Le preneur demandait la nullit\u00e9 de ce cong\u00e9, tandis que les bailleurs pr\u00e9sentaient une demande reconventionnelle d\u2019expulsion. Le tribunal a valid\u00e9 le cong\u00e9 et d\u00e9bout\u00e9 le preneur de l\u2019ensemble de ses pr\u00e9tentions, tout en rejetant la demande d\u2019expulsion comme pr\u00e9matur\u00e9e.<\/p>\n<p>La r\u00e9gularit\u00e9 formelle du cong\u00e9 pour reprise<\/p>\n<p>La d\u00e9livrance du cong\u00e9 par l\u2019usufruitier est r\u00e9guli\u00e8re. Le d\u00e9c\u00e8s de l\u2019un des bailleurs en cours de proc\u00e9dure n\u2019affecte pas la validit\u00e9 de l\u2019acte. La juridiction rappelle que &#8220;la qualit\u00e9 de bailleur et d&#8217;auteur du cong\u00e9 s&#8217;appr\u00e9cie \u00e0 la date de sa d\u00e9livrance&#8221; (Motifs). Cette solution est conforme \u00e0 une jurisprudence constante sur les pr\u00e9rogatives de l\u2019usufruitier. Elle assure la s\u00e9curit\u00e9 juridique des actes en les immunisant contre les \u00e9v\u00e9nements post\u00e9rieurs \u00e0 leur accomplissement. La mention des biens lou\u00e9s dans l\u2019acte de cong\u00e9 est \u00e9galement jug\u00e9e suffisante. Le tribunal estime que &#8220;les dispositions applicables du code rural, \u00e0 savoir l&#8217;article L411-47 de ce code, ne pr\u00e9voit pas que leur absence de mention est source de nullit\u00e9&#8221; (Motifs). Cette interpr\u00e9tation restrictive des conditions de forme favorise la validit\u00e9 des cong\u00e9s lorsque le preneur n\u2019est pas induit en erreur.<\/p>\n<p>La r\u00e9alit\u00e9 du projet de reprise du b\u00e9n\u00e9ficiaire<\/p>\n<p>Le projet agricole du b\u00e9n\u00e9ficiaire est caract\u00e9ris\u00e9 par une pr\u00e9paration s\u00e9rieuse et ancienne. Le tribunal rel\u00e8ve qu\u2019il &#8220;justifie \u00eatre titulaire depuis le 9 juillet 2024 (&#8230;) d&#8217;un brevet professionnel option responsable d&#8217;entreprise agricole&#8221; (Motifs). Cette formation, compl\u00e9t\u00e9e par des stages et attestations, d\u00e9montre une volont\u00e9 r\u00e9elle et un projet de longue date. La capacit\u00e9 financi\u00e8re \u00e0 acqu\u00e9rir le mat\u00e9riel n\u00e9cessaire est \u00e9galement \u00e9tablie par une attestation bancaire. Le tribunal en d\u00e9duit qu\u2019&#8221;il est par cons\u00e9quent d\u00e9montr\u00e9 que Monsieur [C] [O] r\u00e9pond aux conditions de capacit\u00e9 professionnelle exig\u00e9es&#8221; (Motifs). Cette appr\u00e9ciation souveraine des juges du fond v\u00e9rifie concr\u00e8tement l\u2019engagement futur du b\u00e9n\u00e9ficiaire. Elle \u00e9vite ainsi les reprises fictives et garantit l\u2019effectivit\u00e9 de l\u2019exploitation personnelle exig\u00e9e par la loi.
