Le locataire, confront\u00e9 \u00e0 des difficult\u00e9s financi\u00e8res, sollicitait des d\u00e9lais de paiement. Le juge rejette cette demande et ordonne l&#8217;expulsion, tout en accordant une provision pour les sommes dues. La d\u00e9cision pr\u00e9cise les conditions de recevabilit\u00e9 de l&#8217;action en r\u00e9siliation et les modalit\u00e9s de l&#8217;expulsion.<\/p>\n<p>Le formalisme proc\u00e9dural pr\u00e9alable \u00e0 l&#8217;expulsion<\/p>\n<p>Le juge v\u00e9rifie d&#8217;abord le respect des formalit\u00e9s protectrices impos\u00e9es au bailleur. L&#8217;assignation en r\u00e9siliation doit \u00eatre notifi\u00e9e au repr\u00e9sentant de l&#8217;\u00c9tat dans le d\u00e9partement. &#8220;Au vu des pi\u00e8ces produites l\u2019assignation a \u00e9t\u00e9 notifi\u00e9e au repr\u00e9sentant de l\u2019Etat dans le d\u00e9partement par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception&#8221; (Motifs). Cette notification permet la saisine des services d&#8217;accompagnement social. La saisine de la commission d\u00e9di\u00e9e est \u00e9galement requise pour les bailleurs personnes morales. Le juge constate que &#8220;la commission de coordination des actions de pr\u00e9vention des expulsions locatives a \u00e9t\u00e9 saisie par voie \u00e9lectronique avec avis de r\u00e9ception dans les d\u00e9lais requis&#8221; (Motifs). Ces v\u00e9rifications garantissent le respect du cadre protecteur instaur\u00e9 par la loi.<\/p>\n<p>La jurisprudence rappelle l&#8217;importance du signalement pr\u00e9alable des impay\u00e9s. Un tribunal a ainsi jug\u00e9 que &#8220;Depuis lors, la situation d\u2019impay\u00e9s ayant perdur\u00e9, sa demande est donc recevable \u00e0 ce titre&#8221; (Tribunal judiciaire de Mulhouse, le 27 f\u00e9vrier 2025, n\u00b024\/01344). Ce formalisme constitue une condition substantielle de recevabilit\u00e9. Son contr\u00f4le strict par le juge prot\u00e8ge le locataire contre une expulsion pr\u00e9cipit\u00e9e. Il permet l&#8217;intervention des dispositifs sociaux avant toute action judiciaire. La d\u00e9cision affirme ainsi la primaut\u00e9 des mesures de pr\u00e9vention.<\/p>\n<p>L&#8217;appr\u00e9ciation souveraine du refus d&#8217;accorder des d\u00e9lais<\/p>\n<p>Le juge examine ensuite la demande de d\u00e9lais de paiement formul\u00e9e par le locataire. Le texte l\u00e9gal lui en donne le pouvoir, pr\u00e9voyant que &#8220;Le juge peut, m\u00eame d&#8217;office, accorder des d\u00e9lais de paiement dans la limite de trois ann\u00e9es&#8221; (Motifs). Cette facult\u00e9 vise \u00e0 \u00e9viter l&#8217;expulsion lorsque le rattrapage de la dette para\u00eet possible. Le locataire invoquait la perte de son emploi li\u00e9e \u00e0 un titre de s\u00e9jour provisoire. Il proposait un r\u00e8glement mensuel suppl\u00e9mentaire de quatre-vingts euros. Le bailleur s&#8217;opposait \u00e0 cette demande.<\/p>\n<p>Le rejet de la demande repose sur une appr\u00e9ciation concr\u00e8te de la situation. Le juge rel\u00e8ve que l&#8217;int\u00e9ress\u00e9 &#8220;ne s&#8217;est pas rendu au rendez-vous du service social&#8221; (Motifs). Il constate \u00e9galement l&#8217;absence de ressources stables pour l&#8217;ann\u00e9e 2025. Enfin, il estime que &#8220;le type de logement ( type 3 ) le montant du loyer est disproportionn\u00e9&#8221; (Motifs). Ces \u00e9l\u00e9ments conjugu\u00e9s justifient le refus d&#8217;octroyer des d\u00e9lais. Le juge use de son pouvoir d&#8217;appr\u00e9ciation pour \u00e9valuer la capacit\u00e9 future de paiement. Il recherche si les conditions d&#8217;un r\u00e9tablissement durable sont r\u00e9unies.<\/p>\n<p>La port\u00e9e de cette analyse est de pr\u00e9server l&#8217;\u00e9quilibre contractuel. Le l\u00e9gislateur a voulu \u00e9viter que des d\u00e9lais accord\u00e9s ne p\u00e9rennisent une situation d&#8217;impay\u00e9s. Le juge doit concilier la protection du locataire et les droits du bailleur. En l&#8217;esp\u00e8ce, l&#8217;absence de perspective de r\u00e9gularisation guide la d\u00e9cision. Le rejet des d\u00e9lais permet la mise en \u0153uvre de la clause r\u00e9solutoire.
