Le bailleur, une soci\u00e9t\u00e9, a notifi\u00e9 un commandement puis saisi la commission pr\u00e9vue avant d\u2019assigner le locataire. Ce dernier est demeur\u00e9 absent \u00e0 l\u2019audience. Le juge doit appr\u00e9cier la recevabilit\u00e9 de la demande et le bien-fond\u00e9 des condamnations sollicit\u00e9es. L\u2019ordonnance d\u00e9clare la demande recevable et constate la r\u00e9siliation du contrat, tout en ordonnant l\u2019expulsion et le paiement de diverses sommes.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale de la demande en r\u00e9siliation<\/p>\n<p>Le respect des conditions de saisine pr\u00e9alable. Le l\u00e9gislateur a instaur\u00e9 un formalisme strict pour prot\u00e9ger les locataires en difficult\u00e9. L\u2019article 24-II de la loi du 6 juillet 1989 impose aux bailleurs personnes morales une saisine pr\u00e9alable de la commission comp\u00e9tente. Le juge v\u00e9rifie le strict respect des d\u00e9lais entre cette saisine et l\u2019introduction de l\u2019instance. En l\u2019esp\u00e8ce, la soci\u00e9t\u00e9 justifie avoir saisi la commission par courrier recommand\u00e9 re\u00e7u le 4 novembre 2024. L\u2019assignation est intervenue le 28 mars 2025, soit apr\u00e8s l\u2019expiration du d\u00e9lai de deux mois. La demande est donc d\u00e9clar\u00e9e recevable, le juge constatant le respect des d\u00e9lais l\u00e9gaux sans s\u2019attarder sur le mode de saisine. Cette analyse confirme une application litt\u00e9rale du texte, privil\u00e9giant le respect du d\u00e9lai de r\u00e9flexion.<\/p>\n<p>La notification \u00e0 l\u2019autorit\u00e9 administrative. Le dispositif de protection est renforc\u00e9 par une obligation d\u2019information du repr\u00e9sentant de l\u2019\u00c9tat. L\u2019article 24 III de la m\u00eame loi exige la notification d\u2019une copie de l\u2019assignation au pr\u00e9fet. Cette formalit\u00e9 doit intervenir au moins six semaines avant l\u2019audience pour permettre une \u00e9ventuelle intervention. Le juge rel\u00e8ve que cette notification est intervenue le 23 avril 2025 pour une audience fix\u00e9e au 5 septembre suivant. Le d\u00e9lai est donc largement respect\u00e9, permettant de d\u00e9clarer la demande r\u00e9guli\u00e8re sur ce point \u00e9galement. Cette v\u00e9rification minutieuse assure l\u2019effectivit\u00e9 du r\u00f4le de conciliation d\u00e9volu \u00e0 l\u2019autorit\u00e9 pr\u00e9fectorale dans ces contentieux sensibles.<\/p>\n<p>Les effets de la clause r\u00e9solutoire et ses cons\u00e9quences p\u00e9cuniaires<\/p>\n<p>La mise en \u0153uvre effective de la clause contractuelle. La r\u00e9solution pour inex\u00e9cution trouve son fondement dans la volont\u00e9 des parties et la loi. Le bail contient une clause r\u00e9solutoire pr\u00e9voyant la r\u00e9siliation de plein droit apr\u00e8s un commandement de payer demeur\u00e9 infructueux pendant deux mois. Le juge rappelle que &#8220;les contrats l\u00e9galement form\u00e9s tiennent lieu de loi \u00e0 ceux qui les ont faits&#8221; (article 1103 du code civil). Le commandement a \u00e9t\u00e9 signifi\u00e9 le 8 novembre 2024 et est rest\u00e9 sans effet. Le juge constate donc que les conditions de la clause sont r\u00e9unies et que le bail est r\u00e9sili\u00e9 \u00e0 la date du 9 janvier 2025. Cette application stricte du contrat illustre la force obligatoire des conventions, m\u00eame dans un contentieux protecteur du locataire.<\/p>\n<p>La condamnation \u00e0 diverses indemnit\u00e9s et le contr\u00f4le du juge. L\u2019occupation sans titre apr\u00e8s r\u00e9siliation g\u00e9n\u00e8re des obligations indemnitaires et permet une ex\u00e9cution provisoire. Devenu occupant sans droit ni titre, le locataire doit r\u00e9parer le pr\u00e9judice caus\u00e9. Le juge ordonne le paiement d\u2019une indemnit\u00e9 d\u2019occupation provisionnelle, calqu\u00e9e sur le loyer, jusqu\u2019\u00e0 la lib\u00e9ration des lieux. S\u2019agissant de l\u2019arri\u00e9r\u00e9 locatif, le juge op\u00e8re un contr\u00f4le actif du d\u00e9compte produit. Il rel\u00e8ve que des frais de recouvrement y sont inclus sans justification l\u00e9gale ou contractuelle. Il les d\u00e9duit donc du solde r\u00e9clam\u00e9, condamnant le locataire \u00e0 payer la somme provisionnelle recalcul\u00e9e de 1 631,64 euros.
