La cour infirme le jugement de premi\u00e8re instance qui avait prononc\u00e9 la r\u00e9siliation du bail. Elle annule le cong\u00e9 d\u00e9livr\u00e9 par la propri\u00e9taire et condamne cette derni\u00e8re \u00e0 d\u00e9livrer des quittances.<\/p>\n<p>La validit\u00e9 du cong\u00e9 motiv\u00e9 par l&#8217;inex\u00e9cution des obligations<\/p>\n<p>Le contr\u00f4le des motifs l\u00e9gitimes et s\u00e9rieux du cong\u00e9. Le cong\u00e9 doit indiquer le motif all\u00e9gu\u00e9 sous peine de nullit\u00e9 selon l&#8217;article 15 de la loi de 1989. La cour rappelle que les retards r\u00e9p\u00e9t\u00e9s de loyer et l&#8217;absence de justification d&#8217;assurance constituent des motifs l\u00e9gitimes et s\u00e9rieux. Elle constate que le cong\u00e9 du 26 novembre 2022 visait pr\u00e9cis\u00e9ment ces deux manquements contractuels. La formulation du cong\u00e9 respecte donc les exigences l\u00e9gales de pr\u00e9cision \u00e9nonc\u00e9es par le texte.<\/p>\n<p>La port\u00e9e de ce contr\u00f4le est cependant limit\u00e9e \u00e0 la forme de l&#8217;acte. La cour v\u00e9rifie la pr\u00e9sence des motifs dans la notification. Elle ne se prononce pas encore sur leur r\u00e9alit\u00e9 ou leur gravit\u00e9. Cette approche distingue clairement l&#8217;examen de la r\u00e9gularit\u00e9 formelle de l&#8217;appr\u00e9ciation du fond du grief. La validit\u00e9 initiale du cong\u00e9 est ainsi pr\u00e9serv\u00e9e \u00e0 ce stade de l&#8217;analyse juridique.<\/p>\n<p>L&#8217;appr\u00e9ciation in concreto des manquements all\u00e9gu\u00e9s<\/p>\n<p>L&#8217;absence de fondement du grief li\u00e9 \u00e0 l&#8217;assurance. La cour proc\u00e8de \u00e0 un examen concret des faits pour chaque motif. Concernant l&#8217;assurance, elle rel\u00e8ve que la bailleuse &#8220;n&#8217;\u00e9tablit pas avoir demand\u00e9 de justification d&#8217;assurance locative pour les ann\u00e9es 2021 et 2022&#8221;. De plus, des justificatifs sont produits pour les ann\u00e9es concern\u00e9es. Le motif tir\u00e9 du d\u00e9faut d&#8217;assurance ne peut donc fonder la r\u00e9siliation du contrat de location.<\/p>\n<p>Ce raisonnement souligne l&#8217;obligation de la bailleuse d&#8217;activer son droit \u00e0 la justification. La simple absence de production spontan\u00e9e ne suffit pas. La cour rappelle ainsi l&#8217;exigence d&#8217;une demande pr\u00e9alable du bailleur. Cette analyse prive de tout s\u00e9rieux le premier grief invoqu\u00e9 dans le cong\u00e9.<\/p>\n<p>L&#8217;analyse proportionn\u00e9e des retards de paiement. La cour reconna\u00eet l&#8217;existence de retards quasi-syst\u00e9matiques entre 2019 et 2025. Elle note toutefois que &#8220;ces retards de paiement sont intervenus de fa\u00e7on limit\u00e9e et avec une r\u00e9gularisation rapide&#8221;. Les dettes \u00e9taient pay\u00e9es rapidement, comme l&#8217;arri\u00e9r\u00e9 de septembre 2022 r\u00e9gl\u00e9 en octobre.<\/p>\n<p>La solution retenue op\u00e8re une pond\u00e9ration entre la r\u00e9p\u00e9tition des incidents et leur caract\u00e8re circonstanci\u00e9. La r\u00e9gularisation syst\u00e9matique et rapide emp\u00eache de voir une inex\u00e9cution caract\u00e9ris\u00e9e. Cette appr\u00e9ciation att\u00e9nu\u00e9e des retards s&#8217;\u00e9loigne d&#8217;une application automatique de la jurisprudence disponible. Elle rejette implicitement l&#8217;id\u00e9e que la r\u00e9p\u00e9tition seule constitue un motif s\u00e9rieux.<\/p>\n<p>La sanction de l&#8217;absence de cause r\u00e9elle et s\u00e9rieuse<\/p>\n<p>L&#8217;annulation du cong\u00e9 pour d\u00e9faut de motif s\u00e9rieux. Apr\u00e8s avoir \u00e9cart\u00e9 chacun des griefs, la cour en d\u00e9duit que le cong\u00e9 &#8220;doit \u00eatre annul\u00e9&#8221;. Elle infirme donc le jugement qui avait constat\u00e9 la r\u00e9siliation. La d\u00e9cision illustre le contr\u00f4le substantiel exerc\u00e9 par le juge sur les motifs invoqu\u00e9s par le bailleur. Un motif formellement valable peut \u00eatre annul\u00e9 s&#8217;il est d\u00e9pourvu de consistance r\u00e9elle.<\/p>\n<p>La port\u00e9e de cette annulation est la remise en cause de toute la proc\u00e9dure d&#8217;expulsion. La locataire conserve son droit au maintien dans les lieux. La cour ordonne \u00e9galement la d\u00e9livrance des quittances de loyers depuis novembre 2022. Elle applique ainsi strictement l&#8217;article 21 de la loi de 1989, sans toutefois retenir l&#8217;astreinte demand\u00e9e.<\/p>\n<p>La cons\u00e9cration d&#8217;une approche globale et \u00e9quilibr\u00e9e. Cette d\u00e9cision privil\u00e9gie une analyse concr\u00e8te et contextualis\u00e9e des manquements du locataire. Elle refuse de consid\u00e9rer les retards de paiement comme un motif automatique de rupture. La rapidit\u00e9 de la r\u00e9gularisation et le contexte financier sont pris en compte. Cette jurisprudence s&#8217;inscrit dans une recherche de proportionnalit\u00e9.
