Le conseil de prud\u2019hommes avait reconnu la nullit\u00e9 du licenciement et accord\u00e9 des indemnit\u00e9s. La cour d\u2019appel, saisie de l\u2019appel de l\u2019employeur, a r\u00e9form\u00e9 partiellement le jugement pour accorder une indemnisation distincte pour harc\u00e8lement moral. Elle a confirm\u00e9 la nullit\u00e9 du licenciement et ses cons\u00e9quences p\u00e9cuniaires. La solution consacre une protection renforc\u00e9e du salari\u00e9 face \u00e0 des agissements r\u00e9p\u00e9t\u00e9s et un licenciement d\u00e9pourvu de cause r\u00e9elle.<\/p>\n<p>La caract\u00e9risation du harc\u00e8lement moral par la pr\u00e9somption<\/p>\n<p>La cour applique strictement le r\u00e9gime probatoire all\u00e9g\u00e9 pr\u00e9vu par le code du travail. Elle rappelle que le salari\u00e9 doit pr\u00e9senter des \u00e9l\u00e9ments de fait laissant supposer l\u2019existence d\u2019un harc\u00e8lement. Il appartient ensuite \u00e0 l\u2019employeur de prouver que ses agissements ne sont pas constitutifs d\u2019un tel harc\u00e8lement. &#8220;En l&#8217;esp\u00e8ce, M. [O] d\u00e9nonce le fait que le g\u00e9rant de la soci\u00e9t\u00e9 Image &#038; Process, M. [Z], a multipli\u00e9 \u00e0 son encontre les brimades et moqueries&#8221; (Motifs, 1). La cour rel\u00e8ve \u00e9galement des insultes prof\u00e9r\u00e9es et une menace physique directe consign\u00e9e dans une main courante. Des attestations de coll\u00e8gues d\u00e9crivent un comportement manag\u00e9rial violent et lunatique. La cour prend en compte les documents m\u00e9dicaux qui attestent d\u2019un \u00e9tat anxieux et d\u2019un suivi psychologique. &#8220;Apr\u00e8s examen de l&#8217;ensemble des \u00e9l\u00e9ments invoqu\u00e9s par M. [O] (&#8230;) la Cour que les faits mat\u00e9riellement \u00e9tablis, pris dans leur ensemble, laissent supposer l&#8217;existence d&#8217;un harc\u00e8lement moral&#8221; (Motifs, 1). La port\u00e9e de cette analyse est significative. La cour valide une approche globale et cumulative des \u00e9l\u00e9ments de preuve, sans exiger que chaque fait soit gravissime isol\u00e9ment. Les attestations de t\u00e9moins, bien que non corrobor\u00e9es par des proc\u00e9dures formelles, sont jug\u00e9es recevables et cr\u00e9dibles. La valeur de cette d\u00e9cision r\u00e9side dans la mise en \u0153uvre effective du renversement de la charge de la preuve. L\u2019employeur, qui se contente de contester la cr\u00e9dibilit\u00e9 des t\u00e9moignages sans apporter de preuve contraire, \u00e9choue \u00e0 d\u00e9montrer l\u2019absence de harc\u00e8lement. Cette solution rappelle que l\u2019obligation de preuve incombant \u00e0 l\u2019employeur est substantielle et ne peut \u00eatre satisfaite par de simples d\u00e9n\u00e9gations.<\/p>\n<p>La nullit\u00e9 du licenciement et ses cons\u00e9quences indemnitaires<\/p>\n<p>La cour annule le licenciement pour deux motifs cumulatifs et accorde une indemnisation compl\u00e8te. Elle rel\u00e8ve d\u2019abord l\u2019absence de cause r\u00e9elle et s\u00e9rieuse en raison du d\u00e9faut de motivation de la lettre. &#8220;En d\u00e9finitive, la lettre de licenciement n&#8217;articule aucun grief mat\u00e9riellement v\u00e9rifiable et le licenciement est d\u00e9pourvu de cause r\u00e9elle et s\u00e9rieuse&#8221; (Motifs, 2.1). Elle retient ensuite que la v\u00e9ritable cause du licenciement est prohib\u00e9e, li\u00e9e \u00e0 la d\u00e9nonciation de faits de harc\u00e8lement. La cour constate que le licenciement est intervenu peu apr\u00e8s qu\u2019un courrier d\u2019avocat ait reli\u00e9 l\u2019arr\u00eat maladie du salari\u00e9 \u00e0 ces agissements. &#8220;La Cour retient que la soci\u00e9t\u00e9 Image &#038; Process ne d\u00e9montre pas que sa d\u00e9cision de licencier M. [O] est justifi\u00e9e par des \u00e9l\u00e9ments objectifs \u00e9trangers au fait que l&#8217;avocat du salari\u00e9 a fait \u00e9tat des agissements de harc\u00e8lement moral&#8221; (Motifs, 2.1). La port\u00e9e de cette double qualification est protectrice. Le d\u00e9faut de motivation pr\u00e9cise dans la lettre rend le licenciement irr\u00e9gulier, ind\u00e9pendamment de la cause r\u00e9elle. La cour sanctionne \u00e9galement un licenciement discriminatoire fond\u00e9 sur la d\u00e9nonciation de faits illicites. La valeur de l\u2019arr\u00eat r\u00e9side dans le d\u00e9tail du calcul indemnitaire cons\u00e9cutif \u00e0 la nullit\u00e9. La cour ordonne le paiement de l\u2019indemnit\u00e9 compensatrice de pr\u00e9avis, de l\u2019indemnit\u00e9 conventionnelle de licenciement, et d\u2019une indemnit\u00e9 forfaitaire pour licenciement nul. Elle pr\u00e9cise que ces cr\u00e9ances sont inscrites au passif de la liquidation judiciaire de l\u2019employeur. Cette approche garantit au salari\u00e9 une r\u00e9paration int\u00e9grale de son pr\u00e9judice, m\u00eame en situation de d\u00e9faillance de l\u2019entreprise.
