<h2>V. Ce qu&#8217;il faut \u00e9viter si vous voulez conserver une preuve exploitable<\/h2>\n<p>La premi\u00e8re erreur est de lancer imm\u00e9diatement une r\u00e9fection compl\u00e8te. Une fois le tableau remplac\u00e9, les doublages ouverts et les fils d\u00e9pos\u00e9s, le vendeur peut soutenir qu&#8217;il est devenu impossible de discuter contradictoirement l&#8217;\u00e9tat initial.<\/p>\n<p>La deuxi\u00e8me est de se contenter d&#8217;un devis global de remise aux normes. Un devis chiffre. Il n&#8217;explique pas toujours.<\/p>\n<p>La troisi\u00e8me est d&#8217;accuser le vendeur de mauvaise foi sans pi\u00e8ces dat\u00e9es. La qualification de dol ne se plaide pas \u00e0 l&#8217;intuition.<\/p>\n<p>La quatri\u00e8me est d&#8217;oublier que toute installation ancienne n&#8217;est pas un vice cach\u00e9. Si vous ne distinguez pas la simple v\u00e9tust\u00e9 de la dangerosit\u00e9 r\u00e9elle, vous affaiblissez vous-m\u00eame votre dossier.<\/p>\n<h2>VI. L&#8217;objectif probatoire : transformer une suspicion en dossier lisible<\/h2>\n<p>La bonne strat\u00e9gie est simple.<\/p>\n<p>D&#8217;abord, faire constater vite.<\/p>\n<p>Ensuite, r\u00e9unir les pi\u00e8ces ant\u00e9rieures \u00e0 la vente.<\/p>\n<p>Puis, ordonner les indices autour de trois questions :<\/p>\n<ul>\n<li>que r\u00e9v\u00e8le techniquement l&#8217;installation ;<\/li>\n<li>pourquoi ces anomalies existaient-elles d\u00e9j\u00e0 ;<\/li>\n<li>qu&#8217;est-ce qui montre que le vendeur ne pouvait pas les ignorer.<\/li>\n<\/ul>\n<p>Quand cette architecture est pr\u00eate, la discussion juridique devient beaucoup plus nette. Vous pouvez alors articuler utilement la garantie des vices cach\u00e9s, le dol, et, si besoin, la discussion sur la faute du diagnostiqueur.<\/p>\n<p>Pour prolonger cette logique de preuve, les pages du cabinet sur l&#8217;<a href=\"https:\/\/kohenavocats.fr\/avocat-expertise-batiment-paris\/\">expertise b\u00e2timent<\/a> et sur les <a href=\"https:\/\/kohenavocats.fr\/avocat-vices-caches-immobilier-paris\/\">vices cach\u00e9s immobiliers<\/a> permettent de structurer les premi\u00e8res d\u00e9marches avant proc\u00e8s.<\/p>\n<h2>Conclusion<\/h2>\n<p>Prouver que le vendeur connaissait une installation \u00e9lectrique dangereuse avant la vente ne suppose pas de trouver un aveu. Il faut b\u00e2tir un faisceau pr\u00e9cis : incidents anciens, travaux partiels, traces mat\u00e9rielles, documents ant\u00e9rieurs, et comparaison serr\u00e9e entre l&#8217;\u00e9tat annex\u00e9 \u00e0 l&#8217;acte et la r\u00e9alit\u00e9 d\u00e9couverte.<\/p>\n<p>Le bon dossier ne dit pas seulement : &#8220;l&#8217;installation est mauvaise&#8221;.
