Le bailleur, une r\u00e9gie immobili\u00e8re publique, agit contre la locataire qui pr\u00e9sente un arri\u00e9r\u00e9 important. La juridiction prononce la r\u00e9solution du bail et l&#8217;expulsion tout en accordant un d\u00e9lai de six mois pour quitter les lieux. Elle rejette la demande de d\u00e9lais de paiement mais maintient l&#8217;ex\u00e9cution provisoire de la d\u00e9cision.<\/p>\n<p>La gravit\u00e9 du manquement justifiant la r\u00e9solution<\/p>\n<p>L&#8217;appr\u00e9ciation souveraine d&#8217;une obligation essentielle non ex\u00e9cut\u00e9e. Le juge rappelle le fondement l\u00e9gal de l&#8217;obligation de payer le loyer aux termes convenus. Il d\u00e9duit de l&#8217;article 7 de la loi du 6 juillet 1989 et des articles du code civil que cette obligation est essentielle. &#8220;Il se d\u00e9duit de l\u2019ensemble de ces dispositions que l\u2019obligation de payer le loyer fait partie des obligations essentielles du locataire&#8221; (Motifs, 1.2). Le manquement est ainsi caract\u00e9ris\u00e9 par l&#8217;existence d&#8217;une dette persistante et substantielle.<\/p>\n<p>La sanction d&#8217;un manquement grave par la r\u00e9solution judiciaire. La gravit\u00e9 du manquement s&#8217;appr\u00e9cie in concreto au regard du montant et de la dur\u00e9e. Le juge met en perspective le montant de la dette avec la dur\u00e9e du bail pour fonder sa d\u00e9cision. &#8220;Compte-tenu de ce montant, mis en perspective avec la dur\u00e9e du bail, la gravit\u00e9 du manquement aux obligations d\u00e9coulant du bail est suffisamment caract\u00e9ris\u00e9e&#8221; (Motifs, 1.2). Cette approche rejoint celle d&#8217;une autre juridiction qui a jug\u00e9 qu&#8217;un montant important justifiait la r\u00e9solution. &#8220;Au regard du montant particuli\u00e8rement important de la dette, et de l&#8217;absence de paiement du loyer depuis de nombreux mois, le manquement du locataire \u00e0 ses obligations est suffisamment grave&#8221; (Tribunal judiciaire de Bobigny, le 18 mars 2026, n\u00b025\/12837). La r\u00e9solution et l&#8217;expulsion sont donc prononc\u00e9es aux torts exclusifs de la locataire.<\/p>\n<p>L&#8217;articulation entre la sanction et les mesures d&#8217;\u00e9quit\u00e9<\/p>\n<p>Le refus des d\u00e9lais de paiement face \u00e0 l&#8217;absence de reprise des paiements. Le juge use de son pouvoir d&#8217;appr\u00e9ciation pour refuser des d\u00e9lais de paiement. Ce refus se fonde sur l&#8217;insuffisance des revenus et l&#8217;absence de reprise des paiements apr\u00e8s l&#8217;assignation. &#8220;Ses revenus actuels sont manifestement insuffisants pour faire face au loyer de son logement&#8221; (Motifs, 1.2). Cette solution est coh\u00e9rente avec une jurisprudence ant\u00e9rieure qui a adopt\u00e9 un raisonnement similaire. &#8220;En l\u2019esp\u00e8ce, il apparait que le versement des loyers n\u2019a pas repris. Il n\u2019est d\u00e8s lors pas possible de lui accorder des d\u00e9lais de paiement&#8221; (Tribunal judiciaire de B\u00e9ziers, le 13 janvier 2026, n\u00b025\/00370). La condamnation au paiement de l&#8217;arri\u00e9r\u00e9 est donc imm\u00e9diatement exigible.<\/p>\n<p>L&#8217;octroi d&#8217;un d\u00e9lai de gr\u00e2ce et le maintien de l&#8217;ex\u00e9cution provisoire. Des mesures d&#8217;\u00e9quit\u00e9 temp\u00e8rent cependant la s\u00e9v\u00e9rit\u00e9 de la sanction principale. Un d\u00e9lai de six mois pour quitter les lieux est accord\u00e9 en raison de la pr\u00e9carit\u00e9 de la situation. Le juge motive cette d\u00e9cision par les cons\u00e9quences d&#8217;une exceptionnelle duret\u00e9. &#8220;Il convient donc de lui accorder un d\u00e9lai de 6 mois pour quitter les lieux \u00e0 compter de la pr\u00e9sente d\u00e9cision&#8221; (Motifs, 1.2). Parall\u00e8lement, l&#8217;ex\u00e9cution provisoire de droit est maintenue pour ne pas priver la d\u00e9cision de son effet utile. Le juge estime que les circonstances ne justifient pas son \u00e9carte-ment. &#8220;Il n&#8217;y a pas lieu d&#8217;\u00e9carter l&#8217;ex\u00e9cution provisoire de la pr\u00e9sente d\u00e9cision&#8221; (Motifs, 2). Cette d\u00e9cision assure l&#8217;efficacit\u00e9 du jugement tout en m\u00e9nageant un temps d&#8217;adaptation.<\/p>\n<p>Cette d\u00e9cision illustre la recherche d&#8217;un \u00e9quilibre entre la sanction du manquement contractuel et la protection du d\u00e9biteur vuln\u00e9rable. Elle affirme avec fermet\u00e9 le caract\u00e8re essentiel de l&#8217;obligation de payer le loyer. La gravit\u00e9 du manquement est appr\u00e9ci\u00e9e de mani\u00e8re concr\u00e8te et justifie les sanctions les plus s\u00e9v\u00e8res. Toutefois, le juge use de ses pouvoirs pour am\u00e9nager dans le temps les cons\u00e9quences de l&#8217;expulsion. Il distingue ainsi clairement le principe de la sanction et son ex\u00e9cution pratique.
