Suite \u00e0 des impay\u00e9s de loyer, les bailleurs ont engag\u00e9 une proc\u00e9dure en constat de r\u00e9siliation du bail et en expulsion. Le tribunal a examin\u00e9 la recevabilit\u00e9 de la demande et le bien-fond\u00e9 des pr\u00e9tentions. Il a d\u00e9clar\u00e9 la demande recevable et a fait droit aux principales demandes des requ\u00e9rants.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale de la demande en r\u00e9siliation<\/p>\n<p>Le respect des formalit\u00e9s pr\u00e9alables \u00e0 l&#8217;assignation est une condition de recevabilit\u00e9. Le l\u00e9gislateur a instaur\u00e9 un dispositif de pr\u00e9vention des expulsions locatives. L&#8217;assignation aux fins de constat de la r\u00e9siliation doit \u00eatre notifi\u00e9e au repr\u00e9sentant de l&#8217;\u00c9tat &#8220;au moins six semaines avant l&#8217;audience, \u00e0 peine d&#8217;irrecevabilit\u00e9 de la demande&#8221; (article 24 III de la loi du 06 juillet 1989). En l&#8217;esp\u00e8ce, cette notification est intervenue en temps utile, rendant la demande recevable. Cette v\u00e9rification stricte assure la s\u00e9curit\u00e9 juridique de la proc\u00e9dure et garantit l&#8217;intervention des services sociaux. La saisine de la commission comp\u00e9tente dans les d\u00e9lais l\u00e9gaux a \u00e9galement \u00e9t\u00e9 constat\u00e9e. Cette \u00e9tape est essentielle pour permettre un diagnostic social avant toute expulsion.<\/p>\n<p>La qualification des pr\u00e9tentions rel\u00e8ve de l&#8217;office du juge. Ce dernier doit &#8220;donner ou restituer leur exacte qualification aux faits et actes litigieux&#8221; (article 12 du code de proc\u00e9dure civile). Malgr\u00e9 la formulation de la demande, le juge a identifi\u00e9 une action en constat de r\u00e9siliation par acquisition de la clause r\u00e9solutoire. Cette analyse permet de rattacher la demande au r\u00e9gime juridique appropri\u00e9. Elle \u00e9vite toute irrecevabilit\u00e9 li\u00e9e \u00e0 une erreur de qualification par les parties. Le juge s&#8217;est ainsi fond\u00e9 sur le commandement de payer visant express\u00e9ment la clause.<\/p>\n<p>Le constat de la r\u00e9siliation et ses cons\u00e9quences<\/p>\n<p>Les conditions d&#8217;acquisition de la clause r\u00e9solutoire sont strictement encadr\u00e9es. La clause ne produit effet que &#8220;deux mois apr\u00e8s un commandement de payer demeur\u00e9 infructueux&#8221; (article 24 I de la loi du 06 juillet 1989). Le bail litigieux contenait une telle clause. Un commandement de payer a \u00e9t\u00e9 d\u00e9livr\u00e9 et est rest\u00e9 sans effet pendant le d\u00e9lai l\u00e9gal. Le juge a donc pu constater la r\u00e9siliation de plein droit intervenue \u00e0 une date certaine. Cette application rigoureuse prot\u00e8ge le locataire contre une r\u00e9siliation trop h\u00e2tive. Elle conf\u00e8re une s\u00e9curit\u00e9 au bailleur lorsque les conditions sont r\u00e9unies.<\/p>\n<p>La r\u00e9siliation entra\u00eene l&#8217;obligation de lib\u00e9rer les lieux et le paiement d&#8217;une indemnit\u00e9 d&#8217;occupation. L&#8217;occupation sans titre cause un pr\u00e9judice aux propri\u00e9taires. Le tribunal a ordonn\u00e9 l&#8217;expulsion avec le concours de la force publique si n\u00e9cessaire. Il a fix\u00e9 une indemnit\u00e9 d&#8217;occupation mensuelle jusqu&#8217;\u00e0 la lib\u00e9ration effective. La caution solidaire a \u00e9t\u00e9 condamn\u00e9e avec la locataire principale. Le juge a \u00e9galement liquid\u00e9 l&#8217;arri\u00e9r\u00e9 locatif en \u00e9cartant les frais de recouvrement interdits. Cette condamnation solidaire assure au bailleur le recouvrement effectif des sommes dues.
